We delved into the latest updates on U.S. immigration policies, particularly focusing on the new parole program announced by President Biden. This program is set to provide significant benefits for spouses of U.S. citizens who have been in the country for over ten years. However, with the program&#8217;s start date rapidly approaching, there are still many unanswered questions, including the application process and associated costs. I advised our listeners to begin gathering necessary documentation while waiting for official guidance.<\/p>\n<p>We also addressed the Cuban Adjustment Act, a topic of great importance to many in the South Florida community. I explained how this long-standing law allows Cuban nationals, and in some cases, their spouses and children, to obtain U.S. residency. We discussed some common misconceptions, such as the belief that once a Cuban becomes a U.S. citizen, their spouse can still apply under the Cuban Adjustment Act, which is not the case. I also clarified the criticisms surrounding the act, particularly regarding the ability of Cuban residents to return to Cuba shortly after gaining U.S. residency.<\/p>\n<p>During the session, we also touched on other key issues, such as the ISAP program, an alternative to detention that monitors individuals who might otherwise be detained by immigration authorities. This program raised several questions among our viewers, especially regarding its application and the circumstances under which individuals are placed in the program. I emphasized the importance of consulting with an experienced immigration lawyer to navigate these complex issues.<\/p>\n<p>I want to thank everyone who joined the conversation and participated with their questions. What can you tell us about Biden\u2019s parole? What\u2019s happening with it?<\/p>\n<p><strong>MARTHA ARIAS:<\/strong><br \/>\nWell, yes, Juan Camilo. The parole announced by President Biden is supposedly set to begin on Monday, August 19. Monday, August 19, is the date the government said they would start receiving applications for this. However, today is August 13, Tuesday, less than three business days before the program starts, and we still haven\u2019t seen the instructions or regulations published in the Federal Register.<\/p>\n<p>We also don\u2019t know which application will be used to apply for this Parole in Place, nor whether it will have a fee, and if so, how much the fee will be. I imagine there will be a fee, but we still don\u2019t have this information. It\u2019s a bit concerning. According to a notification we received, immigration lawyers, the government will announce all of this close to the program\u2019s start date.<\/p>\n<p>What does this mean? It means that we, as lawyers, might not be ready with all the documentation and everything needed to file the application on August 19. But at least if you\u2019re already gathering evidence, that\u2019s the most you can do at this point.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nIs this the parole that was temporarily suspended for Venezuelans, Cubans, Haitians, and Nicaraguans?<\/p>\n<p><strong>MARTHA ARIAS:<\/strong><br \/>\nNo, this is the parole announced by President Biden in July, if I\u2019m not mistaken, on July 17. It\u2019s a parole for the spouses of U.S. citizens who have been in the United States for more than 10 years. In other words, a person who has been in this country for 10 years and is married to a U.S. citizen can apply for this Parole in Place.<\/p>\n<p>What will they get? They will get a work permit and, of course, this Parole in Place, which is like an admission to later apply for a green card within the United States. Let me give you an example. For instance, Mrs. Maria entered through the border in 1995, meaning without inspection, without a visa, without parole. Mrs. Maria is married to a U.S. citizen and has been here since 1995, so she has been in the United States for more than 10 years.<\/p>\n<p>So, Mrs. Maria, although married to a U.S. citizen, has not been able to receive a green card because she doesn\u2019t have a legal entry, neither an entry nor a parole. So what she\u2019s going to do is apply for this parole, which will give her a legal entry into the United States, and with this parole, Mrs. Maria will be able to receive her green card in the United States, in addition to getting a work permit.