Normally, the first three which are <strong>EB-1<\/strong>, <strong>EB-2<\/strong>, and <strong>EB-3<\/strong> are the ones most used and filled. What immigration announced is that they will try to use all available visas in all employment-related categories before the fiscal year ends. I would not advise many of those people to travel to their country of origin, that is, to Venezuela. This can affect them in the future. Now, obviously, if the person is in a court process, let&#8217;s say the person has<\/p>\n<p>TPS but has an administratively closed case in court or has TPS and still has an open case in immigration court, those people should not travel outside the United States either.<\/p>\n<p>People who have arrests, consult an immigration lawyer first before traveling because there are certain crimes that do not make the person deportable, that is, they will not be deported while in the country but make them inadmissible to re-enter or if they are allowed to enter, they may have problems at the airport. It is called trespassing. Trespassing is like trespassing a dwelling or entering a dwelling without authorization. It is a crime, it may not be a serious crime, but it is a crime.<\/p>\n<p>In Miami or here in the state of Florida, it is more of a misdemeanor, depending on the situation, and there are also other levels of aggravation. Lo que Inmigraci\u00f3n anunci\u00f3 es que va a tratar de usar todas las visas disponibles en todas relacionadas con empleo antes de que se acabe el a\u00f1o fiscal. Recuerden que el a\u00f1o fiscal empieza el 1 de octubre y se acaba el 30 de septiembre de cada a\u00f1o.<\/p>\n<p>O sea que en este momento estamos en el a\u00f1o fiscal 23-24 que se acaba ahora el 30 de Septiembre estamos ya en julio o sea que queda unos cuantos meses para que ellos puedan aprobar el mayor n\u00famero de visas y usar esos cupos disponibles. Por esta raz\u00f3n las personas puede que reciba o sus abogados puede que reciban llamadas de inmigraci\u00f3n de los oficiales pidiendo cierta documentaci\u00f3n o cierta informaci\u00f3n para poder ellos procesar esas peticiones y aprobarlas lo antes posible.<\/p>\n<p>Entonces, si reciben una llamada de inmigraci\u00f3n porque de pronto ustedes no tengan el abogado, pues no les d\u00e9 temor porque los est\u00e9n llamando, es que se est\u00e1 procesando. Es la que se adquiere cuando un ni\u00f1o nace fuera de los Estados Unidos de padres ciudadanos americanos. Puede ser la mam\u00e1 o puede ser el pap\u00e1.<\/p>\n<p>Esta ciudadan\u00eda tiene unos requisitos que cumplir, pero siempre ha existido un problema de interpretaci\u00f3n en alguno de esos requisitos. Entonces, el Servicio de Inmigraci\u00f3n recientemente public\u00f3 una aclaraci\u00f3n.<\/p>\n<p>Le voy a dar un ejemplo. Si el pap\u00e1 o la mam\u00e1, ese ni\u00f1o naci\u00f3 fuera de los Estados Unidos, vamos a decir de un pap\u00e1 ciudadano americano, pero el nombre del pap\u00e1 no estaba escrito en el certificado de nacimiento, el servicio de inmigraci\u00f3n no le dar\u00eda la ciudadan\u00eda a ese menor, porque dice que debe ser escrito el nombre de ese padre en el certificado de nacimiento de la persona cerca al momento de nacer. Esta por ejemplo es una de las aclaraciones.<\/p>\n<p>Otra aclaraci\u00f3n que me parece supremamente importante es cuando los dos padres eran ciudadanos americanos pero no eran casados y vamos a decir uno de ellos fallece, la mam\u00e1 le puede dar la ciudadan\u00eda a ese hijo siempre y cuando haya vivido en los Estados Unidos por lo menos siquiera un a\u00f1o antes de ese ni\u00f1o nacer.<\/p>\n<p>Si la mam\u00e1 le iba a poder otorgar esa ciudadan\u00eda cuando no eran casados, la mam\u00e1 y el pap\u00e1 de ese menor, aunque los dos fueran ciudadanos americanos.<\/p>\n<p>Hay otra cosa interesante que habla esta aclaraci\u00f3n y es, y esta me parece la m\u00e1s interesante, el Estatuto de Inmigraci\u00f3n dice que una persona solamente tiene un chance, es decir, una oportunidad para aplicar a la ciudadan\u00eda derivativa o adquisitiva.<\/p>\n<p>Se aplica en esa forma que la N-600 si se la niegan, no hay derecho a apelaci\u00f3n o la persona no podr\u00eda volver a presentar la petici\u00f3n. Entonces, de ah\u00ed la importancia de que las personas siempre escojan a un abogado para hacer esta petici\u00f3n.