This arose after eight individuals from countries like Cuba, Mexico, Myanmar, Laos, and Vietnam were deported to Sudan, and they filed a lawsuit against the U.S. government. The judge ordered that these individuals be returned, but the administration appealed to the Supreme Court. The situation is very delicate, especially when immigrants could be sent to unfamiliar and potentially unsafe countries, far from their culture and language. The case will be important to watch, especially for those who already have final deportation orders and whose home countries are not accepting their return.<\/p>\n<p>We also talked about the suspension of student visa interviews. Bueno, una semanita corta para muchos, pero abogada, el gobierno de Trump pide a la Corte Suprema permitir la deportaci\u00f3n de inmigrantes a lugares diferentes a su naci\u00f3n de origen. \u00bfQu\u00e9 implica exactamente esta petici\u00f3n del gobierno ante la Corte Suprema?<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nBueno, esta petici\u00f3n exactamente es una apelaci\u00f3n de emergencia que la presidencia hizo despu\u00e9s de que se presentara una demanda en una corte federal por ocho personas que fueron enviadas a Sud\u00e1n y eran personas de otros pa\u00edses. Eran personas, tengo entendido, de Cuba, M\u00e9xico, Myanmar, Laos y otros, Vietnam y otros pa\u00edses asi\u00e1ticos.<br \/>\nEstas personas fueron enviadas all\u00ed y pues presentaron una demanda en contra del gobierno porque dicen los demandantes que no se les dieron las garant\u00edas, no se les inform\u00f3 d\u00f3nde iban a ser enviados y si sus vidas iban a estar o no en peligro en ese pa\u00eds, pa\u00eds que de por s\u00ed es un pa\u00eds que tiene un poco de inestabilidad o situaciones de seguridad.<br \/>\nEntonces, el juez orden\u00f3 al gobierno que estas personas fueran regresadas. El presidente entonces apel\u00f3 a la Corte Suprema. Vamos a ver qu\u00e9 dice la Corte Suprema. Es una situaci\u00f3n delicada, Andreina, porque imag\u00ednese usted, sobre todo para gente como cubanos o mexicanos que est\u00e1n en este continente y ser enviados a un continente totalmente distinto, con otro idioma. Sabemos, no con mucha seguridad, pues es una situaci\u00f3n un poco delicada.<\/p>\n<p><strong>Andreina Gandica:<\/strong><br \/>\n\u00bfY cu\u00e1les son esos pa\u00edses, abogada, donde podr\u00edan ser deportados?<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nEn este momento fueron enviados a Sud\u00e1n. El gobierno, tengo entendido, ha tratado de entrar en acuerdos con terceros pa\u00edses que est\u00e9n dispuestos a recibir a aquellos inmigrantes que van a ser deportados de los Estados Unidos y cuyos pa\u00edses no los reciben. Tengo entendido que ya hicieron este acuerdo con Sud\u00e1n, en Sud\u00e1frica. El otro d\u00eda estaba escuchando que estaban tratando de hacer un acuerdo tambi\u00e9n con Myanmar, otro pa\u00eds asi\u00e1tico. O sea, la administraci\u00f3n est\u00e1 tratando de buscar pa\u00edses, b\u00e1sicamente en otro continente, que acepten inmigrantes deportados de los Estados Unidos.<\/p>\n<p><strong>Andreina Gandica:<\/strong><br \/>\nRecuerden que si tienen pregunta pueden hacerlo a trav\u00e9s del 1-833-867-234, s\u00ed abogada. Pero \u00bfesto afectar\u00eda a personas con casos de asilo en curso o solo a quienes ya tienen una orden de deportaci\u00f3n?<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nSolo a quienes tienen ya una orden de deportaci\u00f3n y personas, b\u00e1sicamente, que no sean recibidas en su pa\u00eds de origen. Por ejemplo, los cubanos, no todos los meses Cuba recibe deportados de aqu\u00ed, de Estados Unidos.<br \/>\nNo s\u00e9 por qu\u00e9 mandaron a un mexicano. Tengo entendido que M\u00e9xico s\u00ed acepta a sus deportados, pero bueno, aqu\u00ed supuestamente fueron personas que fueron enviadas a estos pa\u00edses porque sus pa\u00edses no los recib\u00edan. Eso es lo que aduce la administraci\u00f3n.<br \/>\nEl juez federal que tuvo esta demanda dice, seg\u00fan la noticia, que le dio la oportunidad al gobierno de que explicara la raz\u00f3n por la que fueron enviadas y si se les dio a esas personas la oportunidad de conocer a d\u00f3nde iban a ir.<br \/>\nSeg\u00fan la documentaci\u00f3n que estaba leyendo, no es claro si estas personas tuvieron esa oportunidad porque aparentemente todo fue s\u00faper r\u00e1pido, en menos de 16 horas se proces\u00f3 la partida de ellos y no se les dio la oportunidad. Entonces, es una demanda que obviamente creo que va a continuar, pero es muy muy importante que vaya a la Corte Suprema, porque ah\u00ed es donde vamos a ver si el gobierno va a poder continuar, que dice la corte si va a poder continuar deportando personas a terceros pa\u00edses.