{"id":11604,"date":"2025-06-11T13:39:52","date_gmt":"2025-06-11T17:39:52","guid":{"rendered":"https:\/\/ariasvilla.com\/?p=11604"},"modified":"2025-06-11T13:39:52","modified_gmt":"2025-06-11T17:39:52","slug":"humanitarian-parole-resumes-for-certain-nationalities-amid-confusing-new-restrictions","status":"publish","type":"post","link":"https:\/\/ariasvilla.com\/es\/humanitarian-parole-resumes-for-certain-nationalities-amid-confusing-new-restrictions\/","title":{"rendered":"Humanitarian Parole Resumes for Certain Nationalities Amid Confusing New Restrictions"},"content":{"rendered":"<div class=\"wpb-content-wrapper\"><div class=\"vc_row wpb_row vc_row-fluid\"><div class=\"wpb_column vc_column_container vc_col-sm-12\"><div class=\"vc_column-inner\"><div class=\"wpb_wrapper\">\t\t<div id=\"wd-6849a683cb87f\" class=\"wd-text-block wd-wpb reset-last-child wd-rs-6849a683cb87f text-left\">\n\t\t\t<p>This morning on <a href=\"https:\/\/lapoderosa.com\/radioshow\/noticias-990-edici%C3%B3n-matutina\" target=\"_blank\" rel=\"noopener\"><strong>Noticias 990 AM<\/strong><\/a>, I had the opportunity to discuss the latest developments affecting beneficiaries of <a href=\"https:\/\/www.uscis.gov\/humanitarian\/humanitarian_parole\" target=\"_blank\" rel=\"noopener\"><strong>Humanitarian Parole<\/strong><\/a> and recent <a href=\"https:\/\/www.whitehouse.gov\/presidential-actions\/2025\/06\/restricting-the-entry-of-foreign-nationals-to-protect-the-united-states-from-foreign-terrorists-and-other-national-security-and-public-safety-threats\/\" target=\"_blank\" rel=\"noopener\"><strong>travel restrictions to the United States<\/strong><\/a>.<\/p>\n<p>USCIS has lifted the suspension on pending Humanitarian Parole applications for Cubans, Haitians, Nicaraguans, and Venezuelans. This means cases that were already filed before the program ended may now proceed, though new applications are not being accepted. However, the overall situation remains confusing: while those abroad may be able to enter if their parole is approved, the program remains terminated for those already inside the United States.<\/p>\n<p>I explained that every case is different. Some people may continue their asylum processes, others may be eligible for residency through the <a href=\"https:\/\/www.uscis.gov\/green-card\/green-card-eligibility\/green-card-for-a-cuban-native-or-citizen\" target=\"_blank\" rel=\"noopener\"><strong>Cuban Adjustment Act<\/strong><\/a>, while others without options may face risks of unlawful presence and even deportation. I also described the challenges in seeking bonds for detained asylum seekers, as prosecutors often argue that \u201cbare-bones\u201d or weak asylum claims present a risk for absconding.<\/p>\n<p>We also discussed new travel restrictions affecting countries such as Cuba and Venezuela. People from these countries with visas issued before June 9 can still enter, but those with visas issued after that date cannot. Hemos invitado precisamente a la abogada Martha Arias, especialista en inmigraci\u00f3n. Abogada Arias, buenos d\u00edas. Gracias por estar con nosotros. Much\u00edsimas gracias por atender nuestra llamada. Uno de los temas de inmigraci\u00f3n por estas horas tiene que ver con el <strong>Parol Humanitario<\/strong>. La administraci\u00f3n, el gobierno ha reanudado los tr\u00e1mites para los beneficiarios del Parol. El Departamento de Inmigraci\u00f3n y Ciudadan\u00eda, USCIS, ha levantado la suspensi\u00f3n sobre las solicitudes de Parol Humanitario que benefician a cubanos, haitianos, nicarag\u00fcenses y venezolanos. \u00bfCu\u00e1l es el impacto de esta medida? \u00bfQu\u00e9 esperan ustedes, abogados de inmigraci\u00f3n, que suceda en los pr\u00f3ximos d\u00edas?