			<p>During the interview, we discussed what has been publicly reported about a large enforcement operation in Florida known as “Tidal Wave,” which has been associated with more than 10,000 arrests according to what has been reported in the news. We also discussed reports of increased ICE presence in Central Florida and Orlando beginning around January 20, 2026, including comments publicly attributed to <span style="text-decoration: underline;"><a href="https://www.fox35orlando.com/news/congressman-maxwell-frost-warns-possible-ice-presence-orlando" target="_blank" rel="noopener">Congressman Maxwell Frost</a></span>.</p>
<p>I also shared national-level data attributed to the <span style="text-decoration: underline;"><a href="https://map.americanimmigrationcouncil.org/locations/national/" target="_blank" rel="noopener">American Immigration Council</a></span>, including reported increases in ICE detentions and detention capacity trends. While many public conversations focus on individuals with criminal histories, I emphasized that there are also reports indicating a significant increase in detentions of people without criminal offenses, which raises serious concerns for families who are simply trying to live and work while they pursue lawful options.</p>

			<h3>What happens if someone is detained and has no criminal record?</h3>
<p>One of the most important points I made is that every case is different. When someone is detained, the first legal question is often whether that person can request a bond—and whether an immigration judge will be recognized as having jurisdiction to consider that bond request. Factors like how the person entered the United States (with a visa, with parole, or without inspection) can affect the options available.</p>
<p>We also discussed a tool that may be used in certain situations: habeas corpus, a federal court filing that can challenge detention that is unlawful or unreasonably prolonged. Federal litigation is complex, costly, and highly procedural. Even so, in certain detention cases it may be one of the few meaningful pathways to request review.</p>

			<h3>A serious issue: reports of a DHS memo about home entry</h3>
<p>Orian also raised a topic that has concerned many people: reports of a Department of Homeland Security memorandum suggesting that ICE officers could enter residences to make arrests without a federal judge’s warrant, relying on an administrative form (often discussed as an <span style="text-decoration: underline;"><a href="https://www.ice.gov/sites/default/files/documents/Document/2017/I-205_SAMPLE.PDF" target="_blank" rel="noopener">I-205</a></span>). In the interview, I explained the crucial difference between an administrative document for arrest versus a judge-signed warrant for entering a home. I also shared that, according to what I read, the memo reportedly was not applied in part of Central California due to litigation there.</p>

As an immigration law attorney practicing in this complex field, it is crucial to understand the foundation and scope of these new rules, which revive country-specific restrictions targeting deficiencies in governmental cooperation and perceived security risks.</p>
<p>The stated policy objective is clear: to <strong>protect United States citizens</strong> from foreign nationals who may intend to commit terrorist attacks, threaten national security, espouse hateful ideology, or otherwise exploit U.S. immigration laws for malevolent purposes.

			<h2>The Legal Foundation and Rationale for the Restrictions</h2>
<p>These measures are imposed under the authority of <strong>sections <a href="https://uscode.house.gov/view.xhtml?req=granuleid:USC-prelim-title8-section1182&amp;num=0&amp;edition=prelim" target="_blank" rel="noopener">212(f)</a> and <a href="https://uscode.house.gov/view.xhtml?req=granuleid:USC-prelim-title8-section1185&amp;num=0&amp;edition=prelim" target="_blank" rel="noopener">215(a)</a> of <a href="https://www.uscis.gov/laws-and-policy/legislation/immigration-and-nationality-act" target="_blank" rel="noopener">the Immigration and Nationality Act (INA)</a></strong>. The administration asserts that these steps are necessary because the U.S. Government <strong>lacks sufficient information to assess the risks</strong> posed by foreign nationals from the designated countries.</p>
<p>A critical component of the Proclamation is the directive for the United States to encourage foreign governments to <strong>improve their information-sharing and identity-management protocols and practices</strong>.</p>
<p>The restrictions are based on a joint report submitted by the Secretary of State, the Attorney General, the Secretary of Homeland Security, and the Director of National Intelligence. This assessment considered several factors when determining which countries warranted suspension:</p>
<ol>
<li><strong>Screening and Vetting Capabilities</strong>.</li>
<li><strong>Information Sharing Policies</strong>.</li>
<li><strong>Country-Specific Risk Factors</strong>, including a significant terrorist presence.</li>
<li><strong>Visa-Overstay Rate</strong>.</li>
<li><strong>Cooperation with Accepting Back Removable Nationals</strong>.</li>
</ol>
<p>The Proclamation specifically notes that immigrants (who become Lawful Permanent Residents) are more difficult to remove, increasing the dangers associated with errors when their home countries maintain inadequate identity-management or information-sharing policies.</p>