<\/p>\n<p><strong>Andreina Gandica:<\/strong><br \/>\nAhora, abogada, tenemos otro asunto y me desprendo un poco de este tema como tal para hablar de las entrevistas de visas estudiantiles, porque el gobierno de Trump pausa estas entrevistas de visas de todo el mundo mientras valora elevar ese escrutinio de redes sociales de aspirantes. \u00bfQu\u00e9 impacto tiene esta pausa para quienes ya estaban en proceso de obtener una <strong><a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/us-visas\/study\/student-visa.html\">visa F-1<\/a><\/strong>, por ejemplo?<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nEl impacto es grande, es muy grande para las, sobre todo para las universidades, Andreina. No es solamente los estudiantes que quieran venir a los Estados Unidos. Recuerde que hay muchos otros pa\u00edses europeos que tienen buena calidad de universidades, entre esos, Inglaterra.<br \/>\nPero el punto es, m\u00e1s me pienso yo para las universidades. Usted sabe que las universidades de los Estados Unidos cobran el doble, a veces tres veces m\u00e1s, sus matr\u00edculas de lo que le cobran a estudiantes nacionales o residentes.<br \/>\nEntonces, el ingreso para las universidades de estas visas de estudiantes es grande. Adem\u00e1s, que es una culturizaci\u00f3n y un intercambio de informaci\u00f3n y de educaci\u00f3n muy importante para personas que vienen de pa\u00edses como Suram\u00e9rica, Centroam\u00e9rica.<br \/>\nEntonces, pienso que el impacto grande va a estar en las universidades, Andreina. Las universidades est\u00e1n siendo v\u00edctimas de esta situaci\u00f3n y espero, espero pues que el gobierno recapacite en esto porque igual a las personas les hacen, toman huellas y les hacen una evaluaci\u00f3n de sus antecedentes penales antes de otorgarles una visa de estudiante.<br \/>\nEntonces, yo pienso, es mi opini\u00f3n, que puede ser m\u00e1s impactante para las universidades que para los mismos estudiantes porque los mismos estudiantes pueden encontrar otros pa\u00edses.<\/p>\n<p><strong>Andreina Gandica:<\/strong><br \/>\nClaro, y justamente Trump est\u00e1 ordenando suspender todas las visas para estudiar en Estados Unidos. \u00bfEsta orden ya est\u00e1 vigente o a\u00fan se encuentra en evaluaci\u00f3n, abogada?<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nYo lo que tengo entendido, lo que pude haber revisado el d\u00eda de ayer, es que por ahora est\u00e1n simplemente suspendiendo lo que son las entrevistas, es decir, pausando tal vez las entrevistas, pero todav\u00eda no es algo como que se van a suspender, no. Est\u00e1n pausadas, seguramente van a tener un retraso, pero s\u00ed, esto es inmediato porque recuerde que el Departamento de Estado es el que maneja los consulados y las embajadas.<br \/>\nEntonces, el Departamento de Estado depende directamente del Ejecutivo. Entonces, este tipo de medidas s\u00ed pueden ser tomadas por el Ejecutivo a trav\u00e9s del Departamento de Estado o de su Secretario de Estado, como en este caso el se\u00f1or Marco Rubio. Entonces, pues esta medida est\u00e1 operando en este momento.<\/p>\n<p><strong>Andreina Gandica:<\/strong><br \/>\n\u00bfY qu\u00e9 pasar\u00e1 con los estudiantes internacionales que ya est\u00e1n dentro de Estados Unidos?<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nBueno, por ahora los estudiantes que est\u00e1n en Estados Unidos no tienen ning\u00fan problema, a no ser que est\u00e9n en Harvard. Usted ya sabe este problema que surgi\u00f3 con los estudiantes de Harvard, que la universidad, el gobierno quer\u00eda suspender las visas de estudiantes para esta universidad.<br \/>\nPor lo que el gobierno alega es que la universidad no est\u00e1 ejerciendo o no est\u00e1 haciendo cumplir pol\u00edticas antisemitas que en este momento est\u00e1n dando revueltas y paros y cosas de antisemitismo. Esa es la situaci\u00f3n en Harvard, pero usted ya tambi\u00e9n sabe que un juez federal paus\u00f3 esto y dijo que no, que no se puede ejercer o que no se puede eliminar la posibilidad de estudiantes extranjeros en Harvard.<br \/>\nPero en las otras universidades, contin\u00faan los estudiantes extranjeros con comunicaci\u00f3n corriente haciendo con su arrojo, cursando sus estudios.<\/p>\n<p><strong>Andreina Gandica:<\/strong><br \/>\nAqu\u00ed tenemos una pregunta de Nelson Humana, abogada, dice: \u00bfpara la abogada es m\u00e1s que suficiente prueba el Real ID si ICE lo detiene a uno?<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nBueno, lo que pasa es que el Real ID es una prueba de que la persona tiene una licencia de conducir y de qui\u00e9n es y tiene su foto, pero no es prueba de un estatus migratorio.