<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nS\u00ed, efectivamente. Gracias, Eduardo. Lo que est\u00e1 pasando es que una juez orden\u00f3 que se reanude el tr\u00e1mite de esas peticiones de parol que ya hab\u00edan presentado las personas, estaban en proceso cuando se termin\u00f3 ese parol humanitario por parte de la nueva administraci\u00f3n. Entonces, el proceso debe reanudarse para llegar a una decisi\u00f3n.<br \/>\nSin embargo, hay una petici\u00f3n, por ejemplo, si la persona apenas va a aplicar para la <a href=\"https:\/\/www.uscis.gov\/newsroom\/alerts\/update-on-form-i-134a\" target=\"_blank\" rel=\"noopener\"><strong>I-134A<\/strong><\/a>, que es el affidavit de soporte que presenta ese sponsor o ese patrocinador, esas peticiones s\u00ed no se van a procesar, las nuevas. Es decir, son peticiones que ya est\u00e1n pendientes al momento que se termin\u00f3 el parol. Esas son las que tengo entendido que se van a comenzar o se van a reanudar el procesamiento.<\/p>\n<p><strong>Aaron:<\/strong><br \/>\n\u00bfSe puede saber en cu\u00e1nto tiempo se van a procesar, abogada, estas peticiones?<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nNo, no sabemos en cu\u00e1nto tiempo. Lo que s\u00ed dice el comunicado es que se va a seguir el proceso regular de investigaci\u00f3n porque usted sabe que cada proceso tiene una investigaci\u00f3n donde se revisan antecedentes penales, se revisa todos los antecedentes de las personas en todas partes del mundo. Entonces, no sabemos cu\u00e1nto va a ser el tiempo, pero pues s\u00ed sabemos que dijeron que va a ser una investigaci\u00f3n de cada caso.<\/p>\n<p><strong>Aaron:<\/strong><br \/>\nMientras tanto, \u00bfesta gente est\u00e1 protegida, tiene que tomar alguna medida especial, abogada, por cualquier eventualidad?<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nBueno, acu\u00e9rdense que estos son procesamientos de peticiones de parol de personas que est\u00e1n fuera de los Estados Unidos. Es este parol humanitario para que ellos entren a los Estados Unidos. O sea que estas personas est\u00e1n fuera del pa\u00eds. El parol, por eso es que es confuso. El parol humanitario lo termin\u00f3 el Departamento de Seguridad Nacional y fue apelado, hubo una pausa. Despu\u00e9s la Corte Suprema el 30 de mayo dijo que el presidente s\u00ed ten\u00eda la autoridad o el Ejecutivo de terminarlo y el juicio contin\u00faa. Pero lo que es el parol humanitario en s\u00ed para esas personas que est\u00e1n aqu\u00ed dentro de los Estados Unidos, incluso que se les venc\u00eda a finales de a\u00f1o, el a\u00f1o entra, esto sigue terminado. Por eso es que es confuso. Est\u00e1 terminado para los que est\u00e1n aqu\u00ed, pero entonces van a procesar los casos de los que est\u00e1n apenas para entrar. Como que no tiene mucho sentido para m\u00ed, por lo menos no tiene l\u00f3gica. Porque vamos a suponer que a un cubano o un venezolano le aprueben este parol. Entonces apenas entre, \u00bfqu\u00e9 va a quedar, terminado apenas entre? O sea, servir\u00eda no m\u00e1s para el prop\u00f3sito de entrar, pero despu\u00e9s una vez aqu\u00ed no va a estar activo. Es un poquito, me parece, contradictorio. Todo es confuso porque no le veo la l\u00f3gica a esto.<\/p>\n<p><strong>Eduardo:<\/strong><br \/>\nAhora, ante esta confusi\u00f3n, abogada, \u00bfqu\u00e9 pasa con aquellos que usted menciona que est\u00e1n aqu\u00ed adentro, que el parol ya no est\u00e1 activo para ellos? \u00bfHay alternativas? \u00bfQu\u00e9 es lo que usted le recomienda en la oficina?<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nBueno, cada caso es distinto. Por ejemplo, yo tengo clientes que tienen un asilo pendiente y pueden continuar con este caso de asilo. No van a incurrir en presencia ilegal porque ese asilo los protege para no incurrir en presencia ilegal, tienen permiso de trabajo. Ese es un grupo de personas.