We discussed how the IRS is now publicly committing to share taxpayer information with Department of Homeland Security to identify immigrants subject to deportation, and what that might mean for those who file taxes with an ITIN number. From my experience, this collaboration isn\u2019t entirely new, but the official announcement has certainly caught the public\u2019s attention.<\/p>\n<p>We also touched on President Trump\u2019s move to revoke legal status for those who entered with CBP-1 and the possibility of ending work permits for many who came in under various humanitarian paroles. Another critical topic was the revival of an old 1996 measure dating back to the Clinton era: fines of $998 per day against those who defy deportation orders. ARIAS.: Buenos d\u00edas, Eduardo y Aaron, un saludo para ustedes y toda la audiencia que tienen en esta ma\u00f1ana de hoy.<\/p>\n<p>HOST: Much\u00edsimas gracias, bienvenida. Bueno, quisiera comenzar con la informaci\u00f3n del Servicio de Rentas Internas (IRS). El IRS ha acordado ayudar a los funcionarios de Seguridad Nacional a encontrar a los inmigrantes que est\u00e1n tratando de deportar, comprometi\u00e9ndose a compartir informaci\u00f3n en lo que representa un cambio fundamental en la forma en que el IRS utiliza sus registros, que son estrictamente regulados. \u00bfCu\u00e1l es el impacto de esta \u201casociaci\u00f3n\u201d, si cabe el t\u00e9rmino, entre el IRS y el ICE?<\/p>\n<p>DRA. MARTHA L. ARIAS.: El impacto obviamente es grande, sobre todo para aquellas personas que est\u00e1n presentando taxes con un ITIN number, no con un Social Security. La mayor\u00eda \u2014dir\u00eda yo, no todos\u2014 de quienes tienen un n\u00famero de Seguro Social es porque han presentado alguna petici\u00f3n con Inmigraci\u00f3n que les ha dado ese derecho.<br \/>\nSi no estoy mal, fue en 1999 o por esa fecha cuando el Seguro Social dej\u00f3 de otorgar n\u00fameros a las personas, a menos que tuvieran un tr\u00e1mite migratorio. Antes de 1999 o 2000, por ejemplo, alguien con visa de turista ped\u00eda un Seguro Social y se lo daban. Pero ya despu\u00e9s de esa fecha, no.<\/p>\n<p>Entonces, la mayor\u00eda de las personas que est\u00e1n con un Social es porque tienen alg\u00fan tipo de estatus. Si no lo tienen, es dif\u00edcil para las autoridades determinar si esa persona est\u00e1 legal o no. No s\u00e9 c\u00f3mo van a hacer esa selecci\u00f3n. Obviamente, quienes tienen un ITIN number y est\u00e1n dentro de Estados Unidos pagando impuestos podr\u00edan ser observados. Pero hay gente con ITIN que s\u00ed est\u00e1 legal; no necesariamente todos los que tienen un ITIN est\u00e1n en estatus ilegal.<\/p>\n<p>Mira, ese es mi primer comentario. El segundo es que tampoco nos volvamos locos, porque esto no es nada nuevo. Tal vez el gobierno lo est\u00e1 anunciando as\u00ed para que quede claro, lo est\u00e1n notificando p\u00fablicamente y concret\u00e1ndolo en un acuerdo formal. Pero yo, como abogada de inmigraci\u00f3n, s\u00e9 \u2014en mis 21 a\u00f1os de experiencia\u2014 que Inmigraci\u00f3n, por ejemplo, s\u00ed tiene acceso a las bases de datos del IRS. No s\u00e9 a qu\u00e9 nivel, pero s\u00e9 que lo tienen.<\/p>\n<p>Les voy a poner un ejemplo: tuve un cliente que hab\u00eda presentado por su cuenta la solicitud de ciudadan\u00eda por estar casado con una ciudadana estadounidense durante tres a\u00f1os. Cuando fue a la entrevista, la oficial le pregunt\u00f3 si \u00e9l presentaba los taxes junto con su esposa, y \u00e9l dijo que no, que los presentaba separados. La oficial lo indag\u00f3; ya ten\u00eda toda la informaci\u00f3n de sus impuestos. A la persona le negaron la ciudadan\u00eda, porque la esposa, que hab\u00eda declarado los impuestos por separado, hab\u00eda reclamado que viv\u00eda sola, que no recib\u00eda nada de \u00e9l, e incluso hab\u00eda pedido ayuda del gobierno. Inmigraci\u00f3n los confront\u00f3, porque para pedir la ciudadan\u00eda por los tres a\u00f1os de matrimonio, deben vivir juntos. As\u00ed que era obvio que la oficial hab\u00eda revisado la informaci\u00f3n del IRS tanto de mi cliente como de su esposa.<\/p>\n<p>As\u00ed como este, hay m\u00e1s ejemplos donde Inmigraci\u00f3n ha confrontado a una persona con su informaci\u00f3n del IRS. Para m\u00ed no es algo nuevo; creo que siempre ha existido. Lo que pasa es que, al hacerlo p\u00fablico, al notificarlo, al pueblo le asusta, y creo que en este momento tambi\u00e9n es una t\u00e1ctica para asustar, crear p\u00e1nico.