Now, federal court decisions, such as injunctions, will only apply within their specific state or to the parties involved in the lawsuit, not across the whole country. This shift benefits the current administration and may affect how quickly immigration policies can be challenged in federal courts.<\/p>\n<p>We also discussed President Trump\u2019s recent comments on possibly allowing undocumented immigrants in key industries like agriculture and hospitality to remain in the U.S. under special work permits coordinated by employers. Doctora, muy buenas tardes.<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nMuy buenas tardes, Agust\u00edn. Un saludo para usted y toda la audiencia de Actualidad Radio. Feliz lunes.<\/p>\n<p><strong>Agust\u00edn Acosta:<\/strong><br \/>\nClaro que s\u00ed, igualmente para usted. Doctora, cuando lleg\u00f3 Trump a la Casa Blanca en enero, se manej\u00f3 el tema de que los ni\u00f1os nacidos en Estados Unidos de padres indocumentados o ilegales no pod\u00edan ser considerados ciudadanos de la naci\u00f3n, a pesar del texto que aparece escrito en la Constituci\u00f3n Federal. Inmediatamente se produjeron una serie de demandas y la semana pasada el Tribunal Supremo de Justicia emiti\u00f3 una determinaci\u00f3n sobre esto, pero yo la le\u00ed y me parece que se qued\u00f3 corta la determinaci\u00f3n, no aborda per se el tema de la ciudadan\u00eda de los ni\u00f1os, sino m\u00e1s bien de la capacidad de inmiscuirse de los tribunales federales en el asunto. \u00bfC\u00f3mo lo ve usted?<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nEfectivamente, s\u00ed, Agust\u00edn, as\u00ed mismo es. La Corte Suprema en esta decisi\u00f3n que emiti\u00f3 el viernes pasado no decidi\u00f3 concretamente el punto o el tema legal de si los ni\u00f1os que nacen en Estados Unidos de padres indocumentados van a tener derecho a la ciudadan\u00eda. Ese tema qued\u00f3 todav\u00eda para ser resuelto por la Sala de Apelaciones que est\u00e1 viendo o tocando ese caso. Lo que la Corte Suprema decidi\u00f3 es que las cortes federales o los jueces federales no pueden emitir decisiones que tengan vigencia o aplicaci\u00f3n en todos los Estados Unidos, es decir, en todo el pa\u00eds. En este caso, espec\u00edficamente estamos hablando de una pausa que orden\u00f3 un juez federal a esa orden ejecutiva que no se le pod\u00eda dar la ciudadan\u00eda a las personas nacidas en los Estados Unidos de padres indocumentados. Un juez orden\u00f3 la pausa. La pausa ten\u00eda efecto a nivel nacional, a nivel de todos los Estados Unidos. Entonces, el juez, pues, con esta medida cautelar, lo que hizo fue pausar esto. El gobierno apela, la Sala de Apelaciones, a la Corte Suprema. La Corte Suprema lo que dice es no. Los jueces federales no pueden seguir dando pausas que tengan vigencia en todo el pa\u00eds. Solamente van a tener vigencia esas pausas en el estado y hacia las personas demandantes. Entonces, bueno, esta es una decisi\u00f3n que favorece al gobierno del presidente Trump. Por eso quiere decir que de ahora en adelante, cuando haya una pausa de un juez federal, pues seg\u00fan esta decisi\u00f3n de la Corte Suprema, no va a tener vigencia en todos los Estados Unidos. \u00bfEs alguna ganancia que tiene la administraci\u00f3n actual? Pues que estaba precisamente en contra de que los jueces federales emitieran decisiones de un alcance nacional.<\/p>\n<p><strong>Agust\u00edn Acosta:<\/strong><br \/>\nAmigos, conversamos con la doctora Martha Arias, su tel\u00e9fono es el 305-671-0018. 305-671-0018. Doctora, un tema que hoy tenemos en nuestros titulares, me parece que es interesante porque esto est\u00e1 puramente en el terreno especulativo y a futuro, no hay nada, nada, nada m\u00e1s que un comentario que hizo ayer el presidente Trump durante una entrevista matutina en la cadena Fox. Dijo ayer que considera, que \u00e9l considera una medida que podr\u00eda permitir a los migrantes indocumentados que trabajan en ciertos gremios como la agricultura, la construcci\u00f3n, quedarse en los Estados Unidos con un permiso especial que podr\u00eda ser coordinado por sus empleadores. Y textualmente dijo Trump, aqu\u00ed hay gente muy buena que no ha cometido ning\u00fan delito, que llevan 15 o 20 a\u00f1os trabajando en industrias que me dicen, o sea, dice Trump, que me dicen que no los pueden reemplazar con personas que son ciudadanos y por lo tanto tienen un papel importante en nuestra econom\u00eda y podr\u00edamos, siempre y cuando los empleadores garanticen que no han cometido delito alguno, buscarle una forma para que se queden aqu\u00ed. M\u00e1s o menos, ese fue el comentario que hizo ayer el presidente. Pero creo que pues abre una puerta, tal vez a acomodar a muchas personas que en este momento est\u00e1n en peligro.