<br \/>\nHay otro grupo de personas que, por ejemplo, son cubanos, entonces ya completaron el a\u00f1o y un d\u00eda o est\u00e1n a punto de completar el a\u00f1o y un d\u00eda y pueden aplicar entonces a su residencia a trav\u00e9s del Ajuste Cubano.<br \/>\nHay otro grupo de personas que no tienen nada, ni asilo, ni TPS del 2021, que es el que est\u00e1 vigente este septiembre, no tienen peticiones familiares. Esas son las personas que est\u00e1n en un peligro porque esas personas s\u00ed est\u00e1n incurriendo en presencia ilegal y pues pueden ser sujetas a una detenci\u00f3n y a una deportaci\u00f3n.<br \/>\nHay otro grupo de personas que se casaron con ciudadano americano o con residentes y esas personas est\u00e1n en proceso de residencia a trav\u00e9s de sus peticiones. Esas tambi\u00e9n est\u00e1n protegidas por esa petici\u00f3n de residencia que est\u00e1 en tr\u00e1mite.<br \/>\nEntonces, como usted ve, los casos son distintos dependiendo de cada persona. Yo en mi oficina he aconsejado a los que, por ejemplo, le doy un ejemplo, un caso de una pareja. \u00c9l entr\u00f3 con el parol humanitario, la esposa es residente, no ciudadana, y lo pidi\u00f3. Y la petici\u00f3n est\u00e1 m\u00e1s o menos a unos seis meses de salir. Esa persona decidi\u00f3 inteligentemente salir del pa\u00eds para no incurrir en presencia ilegal y no da\u00f1ar su petici\u00f3n de residencia a trav\u00e9s de la esposa. Esa persona va a salir y va a continuar su procesamiento consular. Tambi\u00e9n, tal vez tenga que estar alejado seis meses, un a\u00f1o de su familia, pero la esposa puede viajar a visitarlo y continuar el proceso porque quedarse en el pa\u00eds es como someterse a una posible deportaci\u00f3n que en el futuro le impida regresar m\u00e1s r\u00e1pido.<br \/>\nEntonces, como te digo, cada caso es distinto.<\/p>\n<p><strong>Aaron:<\/strong><br \/>\nEstamos conversando con la abogada de Migraci\u00f3n Martha Arias y estamos viendo algunos casos en estas \u00faltimas horas, abogada. \u00bfQu\u00e9 pasa si una persona es detenida por ICE? Pero esa persona ya tiene la solicitud de asilo, no tiene antecedentes criminales, tiene su permiso de trabajo activo. \u00bfEsto se considera una detenci\u00f3n arbitraria? \u00bfQu\u00e9 hace usted como abogada cuando se presenta un caso como este?<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nCuando se presenta un caso como este, lo primero que uno tiene que pedir es una fianza para lograr que esa persona salga de detenci\u00f3n y continuar su caso fuera de detenci\u00f3n. Aqu\u00ed hay que analizar porque hay personas que tienen el caso de asilo con la corte y otros que lo tienen con USCIS o con Citizenship and Immigration Services.<br \/>\nEntonces hay que analizar con qui\u00e9n lo tiene. Si el caso est\u00e1 con USCIS y los detienen y los mandan a la corte, es posible que entonces ese caso de asilo ya no contin\u00fae con USCIS sino que va a seguir con la corte. La verdad, cuando una persona entra por la frontera, si esa persona entr\u00f3 por la frontera, el estatuto dice que la persona que entra sin una admisi\u00f3n o sin un parol debe ser detenida. Entonces es posible que esa persona sea detenida mientras dura su proceso de asilo en la corte. Lo que pasa es que hay que tratar de pedir una fianza y le digo la verdad, no est\u00e1 f\u00e1cil pedir fianzas, sobre todo aqu\u00ed en el sur de la Florida, porque los fiscales, que son los que representan al Departamento de Seguridad Nacional y las Cortes de Inmigraci\u00f3n, est\u00e1n oponi\u00e9ndose a esas fianzas.