<\/p>\n<p>HOST: Abogada Arias, el gobierno del presidente Trump revoca el estatus legal a migrantes que entraron a Estados Unidos con el CBP-1. El mensaje fue contundente: \u201cEs hora de que abandonen Estados Unidos.\u201d Lo enviaron a trav\u00e9s de un correo electr\u00f3nico que las familias migrantes recibieron en estos \u00faltimos d\u00edas. \u00bfQu\u00e9 va a pasar con toda esta gente? Se habla de m\u00e1s de 900,000 personas.<\/p>\n<p>DRA. MARTHA L. ARIAS.: Cada persona tendr\u00e1 un caso distinto. Unas podr\u00e1n \u2014y lo har\u00e1n\u2014 registrarse en el CBP-Home, que fue la nueva aplicaci\u00f3n que cre\u00f3 esta administraci\u00f3n para que las personas salgan del pa\u00eds. Algunos lo har\u00e1n, muchos no. Otros ya tendr\u00e1n un estatus o un caso presentado. Por ejemplo, hay cubanos con una solicitud de residencia bajo la Ley de Ajuste Cubano. Otras personas habr\u00e1n pedido asilo, otras se habr\u00e1n casado con ciudadanos americanos, o tendr\u00e1n una petici\u00f3n familiar lista para residencia, etc\u00e9tera. Cada caso es diferente.<\/p>\n<p>De esos 900,000, me atrever\u00eda a decir que m\u00e1s del 50% va a quedar en situaci\u00f3n de ilegalidad, y de esos, algunos saldr\u00e1n, otros no. Pero no podemos decir que todos est\u00e1n en la misma situaci\u00f3n.<\/p>\n<p>HOST: \u00bfQu\u00e9 pasa con los permisos de trabajo de esa gente, abogada?<\/p>\n<p>DRA. MARTHA L. ARIAS.: Se cancelan. Lo mismo que para quienes entraron con el parole humanitario de Hait\u00ed, Cuba, Nicaragua y Venezuela, que supuestamente terminar\u00eda ahora en abril de 2024. Digo \u201csupuestamente\u201d porque ya est\u00e1 anunciado en el Registro Federal desde marzo de 2025 y debe estar all\u00ed 30 d\u00edas para entrar en vigor, a no ser que haya \u2014como todos sabemos\u2014 una demanda y se dicte una medida temporal ordenada por un juez. Pero tal como est\u00e1n las cosas en este momento, concluir\u00eda en abril de 2024 y se cancela el permiso de trabajo. Lo mismo para quienes entraron con CBP-1 y tambi\u00e9n obtuvieron un parole humanitario.<\/p>\n<p>HOST: Usted mencionaba en uno de sus comentarios que nada de esto es nuevo, que estas son resoluciones viejas, leyes anteriores. De hecho, la administraci\u00f3n ha revivido otra ley. Esta es de la era de Bill Clinton, de 1996, para cobrar a los inmigrantes indocumentados por cada d\u00eda que permanezcan en el pa\u00eds. La cifra, creo, son 998 d\u00f3lares al d\u00eda por no auto-deportarse. Repito, es una ley de la era Clinton. MARTHA L. ARIAS.: Dos cosas. Primero, para aclarar: el acuerdo de Inmigraci\u00f3n con el IRS no es una ley y tampoco s\u00e9 si estaba firmado antes. Yo s\u00ed soy testigo de que siempre se ha compartido esa informaci\u00f3n. No s\u00e9 si era un acuerdo que ya exist\u00eda y expir\u00f3, o si se hab\u00eda ratificado antes. Pero lo que quiero decir es que s\u00ed ha existido esa comunicaci\u00f3n entre agencias antes de anunciarlo ahora.<\/p>\n<p>En cuanto a la multa, pues yo, como abogada de inmigraci\u00f3n, no tengo conocimiento de que el presidente Clinton haya establecido una multa de este rango, como lo dice el presidente Trump ahora. La \u00fanica sanci\u00f3n monetaria de la que me acuerdo \u2014y hay varias\u2014 son los mil d\u00f3lares de la 245(i), cuando la persona pod\u00eda ajustar estatus pagando esa penalidad, y eso todav\u00eda existe. Otra sanci\u00f3n se da cuando las personas pagan una fianza para salir, etc\u00e9tera.<\/p>\n<p>Pero una sanci\u00f3n como la que anunci\u00f3 el presidente, de pagar casi mil d\u00f3lares diarios las personas que han sido deportadas, disc\u00falpenme, pero nunca hab\u00eda escuchado de algo as\u00ed. Esto s\u00ed es nuevo. No s\u00e9 si tendr\u00edamos que ir a revisar en los libros de historia, pero desde 2003 que ejerzo como abogada de inmigraci\u00f3n, no exist\u00eda.<\/p>\n<p>Me parece injusto, primero, que sea tan alta, y segundo, que sea diaria. Podr\u00eda ser un monto fijo, por ejemplo, 2,000, 3,000 o 5,000 d\u00f3lares, pero fijar 1,000 d\u00f3lares diarios es excesivo. Adem\u00e1s, si las personas no lo pagan, podr\u00edan tener que responder con sus propiedades. Hay gente que lleva muchos a\u00f1os aqu\u00ed y ha adquirido una casita o apartamento \u2014lo \u00fanico que tienen de ahorros\u2014 y podr\u00edan perderlo.<br \/>\nS\u00ed, violaron la ley, pero me parece una penalidad excesiva.