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nThis Parole in Place&#8230; What used to happen was that Mrs. Maria had to return to her country to process the paperwork there and then come back here to marry and regularize her status. But the thing is, we don\u2019t know many details yet. Since there are so many questions, the best thing to do while we wait for guidance on where to go or what to do is to at least start gathering evidence. But this is very important because there are tens of thousands of people in the country who could benefit from this program. Why does this matter to us?<\/p>\n<p><strong>MARTHA ARIAS:<\/strong><br \/>\nYes, well, the thing is that, remember, certain petitions are sent to specific addresses. Immigration has addresses where we send petitions. The California Service Center is going to change its address. So people need to be vigilant because they should go to the immigration website, and if the petition they\u2019re sending needs to go to the California Service Center, where many employment petitions, business visas, even O visas, are sent, then they need to check, double-check, and make sure they\u2019re sending it to the new address. On the USCIS immigration website, <a href=\"https:\/\/uscis.gov\" target=\"_new\" rel=\"noreferrer noopener\">uscis.gov<\/a>, you\u2019ll find the new address for the service center where you\u2019re sending the package.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nOkay, this is important so that those processes don\u2019t end up being unnecessarily delayed. Let\u2019s move on to another question from another listener, someone who is connected to this Instagram Live from Actualidad Radio and attorney Martha Arias.<br \/>\nHere\u2019s another listener who writes: \u201cI\u2019ve lived in the United States since I was 12, and I\u2019m a citizen. I\u2019m 67 years old and have been married to a Colombian woman for 13 years. She\u2019s been in the United States for three years. During the pandemic, her residency was denied because we didn\u2019t want to get the COVID-19 vaccine. What do we do now?\u201d<\/p>\n<p><strong>MARTHA ARIAS:<\/strong><br \/>\nWell, the COVID vaccine is still a requirement for a person to receive residency in the United States, just as other vaccines are required for people to receive residency. However, there are also exceptions. For example, if the person, for medical reasons, cannot get the vaccine, and there are some people who also refuse for religious reasons.<\/p>\n<p>I would invite that person to consult with an immigration lawyer to find out if the reason they have for not getting the vaccine is either a medical reason or a religious reason.<\/p>\n<p>If it\u2019s a political reason, I would say, well, that political reason isn\u2019t going to help us much; it has to be something religious and genuine. I recently had a lady with this very issue. For religious reasons, it seems they are Pentecostals; I\u2019m not sure if they are or if they\u2019re Jehovah\u2019s Witnesses, but some of them don\u2019t believe in certain synthetic vaccines, certain things, so their religion doesn\u2019t allow it. So this allows one to make an exception.<\/p>\n<p>For example, there are also pregnant women who can\u2019t get the vaccine because they\u2019re pregnant, and there are people with other medical conditions that don\u2019t allow them to receive vaccines. So, this is what needs to be investigated to see if the person falls within one of these exceptions.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nThank you for the response, attorney. Again, if you have questions about these cases, the best recommendation is to consult with an expert immigration lawyer. Attorney, what can you tell us about ISAP or the alternative to the detention program? What exactly is that?<\/p>\n<p><strong>MARTHA ARIAS:<\/strong><br \/>\nYes, well, this is a very important topic, Juan Camilo, because it\u2019s a topic that\u2019s not talked about much, or at least that\u2019s how I see it. Outside, people talk a lot about other things, but this isn\u2019t talked about much. What is ISAP? Or ISAP.<\/p>\n<p>ISAP is an alternative to detention program. That is, if a person could be detained by immigration, but instead of being detained, they will be put under monitoring. This could mean they will have an ankle monitor, or they will be monitored through calls; they are given a phone and monitored through the calls.