Labor certification approval alone does not give the worker a green card, work permit, or lawful permanent residence. It is one step in a larger employment-based immigration process.<\/p>\n<p><strong>This distinction is important.<\/strong> A PERM case is not the same as a temporary work visa, and it is not the same as the final green card stage. The employer must also be willing to comply with the Department of Labor\u2019s recruitment and documentation requirements.<\/p>\n<p>PERM may not be required in every employment-based case. Some categories, such as certain EB-1 petitions, National Interest Waiver cases, Schedule A occupations, or other special categories, may follow a different process. The employer must be involved, truthful, organized, and willing to follow the rules.<\/p>\n<p>Employer responsibilities may include:<\/p>\n<ul>\n<li>Defining the offered job accurately<\/li>\n<li>Confirming that the position is permanent and full-time<\/li>\n<li>Identifying the actual minimum requirements for the job<\/li>\n<li>Requesting a prevailing wage determination<\/li>\n<li>Conducting required recruitment<\/li>\n<li>Reviewing applicants in good faith<\/li>\n<li>Keeping proper recruitment documentation<\/li>\n<li>Preparing a recruitment report<\/li>\n<li>Signing required forms and attestations<\/li>\n<li>Maintaining records in case of an audit<\/li>\n<li>Demonstrating the ability to pay the offered wage at later stages of the process<\/li>\n<li>Responding to requests from the Department of Labor, if needed<\/li>\n<\/ul>\n<p>The employer must be careful not to create job requirements that are inflated, unnecessary, or designed only to favor the foreign worker. The requirements should reflect the employer\u2019s actual minimum needs for the position.<\/p>\n<p>If the employer has recently hired other workers with less training or experience for substantially comparable jobs, that can create issues. The worker must be able to show that they met the employer\u2019s stated minimum requirements by the required point in the process.<\/p>\n<p>Worker qualifications may include:<\/p>\n<ul>\n<li>Education<\/li>\n<li>Degrees<\/li>\n<li>Professional licenses<\/li>\n<li>Training<\/li>\n<li>Prior employment experience<\/li>\n<li>Skills required for the offered position<\/li>\n<li>Certifications, when applicable<\/li>\n<li>Foreign academic records and evaluations, when needed<\/li>\n<li>Letters from prior employers confirming experience<\/li>\n<\/ul>\n<p><strong>The worker should not assume that a r\u00e9sum\u00e9 alone is enough.<\/strong> Employment experience often needs to be documented through detailed letters from prior employers. Education completed outside the United States may need to be evaluated for U.S. equivalency. Licenses, credentials, and specialized training should be reviewed before the case is prepared.<\/p>\n<p>It is also important that the worker\u2019s qualifications match the job requirements.