<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nEfectivamente, eso abre una puerta para todas esas personas porque usted ha visto que el miedo se ha apoderado de la gente, la gente tiene miedo que la detengan, m\u00e1s que la manden a un tercer pa\u00eds al cual no conocen ni siquiera la lengua, no tengan arraigo. Y ahora que se est\u00e1 hablando de esta construcci\u00f3n de esta nueva c\u00e1rcel aqu\u00ed en el condado de Miami-Dade County, pues la gente todav\u00eda tiene m\u00e1s miedo. Entonces esto est\u00e1 ocasionando que sobre todo los negocios que se dedican a la agricultura o los negocios que llaman \u201chospitality business\u201d, estos negocios est\u00e1n sufriendo una escasez de personal y esto podr\u00eda traducirse pues en aumento tambi\u00e9n de los precios, porque pues estas personas normalmente son personas que est\u00e1n dispuestas a trabajar por un salario m\u00e1s bajo. Entonces este anuncio del gobierno dar\u00eda un alivio a ese sector hospitalario y al sector de la agricultura. Esperamos que el presidente pues emita una protecci\u00f3n para estos, para este sector. Vamos a ver. Esto lo anunci\u00f3 \u00e9l y bueno, como todos sabemos, \u00e9l cuando anuncia una cosa es porque ya la tiene en mente cumplir, entonces ojal\u00e1 pues que podamos tener este beneficio.<\/p>\n<p><strong>Agust\u00edn Acosta:<\/strong><br \/>\nClaro que s\u00ed. Y por \u00faltimo, hay otra decisi\u00f3n que tambi\u00e9n afecta a las personas de Hait\u00ed. La noticia dec\u00eda que era medio mill\u00f3n. Yo no creo que haya medio mill\u00f3n de haitianos en los Estados Unidos. A lo mejor yo estoy equivocado. Me parece que son menos personas de Hait\u00ed pero perder\u00edan entonces el tratado de protecci\u00f3n temporal?<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nS\u00ed, perder\u00edan el tratado de protecci\u00f3n temporal a partir de septiembre 2 de este a\u00f1o. Todos los haitianos, el gobierno anunci\u00f3 que no va a renovar el TPS de Hait\u00ed y pues es una gran pena porque tambi\u00e9n sabemos que es un pa\u00eds que tiene muchos problemas, que no se ha podido recuperar de la situaci\u00f3n del terremoto. Y bueno, tambi\u00e9n sabemos que hay problemas de corrupci\u00f3n, que es lo que ayuda a que no se puedan recuperar. Pero, pues, definitivamente el gobierno anunci\u00f3, s\u00ed, se dice que son aproximadamente 500.000 haitianos que se quedar\u00edan sin ese estatus de protecci\u00f3n temporal. Acu\u00e9rdense que ya venimos con varios a\u00f1os renov\u00e1ndose y extendi\u00e9ndose este TPS de personas de Hait\u00ed. Entonces, en septiembre 2 de este a\u00f1o 2025 se les terminar\u00eda el TPS a los haitianos.<\/p>\n<p><strong>Agust\u00edn Acosta:<\/strong><br \/>\nEn cuanto al TPS de los venezolanos y al TPS de los cubanos que le permitir\u00eda a ciertos cubanos despu\u00e9s de un a\u00f1o y un d\u00eda poder entrar por la Ley de Ajuste Cubano, \u00bfha habido alg\u00fan cambio desde la \u00faltima vez que hablamos?<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nNo, no ha habido ning\u00fan cambio. El TPS de Venezuela del 2021 tambi\u00e9n est\u00e1 supuesto a vencer el 10 de septiembre de este a\u00f1o 2025. No ha habido ning\u00fan cambio o ning\u00fan anuncio acerca de esto. Para el 12 de julio se espera, seg\u00fan la ley, es lo normal que se anuncie si se va a extender o no. Vamos a ver cu\u00e1l es la respuesta.<\/p>\n<p><strong>Agust\u00edn Acosta:<\/strong><br \/>\nSi no interviene el gobierno de manera contraria y no dicen nada, \u00bfse volver\u00eda a extender por un a\u00f1o m\u00e1s autom\u00e1ticamente?<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nEs correcto. Si no se anuncia la extensi\u00f3n del TPS, no se dice nada, ni se termina, ni se dice nada, es una extensi\u00f3n autom\u00e1tica de seis meses seg\u00fan la ley. Si el gobierno lo termina, definitivamente como lo hizo ahora con Hait\u00ed, pues se termina. Pero pues vamos a esperar a ver cu\u00e1l es la decisi\u00f3n: si lo termina, si no dice nada o si lo extiende.
