This decision affects around 72,000 Hondurans and 4,000 Nicaraguans currently living and working legally in the United States. Unless there\u2019s a new legal challenge, these TPS protections will expire 60 days after publication in the Federal Register, leaving many in a difficult legal limbo.<\/p>\n<p>We also discussed the uncertainty surrounding the automatic renewal of Venezuelan TPS and work permits, with key dates coming up in July and September. As of now, if no government action is taken, regulations call for a six-month automatic extension. However, with today\u2019s ever-changing landscape, I expect new announcements soon.<\/p>\n<p>Perhaps the most significant development is the signing of the new federal budget, known as the \u201cBig Beautiful Bill.\u201d This law brings <strong>the largest fee increases in decades for nearly all major immigration applications and processes<\/strong>, including asylum, TPS, work permits, and more. For example:<\/p>\n<ul>\n<li>Asylum application: $1,000 (plus $100 for every year pending over one year)<\/li>\n<li>Work permit through asylum: $550 for the initial application; $275 for renewals<\/li>\n<li>TPS application: $500 (up from $85)<\/li>\n<li>Humanitarian parole: $1,000<\/li>\n<li>Special Immigrant Juvenile (SIJ) application: $250<\/li>\n<li>Sponsor for SIJ: $3,500\u2013$5,000<\/li>\n<li>Failure to attend immigration court: $5,000 fine<\/li>\n<li>Appeal to Board of Immigration Appeals: $900<\/li>\n<li>Green card application: $1,500 (previously $1,440)<\/li>\n<li>Waivers: $1,050 (previously $930)<\/li>\n<li>5% tax on money sent abroad (remittances) starting January 2026<\/li>\n<\/ul>\n<p>The new law also provides billions in additional funding for immigration enforcement, border infrastructure, and the hiring of 10,000 new ICE agents.<\/p>\n<p>If you or your loved ones are affected by any of these changes, now is the time to consult with a qualified immigration attorney. Pero ahora vamos a hablar de inmigraci\u00f3n, como siempre hacemos cada lunes a esta hora con la abogada Martha Arias. Doctora, muy buenas tardes.<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nMuy buenas tardes, Agust\u00edn. Un saludo para usted. Feliz comienzo de semana despu\u00e9s de este fin de semana largo.<\/p>\n<p><strong>Agustin Acosta:<\/strong><br \/>\nClaro que s\u00ed, doctora. Hay una noticia hoy que no es nada buena para hondure\u00f1os y para nicarag\u00fcenses. Yo conozco particularmente el caso de un se\u00f1or que vive, trabaja, se ha comportado impecablemente en cuanto a conducta ac\u00e1 en los Estados Unidos desde que lleg\u00f3 en 1998. Hasta ahora ha tenido una protecci\u00f3n del TPS. Yo no s\u00e9 si la protecci\u00f3n que \u00e9l particularmente tiene fue otorgada despu\u00e9s del paso del hurac\u00e1n Mitch. Me parece que algunas personas de Centroam\u00e9rica fueron beneficiadas por el paso de aquel hurac\u00e1n que dej\u00f3 tantos miles de muertos. Hay otras personas que son nicarag\u00fcenses que tambi\u00e9n han tenido alg\u00fan tipo de persecuci\u00f3n pol\u00edtica. La medida, seg\u00fan la informaci\u00f3n que aparece hoy publicada en la prensa americana, es que va a ser la suspensi\u00f3n del TPS para hondure\u00f1os y nicarag\u00fcenses. Afectar\u00eda a 72,000 hondure\u00f1os y 4,000 nicarag\u00fcenses. Cu\u00e9ntenos un poco qu\u00e9 es lo que se sabe dentro del mundo donde usted se desenvuelve.<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nS\u00ed, efectivamente, la secretaria del Departamento de Seguridad Nacional, se\u00f1ora Cristina Om, dijo el d\u00eda de hoy, 7 de julio de este a\u00f1o 2025, que el TPS de Nicaragua y Honduras que va a expirar o que expirar\u00eda \u2014 ya expir\u00f3 el 5 de julio \u2014 queda terminado y esto ser\u00e1 efectivo 60 d\u00edas despu\u00e9s de la publicaci\u00f3n en el registro federal. La publicaci\u00f3n en el registro federal, pues me imagino que es hoy mismo, 7 de julio. Quiere decir que en 60 d\u00edas, pues ya no tendr\u00edan este estatus legal. A no ser que haya, como sabemos que siempre aparece por ah\u00ed alguna demanda que ponga pausa a este TPS. Lo que aduce el Departamento de Seguridad Nacional es que el TPS no estaba supuesto a durar 25 a\u00f1os, que es lo que dicen ellos, un cuarto de siglo, y que ha durado esto, y esto fue a ra\u00edz, como usted dijo, del desastre natural que impact\u00f3 a estos pa\u00edses en 1999. Ellos dicen que la raz\u00f3n de ese desastre natural, que fue lo que lo origin\u00f3, ya no existe.