Where do we stand with this?<\/p>\n<p><strong>MARTHA ARIAS:<\/strong><br \/>\nWell, yes, &#8220;<strong>Parole in Place<\/strong>&#8221; is currently frozen or administratively <strong>halted until September 23<\/strong>. On September 23 of this year, the federal judge in Texas will make a decision. I don&#8217;t know if it will be final, but at least the next decision on what will be done with this parole.<\/p>\n<p>What does this mean?<br \/>\nIn the meantime, people can still apply for &#8220;Parole in Place&#8221; under President Biden&#8217;s guidance, and my advice is to do it. I always tell people to consult a lawyer, of course, and they can consult me or our office. I am a licensed immigration attorney here in the United States, so I can help with this. Obviously, I always want to first talk to the client, ask some questions to make sure the person will be successful and that there are no other issues in their case that could affect it.<\/p>\n<p>My advice is to apply because, Juan Camilo, this is an opportunity for people to obtain residency within the United States if they are married to a U.S. citizen and have been living in the country for more than 10 years. This gives them the opportunity to not have to leave the country and, potentially, not have to present a waiver, which is taking quite a while\u2014the <strong>waiver for unlawful presence<\/strong> is currently taking <strong>between three and a half to four years<\/strong>. So, this is a big opportunity to save time.<\/p>\n<p>Now, it is possible that it could be denied. It is possible that the judge handling this case may decide that the program has to end. It is possible that all the people who applied may be told that the program has to end, and they would be denied. So, people could lose the money, the $580 they paid to immigration and the attorney. Yes, all of this is possible.<\/p>\n<p>But at the same time, as I say, there\u2019s a saying my grandfather used to say: &#8220;if the problem is money, then it&#8217;s not really a problem&#8221;; because financial problems can be solved one way or another. There are other more serious problems that cannot be solved. So, losing the money, losing the investment in the program does not necessarily mean the end of the world; on the contrary, the person is taking a chance that is possibly more economical than requesting a waiver.<\/p>\n<p>And let me explain: <strong>a waiver<\/strong> today <strong>for unlawful presence<\/strong> through immigration <strong>costs about $700<\/strong>, I think $700, $600 or something like that, plus what the attorney charges. The <strong>waiver for the 212<\/strong>, which is for deportation, <strong>costs about $930<\/strong>. So, the waivers that need to be submitted are also not cheap. And by requesting residency within the United States, the person is avoiding this type of waiver. In summary, that is the update and the recommendation, Juan Camilo.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nAttorney, for those who might not be very familiar with this, please briefly explain what &#8220;Parole in Place&#8221; is and who might eventually benefit from it?<\/p>\n<p><strong>MARTHA ARIAS:<\/strong><br \/>\n&#8220;<strong>Parole in Place<\/strong>&#8221; is the parole issued by President Biden to allow people who may have entered through the border or even those who entered with a seaman&#8217;s visa, which is very common, to apply for residency within the United States, even if they are married to U.S. citizens.<\/p>\n<p>So, &#8220;Parole in Place&#8221; allows these people to apply for residency within the United States, which is called an adjustment of status, because they have &#8220;Parole in Place.&#8221; Previously, <strong>President Obama<\/strong> approved it for <span style=\"text-decoration: underline;\">spouses, parents, and children of veterans<\/span> or those in <span style=\"text-decoration: underline;\">active service in the armed forces<\/span>. And the parole for those countries is for people who are outside, trying to enter the country, while Biden&#8217;s parole is for people who are already in the country, who are married to U.S. citizens, who have been in the country for over 10 years, probably have children, properties, and have studied here. So, from a humanitarian perspective, it might not be so difficult for this &#8220;Parole in Place&#8221; figure for spouses of U.S. citizens to be legally validated.