<\/p>\n<p>Esta aclaraci\u00f3n dice que las personas podr\u00edan, si no les aprobaron esa ciudadan\u00eda, pedir reapertura de esa N-600 o de ese caso anterior para salir adelante con su para continuar con el caso.<\/p>\n<p>Entonces, bueno, esta es una de las cosas de esta ciudadan\u00eda adquisitiva. Luego lo enmiendo. No. Ahora esos procesos, si algo llenamos mal, no se van a poder apelar.<\/p>\n<p>Por eso es tan importante que consultemos abogados expertos en inmigraci\u00f3n. Exactamente lo que se anunci\u00f3 esta semana que es importante es c\u00f3mo los DACA, es decir, esos j\u00f3venes que tienen la protecci\u00f3n del DACA, que se llama Deferred Action for Childhood Arrivals, que est\u00e1n aqu\u00ed en los Estados Unidos, se graduaron de una carrera universitaria y tienen una oferta de empleo.<\/p>\n<p>Muchos de estos j\u00f3venes no pueden recibir esa oferta de empleo aqu\u00ed, o no pueden recibir la residencia tampoco, porque entraron tal vez ilegales, sus padres los trajeron sin una visa, y entonces no la pueden recibir, pero tienen esa oferta.<\/p>\n<p>Lo que el gobierno anunci\u00f3 es que esos j\u00f3venes van a poder ir a su pa\u00eds de origen y procesar la visa temporal de trabajo a trav\u00e9s de esa compa\u00f1\u00eda que est\u00e9 pidi\u00e9ndolos. Y procesar el perd\u00f3n D3. El perd\u00f3n D3, D, el n\u00famero 3, D3, es un perd\u00f3n que se da para cubrir muchas de las inadmisibilidades que pudieran tener las personas que est\u00e1n aplicando para una visa temporal de trabajo para que puedan regresar a los Estados Unidos.<\/p>\n<p>Ese perd\u00f3n D3 lo otorga el c\u00f3nsul de los Estados Unidos en el pa\u00eds de origen de la persona. Por ejemplo, le doy un ejemplo, un DACA. Un joven que lleg\u00f3 aqu\u00ed a los Estados Unidos muy joven, tiene el DACA, lo tiene aprobado y se gradu\u00f3 de la universidad, un t\u00edtulo universitario, vamos a suponer que es ingeniero y trabaja con una empresa de ingenieros y esa compa\u00f1\u00eda est\u00e1 dispuesta a hacerle una oferta de trabajo temporal, como por ejemplo la Visage 1B que es para profesionales.<\/p>\n<p>Esa persona va, se pide la petici\u00f3n aqu\u00ed. La aprueban y va a ir al consulado a que le posigen la visa H-1B. En ese momento de salir, ese joven puede ser que haya incurrido en presencia ilegal, es decir, que haya estado ilegal en los Estados Unidos por m\u00e1s de seis meses despu\u00e9s de los 18 a\u00f1os y requiera un perd\u00f3n.<\/p>\n<p>Entonces, este perd\u00f3n de tres es el que le va a ayudar para poder regresar r\u00e1pido. El presidente Biden anunci\u00f3 que estos perdones de tres los va a procesar lo m\u00e1s r\u00e1pido posible. Es decir, se van a procesar por los consulados en forma expedita para que esos j\u00f3venes puedan entonces ir recibir su visa de trabajo y volver a entrar lo m\u00e1s r\u00e1pido a los Estados Unidos a continuar trabajando para ese empleador.<\/p>\n<p>Esa es la noticia. Es muy, muy importante que las personas que tienen el DACA tengan la oferta de empleo, contacten a su abogado de inmigraci\u00f3n o nos llamen si tienen esa oportunidad, oferta de empleo y pueden aplicar tambi\u00e9n para esta y este perd\u00f3n D3 o mucho gusto le podemos ayudar porque esto pues va a beneficiar a muchos muchos de estos fondos<\/p>\n<p>&nbsp;<\/p>\n<p><strong>JUAN CAMILO:<\/strong><\/p>\n<p>Claro, porque una de las de las inquietudes es que seguramente pueden estudiar pero al momento de trabajar ya las condiciones son otras muy diferentes.<\/p>\n<p>Por eso tan importante si ustedes conocen a alguien que desea beneficiario de este programa de acci\u00f3n diferida de los beneficiarios del DACA para que hagan las respectivas consultas con abogados expertos en inmigraci\u00f3n. Esto es lo que se llama el OPT. Ese entrenamiento pr\u00e1ctico les permite trabajar en los Estados Unidos.<\/p>\n<p>Los j\u00f3venes que tienen una carrera que est\u00e1 dentro de las carreras STEM, que es lo que usted dice, ciencias, tecnolog\u00eda, ingenier\u00eda y matem\u00e1ticas, tienen derecho a extender ese OPT hasta por 24 meses. Es decir, tienen el OPT por 24 meses.