<\/p>\n<p>ISAP is a contractor for the federal government that handles this monitoring or tracking of the people who enter the program. So there are many, many questions. Let me give you one, for example, that we get a lot from listeners in a program I have today at seven o\u2019clock in the evening on 1260 AM.<\/p>\n<p>It\u2019s also an immigration program where I answer questions. In that program, I was asked if I could bring my lawyer to the ISAP appointment, because remember, that ISAP appointment is not with an ICE or immigration officer; it\u2019s with an ISAP officer, which is the program for this monitoring. And the answer is yes, you can bring your lawyer to the ISAP appointment.<\/p>\n<p>So, it\u2019s important to know this because many people think it\u2019s not necessary.<\/p>\n<p>Sometimes it\u2019s good because you can explain to the officer, maybe in simpler terms, what they have because they\u2019re not lawyers, and you can show documentation to explain the client\u2019s case. So, for example, that\u2019s one of the questions they ask.<\/p>\n<p><strong>MARTHA ARIAS:<\/strong><br \/>\nYes, well, before that, let me give you another piece of information about this ISAP program. Another important piece of information is that people ask, \u201cWhy was I put in the ISAP program and my spouse wasn\u2019t?\u201d Most of the time, this is determined on a case-by-case basis.<\/p>\n<p>It could be because the person has a criminal conviction. It could be because the person is at higher risk of absconding, meaning they might hide in the country and not show up in court. The person doesn\u2019t have a strong immigration case to resolve because there could be public safety concerns or a history of not showing up to immigration appointments.<\/p>\n<p>It could also be because the person doesn\u2019t have many family ties in the United States, due to medical conditions or even humanitarian reasons, believe it or not. These are some of the reasons that determine whether the person will be in the program. Only people over 18 can be placed in this program. And this is important. The other day, I saw a young girl, 16 years old, who had been placed in the program. It seems it was by mistake when she entered. She said she was older, and they didn\u2019t have a document yet to identify her.<\/p>\n<p>So, they obviously removed her from the program because it\u2019s only for adults over 18 years old. So those are some of the conditions they determine. There are many other questions; we can discuss them in other programs. But I also want you to know that this is done by a contractor for ICE, by a government contractor. It\u2019s not directly ICE, it\u2019s not directly the government.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nOkay. And regarding the question, attorney, do we have any notification or update on the suspended federal government program?<\/p>\n<p><strong>MARTHA ARIAS:<\/strong><br \/>\nYes, Juan Camilo, the humanitarian parole for Venezuela, Cuba, Nicaragua, and Haiti, as you mentioned, was suspended about a week or two ago due to a possible fraud involving the affidavits of support or form I-134A. At this time, there\u2019s no notification from immigration about when they might resume the program or what\u2019s happening with the people who already had their parole approved for travel but couldn\u2019t travel because it was suspended. We also don\u2019t know what will happen to people who already had their parole approved and might be considered part of this fraud. So, at this moment, it\u2019s all very secretive. We don\u2019t know what\u2019s happening. I imagine this is subject to investigation. We don\u2019t know how long it will take, but there\u2019s no official update from the government about this program.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nIf you have any questions about this or how it might affect you once it\u2019s reactivated, if it is reactivated, it\u2019s always good to consult with expert immigration lawyers. It\u2019s about the Cuban Adjustment Act. What can you tell us about the Cuban Adjustment Act? Who really qualifies, and who doesn\u2019t qualify?<\/p>\n<p><strong>MARTHA ARIAS:<\/strong><br \/>\nYes, Juan Camilo, that\u2019s a very important topic, especially here in South Florida. The Cuban Adjustment Act is a law that has been in place for many years, since the 60s, which allows a national of Cuba, meaning a person born in Cuba or in a third country but with Cuban parents who are entitled to Cuban nationality, to receive residency in the United States.