<\/p>\n<p><strong>Agustin Acosta:<\/strong><br \/>\nNo hay ninguna forma, bajo la ley actual de inmigraci\u00f3n, que esto se pueda convertir a una residencia, \u00bfverdad?<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nNo. Las personas que ten\u00edan TPS y lograron, por ejemplo, muchos de mis clientes que lograron tener una residencia es porque viajaron, por ejemplo, con el TPS, volvieron a entrar y sus hijos o c\u00f3nyuges ciudadanos americanos hab\u00edan hecho alguna petici\u00f3n por ellos. Entonces, lograban ajustar el estatus a trav\u00e9s de esa petici\u00f3n familiar y tal vez, pues, haciendo ese viaje, algunos que hab\u00edan entrado tal vez ilegal antes de recibir el TPS.<br \/>\nOtros hab\u00edan entrado con visa, pues lo pod\u00edan hacer apenas sus hijos cumpl\u00edan 21 a\u00f1os. Entonces, pues, la verdad, los pocos que queden con TPS que no hayan podido ajustar su estatus son personas que no tuvieron hijos o nunca se casaron con ciudadano americano y pues el TPS continu\u00f3 siendo su \u00fanica salvaci\u00f3n migratoria. Ahora van a quedar en este limbo jur\u00eddico porque, de no existir una demanda que pause esta decisi\u00f3n, pues va a quedar terminado porque el gobierno s\u00ed lo puede terminar, obviamente.<\/p>\n<p><strong>Agustin Acosta:<\/strong><br \/>\nMartha Arias, amigos, aprovecho en lo que vamos a tratar de recuperar la llamada, darles el tel\u00e9fono de la doctora Arias por si alguno de ustedes necesita una buena representaci\u00f3n legal o asesor\u00eda legal en materia de inmigraci\u00f3n. Ya la tenemos, doctora.<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nS\u00ed, efectivamente, pues como le dec\u00eda, es un procedimiento regular que estos TPS se aprueben o se terminen y el gobierno s\u00ed tiene la autoridad de hacerlo, previo seguimiento a la regulaci\u00f3n, como en este caso es anunciarlo en el Registro Federal por 60 d\u00edas antes. O sea, en otras palabras, se les da como un per\u00edodo de gracia de 60 d\u00edas para las personas, para tomar su decisi\u00f3n de salir del pa\u00eds si no tienen otro remedio para permanecer.<\/p>\n<p><strong>Agustin Acosta:<\/strong><br \/>\nDoctora, la \u00faltima vez que conversamos, o tal vez la pen\u00faltima vez, usted nos hablaba del caso particular de los venezolanos que ten\u00edan un permiso de trabajo que expiraba en cierta fecha y usted nos dijo si el gobierno no interviene, viene una renovaci\u00f3n autom\u00e1tica. \u00bfDe qu\u00e9 fecha estamos hablando espec\u00edficamente y en qu\u00e9 estatus est\u00e1 eso?<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nLa fecha es 12 de julio. Ya estamos acerc\u00e1ndonos.<\/p>\n<p><strong>Agustin Acosta:<\/strong><br \/>\n12 de julio. 12 ya es este fin de semana.<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nCorrecto. O sea que para este fin de semana debemos estar esperando otra noticia sobre el TPS de Venezuela.<\/p>\n<p><strong>Agustin Acosta:<\/strong><br \/>\nSi el gobierno no hace nada y esto se renueva, \u00bfse renueva por un a\u00f1o?<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nSeis meses, seis meses. Si el gobierno no dice nada, la regulaci\u00f3n dice que autom\u00e1ticamente se renueva por seis meses y no creo que el gobierno de esta administraci\u00f3n se vaya a quedar en silencio. Algo ir\u00e1n a decir.<\/p>\n<p><strong>Agustin Acosta:<\/strong><br \/>\nOk, este particular permiso de trabajo. \u00bfCu\u00e1ndo es que se vencer\u00eda, en septiembre?<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nEn septiembre, el 9 de septiembre para algunos, el 6 de septiembre he visto tambi\u00e9n, otros se les vence el 6 de septiembre. Pero s\u00ed, definitivamente los primeros d\u00edas de septiembre es que se vence este permiso de trabajo y el TPS de Venezuela.<\/p>\n<p><strong>Agustin Acosta:<\/strong><br \/>\nO sea, si se renovara, entonces se renovar\u00eda hasta el mes de marzo del a\u00f1o entrante.