One is a law called the <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/travel.state.gov\/content\/travel\/en\/legal\/travel-legal-considerations\/us-citizenship\/child-citizenship-act-of-2000.html\" target=\"_blank\" rel=\"noopener\"><span style=\"text-decoration: underline;\"><em>Child Citizenship Act of 2000<\/em><\/span><\/a><\/span>, which established the right to derivative <strong>citizenship for minors<\/strong> under 18 when their parents become citizens. They must also be residents first and enter before turning 18 or live under the custody of that parent who became a U.S. citizen. That&#8217;s one way.<\/p>\n<p>The other is through acquired citizenship, which applies when the child is born when the parent is already a citizen. Different sets of laws apply, but they have similar requirements. What happens is, many of these minors who acquire derivative or acquired citizenship, the parents rely solely on obtaining a passport for them. They apply for a U.S. passport, prove the parents became U.S. citizens, and receive the passport. Nowadays, the <strong>passport office<\/strong> is more organized and careful in issuing passports.<\/p>\n<p>Unlike 10 or 20 years ago, when passports were issued more leniently, even to minors who didn&#8217;t qualify for derivative citizenship. So, why is it important to get a <a href=\"https:\/\/www.uscis.gov\/sites\/default\/files\/document\/guides\/A4en.pdf\" target=\"_blank\" rel=\"noopener\"><span style=\"text-decoration: underline; color: #0000ff;\">naturalization certificate<\/span><\/a> in addition to the passport? Because think of it this way: the passport is a privilege, not a right. Someone who became a citizen received a passport, but in the future, that person may lose that privilege due to a conviction or an error in issuing the passport. Without a passport or a naturalization certificate, that person has no proof of citizenship.<\/p>\n<p>For example, Florida has a law that allows <strong>passport revocation for unpaid child support<\/strong>. Imagine, a person can lose the right to a passport. Without any other form of proof of citizenship, they face issues. That&#8217;s one reason. If a person loses the passport, they have no way to prove citizenship.<\/p>\n<p>Let me share a client&#8217;s story from years ago. My client lived with his parents in Louisiana. During Hurricane Katrina, his parents died, and their house was destroyed. He knew he was a citizen and once had a passport but lost all documentation. He tried to get a driver&#8217;s license but needed proof of citizenship or residency, which he couldn&#8217;t provide.<\/p>\n<p>He then tried to get a passport, but was asked to prove his parents were citizens before he turned 18. Without his parents&#8217; documentation, he couldn&#8217;t prove anything. He came to my office saying, &#8220;I don&#8217;t know how to prove I&#8217;m a citizen.&#8221; He didn&#8217;t have a passport, driver&#8217;s license, or social security card, just the number memorized.<\/p>\n<p>We started by finding his previous residency number. We requested an Infopass appointment to see if we could locate his previous residency number. Finally, we did, and with it, we requested his parents&#8217; records to prove they became citizens before he turned 18. After years, we succeeded, and he applied for his certificate of citizenship. Once obtained, he got his passport and other documents.<\/p>\n<p>The conclusion is, don&#8217;t rely on the passport alone as proof of your child&#8217;s citizenship. Get the certificate. The application process is expensive, costing around $1,500, but it&#8217;s worth it to have proper documentation. Scan and store it electronically along with the passport and any residency card. If something happens, like a hurricane here in Miami, you&#8217;ll have a way to recover information.<\/p>\n<p>Ensure your children have their birth certificate. While this explanation was long, it&#8217;s crucial.<\/p>\n<p>There&#8217;s a current case in the Florida Keys, <span style=\"color: #0000ff;\"><a style=\"color: #0000ff;\" href=\"https:\/\/www.aclufl.org\/en\/cases\/peter-sean-brown-v-richard-ramsay\" target=\"_blank\" rel=\"noopener\">Peter Sandbrown versus Richard Rick of the police<\/a><\/span>. Let me share this story. Peter Sandbrown, born in Philadelphia and of Jamaican descent, was detained, served his sentence, and released, but <strong>ICE<\/strong> detained him for deportation. Despite showing his citizenship certificate, he was detained until he could prove it. He lost his job and now sues Monroe County for damages. This could happen to anyone. Without a birth certificate, proving citizenship can be challenging. So, always have your child&#8217;s certificate.<\/p>\n<p>For instance, a few minutes ago, a listener mentioned they hadn&#8217;t requested their child&#8217;s naturalization certificate, thinking the passport was enough. The passport is for travel, but the certificate is the official proof of citizenship. It&#8217;s important to make this distinction.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Juan Camilo:<\/strong><\/p>\n<p>Yes, a listener recently mentioned that she didn&#8217;t request the naturalization certificate for her child, thinking the passport was sufficient. With the passport, you can travel, but it&#8217;s a privilege, not the proof of citizenship, which is the naturalization certificate. It&#8217;s crucial to understand this difference. I advise people to pay their fees to avoid delays and complications. Financial waivers require extensive documentation, and many people are disorganized with their finances, creating inconsistencies across agencies. It&#8217;s better to pay the fees if possible.<\/p>\n<p>The other <strong>waivers involve pardons<\/strong> for those who need them due to <strong>illegal presence or criminal records<\/strong>. These waivers require proving extreme hardship on the petitioner, which is challenging. Simple separation is not considered extreme hardship by immigration. It involves showing medical, financial, or other significant support provided by the petitioner.<\/p>\n<p>For example, if a parent relies on their child&#8217;s financial and medical support due to a severe condition, this could be considered extreme hardship. <em>Financial hardship alone is not sufficient<\/em>. <span style=\"text-decoration: underline;\">Consulting a lawyer is crucial<\/span> for waivers as they involve technical rules and extensive evidence beyond just financial support.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Juan Camilo:<\/strong><\/p>\n<p>Lawyer, what about waivers for tourist visas that have been canceled?