<\/p>\n<p>They must have parole or an admission. An admission is what they get when they enter with a visa. And in addition to this, they must stay for a year and a day. After a year and a day, they can apply for residency through the Cuban Adjustment Act. Who else can receive residency through the Cuban Adjustment Act? The spouses of Cubans and the children of Cubans.<\/p>\n<p>For example, there are people from other nationalities, Colombia, Venezuela, Honduras, Nicaragua, who marry a Cuban. These people can also receive residency in the United States through the Cuban Adjustment Act, and the requirements will be the same: that they are married to that Cuban, that the person or spouse or child has been in the United States for a year and a day, and that they were admitted with parole or admission.<\/p>\n<p>So, it\u2019s worth noting here two important points. If that spouse or that Cuban entered through the border a long time ago, wasn\u2019t given parole, and is married, or if that person, that Cuban, is already a U.S. citizen, the person can no longer apply through the Cuban Adjustment Act. Because if the Cuban has already become a citizen, the spouse can no longer apply for residency through the Cuban Adjustment Act. They now have to do it through Parole in Place as the spouse of a citizen. Yes, Juan Camilo, there are many Cubans who have already become U.S. citizens and can no longer give their spouses the benefit of the adjustment. They now have to do it as U.S. citizens.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nNow, does this still apply to all Cubans who arrive, for example, with the parole that was suspended, or who arrive through the southern border, or for people who arrive on rafts? Does it still work the same way?<\/p>\n<p><strong>MARTHA ARIAS:<\/strong><br \/>\nYes, parole, well, the Cuban Adjustment Act still works. What\u2019s not working and was also suspended was the parole given under the \u201cwet foot, dry foot\u201d policy because it was a policy, not even a law. When this \u201cwet foot, dry foot\u201d policy existed, it said that any Cuban who touched American soil was to be given humanitarian parole.<\/p>\n<p>So that\u2019s why you saw on the news that the rafters were there, waiting, and they were desperate to jump off the raft and touch American soil, to put their feet on American soil. At that moment, the \u201cwet foot\u201d policy applied, and they could be given parole. Those Cubans caught at sea and sent back, obviously didn\u2019t have the right to parole because they were at sea; they hadn\u2019t touched American soil. Obama suspended this \u201cwet foot, dry foot\u201d policy, and so we have the problem now that many Cubans entering through the border aren\u2019t given parole. Instead, they\u2019re given a 220a, which is conditional release on their own recognizance, and the debate now is whether that counts as parole or not.<\/p>\n<p>So, well, that\u2019s the situation with the Cuban Adjustment Act. Now, another important thing, Juan Camilo, about the Cuban Adjustment Act is regarding the children.<\/p>\n<p>And this is where I\u2019ve seen many mistakes people make when they don\u2019t seek proper advice. The children of a person, let\u2019s say a Cuban, marry a Colombian. That Cuban who marries the Colombian, the Colombian has a minor child. Her child will also be able to access that Cuban Adjustment Act as long as they live with the mother and the Cuban.<\/p>\n<p>One of the mistakes I\u2019ve seen is that they apply for the child, but the child doesn\u2019t live with the mother and the Cuban but maybe with the biological father somewhere else. The Cuban Adjustment Act requires that the couple lives together and if they have children who will also be derivatively included in the petition, they must live with them. This is also very important for these cases under the Cuban Adjustment Act.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nNow, the Cuban Adjustment Act, and now that you mention it, I see it\u2019s also heavily criticized because they say that after a very short time, Cubans can legally return to Cuba and then come back to the United States. Is this true or not?<\/p>\n<p><strong>MARTHA ARIAS:<\/strong><br \/>\nIt is true. Once a Cuban receives residency in the United States, they can return to Cuba for a visit, and as far as I know, there\u2019s no restriction on the number of trips or visits they can make. The restrictions or limits that exist are those that apply to any resident. A resident must live in the United States and should not spend more than 180 days outside the United States in one trip or in total over a year.