<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nCorrecto.<\/p>\n<p><strong>Agustin Acosta:<\/strong><br \/>\n\u00bfAlguna otra cosa que haya en este momento en v\u00edas judiciales, demandas, contrademandas, procesos de apelaciones que tenga una incidencia sobre inmigraci\u00f3n?<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nBueno, hay algo que me parece importante resaltar. Esto yo creo que ser\u00eda una de las noticias m\u00e1s importantes del d\u00eda de hoy lunes. Despu\u00e9s de que el 4 de julio el presidente ya firm\u00f3 como ley el &#8220;Big Beautiful Bill&#8221;, este bill sobre el presupuesto de los Estados Unidos.<br \/>\n\u00bfQu\u00e9 es lo que contiene esa ley para el tema migratorio? Varias cosas. La primera es un aumento de ciertas tarifas. Le voy a decir unas cuantas nom\u00e1s, que me parecen las m\u00e1s importantes.<br \/>\nLas personas de ahora en adelante, y esto toma efecto el mismo d\u00eda 4 de julio de este a\u00f1o, que es cuando el presidente lo firma. As\u00ed lo dice en la ley. O sea que desde el 4 de julio entra en vigencia.<br \/>\nEsto lo que pasa es que si migraci\u00f3n nos va a tener que anunciar y pues si van a permitir que peticiones que nosotros ya hab\u00edamos enviado antes de que el bill fuera aprobado y que tal vez llegan esta semana nos van a dar ese per\u00edodo de gracia o si van a devolver esas peticiones.<br \/>\nUn ejemplo, peticiones de asilo que anteriormente no se cobraban, van a cobrar $1,000 d\u00f3lares para las personas que apliquen para asilo, $1,000 d\u00f3lares. Si el asilo contin\u00faa pendiente por m\u00e1s de un a\u00f1o, van a cobrar $100 d\u00f3lares por cada a\u00f1o que el asilo est\u00e9 pendiente. Entonces, si una persona tiene un asilo pendiente por 10 a\u00f1os, pues son 10 a\u00f1os pagando $100 d\u00f3lares al a\u00f1o.<br \/>\nEl permiso de trabajo por el asilo, el primer permiso de trabajo va a costar $550 d\u00f3lares. Hoy en d\u00eda el primer permiso de trabajo que se otorga a trav\u00e9s del asilo no tiene costo, pero a partir del 4 de julio de este a\u00f1o 2025, va a costar $550 d\u00f3lares. Y las renovaciones van a costar $275 d\u00f3lares.<\/p>\n<p><strong>Agustin Acosta:<\/strong><br \/>\nLas renovaciones son manuales.<\/p>\n<p><strong>Abogada Martha Arias:<\/strong><br \/>\nEn cada dos a\u00f1os, normalmente 18 meses, porque es lo que normalmente al TPS, 18 meses.<br \/>\nEl TPS, hoy en d\u00eda, se pagan $85 d\u00f3lares, que es lo que cuestan las huellas. Van a cobrar $500 d\u00f3lares para el TPS. No s\u00e9 cu\u00e1les ser\u00e1n los TPS que van a sobrevivir, pero bueno, pusieron una tarifa de $500 d\u00f3lares para el TPS y tambi\u00e9n $550 para la petici\u00f3n del permiso de trabajo inicial con TPS.<br \/>\nLa persona que vaya a pedir un parol, por ejemplo, los cubanos que estaban entrando por la frontera, que nosotros les ped\u00edamos los abogados el parol sea ante ICE y Miramar o el parol que ped\u00edamos, por ejemplo, el de los militares, no ten\u00eda ning\u00fan costo, pero ahora este parol humanitario va a tener un costo de $1,000 d\u00f3lares, tambi\u00e9n bastante alto.<br \/>\nLos ni\u00f1os, las aplicaciones para el Estatus Especial de Inmigrante Juvenil, que es la SIJ, que son los ni\u00f1os que entran sin compa\u00f1\u00eda por la frontera, no ten\u00edan fee, ahora van a tener un fee de $250 d\u00f3lares. Si alguien quiere patrocinar o ser el sponsor de un ni\u00f1o, va a tener que pagar de $3,500 a $5,000 d\u00f3lares. Mientras que, o el profesional calificado que tiene maestr\u00edas, el ingeniero o el m\u00e9dico, esa persona que tiene una experiencia y est\u00e1 calificado. Yo pienso que los trabajos que quedan como en la mitad. Por ejemplo, un trabajo que es muy t\u00edpico, un abogado de otra parte, un abogado aqu\u00ed necesita la licencia para trabajar y aunque est\u00e9 trabajando para otro abogado haciendo cierto tipo de labor, a veces es muy dif\u00edcil conseguirle lograr una certificaci\u00f3n laboral a no ser que est\u00e9 en un nicho espec\u00edfico de la ley. Y hay ciertas ocupaciones as\u00ed, entonces depende del caso, depende de la persona.