<\/p>\n<p>HOST: Abogada Arias, para finalizar este encuentro, \u00bfqu\u00e9 mensaje le puede enviar a la gente que hoy est\u00e1 pendiente de estos casos, de los procedimientos que han cambiado, que podr\u00edan seguir cambiando? ARIAS.: El mensaje es que tengan calma, tengan fe y se asesoren con un buen abogado de inmigraci\u00f3n que les hable claro y les explique bien su caso ante las nuevas medidas. Esos son mis tres consejos. Hemos pasado por administraciones anteriores donde tambi\u00e9n hubo situaciones dif\u00edciles. Mientras est\u00e9n bien asesorados, no cometan delitos y cuiden su conducta \u2014por ejemplo, c\u00f3mo manejan\u2014, eso les ayuda a estar un poco m\u00e1s protegidos mientras se atraviesa esto.<br \/>\nPuede que venga una reforma, puede que pase algo que beneficie a muchos, no sabemos. What is the impact of this \u201cassociation,\u201d if the term fits, between the IRS and ICE?<\/p>\n<p>IMMIGRATION ATTORNEY MARTHA L. ARIAS, ESQ.::<br \/>\nThe impact is obviously significant, especially for those people who are filing taxes with an ITIN number, not a Social Security. The majority \u2014I would say not all, but most\u2014 of those who have a Social Security number is because they have submitted some petition with Immigration that granted them that right.<br \/>\nIf I\u2019m not mistaken, it was in 1999 or around that date when Social Security stopped giving out numbers to people unless they had a pending immigration procedure. Before 1999 or 2000, for example, someone with a tourist visa would ask for a Social Security and they would give it to them. But after that date, no.<\/p>\n<p>So, most people with a Social Security have some type of status. If they don\u2019t, it\u2019s difficult for the authorities to determine if that person is legal or not. I don\u2019t know how they will select people. Obviously, those with an ITIN number who are inside the United States paying taxes, well, those might be looked at. But there are people with an ITIN who are legal; not everyone with an ITIN is illegal.<\/p>\n<p>Look, that\u2019s my first comment. My second comment is, let\u2019s not go crazy because this is nothing new. Maybe the government is announcing it this way so it\u2019s clear, they\u2019re notifying it publicly and formalizing it in an agreement. But I, as an immigration attorney, know \u2014in my 21 years of experience\u2014 that Immigration, for example, does have access to IRS databases. I don\u2019t know what type of access or at what level, but I know it does.<\/p>\n<p>I\u2019ll give you an example: I had a client who had filed his citizenship request on his own for having been married to an American citizen for three years. When he went to the interview, the officer only asked him if he filed taxes together with his wife, and he said no, separately. The officer questioned him; the officer already had all his tax information. They denied the person citizenship because the wife, who had filed taxes separately, had claimed that she lived alone, that she received nothing from her husband, and had even requested assistance. Immigration confronted them, because to request citizenship through three years of marriage, they have to be living together. So it was obvious the officer had reviewed the IRS information for both my client and his wife.<\/p>\n<p>So, just like this, I can give you examples where Immigration has confronted a person with their IRS information. For me, it\u2019s nothing new; I believe it has always existed. The thing is that by making it public, by notifying it, it scares people, and I believe that at this moment one of the tactics is to scare, to create panic.<\/p>\n<p>HOST:<br \/>\nAttorney Arias, President Trump\u2019s government is revoking the legal status of migrants who entered the United States with CBP-1. The message was forceful: \u201cIt is time for you to leave the United States.\u201d They sent it via an email that migrant families received in these last days. What will happen to all these people? It\u2019s said there are more than 900,000 people.<\/p>\n<p>IMMIGRATION ATTORNEY MARTHA L. ARIAS, ESQ.::<br \/>\nThose people, each person will have a different case. Some, obviously, will be able to \u2014and will\u2014 register in CBP-Home, which was the new app this administration created so people can leave the country. Some will do it, many won\u2019t. Others will already have some status or a filed case. For example, some Cubans might have a residency application through the Cuban Adjustment Act. Other people might have requested asylum, others may have married an American citizen, or have a family petition that is already ready for residency, etc. Each person could have a different case.