<\/p>\n<p>So, what is most criticized is perhaps that Cuban who lives here, receiving government benefits, food stamps, housing plans, federal or state aid, and then leaves and stays outside for more than 180 days. That\u2019s what\u2019s criticized. Now, Social Security and all the entities involved in federal or state aid are becoming more likely to request that information and review that person\u2019s travel history.<\/p>\n<p>But this doesn\u2019t only apply to Cubans; it obviously applies to anyone who is a U.S. resident and receiving aid and spends more time outside. But it\u2019s particularly common with Cubans because the Cuban Adjustment Act has, in a way, been a benefit given to Cuba due to the dictatorship it has suffered from for so many years.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nOf course, of course. Attorney, it\u2019s good that you clarify many of these issues for us. El lunes, agosto 19, es la fecha en que el gobierno dijo que se iban a empezar a recibir las peticiones para esto. Sin embargo, hoy estamos a agosto 13, martes, menos de tres d\u00edas h\u00e1biles antes de empezar el programa y todav\u00eda no hemos visto publicado en el registro federal las instrucciones o la regulaci\u00f3n de este programa.<\/p>\n<p>Tampoco sabemos qu\u00e9 aplicaci\u00f3n se va a usar para poder aplicar a este Parol in Place, ni tampoco si va a tener un costo, cu\u00e1nto va a ser el costo. Me imagino que s\u00ed va a tener un costo, pero pues toda esta informaci\u00f3n todav\u00eda no la sabemos. Un poquito preocupante, seg\u00fan una notificaci\u00f3n que recibimos nosotros, los abogados de inmigraci\u00f3n, el gobierno va a anunciar todo esto cerca a la fecha de inicio del programa.<\/p>\n<p>\u00bfQu\u00e9 quiere decir esto? Que puede ser que no estemos listos los abogados con toda la documentaci\u00f3n y todo lo que se necesita para hacer la petici\u00f3n en agosto 19. Es un parol para los c\u00f3nyuges de ciudadanos americanos que llevan m\u00e1s de 10 a\u00f1os dentro de los Estados Unidos. Es decir, una persona que lleve 10 a\u00f1os en este pa\u00eds y est\u00e9 casado o casada con un ciudadano americano puede aplicar para este Parol in Place.<\/p>\n<p>\u00bfQu\u00e9 le van a dar? Les van a dar un permiso de trabajo y obviamente este Parol in Place que es como una admisi\u00f3n para m\u00e1s adelante poder pedir una residencia dentro de los Estados Unidos. Le doy un ejemplo. Por ejemplo, la se\u00f1ora Mar\u00eda entr\u00f3 por la frontera en 1995, es decir, sin inspecci\u00f3n, sin una visa, sin un parol. La se\u00f1ora Mar\u00eda est\u00e1 casada con un ciudadano americano y obviamente est\u00e1 aqu\u00ed desde 1995, o sea que tiene m\u00e1s de 10 a\u00f1os en los Estados Unidos.<\/p>\n<p>Entonces, la se\u00f1ora Mar\u00eda, aunque est\u00e9 casada con su esposo americano, no ha podido recibir la residencia porque no tiene una entrada legal, ni una entrada ni un parol. O sea, la inmigraci\u00f3n tiene unas direcciones donde mandamos las peticiones. El Centro de Servicios de California lo van a cambiar de direcci\u00f3n. Entonces, las personas tienen que estar vigilantes porque vayan a la p\u00e1gina de inmigraci\u00f3n y si la petici\u00f3n que ellos est\u00e1n mandando tiene que ir al Centro de Servicio de California, donde muchas de las peticiones de empleo, de business visas, incluso las visas O, se mandan all\u00e1.<\/p>\n<p>Entonces, si tienen una petici\u00f3n que va para California, por favor, revisen, chequen, aseg\u00farense que est\u00e9n envi\u00e1ndola a la nueva direcci\u00f3n. En la p\u00e1gina de inmigraci\u00f3n de USCIS, <a href=\"https:\/\/uscis.gov\" target=\"_new\" rel=\"noreferrer noopener\">uscis.gov<\/a>, van a encontrar la direcci\u00f3n nueva del centro de servicio donde est\u00e1n enviando el paquete.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nOk, es importante esto para que no terminen esos tr\u00e1mites demor\u00e1ndose de forma innecesaria. Vamos con otra pregunta de otro oyente, de otra persona que est\u00e1 conectada en este Instagram Live de Actualidad Radio y la abogada Martha Arias.