<\/p>\n<p>\u00bfQu\u00e9 es lo que est\u00e1 anunciando el gobierno esta semana? Dice, anunci\u00f3 en julio 12, o sea, hace poco el gobierno anunci\u00f3 que va a publicar en el registro federal unas 8 clasificaciones m\u00e1s o 8 carreras m\u00e1s que pueden entrar dentro de estos programas de STEM. Es decir, que se va a ampliar un poco m\u00e1s ese spectrum o esa posibilidad de un OPT bajo el STEM para los estudiantes internacionales.<\/p>\n<p>Se supone que entra precisamente hoy, julio 23, es el d\u00eda en que est\u00e1 programado para que se publique en el registro federal. As\u00ed que los j\u00f3venes que est\u00e1n con el OPT o que est\u00e1n pensando aplicar para el OPT, revisen este registro federal, por lo menos desde a partir de hoy, julio 23 o de ah\u00ed en adelante, para ver si sus carreras est\u00e1n dentro de estas nuevas carreras que tendr\u00edan acceso al OPT a trav\u00e9s del programa STEM.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>JUAN CAMILO:<\/strong><\/p>\n<p>Abogada, si tienen alguna pregunta sobre esto, si ustedes son estudiantes o sus hijos son estudiantes de carreras STEM, STEM es una sigla de S-T-E-M y por ah\u00ed le meten a veces la A porque le meten a veces artes. Algunas bajaron, pero fueron muy pocas las que bajaron. La mayor\u00eda subieron las tarifas.<\/p>\n<p>As\u00ed que es importante que antes de mandar una petici\u00f3n vayan a la p\u00e1gina de inmigraci\u00f3n. Ellos tienen un &#8220;fee calculator&#8221;, es decir, un c\u00e1lculo de la tarifa que tiene que pagar la persona entre las peticiones que tienen que mandar all\u00ed. Impriman ese fee calculator y adicione a la petici\u00f3n que est\u00e1n mandando como prueba de que si est\u00e1n mandando el pago correcto.<\/p>\n<p>Y les doy este consejo porque muchas veces las personas mandan el pago correcto y con inmigraci\u00f3n usan subcontratistas para que reciban esos paquetes iniciales y los escaneen y los procesen. A veces estas personas cometen errores y devuelven las peticiones diciendo que la tarifa est\u00e1 incorrecta.<\/p>\n<p>Si le anexan esa p\u00e1gina del &#8220;fee calculator&#8221; a sus peticiones, por lo menos yo lo estoy haciendo en la oficina para estar segura de que estamos mandando tambi\u00e9n la tarifa correcta y tambi\u00e9n como para probarle al que procese ese paquete inicial, de que la tarifa ya fue consultada en la misma p\u00e1gina de inmigraci\u00f3n.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>JUAN CAMILO:<\/strong><\/p>\n<p>Otra pregunta por ac\u00e1 internamente que me env\u00edan abogada y casualmente es por un asunto que est\u00e1bamos hablando ayer ac\u00e1 en otro Instagram Live y es sobre las elecciones en Venezuela. Este domingo los venezolanos van a votar. Hay una elecci\u00f3n presidencial para tratar de sacar al dictador Nicol\u00e1s Maduro por las v\u00edas democr\u00e1ticas y a pesar de las dificultades.<\/p>\n<p>Hay muchas personas que est\u00e1n viajando desde Miami, para ir a Venezuela a votar, o sea, teniendo todo puesto arriba y todo el problema que sabemos de falta de democracia en Venezuela. Hay gente que se est\u00e1 metiendo el paseo hasta Venezuela para poder participar del voto.<\/p>\n<p>\u00bfQui\u00e9nes ustedes creen que no deber\u00edan viajar? Los que tienen qu\u00e9 estatus o que est\u00e1n presentando qu\u00e9 papeles deber\u00edan evitar viajar a Venezuela, as\u00ed sea para participar de este proceso electoral.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>MARTHA L. ARIAS, ESQ.:<\/strong><\/p>\n<p>Bueno, definitivamente si una persona est\u00e1 presentando un asilo y es un venezolano, obvio, esta ser\u00eda la persona que menos deber\u00eda viajar porque si sale su asilo puede ser considerado abandonado. Hay nueve veces que pueden pedir permisos de viaje, pero si se viaja al pa\u00eds de origen del que se pide asilo, pues esto es fatal. O sea, que ese es el n\u00famero uno.<\/p>\n<p>Dos, si la persona est\u00e1 en un proceso de residencia, no puede viajar a no ser que tenga un permiso de viaje. El permiso de viaje es un advance parole. Eso se pide directamente con inmigraci\u00f3n. Tienen que pedirlo antes del viaje, no vayan a viajar. As\u00ed est\u00e9n casados con ciudadano americano, no pueden viajar sin ese permiso de viaje.