<br \/>\nClaro, hay muchos estados que requieren un estatus migratorio para la persona poder tener una licencia, pero hay otros que no. Entonces, no es suficiente. How are you, attorney? Good morning.<\/p>\n<p><strong>Attorney Martha Arias:<\/strong><br \/>\nGood morning, Andreina. A greeting to you and your entire audience. Happy week as always.<\/p>\n<p><strong>Andreina Gandica:<\/strong><br \/>\nYes, indeed. Well, a short week for many, but attorney, the Trump administration is asking the Supreme Court to allow the deportation of immigrants to places other than their country of origin. What does this government request to the Supreme Court actually mean?<\/p>\n<p><strong>Attorney Martha Arias:<\/strong><br \/>\nWell, this request is specifically an emergency appeal that the presidency made after a lawsuit was filed in a federal court by eight people who were sent to Sudan and were people from other countries. They were people, I understand, from Cuba, Mexico, Myanmar, Laos, and others\u2014Vietnam and other Asian countries.<br \/>\nThese people were sent there and filed a lawsuit against the government because the plaintiffs say that they were not given guarantees, they were not informed where they would be sent, or if their lives would be in danger in that country\u2014a country that, by itself, has some unrest or security situations.<br \/>\nSo, the judge ordered the government to have these people returned. The president then appealed to the Supreme Court. Let&#8217;s see what the Supreme Court says. It&#8217;s a delicate situation, Andreina, because just imagine, especially for people like Cubans or Mexicans who are from this continent, being sent to a completely different continent, with another language. We know not much security\u2014well, the situation is a little delicate.<\/p>\n<p><strong>Andreina Gandica:<\/strong><br \/>\nAnd what are those countries, attorney, where they could be deported?<\/p>\n<p><strong>Attorney Martha Arias:<\/strong><br \/>\nAt this moment, they were sent to Sudan. The government, as I understand, has tried to enter into agreements with third countries that are willing to receive those immigrants who are going to be deported from the United States and whose countries will not receive them. I understand they already made this agreement with Sudan, in South Africa. The other day I was hearing that they were also trying to make an agreement with Myanmar, another Asian country.<br \/>\nThat is, the administration is trying to find countries, basically on another continent, that accept immigrants deported from the United States.<\/p>\n<p><strong>Andreina Gandica:<\/strong><br \/>\nRemember, if you have a question you can do it through 1-833-867-234, yes attorney. But would this affect people with asylum cases in process or only those who already have a deportation order?<\/p>\n<p><strong>Attorney Martha Arias:<\/strong><br \/>\nOnly those who already have a deportation order and basically people who are not received in their country of origin. For example, Cubans\u2014not every month does Cuba receive deportees from here, from the United States. I don&#8217;t know why they sent a Mexican. I understand that Mexico does accept its deportees, but well, here supposedly these were people who were sent to these countries because their countries were not receiving them. That&#8217;s what the administration claims.<br \/>\nThe federal judge who handled this lawsuit, according to the news, gave the government the opportunity to explain the reason they were sent and whether those people were given the chance to know where they would go.<br \/>\nAccording to the documentation I was reading, it\u2019s not clear if these people had that opportunity because apparently everything was super quick\u2014in less than 16 hours their departure was processed and they were not given the opportunity. So, it\u2019s a lawsuit that I obviously think will continue, but it\u2019s very, very important that it goes to the Supreme Court, because that&#8217;s where we\u2019ll see if the government will be able to continue\u2014what the court says about whether it will be able to continue deporting people to third countries.<\/p>\n<p><strong>Andreina Gandica:<\/strong><br \/>\nNow, attorney, we have another matter and I\u2019ll separate a bit from this topic to talk about student visa interviews, because the Trump administration is pausing these interviews for visas worldwide while considering raising the scrutiny of social media for applicants. What impact does this pause have for those who were already in the process of obtaining an <a href=\"https:\/\/travel.state.gov\/content\/travel\/en\/us-visas\/study\/student-visa.html\" target=\"_blank\" rel=\"noopener\"><strong>F-1 visa<\/strong><\/a>, for example?