<br \/>\nPor ac\u00e1 nos escribe otro oyente y dice: &#8220;Vivo en Estados Unidos desde mis 12 a\u00f1os y soy ciudadano. Tengo 67 a\u00f1os y estoy casado con una colombiana hace 13 a\u00f1os, que lleva tres a\u00f1os aqu\u00ed en Estados Unidos. Durante la pandemia fue negada la residencia porque no quisimos ponernos la vacuna del COVID-19. \u00bfQu\u00e9 hacemos ahora?&#8221;<\/p>\n<p><strong>MARTHA ARIAS:<\/strong><br \/>\nBueno, la vacuna del COVID todav\u00eda es un requerimiento para una persona poder recibir la residencia en los Estados Unidos, as\u00ed como lo son otras vacunas que deben las personas ponerse para poder recibir la residencia. Sin embargo, tambi\u00e9n hay unas excepciones. Por ejemplo, si la persona por razones m\u00e9dicas no se puede poner la vacuna, y hay algunas personas que tambi\u00e9n lo hacen por razones religiosas.<\/p>\n<p>Yo le invito a esa persona que consulte con un abogado de inmigraci\u00f3n para saber si la raz\u00f3n que tiene la persona para no ponerse la vacuna es o una raz\u00f3n m\u00e9dica o una raz\u00f3n religiosa.<\/p>\n<p>Si es una raz\u00f3n pol\u00edtica, digo yo, esa raz\u00f3n pol\u00edtica pues bueno, no nos va a ayudar mucho, tiene que ser algo religioso y de verdad. Yo tuve hace poquito una se\u00f1ora precisamente con ese tema, ella por razones religiosas, parece que son los pentecostales, no s\u00e9 si son o los testigos de Jehov\u00e1, hay algunos de ellos que no creen en ciertas vacunas sint\u00e9ticas, en ciertas cosas, entonces su religi\u00f3n no lo permite. Entonces eso permite que uno haga una excepci\u00f3n.<\/p>\n<p>Por ejemplo, tambi\u00e9n hay mujeres embarazadas, hay mujeres que no les pueden poner la vacuna porque est\u00e1n embarazadas y hay personas que tienen otras condiciones m\u00e9dicas que no les permiten recibir vacunas. Entonces, pues esto es lo que hay que averiguar, a ver si la persona est\u00e1 dentro de una de las excepciones.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nGracias por la respuesta, abogada. Abogada, \u00bfqu\u00e9 nos puede contar de ISAP o la alternativa para el programa de detenci\u00f3n? \u00bfQu\u00e9 es eso exactamente?<\/p>\n<p><strong>MARTHA ARIAS:<\/strong><br \/>\nS\u00ed, a ver, es muy importante este tema, Juan Camilo, porque es un tema realmente del que no se escucha mucho o por lo menos as\u00ed lo considero yo afuera, afuera se habla mucho de otras cosas pero esto no se habla tanto. \u00bfQu\u00e9 es el ISAP? O ISAP.<\/p>\n<p>El ISAP es un programa de alternativo a detenci\u00f3n, es decir, si una persona puede ser detenida por inmigraci\u00f3n pero en vez de ser detenida le van a poner un monitoreo, puede ser porque le van a poner un grillete o le van a hacer seguimiento a trav\u00e9s de llamadas, les dan un tel\u00e9fono y le hacen seguimiento a trav\u00e9s de las llamadas.<\/p>\n<p>ISAP es un contratista del gobierno federal que se encarga de hacer ese seguimiento o ese monitoreo a las personas que van a entrar al programa. Entonces hay muchas, muchas preguntas. Le voy a dar una, por ejemplo, que nos hacen mucho los oyentes en un programa que tengo precisamente hoy a las siete de la noche en la 1260 AM.<\/p>\n<p>Es un programa tambi\u00e9n de inmigraci\u00f3n donde tambi\u00e9n contesto las preguntas. En ese programa me hac\u00edan una pregunta si yo puedo llevar a mi abogado a la cita del ISAP, porque acu\u00e9rdese, esa cita del ISAP no es con un oficial de ICE de inmigraci\u00f3n, es con un oficial de ISAP, que es el programa de este monitoreo. Y la respuesta es s\u00ed, s\u00ed pueden llevar a su abogado a la cita del ISAP.<\/p>\n<p>Entonces, eso es importante que lo sepan porque muchas personas consideran que no es necesario.<\/p>\n<p>A veces es bueno porque uno le explica al oficial de pronto en unos t\u00e9rminos m\u00e1s f\u00e1ciles de que ellos lo tienen porque ellos no son abogados y le muestra documentaci\u00f3n para explicarle el caso del cliente. Entonces, esa es, por ejemplo, una de las preguntas que hacen.<\/p>\n<p><strong>MARTHA ARIAS:<\/strong><br \/>\nS\u00ed, bueno, antes de eso d\u00e9jenme, le doy una otra informaci\u00f3n acerca de este programa de ISAP. La otra informaci\u00f3n que es bien importante es que nos hacen las preguntas las personas, \u00bfpor qu\u00e9 a m\u00ed me pusieron en el programa de ISAP y a mi esposa no? La mayor\u00eda de las veces esto lo determinan en caso por caso.<\/p>\n<p>Puede ser porque la persona tenga una convicci\u00f3n criminal. Puede ser porque la persona tenga m\u00e1s riesgo de que se absconda, es decir, que se pierda, que se esconda dentro del pa\u00eds y no se presente a la corte. La persona no tiene un buen caso de inmigraci\u00f3n para resolver porque pueden haber preocupaciones de seguridad p\u00fablica o una historia de no haberse presentado a citas de inmigraci\u00f3n.