<br \/>\nTambi\u00e9n depende del tiempo que la persona lleva aqu\u00ed en los Estados Unidos y si estuvo ilegal o no. Yo he tenido personas que vienen a mi oficina y, por ejemplo, nunca aplicaron para asilo y aplicaron para el TPS despu\u00e9s de que sali\u00f3, pero despu\u00e9s de dos o tres a\u00f1os de estar sin estatus.<br \/>\nA esa persona yo le digo, la verdad, no vale la pena que haga una certificaci\u00f3n laboral porque, as\u00ed le aprueben la certificaci\u00f3n laboral y le aprueben la I-140, que es la petici\u00f3n que se hace ante inmigraci\u00f3n despu\u00e9s de que le aprueban esa certificaci\u00f3n laboral, si la persona no va a poder recibir la residencia aqu\u00ed dentro del pa\u00eds, va a tener que salir. Pero hay gente que no tiene el castigo porque estuvo o en un asilo o con el TPS o estuvo en un estatus que lo protegi\u00f3 de acumular esa presencia ilegal, que es lo que sanciona la ley, la presencia ilegal.<br \/>\nEntonces, cada caso por eso se debe analizar. Yo tengo, por ejemplo, venezolanos, tengo varios muy calificados, personas venezolanas que est\u00e1n trabajando para compa\u00f1\u00edas muy reputables, con una experiencia buen\u00edsima, que est\u00e1n dispuestos a hacer ese proceso, pero tienen que salir del pa\u00eds, pero nunca acumularon presencia ilegal porque ten\u00edan asilo y despu\u00e9s TPS, entonces siempre se protegieron de no acumular presencia ilegal.<br \/>\nEsas personas pueden salir, pero hay otras que no. Happy start to the week after this long weekend.<\/p>\n<p><strong>Agustin Acosta:<\/strong><br \/>\nOf course, attorney. There is news today that is not good at all for Hondurans and Nicaraguans. I know particularly the case of a gentleman who lives, works, and has behaved impeccably regarding conduct here in the United States since he arrived in 1998. Until now he has had TPS protection. I don\u2019t know if the protection he particularly has was granted after Hurricane Mitch. It seems to me that some people from Central America were benefited because of that hurricane that left so many thousands dead. There are other people who are Nicaraguans who have also suffered some type of political persecution. The measure, according to the information published today in the American press, is that TPS for Hondurans and Nicaraguans will be suspended. It would affect 72,000 Hondurans and 4,000 Nicaraguans. Tell us a bit about what is known within the world in which you work.<\/p>\n<p><strong>Attorney Martha Arias:<\/strong><br \/>\nYes, indeed, the Secretary of the Department of Homeland Security, Mrs. Kristi Noem, said today, July 7, this year 2025, that TPS for Nicaragua and Honduras, which will expire or would have expired \u2014 already expired July 5 \u2014 is ended and this will be effective 60 days after the publication in the Federal Register. The publication in the Federal Register, I imagine, is today, July 7. That means in 60 days, they would no longer have this legal status. Unless, as we know always seems to appear, there is a lawsuit that pauses this TPS. What the Department of Homeland Security argues is that TPS was not supposed to last 25 years, which is what they say, a quarter of a century, and that it has lasted this long, and this was due, as you said, to the natural disaster that impacted these countries in 1999. They say that the reason for that natural disaster, which was the origin, no longer exists.<\/p>\n<p><strong>Agustin Acosta:<\/strong><br \/>\nThere is no way, under current immigration law, that this could be converted to a green card, correct?<\/p>\n<p><strong>Attorney Martha Arias:<\/strong><br \/>\nNo. People who had TPS and managed, for example, many of my clients who managed to get residency, it was because they traveled, for example, with TPS, re-entered, and their children or American citizen spouses had filed petitions for them. So, they managed to adjust status through that family petition and perhaps, by making that trip, some who had maybe entered illegally before receiving TPS.<\/p>\n<p>Others had entered with a visa, so they could do it as soon as their children turned 21. So, truly, the few who remain with TPS and haven\u2019t been able to adjust their status are people who didn\u2019t have children or never married an American citizen, and so TPS continued being their only migratory salvation. Now they will be left in this legal limbo because, unless there is a lawsuit that pauses this decision, it will be ended, because the government can, obviously, end it.