Qu\u00e9 tanto nos va a afectar, no nos va a afectar el tema migratorio y qu\u00e9 tanto vamos a poder tambi\u00e9n entender algunos de los cambios m\u00e1s importantes en materia migratoria en los \u00faltimos meses, en las \u00faltimas semanas, que vamos a poder hacer preguntas de migraci\u00f3n. Si tienen preguntas de migraci\u00f3n, aprovechen para dejarlas en la casilla de abajo. Hemos visto que ac\u00e1 ya hay algunas que nos han dejado durante el d\u00eda tambi\u00e9n por otras v\u00edas, pero muy importante tambi\u00e9n porque vamos a abordar muchas noticias importantes relacionadas con asuntos migratorios. Entonces, para comenzar abogada, que nos puede contar sobre una noticia de que habr\u00eda algunas personas que son beneficiarios del programa DACA, del programa de los Dreamers, pero que podr\u00edan tambi\u00e9n acceder al mercado de salud conocido como el Obamacare, que es un beneficio del gobierno federal. Qui\u00e9nes pueden y qui\u00e9nes no pueden, c\u00f3mo funcionan?<\/p>\n<p><strong>Martha Arias:<\/strong><br \/>\nY bueno, a ver, Juan Camilo, si usted bien lo ha dicho, el Obama, el DACA, primero que todo es un programa, como muchas personas ya saben, para el cual lo sac\u00f3 el presidente Obama en el 2012 para aquellos j\u00f3venes que hab\u00edan entrado a los Estados Unidos antes del 2007 y antes de los 16 a\u00f1os y hab\u00edan estudiado ac\u00e1 entonces pod\u00edan aplicar para esta protecci\u00f3n. Esta protecci\u00f3n si bien ha estado sujeta muchos litigios, en las cortes de inmigraci\u00f3n y en las cortes federales, incluso subi\u00f3 a la sala, a la corte suprema de los Estados Unidos. Si bien ha estado en este tema de litigios, el DACA todav\u00eda en este momento est\u00e1 en vigencia. El DACA primero, el DACA inicial, una extensi\u00f3n que hizo el presidente Biden del DACA para hacerlo extensivo a otro grupo de j\u00f3venes, pero bueno, eso no prosper\u00f3 en las cortes.<\/p>\n<p>\u00bfCu\u00e1l es la noticia? La noticia es, como usted lo dijo, que el Departamento de Salud y de Servicios Humanos de los Estados Unidos emiti\u00f3 un cambio en la regulaci\u00f3n que interpreta que la palabra residente legal en el pa\u00eds, o sea, &#8220;legally resident&#8221; o para efectos del seguro m\u00e9dico. Esa palabra tiene una interpretaci\u00f3n distinta para efectos del seguro, y es distinta a la que se interpreta en inmigraci\u00f3n.<\/p>\n<p>Entonces, esta regulaci\u00f3n lo que hace es una clarificaci\u00f3n de ese t\u00e9rmino y al clarificar el t\u00e9rmino le da la opci\u00f3n a los j\u00f3venes que tienen el DACA de poder acceder al Obamacare. Hay m\u00e1s de 600,000 j\u00f3venes en los Estados Unidos que participan del programa DACA y se cree que m\u00e1s de 100,000 de ellos est\u00e1n sin seguro m\u00e9dico, o sea que esta noticia les va a ayudar.<\/p>\n<p><strong>Juan Camilo:<\/strong><br \/>\nY bueno, entonces potencialmente 100.000 personas que no tienen seguro van a poder tener seguros, que es una muy buena noticia. Y qu\u00e9 bueno que diga que para para estos efectos, para efectos del seguro, porque no es que ahora vayan a pensar que la interpretaci\u00f3n de las cortes es que la gente que tiene de ac\u00e1 ahora es residente. Eso todav\u00eda no es as\u00ed.<\/p>\n<p><strong>Martha Arias:<\/strong><br \/>\nNo. Y la importancia es que este es un documento que emiti\u00f3 el Departamento de Salud de Servicios Humanos donde claramente se refieren a la interpretaci\u00f3n de esta palabra y otra de las cosas que tiene esta nueva regulaci\u00f3n que empieza a partir del 1 de Noviembre de este a\u00f1o 2024. O sea que estos cambios de que estamos hablando empiezan a partir del 1 de Noviembre que es usualmente cuando empiezan las aplicaciones o los registros para el <strong>Obamacare<\/strong>.<\/p>\n<p>Dentro de eso y le aconsejo a las personas que nos est\u00e1n escuchando y que le hagan un reenv\u00edo a este programa es que hablen con sus asesores de seguros m\u00e9dicos para que les digan estos cambios que entran a partir de 1 de noviembre porque los cambios tambi\u00e9n extienden muchos otros programas que se manejan a nivel estatal.