Ayer, cerca de las 7 de la noche, el Tribunal Supremo hab\u00eda determinado, en el caso de un salvadore\u00f1o que fue enviado aparentemente por un error de tipo t\u00e9cnico junto con un grupo de integrantes de la pandilla Salvatrucha a El Salvador, para ser internado en esta prisi\u00f3n de m\u00e1xima seguridad, que deb\u00eda regresar antes de la medianoche. Un juez de primera instancia y luego un tribunal de apelaciones hab\u00edan fallado que, efectivamente, el gobierno estaba obligado a traerlo de regreso antes de la medianoche, pero el Supremo dio una pr\u00f3rroga y dijo: \u201cNo, no, no, es demasiado poco tiempo. Vamos a darle al Poder Ejecutivo la oportunidad de presentar sus argumentos, y tal vez esta semana actuaremos en ese sentido\u201d.<br \/>\nY de ah\u00ed para ac\u00e1 han venido otras dos decisiones muy impactantes. Primero, el Tribunal Supremo ratifica que, efectivamente, el Poder Ejecutivo tiene la capacidad de deportar a personas extranjeras que tengan alg\u00fan tipo de criminalidad en los Estados Unidos bajo la ley de 1798.<\/p>\n<p>CARLOS ACOSTA: La Ley de Enemigos Extranjeros.<\/p>\n<p>AGUSTIN ACOSTA: Exacto, la Ley de Enemigos Extranjeros. Y bajo esa ley, seg\u00fan el Tribunal Supremo (5 a 4), el presidente puede deportar a personas siempre y cuando se les otorgue el debido proceso. Le ponen esa condici\u00f3n. Y hace un rato, tambi\u00e9n el Tribunal Supremo, en otra decisi\u00f3n que no tiene que ver con inmigraci\u00f3n, determin\u00f3 que Trump puede despedir a las personas que est\u00e1n en capacidad de periodo de prueba en los diferentes ministerios federales. Eso no tiene que ver con inmigraci\u00f3n, pero lo anterior s\u00ed.<\/p>\n<p>CARLOS ACOSTA: Pero lo que s\u00ed tiene que ver con inmigraci\u00f3n es que, al parecer, a trav\u00e9s de la Oficina de Rentas Internas (IRS, por sus siglas en ingl\u00e9s), hay, por supuesto, personas indocumentadas que, prepar\u00e1ndose para el d\u00eda en que hagan su tr\u00e1mite para legalizarse, pagan sus impuestos. Entonces, a trav\u00e9s de la oficina del IRS, se podr\u00eda solicitar informaci\u00f3n sobre estas personas, su paradero, d\u00f3nde est\u00e1n. Es decir, esta persona tiene orden de deportaci\u00f3n, no aparece por ninguna parte, pero est\u00e1 pagando impuestos. Estas personas recibieron un per\u00edodo de dos a\u00f1os de permanencia legal en los Estados Unidos. Eso comenz\u00f3 a ocurrir en el a\u00f1o 2023 y ahora se les ha revocado o cancelado esa posibilidad. As\u00ed que, para explicar todas estas cosas siempre con lujo de detalles, saludamos a la doctora Martha Arias, abogada de inmigraci\u00f3n. Doctora, muy buenas tardes nuevamente.<\/p>\n<p>CARLOS ACOSTA: Buenas tardes.<\/p>\n<p>ATTORNEY MARTHA L. ARIAS, ESQ.: Buenas tardes, Agust\u00edn y Carlos. Un saludo para ustedes y para toda su audiencia.<\/p>\n<p>AGUSTIN ACOSTA: Como van las cosas, doctora, vamos a tener que traerla para ac\u00e1 todas las tardes, por lo menos una hora, para que se siente aqu\u00ed con nosotros y est\u00e9 haciendo guardia, porque todos los d\u00edas hay cosas nuevas que discutir.<\/p>\n<p>ATTORNEY MARTHA L. ARIAS, ESQ.: S\u00ed, en esta administraci\u00f3n vamos a tener mucha actividad migratoria y, obviamente, hay necesidad de informaci\u00f3n.<\/p>\n<p>AGUSTIN ACOSTA: Bueno, abordemos primero la ley de 1798. \u00bfC\u00f3mo interpreta usted la determinaci\u00f3n del Supremo y, sobre todo, la condici\u00f3n que le pone al gobierno de que, para deportar a alguien bajo esa ley, tienen que darle el debido proceso ante un magistrado y no simplemente meterlo en un avi\u00f3n y para afuera?<\/p>\n<p>ATTORNEY MARTHA L. ARIAS, ESQ.: En cuanto a esa ley, como les dije anteriormente, me parece bien que la Corte Suprema de los Estados Unidos reconozca que el derecho al debido proceso es un derecho constitucional y que incluso aquellas personas que se aduzca est\u00e1n sin estatus en los Estados Unidos tambi\u00e9n tienen derecho a ese debido proceso. Por ese lado, est\u00e1 bien.