The U.S. government has confirmed that it will not renew the <em>parole<\/em> for Venezuelans, Cubans, Nicaraguans, and Haitians. If you entered the U.S. under this program, especially my Venezuelan clients whose <em>parole<\/em> expires at the end of October 2024, now is the time to act. You can still apply for asylum, TPS, or adjust your status through marriage to a U.S. citizen. It\u2019s critical to make these decisions now to avoid losing your legal status.<\/p>\n<p>For those from Nicaragua and Haiti, your <em>parole<\/em> will begin to expire in January 2025, and unfortunately, there will be no new applicants accepted into the program. However, for my Cuban clients, you still have the option to adjust your status through the <a href=\"https:\/\/www.uscis.gov\/green-card\/green-card-eligibility\/green-card-for-a-cuban-native-or-citizen\" target=\"_blank\" rel=\"noopener\">Cuban Adjustment Act<\/a> after one year and one day of being in the U.S. Don\u2019t wait\u2014consult with an immigration lawyer to explore all your options.<\/p>\n<p>And don\u2019t forget to tune in next week to our Instagram Live, where we will continue to share updates and answer your questions in real-time. So, a person needs to know immigration law to fill out that application, and it\u2019s considered legal advice. The Florida Bar considers that <strong>anyone giving immigration advice must be a lawyer<\/strong>, and a person cannot fill out an application without the support of a lawyer. Even if they are a paralegal or notary, they must be under the supervision of a lawyer.<\/p>\n<p>&nbsp;<\/p>\n<p><strong>Juan Camilo:<\/strong><br \/>\nThank you for that clarification, attorney. Don\u2019t go to fake websites that trick you into thinking they\u2019re official and charge you a fee to apply. This doesn\u2019t cost anything. You enter your information and pay nothing. Absolutely nothing. It was originally set to expire on <strong>October 23<\/strong>.<\/p>\n<p>Now it\u2019s <span style=\"text-decoration: underline;\">extended<\/span> until <strong>November 8<\/strong>. What does this mean? It means that people can continue to apply for Parole in Place on the <a href=\"https:\/\/www.uscis.gov\/keepingfamiliestogether\" target=\"_blank\" rel=\"noopener\">USCIS<\/a> website or the <strong>Citizenship and Immigration Services<\/strong> website, but USCIS won\u2019t decide on those applications yet. They can\u2019t because the government isn\u2019t allowing it. Mire, inicialmente esta informaci\u00f3n sali\u00f3 filtrada, vamos a decir, se sali\u00f3 de alguien de la administraci\u00f3n que inform\u00f3 que no se iba a renovar o extender el <a href=\"https:\/\/www.uscis.gov\/es\/CHNV\" target=\"_blank\" rel=\"noopener\"><strong>parole humanitario<\/strong><\/a> para los que ya estaban aqu\u00ed. Pero ayer oficialmente el gobierno ya dijo que no va a continuar con el parole humanitario para estos pa\u00edses: para Hait\u00ed, Venezuela, Cuba y Nicaragua.<\/p>\n<p>Este es <a href=\"https:\/\/www.uscis.gov\/es\/CHNV\" target=\"_blank\" rel=\"noopener\">el parole humanitario<\/a> que les da dos a\u00f1os para estar dentro de los Estados Unidos legalmente y con un permiso de trabajo. El problema que estamos viendo es que el parole se inici\u00f3 en octubre del 2022 con los venezolanos. O sea que esos primeros venezolanos que entraron con el parole est\u00e1n a punto de expirar ahora a finales de este mes de octubre del 2024.<\/p>\n<p>Esas personas, si no han aplicado para asilo, si no aplicaron para el <a href=\"https:\/\/www.uscis.gov\/humanitarian\/temporary-protected-status\" target=\"_blank\" rel=\"noopener\"><strong>TPS<\/strong><\/a> y no tienen ning\u00fan otro beneficio, tendr\u00edan que salir de los Estados Unidos una vez venza el parole. Si las personas venezolanas cuyo parole va a expirar tienen el <strong>TPS<\/strong>, pues pueden continuar en los Estados Unidos con ese <strong>TPS<\/strong>. Si est\u00e1n casados con ciudadanos americanos, pues tambi\u00e9n pueden hacer su petici\u00f3n de residencia a trav\u00e9s de ese ciudadano americano.