<\/p>\n<p>Tres, las personas que tienen el TPS, y aparte de tener el TPS, tienen doble nacionalidad. Yo no le aconsejar\u00eda a muchas de esas personas que viajen a su pa\u00eds de origen, es decir, a Venezuela. Eso puede afectar en el futuro. No tal vez inmediatamente, pero en un futuro, en cualquier otra petici\u00f3n, le puede afectar.<\/p>\n<p>As\u00ed que yo dir\u00eda que esas son como las principales personas que no pueden viajar. Ahora, obvio, si la persona est\u00e1 en un proceso de corte, vamos a decir la persona tiene TPS, pero tiene un caso cerrado administrativamente en la corte o tiene el TPS y todav\u00eda tiene un caso abierto en la corte de inmigraci\u00f3n, esas personas tampoco deben viajar fuera de los Estados Unidos.<\/p>\n<p>Personas que tengan arrestos, consulten primero un abogado de inmigraci\u00f3n antes de viajar porque hay ciertos delitos que no hacen a la persona deportable es decir no la van a deportar mientras est\u00e1n en el pa\u00eds pero si la hacen inadmisible para volver a entrar o si lo dejan entrar pues pueden tener problemas en el aeropuerto; entonces tambi\u00e9n esas personas que hayan cometido delitos hayan tenido arrestos, deben cuidarse tambi\u00e9n de no viajar.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>JUAN CAMILO:<\/strong><\/p>\n<p>Abogada, finalmente, por ac\u00e1 me hab\u00edan escrito internamente, relacionado con una noticia que fue muy popular hace unos d\u00edas y que continu\u00f3 por un buen tiempo. Y es que cuando celebramos la final de la Copa Am\u00e9rica, ac\u00e1 en el sur de Florida, hubo muchas personas que se colaron, muchas personas que terminaron arrestadas, que terminaron detenidas.<\/p>\n<p>Y esta semana se populariz\u00f3 mucho una noticia en un medio de comunicaci\u00f3n en Colombia que dec\u00eda que a muchas de esas personas ya les hab\u00edan hecho reconocimiento facial en el estadio y que las ten\u00edan identificadas y que seguramente las iban a arrestar y que podr\u00edan potencialmente hasta tener consecuencias migratorias. \u00bfEsto puede ser as\u00ed? \u00bfEs verdad?<\/p>\n<p>&nbsp;<\/p>\n<p><strong>MARTHA L. ARIAS, ESQ.:<\/strong><\/p>\n<p>S\u00ed, es correcto. Las personas que entran con visa a los Estados Unidos, cualquier visa temporal incluyendo la visa de turista, tienen que tener cuidado en c\u00f3mo manejan esas visas y c\u00f3mo se comportan.<\/p>\n<p>Yo pienso que no hay necesidad de advertirle a nadie que se porte bien en un tercer pa\u00eds, pero desafortunadamente parece que hay personas que s\u00ed hay que recordarles que cuando llegan a un tercer pa\u00eds o a otro pa\u00eds que no es su pa\u00eds de origen, incluso deben comportarse adecuadamente de acuerdo a la ley.<\/p>\n<p>El entrar a un escenario deportivo o cualquier otro escenario, incluso a cualquier sitio privado o p\u00fablico, sin autorizaci\u00f3n, sin un tiquete, sin una boleta de entrada, sin una autorizaci\u00f3n, eso es un delito. Se llama &#8220;trespassing&#8221;. &#8220;Trespassing&#8221; es como allanar una morada o entrar a una morada sin autorizaci\u00f3n. Eso es un delito, puede que no sea un delito tan grave, pero es un delito.<\/p>\n<p>En Miami o aqu\u00ed en el estado de la Florida, m\u00e1s bien es un &#8220;misdemeanor&#8221;, dependiendo y tambi\u00e9n hay otros niveles de agravamiento. Puede ser m\u00e1s agravado si la persona entra, hace el trespassing y tambi\u00e9n comete delitos dentro de esa morada, dentro de esos premises, dentro de ese lugar. Las visas de turista son &#8220;discretionary&#8221;, es decir, el c\u00f3nsul tiene la discreci\u00f3n de darlas o negarlas.<\/p>\n<p>Entonces, si la persona cometi\u00f3 delitos, si le ven en los videos estos comportamientos, lo m\u00e1s probable es que pueden negarle esa visa o esa renovaci\u00f3n en el futuro.<\/p>\n<p>Entonces, s\u00ed, claro que puede haber una consecuencia migratoria negativa para las personas que estuvieron en esa oportunidad en el estadio y que se avalancharon o se avanzaron a entrar y que se hicieron en las como en las gradas del estadio porque obviamente estaban en las gradas porque no ten\u00edan boleta.<\/p>\n<p>Estas personas poco a poco les fueron sacando del estadio.
