In my recent interview on Unión Radio’s “A Tiempo” with Eduardo Rodríguez and Saúl Noriega, I addressed the latest proclamation issued by President Donald Trump that directly impacts Venezuelans seeking to enter the United States.

As of June 9, 2025, both immigrant and non-immigrant visas for Venezuelans wishing to enter the U.S. are suspended. This includes business (B1), tourism (B2), student (F), and practical training (M, J) visas. Anyone applying for these visas after this date will not be permitted entry.

However, there are important exemptions:

Venezuelans with U.S. permanent residency (green card holders)

Those with dual nationality entering with another country’s passport

Certain athletic, diplomatic, or NATO groups

Children adopted under the Hague Convention or those whose residency was obtained through adoption

Immediate relatives of U.S. citizens (such as minor children, spouses, or parents petitioned by their U.S. citizen family members)

If you are a Venezuelan in the U.S. on a tourist visa, these new restrictions do not apply to you, but it is essential to leave before your permitted stay ends. Overstaying could result in serious immigration consequences as the U.S. government plans to strictly enforce visa time limits moving forward.

For those with recently issued visas (before June 9, 2025), you can still enter the U.S., but be prepared for possible delays at the airport and bring documents showing the purpose and duration of your stay.

Remember, anyone with questions about their specific situation should seek personalized legal advice. I am always here to support and guide our community through these uncertain times.

For more information or to schedule a consultation, please call my office at 305-671-0018

Greetings to you and all the people of Venezuela.

Host:
Thank you. Look, Martha, we are, of course, facing great expectation, a lot of uncertainty with all this immigration topic, the decisions that Donald Trump has been making. In fact, today it’s on the front pages of the newspapers, with photos from Los Angeles, a city Trump says he will “liberate” regarding these immigration raids.
But in the specific case of the suspension of the entry to the United States of Venezuelans with tourist, student, or business visas, how can you guide us as far as knowledge goes at this moment?

Attorney Martha Arias:
Well, let’s see, the proclamation issued by President Trump last week says that immigrant visas, which are permanent residency, and non-immigrant visas for Venezuelans who will enter after June 9, which is today, Monday, June 9, 2025, are suspended.
Immigrant visas are the permanent residencies received at U.S. consulates. The non-immigrant visas specifically mentioned in the regulation are the B1 and B2, which are for business and tourism; the F, which is the student visa; and the M and J, which are practical study visas. Those now have restricted entry to the United States after today. And also, for those who did not have a visa and were applying for it, well, it will not be valid either.
Who are exempt from this prohibition? Very important, people who are U.S. residents. So, if a Venezuelan is already a resident of the United States, that is, already has a green card, that person can continue entering.
Also, Venezuelans with dual nationality if they enter with the passport of that second nationality.
Third, certain athletic groups or members of athletic groups, diplomatic visas, or NATO visas, N-A-T-O. Also, children adopted under the Hague International Conventions or who received their residency through adoption.
Immediate relatives of U.S. citizens. If you are a Venezuelan minor and your mom or dad petitioned for you, or conversely, if you are a Venezuelan who petitioned for your parents or spouse, they will be able to enter if petitioned by relatives who are U.S. citizens.
If the petitioner is a resident, that is suspended. So that, in summary, is who can or cannot enter as of this date.

Host:
Now, attorney, recommendations for Venezuelans who are there, especially since there is a climate of uncertainty and a lot of fear for those who have a planned trip. For example, “Should I leave with all this going on? Maybe if I leave and when I return, I’ll have problems?” From your perspective, and since you know the site, what is your recommendation for Venezuelans there who have their documents, as is commonly said?

Attorney Martha Arias:
Well, here we have to distinguish two types of visas. The Venezuelan who is already in the United States with a permanent residency visa, that is, an immigrant visa, a green card as people call it, that person will have no problem. They can travel outside the U.S. and return. Obviously, it’s always advisable to seek the advice of an attorney in case that Venezuelan, or whoever, has committed any crime in the United States because there are certain grounds of inadmissibility that do not allow a person to enter when they have committed crimes.
So, those here with a green card or residency have no problem. The Venezuelan who is visiting, who is here with a tourist visa, already inside the United States, is not subject to this prohibition.
However, very important, that person must leave within the term allowed by law. If they were given six months to stay, they must leave before those six months. This is important to know because after this proclamation there are also announcements that the government will start enforcing those permitted stays for people who stay longer than their visas allow.
So, people need to recognize this now. If a Venezuelan is traveling with a tourist visa, make sure to leave before the time given by CBP, the Customs and Border Protection authority, at the time of entry.

Host:
Martha, just to clarify what is clear to understand, but has a big impact. People who recently, in the Venezuelan case, with so many difficulties to renew or obtain a visa, who post on social media: “Here I am in Bogotá, I have my visa,” “Here I am in Curaçao,” those people, as of today, with that newly issued visa, can they not enter the United States?

Attorney Martha Arias:
If the visa was issued before June 9, they can enter.
However, they need to be careful when entering. They may experience some delays, as many news sources have said here. Even though the prohibition only applies to those who did not have a visa on June 9, today, those who already have a visa may experience delays at the airport. Bring documents that show why you’re coming, what you’re going to do, how long you’ll stay, if you’re coming for a course, a class, a seminar, if you’re specifically coming to visit a family member in the U.S. who is sick, or if you’re coming for vacation, proof of where you’re coming from, what hotel, what you’re going to do here in the United States.
Because I do think you may experience delays at entry, but you can enter.

Host:
Now, attorney, as part of the argument, in a minute you said this restriction—that almost 10% of those with a tourist visa stayed. Basically, in this last minute we have, what is the scenario for someone whose visa expired while in the U.S., but decides to stay?

Attorney Martha Arias:
What happens is, if I understand the question, the visa that a person has stamped in their passport may be about to expire. But if, at the time of entry, they were given six months to stay, the person can remain for the time indicated in the entry document called the I-94, even if the visa is already expired. The important thing is to comply with the time allowed on the I-94 and leave before the expiration of that document.

Host:
Wow, very grateful, Martha, for your kindness, for the usefulness of your information. We hope to continue counting on you for necessary follow-up on this subject. A big hug.

Attorney Martha Arias:
Thank you very much to all of you. Congratulations, and we are at your service.

Host:
Martha Arias, immigration attorney expert from Miami.

As an immigration attorney, I understand how new immigration policies can create fear and confusion in our community.