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nAttorney, to change the topic now, if someone has a question related to &#8220;Parole in Place&#8221; and wants to start this process without waiting until September and wants to get ahead by starting the application, the best alternative is to opt for expert immigration attorneys. And also, of course, her website is AriasVilla.com, which is the name of her law firm, where you can find much more information.<\/p>\n<p>Attorney, can you tell us about the <strong>basic requirements for making a citizenship petition<\/strong>?<\/p>\n<p><strong>MARTHA ARIAS:<\/strong><br \/>\nYes, Juan Camilo, that&#8217;s a very common question because people often get confused about the <strong>citizenship requirements<\/strong> for those who have been in the United States for five years and those who have been married and living with an American citizen for three years.<\/p>\n<p>So, the basic requirements are that they have been residents in the United States for five years and have been in the country for at least half the time within the five years preceding the application.<\/p>\n<p>Let me explain: if the person has been in the United States for 15 years, but two years before applying, they went to their home country, stayed for 10 months, and had many trips abroad. It doesn\u2019t matter if they&#8217;ve been in the country for 15 years; if in the last two years before applying they spent more time outside than inside, <strong>they won&#8217;t qualify<\/strong>. So, I repeat, half of the time must have been spent in the United States in the five years preceding the application.<\/p>\n<p>The person also has to show they have <strong>good moral character<\/strong>, which involves <strong>not owing money to the IRS<\/strong> or being behind on payments, <strong>owing child support<\/strong>, or being in arrears on that support, <strong>being arrested<\/strong>, or <strong>convicted of any crime in the five years before applying.<\/strong><\/p>\n<p>These are the basic requirements in general terms. People who are married and living with a U.S. citizen and have been for three years can apply as long as they show they&#8217;ve been married to a U.S. citizen and have been residents for three years. The requirement for time spent in the U.S. is half of three years, which is obviously less than half of five years, and they also need to show good moral character. The same applies as what I explained for those with five years regarding good moral character, it applies to the three-year residents too.<\/p>\n<p>A common question, Juan Camilo is, if someone is married to a resident who recently became a U.S. citizen, can they apply for citizenship right away? The answer is no because they need to have been married to that U.S. citizen for three years. So, if the U.S. citizen has been a citizen for five months, you can&#8217;t speed up the citizenship petition.<\/p>\n<p>So, there are always some requirements that are a bit complicated for people to interpret. That\u2019s why it&#8217;s good to consult an immigration attorney, a licensed professional who specializes in immigration, because this ensures that your petition meets the requirements and that you don\u2019t lose your money if your petition is rejected.<\/p>\n<p>As an attorney, you cannot guarantee anyone&#8217;s results, Juan Camilo, and this is something I like to discuss in general terms, not just with citizenship petitions, but with any petition. We cannot guarantee the results to anyone. In fact, it&#8217;s a breach of professional ethics for an attorney to guarantee a client a result because the results depend on the government and immigration services. You can guarantee that you are filing the petition according to the law and legal requirements, but the outcome is beyond our control.<\/p>\n<p>So, it&#8217;s important for people to keep this in mind because at least the petition will be correctly submitted when done with an attorney.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nOkay. Attorney, several questions caught my attention. And this is ideal for people to share because it can be instructional for those who want to become citizens, who have doubts but aren&#8217;t sure if they should apply or not. This is a great opportunity to clear those doubts. Someone just messaged me on WhatsApp asking, \u201c<strong>What does good moral character mean? Does it mean that if I have a DUI or parking tickets, my life will get complicated or not?