<\/p>\n<p>Porque la persona no tenga mucho lazo familiares en los Estados Unidos por condiciones m\u00e9dicas, por condiciones tambi\u00e9n humanitarias, cr\u00e9alo o no, puede ser las razones que se determinan si la persona va a estar all\u00ed. Solamente personas mayores de 18 a\u00f1os las pueden poner en este programa. Y esto es importante. La otra vez vi una ni\u00f1a jovencita de 16 a\u00f1os que la hab\u00edan puesto en el programa. Parece que fue por error cuando entr\u00f3. Ella dijo que era m\u00e1s adulta y no ten\u00edan un documento todav\u00eda para identificarla.<\/p>\n<p>Pues obviamente la quitaron del programa porque solamente es para adultos mayores de 18 a\u00f1os. Entonces pues m\u00e1s o menos esas son las condiciones, lo que ellos determinan. Hay muchas otras preguntas, despu\u00e9s en otros programas podemos hablar, pero tambi\u00e9n quiero que sepan que eso lo hace un contratista de ICE, con un contratista del gobierno. No es directamente el gobierno, no es directamente ICE.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nOK. Y de la pregunta, abogada, de si tenemos alguna notificaci\u00f3n o alguna actualizaci\u00f3n sobre el programa suspendido del gobierno federal.<\/p>\n<p><strong>MARTHA ARIAS:<\/strong><br \/>\nS\u00ed, Juan Camilo, el parol humanitario para Venezuela, Cuba, Nicaragua y Hait\u00ed, como usted bien lo dijo, fue suspendido ya hace, creo que una semana o dos semanas debido a un posible fraude en lo que fueron las &#8220;affidavits of support&#8221; o la forma I-134A. Todav\u00eda en este momento no hay ninguna notificaci\u00f3n de parte de inmigraci\u00f3n de cu\u00e1ndo puedan reanudar el programa o qu\u00e9 es lo que est\u00e1 pasando con las personas que ya ten\u00edan aprobado el parol para viajar, pero pues por ser suspendido no han podido viajar. Tampoco sabemos las personas que tienen ya aprobado el parol y de pronto estuvieron consideradas que est\u00e1n dentro de este fraude, qu\u00e9 les va a pasar. As\u00ed que todav\u00eda en ese momento es un hermetismo total. No sabemos qu\u00e9 est\u00e1 pasando. Me imagino que esto est\u00e1 sujeto a una investigaci\u00f3n. No sabemos cu\u00e1nto tarde, pero no hay ninguna actualizaci\u00f3n oficial de parte del gobierno acerca de este programa.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nSi tienen alguna pregunta sobre esto o c\u00f3mo les va a afectar una vez se reactive, si es que se reactiva, siempre es bueno que consulten con abogados expertos en migraci\u00f3n. El ajuste cubano es una ley que existe desde hace muchos a\u00f1os, desde los 60; que le permite a un nacional de Cuba, es decir, una persona que ha nacido en Cuba o en un tercer pa\u00eds, pero de padres cubanos que tiene derecho a la nacionalidad cubana a recibir la residencia en los Estados Unidos.<\/p>\n<p>Tiene que tener un parol, una admisi\u00f3n. Una admisi\u00f3n es la que le dan cuando entra con una visa. Y adem\u00e1s de esto, tiene que permanecer un a\u00f1o y un d\u00eda. Estas personas tambi\u00e9n pueden recibir la residencia en los Estados Unidos con el ajuste cubano y los requisitos van a ser los mismos, que est\u00e9n casados con ese cubano, que lleven un a\u00f1o y un d\u00eda esa persona o ese c\u00f3nyuge o ese hijo aqu\u00ed en los Estados Unidos y que hayan sido admitidos con parol o con una admisi\u00f3n.<\/p>\n<p>Entonces, \u00bfvalga la pena entonces para unir dos puntos aqu\u00ed importantes? Y es, si ese c\u00f3nyuge o ese cubano entr\u00f3 por la frontera hace mucho tiempo, no le dieron parol y est\u00e1 casado, o esa persona est\u00e1, ese cubano ya es ciudadano americano, ya la persona no puede pedir el ajuste cubano, porque si ya el cubano se hizo ciudadano, el c\u00f3nyuge no puede pedir la residencia a trav\u00e9s del ajuste cubano. Ya le toca hacerlo con el parol in place y como esposo de ciudadano. S\u00ed, Juan Camilo, hay muchos cubanos que ya se han hecho ciudadanos americanos, que ya no le pueden dar el beneficio del ajuste a sus parejas. Ya lo tienen que hacer como ciudadanos americanos.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nAhora esto sigue aplicando para todos los cubanos que llegan, por ejemplo, con el parol que suspendieron o que llegan por la frontera sur o para las personas que llegan en balsa, \u00bfeso sigue funcionando exactamente igual?