			<h3>Tier 2: Partial Suspension of Entry (7 Countries)</h3>
<p>For the following seven countries, the entry of nationals as <strong>immigrants is suspended</strong>, and the entry of nationals as <strong>nonimmigrants is suspended specifically for B-1, B-2, B-1/B-2, F, M, and J visas</strong>.</p>
<p>Furthermore, consular officers are directed to <strong>reduce the validity</strong> for any other nonimmigrant visa issued to nationals of these partially restricted countries (such as H or L visas), to the extent permitted by law.</p>
<p>The partially restricted countries are: Burundi, Cuba, Laos, Sierra Leone, Togo, Turkmenistan, and Venezuela. (Note that Cuba is also identified as a state sponsor of terrorism and fails to share sufficient law enforcement information).</p>

			<h2>Practical Application: Who is Affected and When?</h2>
<p>The Proclamation is effective as of <strong>June 9, 2025, at 12:01 am eastern daylight time</strong>.</p>
<p>Crucially, the suspensions apply <strong>only</strong> to foreign nationals of the designated countries who are:</p>
<ol>
<li><strong>Outside the United States</strong> on the effective date.</li>
<li><strong>Do not have a valid visa</strong> on the effective date.</li>
</ol>
<p>This means that <strong>no immigrant or nonimmigrant visa issued before the applicable effective date shall be revoked</strong> pursuant solely to this proclamation. If a client holds a valid visa, they are generally protected from having that specific visa canceled under these new rules.</p>
<h3>Navigating Exceptions and Waivers</h3>
<p>For those advising clients from these 19 countries, the exceptions offer the best path forward. The restrictions <strong>do not apply</strong> to several key groups:</p>
<ul>
<li><strong>Lawful Permanent Residents (LPRs)</strong> of the United States.</li>
<li><strong>Dual nationals</strong> traveling on a passport issued by a non-designated country.</li>
<li>Immediate Family Immigrant Visas (<strong>IR-1/CR-1, IR-2/CR-2, IR-5</strong>), provided there is clear and convincing evidence of identity and family relationship (e.g., DNA).</li>
<li><strong>Adoptions</strong> (IR-3, IR-4, IH-3, IH-4).</li>
<li>Afghan Special Immigrant Visas.</li>
<li>Immigrant visas for <strong>ethnic and religious minorities facing persecution in Iran</strong>.</li>
<li>Specific official/international organization visas (A-1, A-2, C-2, C-3, G-1, G-2, G-3, G-4, NATO categories).</li>
</ul>
<p>Beyond these blanket exceptions, the Proclamation establishes mechanisms for <strong>discretionary, case-by-case waivers</strong>:</p>
<ul>
<li>The <strong>Secretary of State</strong> may grant an exception if the individual’s travel would serve a <strong>United States national interest</strong>.</li>
<li>The <strong>Attorney General</strong> may grant an exception if the travel would advance a <strong>critical United States national interest involving the Department of Justice</strong>, such as the presence of witnesses in criminal proceedings.</li>
</ul>
<p>Finally, it is paramount to remember that these restrictions <strong>do not limit the ability of an individual to seek asylum, refugee status, withholding of removal, or protection under the Convention Against Torture (CAT)</strong>, consistent with U.S. laws.</p>