<\/strong>\u201d<\/p>\n<p><strong>MARTHA ARIAS:<\/strong><br \/>\nSome traffic tickets can complicate matters. For example, there are tickets that are purely traffic-related, like parking tickets or expired insurance. Other tickets are for minor issues like a broken tail light. These normally should not cause problems with citizenship or moral character.<\/p>\n<p>But there are traffic tickets that are criminal in nature. They are called criminal traffic offenses. Criminal traffic tickets include DUI, running a red light, and possibly speeding. These can affect you. Normally, if the person has only one, has met the requirements, paid it, and explained the reason\u2014maybe they had a sick child they were rushing to the hospital\u2014that might work in their favor. Of course, every case has to be analyzed based on its facts.<\/p>\n<p>But suppose it\u2019s a speeding ticket or a traffic violation within the last three or five years before applying, and the person has 15 more on their record, not within the three or five years, but still\u2014well, then we\u2019re talking about the officer interpreting it differently, because there could be a pattern of behavior showing poor conduct. So again, traffic tickets and everything else are analyzed within the totality of circumstances of each case.<\/p>\n<p>I had a client who had, incredibly, almost every traffic ticket that could be given, and this person had many, many, many, and it shows a certain pattern. Let&#8217;s say it&#8217;s dangerous to the community because a vehicle is a weapon, believe it or not, and that&#8217;s how it&#8217;s been interpreted in the courts. You can kill someone with a vehicle; a vehicle can injure someone; a vehicle can damage private property. A vehicle is a weapon.<\/p>\n<p>So, if a person driving a vehicle is irresponsibly accumulating more tickets than expected, that shows a pattern of behavior that can be considered <strong>poor moral character<\/strong> because it\u2019s a danger to society. So, you have to interpret all of this. Now, if we&#8217;re talking about one or two occasional tickets over many years of driving, it may not be seen negatively in terms of demonstrating good character. So, we review everything in its own context and circumstances.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nWe are talking to attorney <strong>Martha Arias<\/strong> about immigration issues and what the requirements are for applying for U.S. citizenship, including many common doubts. You mentioned something that caught my attention: one of the problems could be having been arrested or convicted. But what happens when someone is arrested and found innocent? Does that affect them or not, because sometimes the record shows an arrest but no conviction?<\/p>\n<p><strong>MARTHA ARIAS:<\/strong><br \/>\nCorrect. The person should disclose it, present it to immigration, include it in their application, and bring the documentation proving that the case was dismissed or there was no action on the case. This is favorable. When there is no action or the case is dismissed, it means that the person was not found guilty, and obviously, that will work in their favor to demonstrate good moral character.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nAnd what happens if someone gets arrested after submitting their application? Because these processes take so long, what if someone gets arrested after filing their papers and now has a record? What do we do then?<\/p>\n<p><strong>MARTHA ARIAS:<\/strong><br \/>\nIt&#8217;s also important\u2014obviously, very important, extremely important\u2014to disclose it. Send immigration a copy of the ticket along with proof of its dismissal, payment, or the final decision, the final disposition of the case. Or have it ready and bring it to the citizenship interview. Sometimes it happens that the arrest occurs after the citizenship interview but before the oath ceremony. Today, most offices are immediately swearing in people right after the citizenship interview if everything goes well.<\/p>\n<p>But there are instances where that\u2019s not the case, and it\u2019s also been very common for a person to get their citizenship appointment and then leave the appointment and be arrested, or leave the country. This has to be disclosed to immigration. I\u2019ve had cases like these. It doesn\u2019t necessarily mean that the petition will be denied in all cases. It could still be approved, but it must be disclosed, and obviously, it depends on the case.