<\/p>\n<p><strong>Agustin Acosta:<\/strong><br \/>\nMartha Arias, friends, I\u2019ll take the opportunity as we try to recover the call to give you the phone number of attorney Arias in case any of you need good legal representation or legal advice on immigration matters. What specific date are we talking about and what is the status of that?<\/p>\n<p><strong>Attorney Martha Arias:<\/strong><br \/>\nThe date is July 12. We\u2019re getting close.<\/p>\n<p><strong>Agustin Acosta:<\/strong><br \/>\nJuly 12. 12 is already this weekend.<\/p>\n<p><strong>Attorney Martha Arias:<\/strong><br \/>\nCorrect. So, for this weekend, we should be expecting other news about TPS for Venezuela.<\/p>\n<p><strong>Agustin Acosta:<\/strong><br \/>\nIf the government does nothing and this renews, does it renew for a year?<\/p>\n<p><strong>Attorney Martha Arias:<\/strong><br \/>\nSix months, six months. If the government says nothing, the regulation says it\u2019s automatically renewed for six months, and I don\u2019t think this administration\u2019s government will remain silent. They\u2019ll say something.<\/p>\n<p><strong>Agustin Acosta:<\/strong><br \/>\nOk, this particular work permit. When does it expire, in September?<\/p>\n<p><strong>Attorney Martha Arias:<\/strong><br \/>\nIn September, September 9 for some, September 6 for others, I\u2019ve seen. I think this would be one of the most important news items today, Monday. After July 4, the president signed into law the &#8220;Big Beautiful Bill,&#8221; this bill on the U.S. budget.<\/p>\n<p>What does that law contain for the immigration issue? Several things. The first is an increase in certain fees. I\u2019ll mention just a few, which seem most important to me. From now on, and this takes effect on July 4 of this year, which is when the president signed it. That\u2019s what the law says. So, from July 4, it\u2019s in effect. The thing is that immigration will have to announce if they will allow petitions we already sent before the bill was approved and that maybe arrive this week, whether they\u2019ll give us that grace period or return those petitions.<\/p>\n<p>An example: asylum petitions that previously were not charged a fee will now cost $1,000 for people who apply for asylum, $1,000. If the asylum remains pending for more than a year, they will charge $100 for each year the asylum is pending. So, if a person has an asylum pending for 10 years, it\u2019s 10 years paying $100 per year.<\/p>\n<p>The work permit for asylum, the first work permit, will cost $550. Today, the first work permit through asylum is free, but as of July 4, 2025, it will cost $550. Renewals will cost $275.<\/p>\n<p><strong>Agustin Acosta:<\/strong><br \/>\nRenewals are manual.<\/p>\n<p><strong>Attorney Martha Arias:<\/strong><br \/>\nEvery two years, normally 18 months, because normally TPS is 18 months. TPS, today, costs $85, which is the fingerprint fee. They will now charge $500 for TPS. I don\u2019t know which TPS will survive, but anyway, they set a fee of $500 for TPS and also $550 for the initial work permit request with TPS. People who want to request parole, for example, Cubans who were entering at the border, we lawyers used to request parole at ICE in Miramar or, for example, parole for the military, had no cost, but now this humanitarian parole will cost $1,000, also quite high.<\/p>\n<p>Children, applications for Special Immigrant Juvenile Status, SIJ, which are children who enter unaccompanied at the border, had no fee, now will have a fee of $250. If someone wants to sponsor a child, they will have to pay from $3,500 to $5,000. For example, that child enters at the border, there\u2019s a sponsor willing to be the sponsor so the child is let in, they will have to pay that money. This, which seemed very important to me: the person who fails to attend or doesn\u2019t show up to an Immigration Court appointment will be charged $5,000 for not attending that immigration appointment, quite high, as a fine.