			<p>First, two federal judges, one in Colorado and another in New York, have ruled that using <a href="https://www.whitehouse.gov/presidential-actions/2025/03/invocation-of-the-alien-enemies-act-regarding-the-invasion-of-the-united-states-by-tren-de-aragua/" target="_blank" rel="noopener">the Alien Enemies Act</a> to deport individuals accused of belonging to the Tren de Aragua is legally questionable. This law, originally meant for wartime or hostile invasions, is now the subject of serious court challenges. For now, the executive action attempting to use it for deportations is paused.</p>
<p>Next, regarding <a href="https://www.uscis.gov/humanitarian/humanitarian_parole" target="_blank" rel="noopener">the humanitarian parole program</a>, the government tried to overturn a federal judge’s decision that paused the termination of the program. The Court of Appeals rejected that emergency action, so the humanitarian parole remains protected for now.</p>
<p>We also discussed <a href="https://www.flhsmv.gov/driver-licenses-id-cards/real-id/#:~:text=The%20federal%20REAL%20ID%20Act,credentials%20after%20January%201%2C%202010." target="_blank" rel="noopener">the Real ID Act</a>, which officially took effect on May 7. While it has been in development for nearly 20 years, it’s important to remember that all travelers—U.S. citizens and legal residents alike—must carry the correct identification when traveling domestically. If you don’t have a Real ID-compliant license, you’ll need your green card, valid passport, or other official documents showing your legal status or citizenship.</p>
<p>Many listeners asked if they should avoid leaving the U.S. under current immigration policies. My advice: every case is unique. Those with criminal records or past immigration violations should consult an attorney before traveling. However, if you have maintained a clean legal and immigration record, you can generally continue your life—including family trips—without fear.</p>

Quisiera comenzar este recorrido con la abogada Martha Arias con la información que incluye a dos jueces federales que dictaminan que es inválido el uso de la Ley de Enemigos Extranjeros para deportar a acusados de pertenecer al Tren de Aragua. Una jueza en Colorado, su nombre Charlotte Zweeny, fue apuntada allí por Joe Biden y ella se suma en este mismo debate al juez Alvin Hellerstein, juez superior del Tribunal de Distrito de Estados Unidos para el Distrito Sur de Nueva York, que fue colocado allí por Bill Clinton. Ante esta, digamos, participación de estos dos jueces, ¿cuál sería el futuro inmediato de esta acción del gobierno federal de utilizar la Ley de Enemigos Extranjeros para deportar, repito, a los acusados de pertenecer al Tren de Aragua?</p>

Sí, Eduardo. Por ahora, esta ley, o más bien esta medida del presidente Trump de aplicar la Ley de Enemigos Extranjeros para deportar a las personas del Tren de Aragua es una ley que sigue en controversia y en litigio. Todavía no es la última palabra. Las personas están demandando a las cortes federales, y por eso usted ve que son distintos jueces los que emiten estas decisiones, porque las personas que han tenido sus familiares deportados bajo esta ley, pues están demandando. Es una ley controversial porque la ley dice que esto puede ocurrir cuando hay una invasión o una incursión depredadora. Entonces, estas cortes, en este caso las dos que usted mencionó, han cuestionado si esa entrada de estas personas supuestamente vinculadas al Tren de Aragua es una invasión o es una incursión depredadora bajo la ley para que el gobierno pueda usarla. Entonces esa es la interpretación. Todavía una de las cortes que usted mencionó ordenó a los demandados que explicaran por qué ellos consideran esto una invasión. Otra pregunta legal que está dentro del litigio es si una invasión puede ser ocasionada, o esa invasión depredadora ocasionada por una organización delictiva, y esto se considera una invasión del Estado, del país en sí, en otras palabras, de Venezuela. Entonces, son unos temas legales importantes que está decidiendo la corte. Por ahora, la medida ejecutiva dice que no se puede aplicar.</p>