<\/p>\n<p><strong>MARTHA ARIAS:<\/strong><br \/>\nS\u00ed, el parol, a ver, el ajuste cubano sigue funcionando. Lo que no est\u00e1 funcionando y fue suspendido tambi\u00e9n fue el parol, el que daban con aquella&#8230; porque era una pol\u00edtica, no era ni siquiera una ley que se llamaba la pol\u00edtica de &#8220;pies secos, pies mojados&#8221;. Cuando esta pol\u00edtica de &#8220;pies secos, pies mojados&#8221; existi\u00f3, la pol\u00edtica dec\u00eda que ese cubano que tocaba tierra americana se le deb\u00eda dar un parol humanitario.<\/p>\n<p>Entonces, por eso usted ve\u00eda las noticias en la televisi\u00f3n que los balseros estaban ah\u00ed esper\u00e1ndolos y ellos eran desesperados por tirarse de la balsa y tocar tierra americana, poner sus pies en la tierra americana. En ese momento ya aplicaba la pol\u00edtica de &#8220;pies secos&#8221;, y les pod\u00edan dar un parol.<\/p>\n<p>Aquellos cubanos que cog\u00edan en alta mar y los devolv\u00edan, obviamente pues no ten\u00edan derecho a un parol porque estaban en alta mar, no estaban, no pisaban tierra americana. Obama suspendi\u00f3 esta pol\u00edtica de &#8220;pies secos, pies mojados&#8221; y pues de ah\u00ed el problema que tenemos en este momento que muchos cubanos que est\u00e1n entrando por la frontera no les dan el parol, entonces les dan una 220a que es una libertad condicional bajo palabra y pues ese es el debate que hay en este momento si eso es un parol o no.<\/p>\n<p>Entonces, bueno, es la situaci\u00f3n con lo del ajuste cubano. Ahora, otra cosa importante, Juan Camilo, del ajuste cubano es en la parte de los hijos.<\/p>\n<p>Y esto yo le he visto muchos errores que a veces cometen las personas que no buscan la asesor\u00eda adecuada. Los hijos de una persona, vamos a decir un cubano, se casa con una persona colombiana. Ese cubano que se casa con esta colombiana, la colombiana tiene un hijo menor de edad. El hijo de ella tambi\u00e9n va a poder acceder a ese ajuste cubano siempre y cuando viva con la mam\u00e1 y con el cubano.<\/p>\n<p>Uno de los errores que yo he visto es que le hacen la aplicaci\u00f3n al ni\u00f1o pero el ni\u00f1o no vive con esa mam\u00e1 y con ese cubano, sino que tal vez con el pap\u00e1 biol\u00f3gico en alguna otra parte. Entonces el ajuste cubano requiere que la pareja viva junta y si tienen hijos que tambi\u00e9n van a ser derivativos de la petici\u00f3n, tambi\u00e9n tienen que vivir con ellos. Eso tambi\u00e9n es bien importante para estos casos del ajuste cubano.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nAhora el tema del ajuste cubano y ahora que usted lo menciona veo tambi\u00e9n que es muy criticado porque dicen que despu\u00e9s de un tiempo muy corto, los cubanos pueden tener la posibilidad de volver legalmente a Cuba y luego venir a Estados Unidos. \u00bfEs as\u00ed o no es as\u00ed?<\/p>\n<p><strong>MARTHA ARIAS:<\/strong><br \/>\nEs as\u00ed. Un cubano, una vez recibe la residencia en los Estados Unidos, puede regresar a Cuba de visita y pues no hasta donde yo tengo entendido, no hay ninguna restricci\u00f3n en cuanto al n\u00famero de viajes o visitas que hacen. Las restricciones o los l\u00edmites que existen son los que existen para cualquier residente. Un residente debe vivir en los Estados Unidos y no debe pasar m\u00e1s de 180 d\u00edas fuera de los Estados Unidos o en un solo viaje o en el agregado del a\u00f1o. Entonces, lo que m\u00e1s se critica es de pronto ese cubano que vive ac\u00e1 que est\u00e1 recibiendo beneficios del gobierno, estampillas, planes de vivienda, ayudas federales o estatales, y ese se va y permanece m\u00e1s de 180 d\u00edas por fuera.<\/p>\n<p>Eso es lo que se critica. Ahora, si el Social Security, todas las entidades que est\u00e1n en esto de las ayudas federales o estatales, est\u00e1n ya m\u00e1s pronto a pedir esa informaci\u00f3n y a mirar la historia de viajes de esa persona.<\/p>\n<p>Pero esto no solamente aplica para los cubanos, obviamente aplica para cualquier persona que sea residente de los Estados Unidos y est\u00e9 recibiendo ayudas y permanezca m\u00e1s tiempo por fuera. Pero particularmente se ve mucho con los cubanos, por lo que el ajuste cubano, de cierta forma, ha sido un beneficio que se ha dado al pa\u00eds de Cuba, pues debido a la dictadura de la que ha sufrido por tantos a\u00f1os.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nClaro, claro.
