So, that category allows the person to apply even for residence when that person does not have an employer, a process is done called the national interest waiver.<\/p>\n<p>And it is being announced a lot by many lawyers and non-lawyers or at least non-lawyers here in the United States, this waiver of the EB-2 or residence through the EB-2 with the national interest waiver.<\/p>\n<p>And it is being sold like hotcakes, Juan Camilo. It is expensive. It is a petition that can cost between 10 thousand to 15 thousand 18 thousand dollars. It depends on the law firm that does it. And I see people who have taken this like hotcakes, as if it were 15 thousand dollars. They get 100 200 people to do the cases. And they are really unmerited cases, they are cases that do not qualify for that EB-2 visa. So it was one application plus one appeal, plus another second application.<\/p>\n<p>An exaggerated amount and craziness from the people who had to do that and that was what the person wanted to hear. So that is what I want to tell you because when I saw that and I said, <strong>&#8220;Oh my God, a person spent 60,000 dollars and still kept trusting and hearing, thinking that this is something that can be achieved.&#8221;<\/strong> It makes me sad that people hope so much and that others deceive them that way. So be careful with those conditions, use common sense.<\/p>\n<p>If you know that you are a person who has received many awards, many recognitions, has books, has records or what do I know. So of course, you know if maybe you will qualify for that. El Departamento de Estado, que es el que emite los pasaportes, public\u00f3 en el Registro Federal ahora el 26 de junio de julio de este a\u00f1o un cambio. El cambio le permite a un padre que no pueda estar presente mandar un affidavit notarizado, en el cual \u00e9l autoriza que su hijo pueda obtener el pasaporte. Anteriormente solamente se permit\u00eda a este afideide que se firmara delante de un agente de pasaportes. Entonces hab\u00eda problemas porque si por ejemplo estaba en otra parte o en otro estado, en otro pa\u00eds, la persona no ten\u00eda acceso a ese agente de pasaportes para firmar. Entonces ahora dan esa opci\u00f3n de que sea a trav\u00e9s de un notario.<\/p>\n<p>Entonces, ese pap\u00e1 o mam\u00e1 que no va a estar presente para sacar el pasaporte de sus hijos puede enviar una autorizaci\u00f3n notarizada en la que autorice al otro padre a que saque el pasaporte para su hijo menor de edad. Para los hijos menores de edad s\u00ed se demora un poquito menos. Los hijos menores de edad son los menores de 21 a\u00f1os para inmigraci\u00f3n.<\/p>\n<p>Para los adultos, los hijos adultos que un residente pide van por el 1 de mayo del 2016. ARIAS, ESQ.:<\/strong><br \/>\nA ver, el problema que est\u00e1 pasando, Juan Camilo, es que el servicio de inmigraci\u00f3n se est\u00e1 demorando mucho en emitir los recibos y esta es una oportunidad para las personas que no se est\u00e1n escuchando ahora en este v\u00eddeo. Hoy es julio 30 al 2024, posiblemente lo puedan ver despu\u00e9s, pero pues en este momento la actualidad es que m\u00e1s o menos desde abril de este a\u00f1o se han presentado muchas demoras en la emisi\u00f3n de recibos por parte de inmigraci\u00f3n.