{"id":11554,"date":"2025-05-17T10:43:05","date_gmt":"2025-05-17T14:43:05","guid":{"rendered":"https:\/\/ariasvilla.com\/?p=11554"},"modified":"2025-05-17T10:43:05","modified_gmt":"2025-05-17T14:43:05","slug":"what-you-need-to-know-about-the-new-bipartisan-tps-bill-for-venezuelans","status":"publish","type":"post","link":"https:\/\/ariasvilla.com\/es\/what-you-need-to-know-about-the-new-bipartisan-tps-bill-for-venezuelans\/","title":{"rendered":"What You Need to Know About the New Bipartisan TPS Bill for Venezuelans"},"content":{"rendered":"<div class=\"wpb-content-wrapper\"><div class=\"vc_row wpb_row vc_row-fluid\"><div class=\"wpb_column vc_column_container vc_col-sm-12\"><div class=\"vc_column-inner\"><div class=\"wpb_wrapper\">\t\t<div id=\"wd-6828934d9468d\" class=\"wd-text-block wd-wpb reset-last-child wd-rs-6828934d9468d text-left\">\n\t\t\t<blockquote><p>\nLast week, I had the opportunity to speak with Raffa Mej\u00edas on EVTV\u2019s program \u201cD\u00edgalo Aqu\u00ed\u201d about an important development in immigration policy: a new bipartisan bill introduced in Congress that would extend Temporary Protected Status (TPS) for Venezuelans into 2025.\n<\/p><\/blockquote>\n\t\t<\/div>\n\t\t<\/div><\/div><\/div><\/div><div class=\"vc_row wpb_row vc_row-fluid\"><div class=\"wpb_column vc_column_container vc_col-sm-12\"><div class=\"vc_column-inner\"><div class=\"wpb_wrapper\">\t\t<div id=\"wd-68289363d90a3\" class=\"wd-text-block wd-wpb reset-last-child wd-rs-68289363d90a3 text-left\">\n\t\t\t<p>This proposal, co-sponsored by Republican Mar\u00eda Elvira Salazar and supported by Florida Democrats, aims to secure legal protection for all Venezuelans present in the U.S. at the time of the bill&#8217;s approval. Unlike previous extensions, this new TPS legislation could benefit even those who arrived in 2024\u2014expanding protections more broadly than before.<\/p>\n<p>I explained during the interview that this bill could offer both political and legal benefits. Politically, if passed by a Republican-led Congress, it could provide the administration with leverage to show strength while delivering humanitarian support. Legally, the bill would make ongoing litigation over the previous termination of TPS moot\u2014resolving current legal uncertainties and clearing the way for a clean and stable program.<\/p>\n<p>But time is of the essence. The current TPS designation for Venezuelans expires in September 2025. Yo pienso que puede ser posible que el Congreso act\u00fae a trav\u00e9s de esta ley, es decir, que la apruebe, puede ser posible. Y me parece que ser\u00eda un buen movimiento, una buena jugada de la administraci\u00f3n. Porque, a mi pensar, la administraci\u00f3n del presidente Trump quiere deportar al mayor n\u00famero de personas y quiere mostrar fuerza o ser estricto con la inmigraci\u00f3n. Y si este TPS lo pasa al Congreso, del cual la mayor\u00eda republicana sabemos tiene casi todo el Congreso, entonces ser\u00eda un punto favorable para el presidente. Porque en vez de decir: &#8220;fui yo el que lo aprob\u00e9&#8221;, es el mismo Congreso el que lo aprueba. Entonces, eso ser\u00eda un beneficio grande para el Ejecutivo y, igualmente, ser\u00eda un gran beneficio para los venezolanos.<\/p>\n<p><strong>Raffa Mej\u00edas:<\/strong><br \/>\nAbogada, el hecho de ser una ley bipartidista le da mayor oportunidad de ser aprobada. \u00bfPodr\u00eda pasar en el primer comit\u00e9? \u00bfQu\u00e9 se podr\u00eda valorar en este momento?<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nYo pienso que s\u00ed. Obviamente, el ser bipartidista ayuda much\u00edsimo. El hecho de que haya all\u00ed una republicana apoy\u00e1ndolo, como Mar\u00eda Elvira, y dos dem\u00f3cratas de la Florida, ayuda much\u00edsimo. Yo pienso que eso es un punto a favor. Y tambi\u00e9n el hecho de que es un tema que todos estamos&#8230; incluso muchos republicanos est\u00e1n a favor del TPS de Venezuela. Ahora, esto ser\u00eda como un proyecto bipartidista, como que dejar\u00eda a la administraci\u00f3n de Biden a un lado, cosa que la administraci\u00f3n no quiere. Entonces, pienso&#8230; a m\u00ed lo \u00fanico que me preocupa es, de pronto, la demora. Porque acu\u00e9rdese que el TPS, todo proyecto de ley en el Congreso, usualmente toma tiempo. Ahora, si de pronto lo aprueban de una forma r\u00e1pida, pues eso ser\u00eda un beneficio. Tiene que ser antes de septiembre, ojal\u00e1, que es cuando terminar\u00eda el TPS de los venezolanos este a\u00f1o.