<\/p>\n<p>Recuerde que los seguros tienen una parte que se lo vamos a querer, que es la parte federal, pero tambi\u00e9n cada estado tiene unos programas distintos. Por ejemplo, hay un programa que se llama &#8220;<strong>Qualified Health Plan<\/strong>&#8221; y otro que se llama &#8220;<strong>Health Program<\/strong>&#8220;, &#8220;<strong>Basic Health Program<\/strong>&#8220;. Entonces, dependiendo del programa que tienen los estados, si es uno o el otro, este programa de la interpretaci\u00f3n, la nueva interpretaci\u00f3n de lo que es un residente legalmente, una persona residente legalmente en el estado, va a tener un efecto tambi\u00e9n en esos otros programas de seguro.<\/p>\n<p>Entonces no solamente el cambio viene para los <strong>DACA<\/strong>, viene tambi\u00e9n para personas que tienen el Obamacare o que no tienen el seguro porque no han podido, porque la interpretaci\u00f3n y el programa dentro de su estado no les ha permitido; pero pues con este nuevo cambio puede que tengan acceso. Entonces, es importante que se comuniquen y le pregunten a su asesor m\u00e9dico si estos nuevos cambios le pueden ayudar en su programa de seguro m\u00e9dico.<\/p>\n<p><strong>Juan Camilo:<\/strong><br \/>\nSi tiene alguna pregunta relacionada con cualquiera de esos temas, siempre es bueno que consulten con expertos. Y pregunta, \u00bfqu\u00e9 pasa si una persona que entr\u00f3 ilegalmente a Estados Unidos est\u00e1 casada ahora con un ciudadano, lleva m\u00e1s de cinco a\u00f1os casada, puede? \u00bfQu\u00e9 puede pasar con esa persona? \u00bfPuede regularizar su situaci\u00f3n o c\u00f3mo funciona eso?<\/p>\n<p><strong>Martha Arias:<\/strong><br \/>\nS\u00ed, normalmente las personas que entran ilegales a los Estados Unidos no pueden recibir la residencia dentro del pa\u00eds aunque est\u00e9n casados con un ciudadano americano. Y la raz\u00f3n es que la ley exige que la persona est\u00e9 en un estatus legal o que haya entrado legalmente a los Estados Unidos, o que est\u00e9 en una protecci\u00f3n que pueda ser beneficiario de una protecci\u00f3n que exist\u00eda antes que llamada 245-I. Entonces si la persona no est\u00e1 protegida por la 245-I o entr\u00f3 en forma ilegal, entonces esa persona para poder recibir la residencia tiene que tener la petici\u00f3n familiar, tiene que pedir un perd\u00f3n, hacer un proceso consular y salir de los Estados Unidos al consulado a recibir la residencia.<\/p>\n<p>Parece complicado, bueno, es mucho trabajo s\u00ed, pero es algo muy viable. Desde el 2012 sali\u00f3 tambi\u00e9n este perd\u00f3n, se llama el perd\u00f3n provisional o el state side waiver y se ha venido aplicando perfectamente. La persona normalmente lo que sale fuera de los Estados Unidos es m\u00e1s o menos alrededor de unos dos semanas, tres semanas, no es tanto tiempo. O sea, en dos semanas o tres van al consulado, reciben su residencia y regresan.<\/p>\n<p>Pero as\u00ed es importante, Juan Camilo, que la gente que va a hacer este proceso, consiga a su abogado, que sea un abogado experto en inmigraci\u00f3n, graduado y licenciado aqu\u00ed en los Estados Unidos, para que pueda tener un caso exitoso. Porque si esa persona no aval\u00faan bien su caso y tiene alguna inhabilidad, adem\u00e1s de la presencia ilegal&#8230; pues lo pueden dejar ah\u00ed en el consulado. O sea que uno como abogado es muy cuidadoso en analizar un caso, a ver a qui\u00e9n va a mandar al consulado, porque hay personas que definitivamente no se pueden mandar.<\/p>\n<p><strong>Juan Camilo:<\/strong><br \/>\nWow, interesante. Usted no va, si usted se inscribi\u00f3 para participar de la Loter\u00eda de Visas, usted no va a recibir un e-mail del Departamento de Estado dici\u00e9ndole mire se gan\u00f3 la Loter\u00eda de Visas. Usted directamente tiene que ir a la p\u00e1gina del Departamento de Estado donde aplic\u00f3 para esa visa, para esa loter\u00eda de visas, y usted mismo con su n\u00famero de caso entrar all\u00ed a ver si ya gan\u00f3 o no gan\u00f3.<\/p>\n<p>Nadie le debe mandar un email. Si usted recibe un email es un scam, es un fraude, es un robo. Repito. Obviamente los amantes de lo ilegal o de lo fraudulento, del robo, empiezan a mandar estos emails. Le pueden robar su identidad, le pueden robar su platiquen, pues muchas otras consecuencias, \u00bfok?