<\/p>\n<p>\u00bfQu\u00e9 quiere decir esto? Que cuando, por ejemplo, usted manda una petici\u00f3n de asilo y se est\u00e1n demorando casi tres meses, cinco meses para que le manden el recibo. Manda una petici\u00f3n de ciudadan\u00eda o cualquier otro documento o alguna petici\u00f3n y en algunos casos se est\u00e1n demorando mucho en emitir los recibos. Digo en algunos casos porque tengo que ser clara, yo en mi oficina he tenido casos que los recibimos m\u00e1s o menos en 4 o 5 semanas, que est\u00e1 dentro de lo m\u00e1s o menos normal, pero de verdad que tambi\u00e9n hay casos, hace poquito tuvimos uno que se est\u00e1 demorando casi dos meses en emitir los recibios, entonces s\u00ed hay retardos en eso. Presente una visa de fianc\u00e9, una K1, hace m\u00e1s o menos unos, yo dir\u00eda unos tres meses. Y exactamente se demor\u00f3 casi los tres meses en que nos llegara el recibo. Est\u00e1n muy lentos. Ahora no solamente es el retardo en recibir los recibos. Tambi\u00e9n hay el retardo en la emisi\u00f3n de las tarjetas de empleo, o sea, de permisos de trabajo. La gente tiene que ser consciente de esto porque es que a veces las personas piensan que nosotros los abogados tenemos unos poderes sobrenaturales en frente a inmigraci\u00f3n y que podemos llamarlos a ellos cuando queramos y ordenarles que emitan los permisos de trabajo r\u00e1pido. Y eso no es as\u00ed.<\/p>\n<p>El servicio de inmigraci\u00f3n se toma lo que se tome para emitir estos permisos y pues no depende de nosotros. Ahora, es cierto que nosotros podemos hacerles seguimientos y tal vez estar al tanto para ver si acosamos, vamos a decir un poquito, para que emitan esos permisos de trabajo, pero no necesariamente eso quiere decir tambi\u00e9n que nos van a escuchar. A veces uno hace seguimientos a caso tres, cuatro veces y tampoco logra el objetivo.<\/p>\n<p>Entonces, lo que yo le aconsejo a las personas es que tengan paciencia. Los recibos s\u00ed se est\u00e1n demorando. N\u00famero uno, los permisos de trabajo se est\u00e1n demorando. Tambi\u00e9n hay errores que est\u00e1n devolviendo algunas peticiones por las tarifas incorrectas. Eso tambi\u00e9n pasa debido al cambio de las tarifas en abril.<\/p>\n<p>Entonces, bueno, el punto aqu\u00ed es tener paciencia, entender al abogado, si es que tiene un abogado y pues ir con paciencia porque la verdad no hay nada que nadie pueda hacer para cambiar estos tiempos con inmigraci\u00f3n. Por ahora tenemos una dictadura que es la que est\u00e1 all\u00ed y por eso tienen el TPS los venezolanos y pues aunque no todo el mundo califica para el asilo, tal vez algunos m\u00e1s enfocados al asilo humanitario y pues sus asilos est\u00e1n pendientes.<\/p>\n<p>\u00bfQu\u00e9 va a pasar en Venezuela? Si Maduro contin\u00faa en el poder sabiendo que perdi\u00f3 las elecciones, pues continuar\u00edamos, yo creo, con el estatus que tenemos. \u00bfQu\u00e9 esto genere o no otra ola migratoria? Bueno, eso es especular. Sabemos que de Venezuela est\u00e1n huyendo todas las personas de este del hambre del sobre todo del caos y de la inseguridad que trae una dictadura. Y pues yo me imagino que como pasa en Cuba, en Nicaragua, siguen saliendo en estos pa\u00edses as\u00ed la gente huye. Entonces bueno, eso ya ser\u00eda especular si va a haber una salida masiva o no. En cuanto al contrario, si logran sacar a, me perdona que use esta palabra pero es que me parece la m\u00e1s bonita y la m\u00e1s decente para calificar a una persona como Maduro y es un energ\u00fameno porque es que yo no entiendo como un ser humano puede ser tan malo. Y puede subyugar a todo el mundo y crearle una destrucci\u00f3n a un pa\u00eds entero. Entonces, en alg\u00fan modo como este, si \u00e9l pierde el poder o sale del poder, yo la verdad no