<\/p>\n<p><strong>Raffa Mej\u00edas:<\/strong><br \/>\nAbogada, tomando en cuenta el primer TPS para los venezolanos en 2021, posteriormente la extensi\u00f3n en 2023, y ahora este de 2025, \u00bfcu\u00e1les ser\u00edan las diferencias a valorar?<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nBueno, ah\u00ed yo pienso que va a haber una confusi\u00f3n grande. Este proyecto dice que aplicar\u00edan todos los venezolanos que est\u00e9n presentes en los Estados Unidos al momento de la aprobaci\u00f3n. Quiere decir que va a cobijar a bastantes personas. No solamente los del 2021, los del 2023, incluso los que hayan llegado el a\u00f1o pasado, 2024, hasta el momento de la aprobaci\u00f3n. Eso es una ventaja. Pero mi preocupaci\u00f3n con la confusi\u00f3n legal es que todos sabemos que el presidente Trump, a trav\u00e9s del Departamento de Homeland Security, termin\u00f3 el TPS, sobre todo este del 2023. Y hay un litigio en el cual se dio una medida cautelar diciendo que no aplica esa terminaci\u00f3n del TPS por parte de la administraci\u00f3n actual. Es decir, el TPS queda, por ahora, extendido hasta el a\u00f1o entrante, octubre de 2026. Con la entrada de esta ley, yo pienso que se resolver\u00eda ese problema legal, de hecho. Porque entonces ese litigio va a ser lo que se llama \u201cmoot.\u201d \u201cMoot\u201d quiere decir que ya no tenemos por qu\u00e9 pelear, o sea, esto ya se resolvi\u00f3 por el Congreso. Esas demandas todas se caer\u00edan porque ya no hay ning\u00fan litigio que resolver. Entonces, eso ser\u00eda el beneficio legal. Look, I think it is possible that Congress acts through this law, that is, that it approves it\u2014it could be possible. And it seems to me that it would be a good move, a good play by the administration. Because, in my opinion, the administration of President Trump wants to deport the largest number of people and wants to show strength or be strict on immigration. And if this TPS is passed to Congress\u2014which we know is mostly Republican\u2014it would be favorable for the president. Because instead of saying, &#8220;I was the one who approved it,&#8221; it\u2019s the Congress itself that would approve it. So, that would be a big benefit for the Executive and also a great benefit for Venezuelans.<\/p>\n<p><strong>Raffa Mej\u00edas:<\/strong><br \/>\nAttorney, the fact that it is a bipartisan law gives it more chances of being approved. Could it pass in the first committee? What could be evaluated at this moment?<\/p>\n<p><strong>Attorney Martha Arias:<\/strong><br \/>\nI think so. Obviously, being bipartisan helps a lot. The fact that there is a Republican supporting it, like Mar\u00eda Elvira, and two Democrats from Florida helps a lot. I think that\u2019s a point in its favor. Also, the fact that it&#8217;s an issue that everyone is&#8230; even many Republicans are in favor of TPS for Venezuela. Now, this would be a bipartisan project, like leaving the Biden administration aside, which is something the administration doesn&#8217;t want. So I think&#8230; the only thing that worries me is maybe the delay. Because remember that TPS, every bill in Congress, usually takes time. Now, if they approve it quickly, well, that would be the benefit. It has to be before September, hopefully, which is when the current TPS for Venezuelans ends this year.<\/p>\n<p><strong>Raffa Mej\u00edas:<\/strong><br \/>\nAttorney, taking into account the first TPS for Venezuelans in 2021, then the extension in 2023, and now this 2025 one, what would be the differences to consider?<\/p>\n<p><strong>Attorney Martha Arias:<\/strong><br \/>\nWell, there I think there\u2019s going to be a big confusion. This project says that it would apply to all Venezuelans who are present in the United States at the time of approval. That means it\u2019s going to cover a lot of people. Not only those from 2021, 2023\u2014even those who arrived last year, 2024, up to the moment of approval. That\u2019s an advantage. But my concern with the legal confusion is that we all know that President Trump, through the Department of Homeland Security, ended TPS\u2014especially the 2023 one. And there is litigation where a preliminary injunction was granted saying that that termination of TPS by the current administration does not apply. That is, TPS remains, for now, extended until next year, October 2026. With the entry of this law, I think that legal or de facto problem would be resolved. Because then that litigation would become what is called \u201cmoot.\u201d Moot means we no longer have to fight. That is, this is already resolved by Congress. All those lawsuits would fall away because there is no litigation left to resolve. So that would be the legal benefit.