Abogada Arias, mientras esto pasa con este tema específico, la Corte de Apelaciones rechaza la acción de emergencia en contra del parole humanitario. ¿Nos puede explicar un poco qué es lo que está pasando con este punto del parole?</p>
<p>Martha Arias:<br />
Sí, el punto del parole es que, como sabemos, la nueva administración terminó el parole humanitario, incluso para aquellas personas que todavía lo tenían vigente por algunos meses más. Al pararlo, presentaron una demanda en contra de esto las partes afectadas y el juez federal paró entonces, o más bien dio una medida cautelar donde pausó, paró la aplicación de esa medida ejecutiva del gobierno. Entonces, el gobierno presentó una moción de emergencia pidiendo que se paralizara el que no se aplicara la orden de ese juez que paralizó la aplicación del parole, o sea, tumbar el parole. Entonces, el juez que esta noticia que hay, que salió ayer, es que un juez federal del circuito primero no concedió esa moción de emergencia al gobierno. El parole sigue pausado. La medida del gobierno de quitarlo, tumbarlo, terminarlo, no opera todavía por orden de un juez federal.</p>
<p>Host:<br />
Abogada Arias, ahí, obviamente, a partir del día 7 de mayo, esa es la fecha en que comenzó la implementación del Real ID. No tiene quizá esto que ver con las medidas migratorias de la administración Trump porque esto viene desde hace 20 años corriendo la implementación de este nuevo Real ID. Pero con esta implementación hay medidas que deben tomar tanto ciudadanos estadounidenses si no pudieron cambiar la licencia como los que son residentes legales del país o extranjeros que están residenciados en Estados Unidos. Si no tienen el Real ID, una de las medidas que deben mantener es llevar la tarjeta de residente permanente, pasaporte válido para no migrantes, un documento emitido por el gobierno que muestre su nombre completo, documento del Departamento de Seguridad Nacional que acredite su presencia legal en el país, y para los estadounidenses, para los ciudadanos, pasaporte válido o vigente, si no lo tiene vigente, copia original o certificada de un acta de nacimiento, certificado de naturalización emitido por el Departamento de Seguridad Nacional, certificado de ciudadanía. Es decir, para viajar internamente tienen que llevar estos documentos. Ahora, a donde quiero llegar con la abogada Martha Arias: sumamos el Real ID con las medidas migratorias de la administración. Los inmigrantes con estatus legal, ¿deben evitar salir de Estados Unidos?</p>
<p>Martha Arias:<br />
Yo pienso que eso es dependiendo de cada caso. Cada caso se va a analizar en sus hechos. A personas que han cometido delitos, han tenido arrestos, aunque los hayan declarado inocentes, esas personas tienen que tener cuidado en salir porque sí puede haber una repercusión al entrar. Aunque puede que no sean deportables o inadmisibles al momento de entrar, tienen que ir con cautela. No diría yo que todos nos tenemos que entrar en esa de que no podemos salir, no podemos viajar, no podemos hacer nada porque estamos con temor. Yo pienso que no. Tenemos que tener positivismo, sobre todo, por ejemplo, una persona que es residente de los Estados Unidos, nunca ha sido arrestada, no tiene ningún récord derogatorio malo en su récord migratorio, es decir, nunca la han acusado de mentir, nunca ha presentado ninguna petición fraudulenta, no tiene arresto, no tiene nada. Es una señora casada con su familia, que va a un viaje de familia con sus hijos, su esposo, o puede ser un hombre igual, sin ningún récord criminal, que va a hacer un viaje con su esposa, con sus padres, qué sé yo, o solo. Esa persona no debería tener miedo porque no hay absolutamente nada derogatorio en su récord, ni en la parte criminal ni en la parte migratoria que debiera causarle temor. Entonces yo no le estoy diciendo a las personas y sobre todo a los que tienen este perfil que estoy mencionando: sigan su vida común y corriente mientras usted no haga nada malo y haya cumplido con la ley, no tiene problema. Yo personalmente, mire, yo viajé hace 15 días. Yo soy ciudadana. La gente está diciendo: &#8220;No, incluso los ciudadanos no deben viajar y hasta los abogados de inmigración les están diciendo.&#8221; Y yo viajé sin ningún problema porque no tengo nada derogatorio en mi récord y pues estoy tranquila y créame que la entrada fue tranquila. Yo entré, no hubo ningún problema. Yo miraba la línea de los residentes y veía que la gente iba fluyendo, pasando, todo el mundo en la expresión de la cara era de complacencia, pues, de que pasaban sin ningún problema. Yo pienso que también estamos haciendo mucha bulla que causa un poco de temor. Ahora, vuelvo y repito, el que tiene&#8230; Hay una expresión muy popular que decimos los latinos: &#8220;El que tiene rabo de paja, no se arrima a la candela.&#8221; O sea, si una persona tiene algo que esconder o algo derogatorio en su pasado, pues sí, sea precavido y trate de no viajar. Pero el resto no debería haber ningún problema. Ahora, esto del Real ID Act sí es muy importante, sobre todo en estos viajes nacionales. Esto viene desde la ley del Patriot Act que salió después del ataque de las Torres Gemelas, que se establecieron una cantidad de medidas, incluyendo esta, incluyendo la doble verificación de las cuentas bancarias. Entonces, esto es una medida que la gente sí tiene que tomar muy en serio. El que no tenga esa licencia ya que esté de acuerdo con el Real ID, vaya y la saque. El que ya se ha hecho ciudadano y el departamento de motores y vehículos todavía no tiene su récord como ciudadano, vaya, saque la nueva licencia y muestre su certificado de ciudadanía para que ellos también actualicen los recursos. Eso es una función, una tarea que mucha gente no hace.</p>