<\/p>\n<p>Of those 900,000, I would say a large number \u2014and I could dare to say more than 50%\u2014 will end up in that situation of illegality, and of those, some will leave, others won\u2019t. That\u2019s the situation, but we can\u2019t say that everyone is in the same position.<\/p>\n<p>HOST:<br \/>\nWhat happens to the work permits of those people, attorney?<\/p>\n<p>IMMIGRATION ATTORNEY MARTHA L. ARIAS, ESQ.::<br \/>\nThey get canceled. The same as those who entered with the humanitarian parole for Haiti, Cuba, Nicaragua, and Venezuela, which supposedly would end now in April 2024. I say \u201csupposedly\u201d because it\u2019s already announced in the Federal Register from March 2025, and it has to be there for 30 days to go into effect, unless there is \u2014as we all know\u2014 a lawsuit and perhaps a pause or temporary measure ordered by a judge. But as things stand right now, it ends April 2024 and your work permit is canceled. The same for those who entered with CBP-1 and also obtained humanitarian parole.<\/p>\n<p>HOST:<br \/>\nYou mentioned in one of your comments that none of this is new, that these are old resolutions, old laws, previous laws. In fact, the administration has revived another law. This is from the Clinton era, William Jefferson Clinton, from 1996, to charge undocumented immigrants for each day they remain in the country. The figure, I believe, is $998 a day for not self-deporting. I repeat, it is a law from the Clinton era; many people were even surprised because they did not know that Bill Clinton himself had enacted a law imposing such a large fine on foreigners who defied a deportation order. I\u2019d like to hear your comment on that.<\/p>\n<p>IMMIGRATION ATTORNEY MARTHA L. ARIAS, ESQ.::<br \/>\nTwo things. One, to clarify: the Immigration agreement with the IRS is not a law, and I also don\u2019t necessarily know if it was signed before. What I do know is that this information has always been shared. I don\u2019t know if it was an agreement that might have been signed and never ratified or expired, but what I mean is that the communication between those agencies existed before announcing it now.<\/p>\n<p>Now, regarding the fine, as an immigration attorney I don\u2019t have knowledge that President Clinton established a fine of this range, as President Trump says now. The only monetary sanction I recall \u2014and there are several\u2014 was the $1,000 of 245(i) when the person could adjust status by paying that penalty, and that still exists. Then there were penalties when people posted a bond or had to leave.<\/p>\n<p>But a fine like the one the president announced, paying almost $1,000 a day by people who have been deported, excuse me, but I had never heard of a sanction or penalty of that kind. This is new. I don\u2019t know; we might have to go look in the books, but since 2003 when I started practicing as an immigration attorney, it didn\u2019t exist.<\/p>\n<p>But if it did exist, well, it seems unfair. Two things: unfair that it is so high and unfair that it is daily. It could be a lump sum penalty, for example, $3,000, $2,000, up to $5,000, I don\u2019t know, some determined amount. But imposing $1,000 daily, and the second unfair part is that if people don\u2019t pay it, they might have to answer with their properties. Some people have been here for so many years, they have a house or a small apartment \u2014the only thing they have from their savings\u2014 and now face losing that. Yes, they broke the law, obviously, we won\u2019t deny that, but this kind of penalty seems excessive under the law.<\/p>\n<p>HOST:<br \/>\nAttorney Arias, to close this conversation, what message can you send to people who today are waiting for news on these cases, procedures that have changed, that could keep changing? There\u2019s a lot of uncertainty and many people are anxious. What message can you give them?<\/p>\n<p>IMMIGRATION ATTORNEY MARTHA L. ARIAS, ESQ.::<br \/>\nThe message is have calm, have faith, consult a good immigration attorney who will tell you things clearly and explain your case well under the new measures. Those are my three pieces of advice. We\u2019ve gone through previous administrations where difficult situations also arose. So as long as you\u2019re well advised, don\u2019t commit crimes, be careful about your behavior \u2014for example, how you drive\u2014 that helps you be a bit more protected while all this goes on.<br \/>\nIt could be that a reform might come, maybe something will happen that benefits us, we don\u2019t know.