<\/p>\n<p>Well, and there are other fee increases, for example, today, when someone appeals to the appeals board, for example, loses an asylum case and appeals to the appeals board, which is the Board of Immigration Appeals. Today the fee was like two hundred something, one hundred something. And not knowing&#8230;<\/p>\n<p><strong>Attorney Martha Arias:<\/strong><br \/>\nAnd knowing where they\u2019re going because it\u2019s not like they\u2019ll just go out in the street to see who they run into to deport. Those deportations will also be, obviously, thought out, planned, knowing where they\u2019ll arrive, who they\u2019ll pick up. For this there is a special fund to hire 10,000 more ICE agents.<br \/>\nSo, the bill signed by the president, the &#8220;Big Beautiful Bill,&#8221; which is now law, has these two important things for immigration: increase in the immigration budget and fee increases. Agustin, I think it\u2019s important to say this today, Monday, this was signed Friday, people were still resting from the weekend, but today we have this important news for listeners.<\/p>\n<p><strong>Agustin Acosta:<\/strong><br \/>\nSince the process started in January, have you seen in your office any increase in labor certifications, that is, people who have been here with parole, TPS, or some other migratory figure?<\/p>\n<p><strong>Attorney Martha Arias:<\/strong><br \/>\nI have seen more consultations, yes.<\/p>\n<p><strong>Agustin Acosta:<\/strong><br \/>\nBut the issue of labor certifications, is it an uphill struggle or is it truly something that could be a channel for some people to seek regularization?<\/p>\n<p><strong>Attorney Martha Arias:<\/strong><br \/>\nFor some people it could be a channel, it\u2019s an option. But it doesn\u2019t apply to everyone, because, see, I always tell people that there are tasks, for example, low-skill, which are people who don\u2019t need much education or experience, but yes, even if low-skill, nobody wants to do that work. For example, agricultural work. Jobs where there\u2019s no training, not much study needed, but nobody wants to put up with ten hours in the Florida sun, with humidity, mosquitoes, picking tomatoes or crops. So, that type of person, even though it\u2019s low-skill, can maybe, if they have a job offer and all, obtain a benefit. While, or the highly qualified professional who has a master\u2019s, engineer, or doctor, that person who has experience and is qualified. I think the jobs that are in the middle.<\/p>\n<p>For example, a very typical job, a lawyer from another country, a lawyer here needs a license to work and even if working for another lawyer doing certain work, sometimes it\u2019s very hard to get them a labor certification unless they are in a very specific legal niche. And there are certain occupations like that, so it depends on the case, the person. Also depends on how long the person has been in the U.S. and if they were illegal or not. I\u2019ve had people come to my office who, for example, never applied for asylum and applied for TPS after it came out, but after two or three years of being without status. To that person I say, honestly, it\u2019s not worth it to get a labor certification, because even if they approve it and approve the I-140, which is the petition made to immigration after they approve that labor certification, if the person cannot get their green card here, they\u2019ll have to leave. But since they were over a year illegal, they\u2019ll be subject to a penalty of 10 years not being able to enter.<\/p>\n<p>So, they\u2019ll spend a lot of money on that labor certification and on the I-140, which we\u2019re talking about more than $15,000 between lawyers and fees, for what? To reach a dead end and have to leave for 10 years and what employer will wait 10 years. So, I tell them, but there are innocent people who fall into not very honest hands, where they don\u2019t explain and just say, sure, I\u2019ll do those steps, but they know you\u2019ll reach a dead end, and when you get to the dead end they say, oh, sorry, look. So that\u2019s why I always tell people, ask well, because not everyone can get a labor certification. And even if they get it, it\u2019s not always possible to get a green card.<\/p>\n<p><strong>Agustin Acosta:<\/strong><br \/>\nYes, because of illegality, right?