<br \/>\nPor el lado de si se puede usar esa Ley de Enemigos Extranjeros para efectos de deportar a una persona inmigrante que pertenezca a cualquier pa\u00eds, aunque no sea un pa\u00eds que est\u00e9 en guerra con Estados Unidos, desde el punto de vista legal no estoy de acuerdo. Me parece que esa ley de enemigos extranjeros habla precisamente de eso: de personas nacionales de pa\u00edses enemigos con los cuales Estados Unidos tiene un conflicto. Entonces, no necesariamente todos los inmigrantes en Estados Unidos vienen de pa\u00edses en conflicto. Bueno, al menos se logr\u00f3 algo desde el punto de vista constitucional.<\/p>\n<p>CARLOS ACOSTA: Ahora, quisiera preguntarle sobre el tema del debido proceso, doctora. Es decir, apelando a la Ley de Enemigos Extranjeros de 1798, la Oficina de Seguridad Nacional o ICE atrapa a una persona y la va a deportar. Cuando hablamos de derecho al debido proceso, \u00bfes que esa persona, antes de ser deportada, tiene derecho a ser presentada ante un juez para que defienda su caso?<\/p>\n<p>ATTORNEY MARTHA L. ARIAS, ESQ.: S\u00ed, son varias cosas. F\u00edjese, por ejemplo, en el caso de estas personas que se aduce son miembros de pandillas. Primero, el gobierno tiene que aportar suficiente prueba para demostrar que estas personas pertenecen a una pandilla. Eso es importante.<br \/>\nSegundo, despu\u00e9s de que se demuestre que pertenece a una pandilla, puede usarse el Estatuto de Inmigraci\u00f3n para una deportaci\u00f3n. El Estatuto de Inmigraci\u00f3n prescribe o tipifica todas las razones por las cuales una persona puede ser deportada de los Estados Unidos; dentro de ellas, obviamente, tambi\u00e9n hay actos de terrorismo y pertenencia a pandillas. Entonces, como existe esa secci\u00f3n de la ley que dice \u201csi usted comete actos de terrorismo o es miembro de una pandilla, puede ser deportado\u201d, el gobierno, al invocar esa secci\u00f3n de la ley, obviamente tiene que probarle a la persona que es miembro de esa pandilla o que cometi\u00f3 esos actos terroristas, etc\u00e9tera.<br \/>\nEso es lo que nos referimos con el debido proceso: tiene que haber pruebas de la vinculaci\u00f3n a una pandilla y, despu\u00e9s, la persona debe tener su defensa ante un proceso de inmigraci\u00f3n. Ahora bien, es cierto, y quiero decirlo para que las personas sean conscientes de esto tambi\u00e9n: hay algunos delitos que se consideran felon\u00edas agravadas para efectos de inmigraci\u00f3n. En el caso de un delito que se considera una felon\u00eda agravada para efectos de inmigraci\u00f3n, una persona puede ser deportada sin tener un proceso de deportaci\u00f3n o de remoci\u00f3n, porque hay una secci\u00f3n de la ley que as\u00ed lo permite. Pero entonces el gobierno va a tener que probar que ese delito es una felon\u00eda agravada para efectos de inmigraci\u00f3n. Y a eso nos referimos con el debido proceso.<\/p>\n<p>AGUSTIN ACOSTA: Doctora, pasemos entonces a la determinaci\u00f3n del Departamento de Seguridad Nacional de revocar el estatus de permanencia legal en los Estados Unidos a las personas que entraron por la aplicaci\u00f3n CBP One.<\/p>\n<p>ATTORNEY MARTHA L. ARIAS, ESQ.: Mi opini\u00f3n es que es una medida que, de pronto, vaya a surtir efectos para el gobierno, pero no s\u00e9 en qu\u00e9 porcentaje. Si yo calculo, siendo muy ambiciosa, podr\u00eda ser un 30 o hasta un 40% de personas que s\u00ed se vayan. El gobierno ha dicho que se cancela CBP One y se abri\u00f3 una nueva aplicaci\u00f3n llamada CBP Home, y quienes entraron con CBP One deben autodeportarse usando la misma aplicaci\u00f3n CBP Home para salir del pa\u00eds.<br \/>\nAhora bien, no todas las personas que entraron con CBP One est\u00e1n en este momento sin estatus. Algunas de ellas podr\u00edan haber ajustado, por ejemplo, bajo la Ley de Ajuste Cubano; otras podr\u00edan haberse casado con un ciudadano estadounidense. Dentro de ese grupo hay personas que ya tienen otro tipo de salida legal. Sin embargo, habr\u00e1 un porcentaje que no tiene estatus y esas son las que deber\u00edan irse de acuerdo con esa orden del Poder Ejecutivo.