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nAttorney, is it true that one can only submit the application once or can only apply once with a naturalization document, and if it\u2019s denied, you can\u2019t go through that route again?<\/p>\n<p><strong>MARTHA ARIAS:<\/strong><br \/>\nWell, the citizenship, the naturalization petition, which is the <a href=\"https:\/\/www.uscis.gov\/n-400\" target=\"_blank\" rel=\"noopener\"><strong>N-400<\/strong><\/a>, can be submitted as many times as you like. It\u2019s not just once; you can apply as many times as you want. The <a href=\"https:\/\/www.uscis.gov\/n-600\" target=\"_blank\" rel=\"noopener\"><strong>N-600<\/strong><\/a> petition, which is the application for a naturalization certificate derived from parents, can only be applied for once. You can&#8217;t apply multiple times.<\/p>\n<p>Previously, we mentioned this in these videos; there wasn\u2019t even a possibility of doing anything else.<\/p>\n<p>Today, this year, immigration services made a correct decision by allowing, within the United States, you can request a motion to reopen with an <a href=\"https:\/\/www.uscis.gov\/i-290b\" target=\"_blank\" rel=\"noopener\"><strong>I-290B<\/strong><\/a> form, which is to request a reopening of that N-600 naturalization case if it has been denied. But again, I repeat, this is in the context of the N-600, which is applied for by children, youths, or even adults who qualify for derivative citizenship through their parents.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nOkay, thanks for that clarification, attorney. This is for a person born recently. If it&#8217;s someone who was born a long time ago, you have to look at the date of birth because the law has changed over time. So, depending on when the baby was born, that will determine which law applies.<\/p>\n<p>The requirement I just mentioned\u2014five years, with three after the age of 14\u2014is the most recent that applies, obviously, to a baby or a person born recently. So, what the person needs to do is go to the U.S. consulate in that country where they are living, in this case, Peru, and request a Foreign Birth Certificate.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nOkay, another question here, attorney. I think it\u2019s similar to what you already answered regarding seamen or sailors: <strong>A person married to a U.S. citizen but entered the United States with a seaman visa. Can these people apply for residency here in the United States?<\/strong><\/p>\n<p><strong>MARTHA ARIAS:<\/strong><br \/>\nNo. People who enter with a seaman\u2019s visa, the C-1, and there is another, the C-2, cannot receive residency within the United States. It&#8217;s a limitation. Even though these people are admitted because they are granted entry by an immigration officer or CBP, the law states they cannot receive residency within the country.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nOkay. Another question here. And if you have doubts of this kind, because sometimes the questions people send make you wonder who they are or where these cases come from. Attorney, <strong>what happens to a person who entered the United States with someone else\u2019s passport?<\/strong> <strong>Then they married a U.S. citizen. Can they apply for residency or not?<\/strong><\/p>\n<p><strong>MARTHA ARIAS:<\/strong><br \/>\nYes, they can apply for residency. The person will have to first show how they entered and that they were admitted with that passport that wasn\u2019t theirs, and probably not even their visa, of course. They must request a waiver. The waiver requested is called the <a href=\"https:\/\/www.uscis.gov\/i-212\" target=\"_blank\" rel=\"noopener\"><strong>212 waiver<\/strong><\/a>, which is for people who have committed fraud or lied to the United States.<\/p>\n<p>This waiver requires a higher standard of proof. It&#8217;s not an easy waiver. Let&#8217;s say it&#8217;s a medium standard of proof. You need to send a lot of evidence to prove that the U.S. citizen spouse will suffer extreme hardship if the person is not granted residency. They will demand quite a bit.<\/p>\n<p>I have had cases like this where the person entered with a passport that did not belong to them. There is an expression in law called a &#8220;<strong>foreign switch passport<\/strong>,&#8221; which is a passport with the person\u2019s photo but someone else\u2019s details.