s\u00e9 tambi\u00e9n qu\u00e9 va a pasar en Venezuela. Juan Camilo, acu\u00e9rdese que estos problemas ya tienen unas ra\u00edces ondas. El sistema de esta mafia criminal que se apodera del pa\u00eds tiene sus ra\u00edces, o sea, no solamente el problema es maduro. Maduro es el iceberg, lo que se ve arriba del hielo, \u00bfs\u00ed? Pero por debajo hay una corrupci\u00f3n y una descomposici\u00f3n total del gobierno. Y entonces, volver a establecer ese gobierno, tratar de establecer una democracia y limpiar del poder toda esta corrupci\u00f3n que hay. A m\u00ed me parece que es una tarea dif\u00edcil, ojal\u00e1 que el pueblo de Venezuela lo logra hacer, pero entonces eso va a generar que tambi\u00e9n salga la gente o no, no sabemos. Tal vez eventualmente el TPS lo quitaran si se logra establecer esa democracia en firme. Pero yo soy de las que pienso que una democracia despu\u00e9s de tantos a\u00f1os como lo que lleva Venezuela, \u00bfcu\u00e1nto lleva? Entonces, por esa misma raz\u00f3n, yo creo que el TPS no es algo que lo vayan a quitar inmediatamente, porque es que no es solamente que salga, salga Ch\u00e1vez. O sea, hay muchos. Mucha putefacci\u00f3n ah\u00ed abajo enraizada en ese gobierno. Entonces sale el enerm\u00f3meno mayor, pero hay que dar unos cuantos engendros de eso. S\u00e9 que vamos a ver. La idea es que ojal\u00e1 ojal\u00e1 que puedan liberarse de este de este yugo tan feo y puede salir a flote. Con una un pa\u00eds como el que ten\u00edan antes, no? Por lo menos que se pueda vivir, trabajar, que la gente tenga m\u00e1s seguridad. Por lo menos.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nOjal\u00e1. Abogada, antes de irnos una una pregunta tambi\u00e9n relacionada con otro tema y es hay una advertencia con las y b2 con las EB-2 en que consiste esto exactamente?<\/p>\n<p><strong>MARTHA L. ARIAS, ESQ.:<\/strong><br \/>\nS\u00ed, bueno. Esto es una advertencia m\u00e1s bien que yo quiero dar como abogada de inmigraci\u00f3n que est\u00e1 en este proceso todos los d\u00edas. Yo, yo, este es mi trabajo. Yo estoy constantemente viendo casos nuevos de personas nuevas que vienen a mi consulta y asimismo escuchando muchas cosas que pasan all\u00e1 afuera.<\/p>\n<p>Quiero darles este, este consejo. Y es un consejo legal, porque soy abogada y porque tengo experiencia en el \u00e1rea de migraci\u00f3n y es el siguiente; las personas la EB-2 es una categor\u00eda una preferencia dentro de las cuales la persona puede aplicar cuando tienen unas habilidades especiales en algo puede ser las artes, los negocios, la ciencia, la tecnolog\u00eda. Entonces esa categor\u00eda le permite a la persona aplicar incluso una residencia cuando esa persona no tiene un empleador se hace un proceso que se llama el perd\u00f3n del inter\u00e9s nacional o el national interest waiver; entonces se est\u00e1 anunciando mucho por muchos abogados y no abogados o por lo menos no abogados aqu\u00ed en los Estados Unidos ese perd\u00f3n de la EB-2 o la residencia a trav\u00e9s de la EB-2 con el perd\u00f3n de inter\u00e9s nacional o el national interest waiver.<\/p>\n<p>Y se est\u00e1 vendiendo como papa caliente, Juan Camilo. Es costoso. Es una petici\u00f3n que puede costar entre unos 10 mil a 15 mil 18 mil d\u00f3lares. Depende del bufete de abogado que lo haga. Y yo veo a gente que ha cogido esto como papa caliente, como que son 15 mil d\u00f3lares. Se consiguen 100 200 personas que que que hagan los casos. Y realmente son casos que no son meritorios, son casos que no califican para esa visa EB-2. Pero como dicen por ah\u00ed, les montan esos casos, les inventan una cantidad de cosas, les arman un caso pues como si fuera una Shakira, un Carlos V, una persona de una habilidad extraordinaria o un Elon Musk, una persona de habilidad en los negocios, qu\u00e9 s\u00e9 yo.