<\/p>\n<p>AGUSTIN ACOSTA: \u00bfLes han dado un plazo para salir del pa\u00eds?<\/p>\n<p>ATTORNEY MARTHA L. ARIAS, ESQ.: Seg\u00fan tengo entendido, no. Yo no he visto personalmente ninguna de esas notificaciones. Gracias a Dios, no tengo ning\u00fan cliente que haya recibido una notificaci\u00f3n de ese tipo. Aparentemente, no les est\u00e1n dando ning\u00fan plazo.<br \/>\nEs diferente a lo que pas\u00f3 con el parole humanitario que fue cancelado, pues ah\u00ed s\u00ed les dijeron que deb\u00edan irse 30 d\u00edas despu\u00e9s de la publicaci\u00f3n en el Registro Federal, y esa fecha ser\u00eda el 24 de abril de este a\u00f1o. No sabemos si vaya a haber alguna demanda donde se pause esa decisi\u00f3n.<\/p>\n<p>CARLOS ACOSTA: \u00bfQu\u00e9 pas\u00f3 en Massachusetts con eso, doctora?<\/p>\n<p>ATTORNEY MARTHA L. ARIAS, ESQ.: La pausa de la decisi\u00f3n sigue pendiente. No he escuchado si hay alguna apelaci\u00f3n por parte del gobierno. Todav\u00eda est\u00e1 igual. Estamos dentro del tiempo en que el gobierno podr\u00eda apelar esa decisi\u00f3n, pero a\u00fan no ha ocurrido.<\/p>\n<p>AGUSTIN ACOSTA: Muy bien. \u00bfSe nos queda algo por fuera?<\/p>\n<p>CARLOS ACOSTA: El tema de compartir informaci\u00f3n con la Oficina de Rentas Internas.<\/p>\n<p>AGUSTIN ACOSTA: \u00a1Ah, s\u00ed! Est\u00e1 esa idea de que algunas personas indocumentadas, pero que pagan sus impuestos de forma regular, lo hacen porque son conscientes de que si en alg\u00fan momento van a tramitar su residencia, el hecho de ser puntuales con el pago de impuestos les ayudar\u00eda. Pues ahora se le est\u00e1 pidiendo al IRS que ayude a ubicar a quienes tienen orden de deportaci\u00f3n pero han estado pagando impuestos.<\/p>\n<p>ATTORNEY MARTHA L. ARIAS, ESQ.: S\u00ed, las personas que tienen una orden de deportaci\u00f3n&#8230; va a tener que hacerse un acuerdo entre agencias, porque la oficina del Executive Office for Immigration Review y ICE son las dos agencias que saben si una persona tiene deportaci\u00f3n y, obviamente, tendr\u00e1n el nombre y posiblemente un n\u00famero de Seguro Social. Entonces, quien sea en el gobierno pasar\u00e1 una lista al IRS con esos n\u00fameros de Seguro Social para ver cu\u00e1l es la informaci\u00f3n que est\u00e1n dando.<br \/>\nSinceramente, a m\u00ed lo que me parece es que quien tenga permiso de trabajo no va a tener tanto problema, a menos de que el gobierno quiera ver cu\u00e1nto pagan de impuestos. Realmente, quien estar\u00eda m\u00e1s asustado es la persona que no tiene ning\u00fan estatus y que posiblemente tenga un ITIN (ese n\u00famero de identificaci\u00f3n tributaria). Ah\u00ed s\u00ed es claro que esa persona no tiene un estatus legal.<\/p>\n<p>AGUSTIN ACOSTA: Doctora, y por \u00faltimo, hace algunos d\u00edas el gobierno estableci\u00f3 una exigencia de que las personas en esta situaci\u00f3n de estatus migratorio irregular se inscribieran con el gobierno; no s\u00e9 si a trav\u00e9s de Inmigraci\u00f3n, pero deb\u00edan registrar sus datos, direcci\u00f3n, etc\u00e9tera. \u00bfUsted sabe c\u00f3mo est\u00e1 funcionando ese programa o si la mayor\u00eda ha hecho caso omiso?<\/p>\n<p>ATTORNEY MARTHA L. ARIAS, ESQ.: S\u00ed, ese programa ya el gobierno lo implement\u00f3 y la forma est\u00e1 disponible. Esa registraci\u00f3n no ha dado datos en este momento de cu\u00e1ntas personas se hayan registrado. Es un requerimiento nuevo. Ya vi que Inmigraci\u00f3n emiti\u00f3 la forma G-325R, que es la nueva forma que la persona tiene que llenar. La p\u00e1gina de USCIS ya tiene la forma publicada. Desde el 20 de enero de este a\u00f1o (2023) se emitieron los requisitos que la persona debe cumplir para registrarse.