<br \/>\nY una de las cosas que yo he visto como se est\u00e1n oponiendo es que antes de eso le explico, cuando uno presenta una fianza para una persona que es detenida, la ley le exige al abogado probar dos cosas: uno, que la persona no va a ser un peligro para la comunidad y dos, que la persona no tiene riesgo de que se pierda o que se esconda y no se presente a la corte, en ingl\u00e9s se llama &#8220;risk of absconding&#8221;. Entonces nos toca probar esas dos cosas y \u00bfqu\u00e9 es lo que pasa cuando hay una persona que nunca ha tenido un delito, nunca ha sido arrestada, no tiene antecedentes? Obviamente nosotros argumentamos que no es un peligro para la sociedad porque no tiene ning\u00fan r\u00e9cord criminal. Y dos, cuando para probar que no se va a esconder uno muestra que tiene un esposo, que tiene dos hijos, esposa o que muestra el apoyo de su empleador o muestra lo que uno m\u00e1s puede.<br \/>\n\u00bfQu\u00e9 pasa en estos casos? Los argumentos que he visto \u00faltimamente que est\u00e1n haciendo los fiscales de inmigraci\u00f3n es: &#8220;Ah, no, es que miramos la petici\u00f3n de asilo y la petici\u00f3n de asilo es muy d\u00e9bil. Ah\u00ed no hay evidencia, esta persona tiene una gran probabilidad de que no va a triunfar en su caso de asilo. Por lo tanto, un riesgo para tu pa\u00eds. Por lo tanto, esta persona s\u00ed presenta un riesgo de que se esconda y no se presente en el futuro.&#8221; O sea que esas personas que presentaron asilos d\u00e9biles o simplemente la planilla as\u00ed, como nosotros los abogados llamamos el &#8220;bare-bone petition&#8221;, o sea, lo esquel\u00e9tico, lo huesitos nom\u00e1s, esa persona tiene un peligro de que no le den la fianza, diciendo que se va a esconder porque su petici\u00f3n de asilo es d\u00e9bil. Esos son los argumentos que estamos lidiando nosotros los abogados para lograr una fianza.<br \/>\nSi no se logra la fianza, entonces la persona debe continuar defendiendo su caso de asilo en la Corte de Inmigraci\u00f3n bajo detenci\u00f3n.<\/p>\n<p><strong>Eduardo:<\/strong><br \/>\nAbogada Martha Arias, obviamente esta semana entr\u00f3 en vigor la restricci\u00f3n de entrada de viajes a Estados Unidos, esto digamos afecta directamente a pa\u00edses como Afganist\u00e1n, Birmania, Chad, pero hay restricciones para Cuba, para Venezuela espec\u00edficamente, son siete pa\u00edses que tienen restricciones de viaje. \u00bfQu\u00e9 pasa con las personas que ya ten\u00edan un visado que les permit\u00eda entrar a Estados Unidos?<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nLas personas de Cuba y de Venezuela que ya ten\u00edan un visado pueden ingresar a los Estados Unidos si ese visado fue emitido antes de junio 9. No van a tener problema, de pronto es aconsejable que tengan toda la documentaci\u00f3n al d\u00eda y que pronto sepan que pueden experimentar retardos en el ingreso a los Estados Unidos, en su admisi\u00f3n, porque los cuestionar\u00e1n y les har\u00e1n preguntas, pero pueden ingresar. Los que tengan una visa de inmigrante o de no inmigrante, visa de inmigrante de la residencia, la visa emitida por los consulados o una visa de no inmigrante como la visa de turista, la visa de estudiante, la J, la M, que son de estudiantes, pero es pr\u00e1ctico. Ellos tampoco van a poder ingresar si esa visa fue emitida despu\u00e9s de junio 9.<br \/>\nEn Hait\u00ed la limitaci\u00f3n s\u00ed es estricta. Obviously, we argue that they are not a danger to society because they have no criminal record. And to prove they will not abscond, you show they have a spouse, two children, a wife, or employer support, or whatever else you can.<br \/>\nWhat happens in these cases? The arguments I\u2019ve seen lately from immigration prosecutors are, \u201cNo, we look at the asylum petition and the asylum petition is very weak. There\u2019s no evidence, this person has a high probability of not succeeding in their asylum case. Therefore, a risk for your country.