<\/p>\n<p>O si <a href=\"https:\/\/ariasvilla.com\/es\/services\/political-asylum\/\" target=\"_blank\" rel=\"noopener\">aplicaron para asilo<\/a> y su asilo est\u00e1 pendiente, tambi\u00e9n pueden continuar con su asilo. Es decir, tienen que hacer algo que les d\u00e9 un estatus migratorio por el resto de tiempo que vayan a estar aqu\u00ed, o de lo contrario, deben salir del pa\u00eds.<\/p>\n<p><strong>Juan Camilo: <\/strong><br \/>\n\u00bfY qu\u00e9 va a pasar con el resto? El resto es el <strong>parole humanitario<\/strong> para Nicaragua y Hait\u00ed, que se va a empezar a expirar a partir de enero del 2025.<\/p>\n<p><strong>Martha Arias: <\/strong><br \/>\nS\u00ed, porque el de esos pa\u00edses se estableci\u00f3 en enero del 2023. Entonces, los que hayan entrado a partir de enero del 2023, que tuvieron dos a\u00f1os, a partir de enero del 2025 se les va a empezar a expirar y van a estar en la misma situaci\u00f3n. Los cubanos tienen una situaci\u00f3n distinta porque son personas que tienen derecho al ajuste cubano despu\u00e9s de un a\u00f1o y un d\u00eda de estar en los Estados Unidos. As\u00ed que, vamos a decir que ese <strong>parole humanitario<\/strong> les ha beneficiado m\u00e1s a los cubanos, pues porque son los que van a poder permanecer en los Estados Unidos con un ajuste de estatus. Los otros pa\u00edses, pues ya lo que dijimos anteriormente, tendr\u00e1n que hacer algo o salir de los Estados Unidos. Pero tampoco se va a renovar, no se va a continuar recibiendo aplicaciones nuevas de este parole humanitario para nuevos aplicantes. Esa s\u00ed fue la informaci\u00f3n que sali\u00f3 ayer.<\/p>\n<p><strong>Juan Camilo: <\/strong><br \/>\nAbogada, \u00bfqu\u00e9 puede significar eso para <a href=\"https:\/\/www.cbp.gov\/about\/mobile-apps-directory\/cbpone\" target=\"_blank\" rel=\"noopener\"><strong>la aplicaci\u00f3n CBP One<\/strong><\/a> que en este momento ya va a parar o cu\u00e1ndo va a parar? Y, sobre todo, la gente que ya envi\u00f3 la aplicaci\u00f3n pero no han recibido respuesta, \u00bfqu\u00e9 le podemos decir a esa gente?<\/p>\n<p><strong>Martha Arias: <\/strong><br \/>\nA ver, los que est\u00e1n esperando su cita a trav\u00e9s de la aplicaci\u00f3n <a href=\"https:\/\/www.cbp.gov\/about\/mobile-apps-directory\/cbpone\" target=\"_blank\" rel=\"noopener\">CBP One<\/a> pueden seguir esperando. No s\u00e9 si es cierto, porque yo hablaba con ciertos oficiales de CBP y me dec\u00edan que las entradas por la frontera continuaban a gran escala. No se gu\u00eden por lo que le fue bien a un amigo o vecino que lo hizo con un notario, lo mejor es orientarse con personas expertas en asuntos migratorios, con abogados licenciados a nivel nacional en temas de migraci\u00f3n.<\/p>\n<p><strong>Martha Arias: <\/strong><br \/>\nA ra\u00edz de esto que usted est\u00e1 diciendo, Juan, una persona de Nicaragua le ayud\u00f3 a otra persona de Nicaragua a llenar una aplicaci\u00f3n de asilo, y este se\u00f1or fue acusado de fraude migratorio. Cobraba casi igual que un abogado, supuestamente dec\u00eda que \u00e9l no asesoraba en casos de asilo, que ten\u00eda otra persona que le ayudaba o refer\u00eda los casos, pero realmente \u00e9l era el que hac\u00eda estos casos de asilo y fue condenado.<\/p>\n<p>Esto es porque llenar una aplicaci\u00f3n de inmigraci\u00f3n conlleva dar un consejo legal. No es simplemente que una persona est\u00e1 llenando un formato. Ese formato tiene unas preguntas que son redactadas y dise\u00f1adas de acuerdo a la ley. Entonces, una persona necesita saber de inmigraci\u00f3n, cr\u00e9alo o no, para llenar esa aplicaci\u00f3n, y se considera consejo legal. La Barra de Abogados de la Florida considera que quien d\u00e9 consejo migratorio tiene que ser un abogado, y una persona no puede llenar una aplicaci\u00f3n sin el apoyo de un abogado. O sea, <strong>octubre 9<\/strong>, que es mi\u00e9rcoles, va a estar cerrada. Todav\u00eda no han dicho si va a estar cerrada el 10.