<br \/>\nEsa forma G-325R ya est\u00e1 disponible. Lo que pasa es que no s\u00e9 si el gobierno har\u00e1 p\u00fablico cu\u00e1ntas personas se hayan registrado. Ah\u00ed, en la solicitud, est\u00e1 clar\u00edsimo qui\u00e9n debe registrarse y c\u00f3mo. Recuerden que la p\u00e1gina web de Inmigraci\u00f3n tambi\u00e9n est\u00e1 en espa\u00f1ol. Entonces, les dir\u00eda a las personas que lean esa p\u00e1gina para saber si deben registrarse. Ellos mismos pueden hacerlo. No parece ser algo complicado.<\/p>\n<p>AGUSTIN ACOSTA: Bueno, como siempre hacemos, al final me gusta dar su tel\u00e9fono, porque la molestamos a usted varias veces con este tema, y usted deja de trabajar y atender sus cosas. Yesterday, late in the day, around 7 p.m., the Supreme Court had determined, in the case of the Salvadoran who was sent apparently due to a technical-type error along with a group of members of the Salvatrucha gang to El Salvador to be placed in that maximum-security prison, that he had to return before midnight. A first-instance judge and then an appeals court had ruled that, effectively, the government was obligated to bring him back before midnight, but the Supreme Court granted an extension and said, \u201cNo, no, no, it\u2019s too little time. We\u2019re going to give the Executive Branch the opportunity to present its arguments, and maybe this week we\u2019ll act in that regard.\u201d<br \/>\nAnd since then, there have been two other very impactful decisions. First, the Supreme Court confirms that, effectively, the Executive Branch has the capacity to deport foreign persons who have some type of criminality in the United States under the 1798 law.<\/p>\n<p>CARLOS ACOSTA: The Foreign Enemies Law.<\/p>\n<p>AGUST\u00cdN ACOSTA: Exactly, the Foreign Enemies Law. And under that law, according to the Supreme Court (5 to 4), the president can deport people as long as they are given due process. They set that condition. And just a little while ago, also the Supreme Court, in another matter that has nothing to do with immigration, determined that Trump can fire people who are in a probationary capacity in different federal departments. That does not have to do with immigration, but the previous point does.<\/p>\n<p>CARLOS ACOSTA: But what does have to do with immigration is that, apparently, through the Internal Revenue Service (IRS), known by its initials in English, there are, of course, undocumented people who, preparing for the day they do their procedure to legalize themselves, pay their taxes; so through the IRS, information could be requested about these people, their whereabouts, where they are\u2014meaning this person has a deportation order, doesn\u2019t show up anywhere, but this person who has a deportation order is paying taxes; let\u2019s see where he lives.<\/p>\n<p>AGUST\u00cdN ACOSTA: And lastly, the Department of Homeland Security, this morning, revoked the status that had been granted to the people who entered under the CBP One application. These people received a period of two years of legal stay in the United States. That began to happen in 2023, and now that possibility has been revoked or canceled. So, to explain all these things, always in great detail, we welcome attorney Martha Arias, immigration attorney. Attorney, good afternoon again.<\/p>\n<p>CARLOS ACOSTA: Good afternoon.<\/p>\n<p>ATTORNEY MARTHA L. ARIAS, ESQ.: Good afternoon, Agust\u00edn and Carlos. Greetings to you and to your entire audience.<\/p>\n<p>AGUST\u00cdN ACOSTA: Given how things are going, attorney, we\u2019re going to have to bring you here every afternoon, at least for an hour, so you can sit here with us and keep watch, because there are new things to discuss every day.<\/p>\n<p>ATTORNEY MARTHA L. ARIAS, ESQ.: Yes, with this administration we\u2019re going to have a lot of immigration activity, so obviously there is a need for information.<\/p>\n<p>AGUST\u00cdN ACOSTA: Well, let\u2019s address first the 1798 law. How do you interpret the Supreme Court\u2019s determination, and especially the condition they place on the government that, to deport someone under that law, they have to give them due process before a magistrate, not just put them on a plane and out they go?