<\/p>\n<p><strong>Attorney Martha Arias:<\/strong><br \/>\nThe impact is big, it&#8217;s very big, especially for the universities, Andreina. It\u2019s not just the students who want to come to the United States. Remember, there are many other European countries that have good quality universities, among them England. But the point is, more so I think for the universities. You know that U.S. universities charge double, sometimes three times more, tuition than they charge to national or resident students.<br \/>\nSo, the income for universities from these students is significant. Besides, it is a culturalization and a very important exchange of information and education for people who come from countries like South America, Central America. So, I think the big impact will be on the universities, Andreina. The universities are being victims of this situation and I hope, I really hope the government reconsiders this because people still have fingerprints taken and their criminal background is checked before granting a student visa. So, I think, in my opinion, it could be more impactful for the universities than for the students themselves because students can find other countries.<\/p>\n<p><strong>Andreina Gandica:<\/strong><br \/>\nOf course, and just now Trump is ordering all visas for studying in the United States to be suspended. Is this order already in effect or is it still under evaluation, attorney?<\/p>\n<p><strong>Attorney Martha Arias:<\/strong><br \/>\nWhat I understand, what I was able to review yesterday, is that for now they are simply suspending what are the interviews\u2014that is, perhaps pausing the interviews\u2014but it&#8217;s not yet something like they are going to be suspended, no. They are paused, they will surely have a delay, but yes, this is immediate because remember that the Department of State is the one that manages the consulates and embassies.<br \/>\nSo, the Department of State depends directly on the Executive. So, this type of measure can be taken by the Executive through the Department of State or its Secretary of State, as in this case Mr. Marco Rubio. So, this measure is operating at this time.<\/p>\n<p><strong>Andreina Gandica:<\/strong><br \/>\nAnd what will happen to international students who are already inside the United States?<\/p>\n<p><strong>Attorney Martha Arias:<\/strong><br \/>\nWell, for now the students who are in the United States do not have any problem, unless they are at Harvard. You already know about this problem that arose with Harvard students, that the university\u2014the government wanted to suspend student visas for this university.<br \/>\nWhat the government alleges is that the university is not enforcing or not applying antisemitic policies and that right now there are protests and strikes and antisemitism issues. That is the situation at Harvard, but you also know that a federal judge paused this and said that no, you can&#8217;t do that, you can&#8217;t eliminate the possibility of foreign students at Harvard.<br \/>\nBut at other universities, foreign students continue with regular communication and continue studying as usual.<\/p>\n<p><strong>Andreina Gandica:<\/strong><br \/>\nHere we have a question from Nelson Humana, attorney, he says: For the attorney, is the Real ID sufficient proof if ICE detains someone?<\/p>\n<p><strong>Attorney Martha Arias:<\/strong><br \/>\nWell, what happens is that the Real ID is proof that the person has a driver&#8217;s license and who they are and has their photo, but it is not proof of immigration status.<br \/>\nOf course, there are many states that require immigration status for a person to have a license, but there are others that do not. So, it is not sufficient. You must have some other proof that shows your immigration status, such as a green card, proof of citizenship, also if you have DACA, then proof of your work permit with DACA.<br \/>\nIf you have a pending asylum, the proof that you have that asylum pending or your work permit through asylum, anything that shows that status.<br \/>\nFor example, another thing, and this is something I have been asked, people who have a U visa, while the U visa is pending, really the person does not have much to show except some receipts. But after three or four years of that visa being pending, immigration issues a document called &#8220;Prima Fashion Eligibility.&#8221; That is, it\u2019s a document that says at first sight eligible for this benefit.