<\/p>\n<p>So, in these cases, it is possible to request residency by showing this entry because it is a legal entry, but obviously, you will have to request a waiver because the person lied upon entering the United States.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nAttorney, <strong>what happens to someone who has a removal order from the country, a deportation order?<\/strong> I imagine from 2016, because their asylum request was denied. <strong>Can that person apply for President Biden&#8217;s &#8220;Parole in Place&#8221; or not?<\/strong><\/p>\n<p><strong>MARTHA ARIAS:<\/strong><br \/>\n<strong>Yes, they can apply<\/strong>, they can apply for &#8220;Parole in Place,&#8221; but obviously, that person cannot move from &#8220;Parole in Place&#8221; to residency if it&#8217;s approved. The person must apply to reopen their deportation case. Anyone who has a deportation or removal order in the United States and wants to receive residency within the country, and the person has not been expelled from the country, obviously, <strong>must request a reopening of the case<\/strong>.<\/p>\n<p>Why? <strong>To overturn that deportation<\/strong>. Once it is overturned and the case is concluded, then they can request residency with USCIS, with &#8220;U.S. Citizenship and Immigration Services.&#8221; Because what people have to understand is that once someone has a deportation order, the case remains with the immigration judge or the Board of Appeals if the person appealed.<\/p>\n<p>So, if they have &#8220;Parole in Place&#8221; and want to request residency, they must follow a process, Juan Camilo. That\u2019s why <strong>it\u2019s very important to hire an attorney<\/strong>, contact them, because these cases are important to have a correct resolution.<\/p>\n<p>If they request residency directly from USCIS or immigration while having a deportation order, they will deny the residency, and you will lose your money.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nBut finally, <strong>what can you tell us about those who have doubts about, for example, not &#8220;Parole in Place,&#8221; but the humanitarian parole request for Cubans, Venezuelans, Nicaraguans, Guatemalans?<\/strong> It seems that many of these cases apply to nationals of various countries. <strong>Can someone be in one type of request and then sponsor someone else, like being married and now wanting to sponsor someone else?<\/strong> <strong>Are there any impediments, do these processes cancel each other out or not?<\/strong><\/p>\n<p><strong>MARTHA ARIAS:<\/strong><br \/>\nNo, immigration doesn&#8217;t usually have impediments between one case and another, depending on each case, but normally there is no contradiction between cases. For example, I\u2019ll give you a very common example. There are people whose son, an American citizen, filed a petition for them, but they previously had a petition from a sister or another family member. That petition doesn\u2019t get canceled; it&#8217;s just that one will likely allow them to receive residency faster than the other, but they do not cancel each other out.<\/p>\n<p>You can have a petition from a sister, a petition from a son, a petition from a father or mother, and they will not cancel each other out. It&#8217;s simply a matter of which will be faster and, also, which gives you the chance to receive residency within the country or which requires you to leave the country to receive residency abroad. That&#8217;s the distinction, but there\u2019s no contradiction.<\/p>\n<p>I\u2019ll give you another example that is very common, and I know this will be of great interest to the listeners: there are people who have a tourist visa but also, for example, have an investor visa. So, people always ask, \u201cWell, if I apply for the visa, I have the tourist visa, and I apply for the investor visa, will they cancel the tourist visa?\u201d No, you can continue with your tourist visa; the only thing is that every time you enter the United States, if you enter on your tourist visa, because that\u2019s what you have, you must declare it, and that\u2019s the visa you will be admitted under.<\/p>\n<p>There\u2019s no problem. The same applies to someone entering with a student visa. If they have an approved student visa but also a tourist visa, the student visa does not cancel the tourist visa. And so on. Obvio es muy importante, supremamente importante manifestarlo. Esto es para una persona que haya nacido recientemente. Si es una persona que naci\u00f3 hace mucho tiempo atr\u00e1s, hay que mirar la fecha de nacimiento porque la ley en este sentido ha cambiado. Entonces, dependiendo de la fecha en que naci\u00f3 ese beb\u00e9 es que se mirar la ley que aplica.