<\/p>\n<p>ATTORNEY MARTHA L. ARIAS, ESQ.: Regarding that law, as I mentioned before, it seems good to me that the Supreme Court of the United States recognized that the right to due process is a constitutional right, and that even those people who are alleged to be without status in the United States also have the right to due process. On that side, it\u2019s good.<br \/>\nOn the side of whether that Foreign Enemies Law can be used for the purpose of deporting an immigrant person who belongs to any country, even if it\u2019s not a country at war with the United States, from a legal standpoint, I disagree. It seems to me that this foreign enemies law talks precisely about that: about nationals of enemy countries with which the United States has a conflict. So not necessarily all immigrants in the United States come from countries in conflict. Well, at least from the constitutional standpoint something was achieved.<\/p>\n<p>CARLOS ACOSTA: Now, I would like to ask you about the due process issue, attorney. That is, by invoking the 1798 Foreign Enemies Law, Homeland Security or ICE arrests someone and is going to deport them. When we talk about the right to due process, does that mean that, before being deported, that person has the right to appear before a judge to defend their case?<\/p>\n<p>ATTORNEY MARTHA L. ARIAS, ESQ.: Yes, there are several aspects. Look, for example, at the case of these people who are alleged to be members of gangs. First, the government has to provide sufficient proof to show that these people belong to a gang. That\u2019s important.<br \/>\nSecond, after it\u2019s shown that they belong to a gang, the Immigration Statute can be used for a deportation. The Immigration Statute prescribes or typifies all the reasons why a person can be deported from the United States; among them, obviously, are also terrorist acts and membership in gangs. So, since there\u2019s a section of the law that says, \u201cIf you commit terrorist acts or you\u2019re a member of a gang, you can be deported,\u201d the government, in invoking that section of the law, obviously has to prove to the person that they are a member of that gang or that they committed those terrorist acts, or whatever it may be.<br \/>\nThat\u2019s what we refer to with due process. There must be proof of a connection to a gang, and then the person has to have a defense in an immigration proceeding. Now, it\u2019s true\u2014 and I want to say this so people are aware\u2014there are some crimes that are considered aggravated felonies for immigration purposes. In the case of a crime that\u2019s considered an aggravated felony for immigration purposes, a person can be deported without having a deportation or removal proceeding, because there\u2019s a section of the law that allows it. But then the government will have to prove that the person\u2019s crime is an aggravated felony for immigration purposes. And that\u2019s what we mean by due process.<\/p>\n<p>AGUST\u00cdN ACOSTA: Attorney, let\u2019s move on to the Department of Homeland Security\u2019s determination to revoke the legal residency status in the United States of the people who entered via the CBP One application.<\/p>\n<p>ATTORNEY MARTHA L. ARIAS, ESQ.: In my opinion, it\u2019s a measure that may yield results for the government, but I don\u2019t know in what percentage. If I calculate, and I might be ambitious, it could be 30% or up to 40% of people who might indeed leave. The government has said that CBP One is being canceled and a new application called CBP Home was opened, and those who entered with CBP One must self-deport using the same CBP Home application to leave the country.<br \/>\nNow, not all the people who entered with CBP One are currently without status. Some of them may have adjusted status under, for example, the Cuban Adjustment Act; others may have married a U.S. citizen. Among those people, some have another type of legal relief. However, there will be a percentage that does not have status, and those are the ones who should leave, according to this order from the Executive Branch.