<\/p>\n<p>Entonces la gente est\u00e1 cayendo v\u00edctima de eso y lo he visto mucho y me da mucho pesar ver por qu\u00e9. Estos no son procesos baratos, son 15, 20 mil d\u00f3lares. Que normalmente la persona tiene que invertir entonces.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nNo es que ya est\u00e1n en la plata, esa plata se perdi\u00f3, ya esa plata no la van a recuperar. No es como que si no, si no le salieron los papeles, le devuelven la plata.<\/p>\n<p><strong>MARTHA L. ARIAS, ESQ.:<\/strong><br \/>\nExacto. Y el problema de esto es que todo el mundo quiere escuchar lo que quiere escuchar. La gente quiere escuchar que s\u00ed califica para algo. La gente quiere escuchar que s\u00ed tiene una esperanza, \u00bfs\u00ed? Entonces, por eso cuando llegan estos vivos o estas personas amantes de las mentiras y de mucho dinero, les ofrecen este producto y la gente dice, \u00a1uy no! Pues claro, o sea, buen\u00edsimo, porque los endulzan y les alimentan su esperanza.<\/p>\n<p>Entonces, la gente se busca la plata de donde no la tenga Juan Camilo para pagar ese tipo de procesos. Y despu\u00e9s se dan cuenta pues que esos procesos no los llevan a ninguna parte. Y peor a\u00fan, f\u00edjese yo la otra vez vi a una se\u00f1ora que se hab\u00eda gastado m\u00e1s de sesenta mil d\u00f3lares en un caso como esto porque lo perdi\u00f3 y le dijeron que no, que apelara y mientras la apelaci\u00f3n estaba pendiente, le dijeron que tranquila, que mandemos una nueva. Entonces fue una aplicaci\u00f3n m\u00e1s una apelaci\u00f3n, m\u00e1s otra segunda precisi\u00f3n.<\/p>\n<p>Una cantidad exagerada y una locura de las personas que ten\u00edan que hacer eso y eso era lo que la persona quer\u00eda escuchar. Entonces eso es lo que yo quiero decirle, porque cuando yo vi eso y yo por Dios, bendito, una persona gastaste 60 mil d\u00f3lares y todav\u00eda seguir confiando y escuchar, pensando que esto es algo que s\u00ed se puede lograr. Me da pesar que la gente se esperan se tanto y que otros lo enga\u00f1en de esa forma. Entonces tengan cuidado con esas condiciones, usen el sentido com\u00fan.<\/p>\n<p>Si usted sabe que es una persona que ha recibido muchos premios, muchos reconocimientos, tiene libros, tiene discos o qu\u00e9 s\u00e9 yo. Entonces claro, usted mismo sabe si de pronto va a calificar para eso. Pero si usted sabe que usted es de pronto un profesional normal que ha trabajado toda su vida, que de pronto ha tenido unos trabajitos buenos, que tiene un t\u00edtulo universitario, de pronto una maestr\u00eda, pero que no sobresale dentro del mont\u00f3n, porque vamos a decir es un profesional normal.<\/p>\n<p>Posiblemente usted no califica para esto por m\u00e1s que usted quiera escucharlo y por m\u00e1s que tenga esperanza. Esa es la informaci\u00f3n sobre esto. En la EB-2, vistas de inter\u00e9s nacional est\u00e1n haciendo conferencias, reuniones. Reunen 100, 200 personas en todos los pa\u00edses. Yo he visto que lo hacen en Colombia, en todos los pa\u00edses de Sudam\u00e9rica y aqu\u00ed mismo en Estados Unidos. Pues obviamente, imag\u00ednese usted, Juan Camilo, si usted tiene 100 clientes que le pagan 15000 d\u00f3lares, 20 mil d\u00f3lares en mes.