<\/p>\n<p>Esta que le acaba de decir de los cinco a\u00f1os y tres despu\u00e9s de los 14 a\u00f1os, es la m\u00e1s reciente que aplica, obviamente, a un beb\u00e9 o una persona que nasca ahora recientemente. Es una limitante. Aunque esas personas son admitidas porque les dan una admisi\u00f3n al pa\u00eds, ven a un oficial de inmigraci\u00f3n o de CVP, esas personas la le dice que no pueden recibir la residencia dentro del pa\u00eds.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nOK. Por ac\u00e1 tambi\u00e9n una pregunta. Y si tienen dudas de este tipo, porque hay veces que las preguntas que env\u00edan uno dice, pero qui\u00e9n, pero aqu\u00ed le pas\u00f3, \u00bfveis? Ac\u00e1 nos han llegado a las preguntas m\u00e1s naturales, m\u00e1s normales del mundo y algunas que son como de una pel\u00edcula de ficci\u00f3n. Hay unas preguntas que no dice por estos casos de donde salieron.<\/p>\n<p>Abogada que pasa a una persona, entr\u00f3 a Estados Unidos con un pasaporte de otra persona? La persona va a tener que pedir un primero mostrar como entr\u00f3 y que fue admitida con ese pasaporte que no era suyo y tal vez tampoco la v\u00edsera suya, obviamente. Y tiene que pedir un perd\u00f3n. El perd\u00f3n que se pides un perd\u00f3n que se llama el 12 y que es el perd\u00f3n para las personas que han cometido fraude o han mentido a los Estados Unidos.<\/p>\n<p>Ese perd\u00f3n requiere un est\u00e1ndar de prueba m\u00e1s alto. No es un perd\u00f3n tan f\u00e1cil. Vamos a decir que es un est\u00e1ndar de prueba medio. O sea, que hay que mandar mucha evidencia para probar, que es el cong\u00fce ciudadano. Americano va a sufrir un dolor extremo si a la persona no le da la residencia, pero les van a exigir bastante.<\/p>\n<p>Yo he tenido casos as\u00ed donde la persona ha entrado con una pasaporte que no le pertenec\u00eda. Hay una expresi\u00f3n en derecho que se llama foro switch password. Foro switch password es un pasaporte que tiene la foto de la persona, pero los datos de otra persona.<\/p>\n<p>Entonces en esos casos s\u00ed es posible pedir la residencia mostrando esa entrada porque es una entrada legal, pero obviamente va a tener que pedir un perd\u00f3n. Pues porque menti\u00f3 obviamente al entrar a los Estados Unidos.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nAbogada, \u00bfqu\u00e9 pasa con una persona que tiene una orden de remoci\u00f3n del pa\u00eds, un orden de deportaci\u00f3n? Imagino del 2016, porque le negaron una solicitud de asilo. Esa persona puede aplicar para el &#8220;Parole in Place&#8221; del presidente Biden o no?<\/p>\n<p><strong>MARTHA ARIAS:<\/strong><br \/>\nS\u00ed, puede aplicar, puede aplicar para el &#8220;Parole in Place&#8221;, pero obviamente esa persona no puede pasar del &#8220;Parole in Place&#8221; si se lo aprobaban a la residencia. La persona tiene que aplicar para la reapertura de su caso de deportaci\u00f3n. Cualquier persona que tenga una orden de deportaci\u00f3n o de remoci\u00f3n en los Estados Unidos para poder recibir la residencia aqu\u00ed dentro del pa\u00eds y la persona no ha sido expulsada, obviamente el pa\u00eds. La persona tiene que pedir una reapertura del caso.<\/p>\n<p>Para qu\u00e9 pues para tumbar esa deportaci\u00f3n, una vez la tumba y el caso se termine, entonces s\u00ed puede pedirse la residencia con USCIS, con &#8220;US Citizenship Immigration Services&#8221;. Porque lo que la gente tiene que entender es que una persona, una vez tiene una deportaci\u00f3n, el caso qued\u00f3 con el juez de inmigraci\u00f3n o con la sala de apelaciones y la persona pel\u00f3.<\/p>\n<p>Entonces en el caso de que tenga el Parolin Place y quiere pedir una residencia, tiene que seguir un proceso o en Camilo,<br \/>\npor eso es muy importante o el repito contratar al abogado, contactarlo, porque estos casos son importantes para poder tener una soluci\u00f3n correcta.<\/p>\n<p>Es si piden la residencia directamente a USCIS o inmigraci\u00f3n, teniendo una deportaci\u00f3n, le van a negar la residencia y va<br \/>\na perder su dinero.<\/p>\n<p><strong>JUAN CAMILO:<\/strong><br \/>\nPero, afinalmente, \u00bfqu\u00e9 nos puede contar para las personas que tengan alguna duda sobre esto relacionada con, por ejemplo, no el Parolin Place sino la solicitud de parolumanitario para cubanos, venezolanos, dicaraguens, guatemaltecos?