<\/p>\n<p>AGUST\u00cdN ACOSTA: Have they been given a deadline to leave the country?<\/p>\n<p>ATTORNEY MARTHA L. ARIAS, ESQ.: As far as I understand, no. I have not personally seen any of those notifications. Thank God, I don\u2019t have any client who has received a notification of that kind. Apparently, they\u2019re not giving them any deadline.<br \/>\nThat\u2019s different from what happened with the humanitarian parole that was canceled, because there they did say they had to leave 30 days after publication in the Federal Register, and that date would be April 24 of this year. We don\u2019t know whether there will be some lawsuit that pauses that decision.<\/p>\n<p>CARLOS ACOSTA: What happened in Massachusetts with that, attorney?<\/p>\n<p>ATTORNEY MARTHA L. ARIAS, ESQ.: That pause on the decision is still pending. I haven\u2019t heard if there is any appeal by the government. It\u2019s still the same. We are within the time period in which the government can also appeal that decision, but that has not happened yet.<\/p>\n<p>AGUST\u00cdN ACOSTA: All right. Is there anything we left out?<\/p>\n<p>CARLOS ACOSTA: Sharing information with the Internal Revenue Service.<\/p>\n<p>AGUST\u00cdN ACOSTA: Ah, yes. There\u2019s this idea that some undocumented people, but who pay their taxes regularly, do it because they are aware that if at any point they will process their residency, being punctual with tax payments would help them. Now the IRS is being asked to help locate those who have deportation orders but have been paying taxes.<\/p>\n<p>ATTORNEY MARTHA L. ARIAS, ESQ.: Yes, people who have a deportation order\u2026 there will have to be an agreement among agencies, because the Executive Office for Immigration Review and ICE are the two agencies that know whether a person is deported, and obviously they will have the name and possibly a Social Security number. Then whoever it is in the government will send a list to the IRS: \u201cThese people have these Social Security numbers. What information are they providing?\u201d<br \/>\nHonestly, it seems to me that those who have work permits won\u2019t have as much trouble, unless the government wants to see how much they\u2019re paying in taxes. Really, the one who might be most afraid is the person who doesn\u2019t have any status and who perhaps has an ITIN number (that tax ID number), because there it\u2019s clear that that person doesn\u2019t have legal status.<\/p>\n<p>AGUST\u00cdN ACOSTA: Attorney, and finally, a few days ago the government established a requirement that people in this irregular migratory status had to register with the government; I don\u2019t know if it\u2019s through Immigration, but they had to record their details, address, etc. Do you have any idea how that program is working or if most people have ignored it?<\/p>\n<p>ATTORNEY MARTHA L. ARIAS, ESQ.: Yes, that program has already been implemented by the government, and the form is available. That registration hasn\u2019t given us data at this time on how many people have registered. It\u2019s a new requirement. I\u2019ve seen that Immigration issued form G-325R, which is the new form that a person has to fill out. The USCIS website already has that form posted. Since January 20 of this year (2023), the requirements that a person must meet to register were laid out.<br \/>\nThat G-325R form is already available. What happens is, right now, I don\u2019t know if the government will make public how many people have registered. In the application it\u2019s very clear who has to register and how. Remember that the Immigration website is also in Spanish. So I would tell people to read that page to figure out if they need to register. They can register themselves. It doesn\u2019t look complicated.<\/p>\n<p>AGUST\u00cdN ACOSTA: Well, as we always do, at the end I like to give out your phone number, because we bother you several times about this topic, and you stop working and taking care of your business.