<\/p>\n<p><strong>Juan Camilo:<\/strong><br \/>\nQue nos haga esa aclaraci\u00f3n abogada porque una de las razones tambi\u00e9n por las que sugerimos constantemente que contacten abogados expertos en asuntos migratorios no es solamente para que sus tr\u00e1mites queden hechos bien porque seguramente nosotros vamos a poder llenar un formulario, vamos a encontrar informaci\u00f3n sobre los tr\u00e1mites que tengamos que hacer pero las minucias de la&#8230; Esos, esa letra peque\u00f1a, esos cambios importantes pueden hacer una diferencia gigantesca entre que un proceso sea exitoso y no sea exitoso. Entonces hacemos esas recomendaciones de que consulten con abogados expertos en migraci\u00f3n por eso, pero tambi\u00e9n por otra cosa importante. Y es para que no caigamos en las trampas que pone la gente, porque hay mucha gente que se aprovecha de la necesidad que tienen much\u00edsimas personas en Estados Unidos de resolver sus asuntos migratorios. Y al momento de ver la cantidad de trampas, de fraudes, o de personas que se hacen pasar por profesionales que realmente no lo son, o que dicen tener un conocimiento que realmente no tienen, es muy, muy problem\u00e1tico m\u00e1s adelante. Hemos visto much\u00edsimos casos de recomendaciones mal hechas, en los que le dicen, no, es que esta persona me dijo que porque yo mejor no revisaba, es mejor irse por personas que sepan realmente de estos temas. Y lo mejor es consultar con abogados expertos.<\/p>\n<p><strong>Martha Arias:<\/strong><br \/>\nMira, Juan Camilo, ahora que usted dice eso, aprovecho para contarle, por ejemplo, algo que pas\u00f3 en estos d\u00edas en la oficina y es un cliente m\u00edo, un cliente que nosotros le hemos ayudado con su caso antes y estaba listo para aplicar a su ciudadan\u00eda y bueno, tuvo un problema econ\u00f3mico, no lo hizo con nosotros y pues alguien le dijo no pues yo le puedo ayudar yo no le cobro sino tanto le hizo la aplicaci\u00f3n pero cometi\u00f3 un error grave y es que no puso sus hijos, sus hijos no est\u00e1n biol\u00f3gicos no est\u00e1n dentro los Estados Unidos est\u00e1n fuera de los Estados Unidos pero eso es grave \u00bfpor qu\u00e9? Porque si la persona esos hijos exist\u00edan ya que en este caso s\u00ed exist\u00edan cuando la persona se hizo residente al momento de llenar la aplicaci\u00f3n e imigraci\u00f3n se va a cuestionar por qu\u00e9 no escribi\u00f3 los hijos, y la y posiblemente lo que inmigraci\u00f3n va a pensar es que la persona est\u00e1 tratando de ser un poquito &#8220;sneaky&#8221; se dice en Ingl\u00e9s un poquito mentirosito y no pone los hijos porque esos hijos son menores de edad y para efectos de recibir la ciudadan\u00eda usted tiene que probar que tiene buen car\u00e1cter moral. Una de las cosas que ellos consideran, digo ellos, inmigraci\u00f3n, del car\u00e1cter moral es que la persona tiene que mostrar que est\u00e1 al d\u00eda y pagando la manutenci\u00f3n de sus hijos o el child support.<\/p>\n<p>Entonces claro, si usted ve en una aplicaci\u00f3n, tiene hijos menores y no los pone, lo que inmigraci\u00f3n va a pensar, ah, este est\u00e1 ac\u00e1 tratando de hacerse loquito, de no poner esa informaci\u00f3n para nosotros no preguntarle. Y eso es mentir. Entonces eso es grave. Eso es grave porque si le da con un oficial que no tenga la paciencia de entender que la persona busc\u00f3 la ayuda de alguien que no estaba capacitado y escribi\u00f3 pues esto mal, entonces si no tiene esa paciencia y no lo va a escuchar, pues lo que va a pensar es que est\u00e1 tratando de enga\u00f1ar al servicio de inmigraci\u00f3n, est\u00e1 tratando de cometer fraude y pues no, no le voy a aprobar porque no tiene buen car\u00e1cter moral por mentiroso. Y por qu\u00e9 hay menos personas aplicando para eso?<\/p>\n<p><strong>Martha Arias:<\/strong><br \/>\nBueno, es interesante la raz\u00f3n que dio inmigraci\u00f3n de por qu\u00e9 este a\u00f1o las aplicaciones que se recibieron electr\u00f3nicas, porque recuerde, hay una aplicaci\u00f3n electr\u00f3nica que se hace m\u00e1s o menos en marzo de cada a\u00f1o. Es com\u00fan, la gente piensa que no es com\u00fan que se otorguen pasaportes, sobre todo antes. Ahora no tanto, antes se otorgaban pasaportes de ciudadanos americanos o personas que realmente no calificaban para ese beneficio.