I would like to begin this discussion with attorney Martha Arias with the information that includes two federal judges who have ruled that it is invalid to use the Alien Enemies Act to deport those accused of belonging to the Tren de Aragua. A judge in Colorado, her name Charlotte Zweeny, was appointed there by Joe Biden, and she joins in this same debate with Judge Alvin Hellerstein, senior judge of the United States District Court for the Southern District of New York, who was placed there by Bill Clinton. Given this, let’s say, participation of these two judges, what would be the immediate future of this action by the federal government to use the Alien Enemies Act to deport, I repeat, those accused of belonging to the Tren de Aragua?</p>
<p>Martha Arias:<br />
Yes, Eduardo. For now, this law, or rather this measure by President Trump of applying the Alien Enemies Act to deport people from the Tren de Aragua, is a law that remains controversial and in litigation. It is not yet the final word. People are suing the federal courts, and that’s why you see that different judges are issuing these decisions, because people who have had family members deported under this law are suing. It is a controversial law because the law says that this can happen when there is an invasion or a predatory incursion. And so these courts, in this case the two that you mentioned, have questioned whether the entry of these people supposedly linked to the Tren de Aragua is an invasion or a predatory incursion under the law so that the government can use it. So that is the interpretation. One of the courts you mentioned has even ordered the defendants to explain why they consider this an invasion. Another legal question that is within the litigation is whether an invasion can be caused, or that predatory invasion caused by a criminal organization, and whether this is considered an invasion by the state, by the country itself—in other words, by Venezuela. So, these are important legal issues that the court is deciding. For now, the executive measure says that it cannot be applied.</p>
<p>Host:<br />
Attorney Arias, while this is happening with this specific issue, the Court of Appeals rejects the emergency action against humanitarian parole. Can you explain to us a little what is happening with this matter of the parole?</p>
<p>Martha Arias:<br />
Yes, the matter of the parole is that, as we know, the new administration ended the humanitarian parole, even for those people who still had it valid for a few more months. Upon stopping it, a lawsuit was filed against this by the affected parties, and the federal judge then stopped, or rather issued a preliminary injunction where he paused, stopped the application of that executive measure by the government. So, the government filed an emergency motion asking that the order of that judge stopping the application of the parole—or rather, overturning the parole—be paralyzed. So, the news that came out yesterday is that a federal judge from the first circuit did not grant that emergency motion to the government. The parole remains paused. The government’s measure to remove it, overturn it, terminate it, does not yet operate by order of a federal judge.</p>
<p>Host:<br />
Attorney Arias, obviously, starting from May 7, that is the date when the implementation of the Real ID began. This may not have to do with the immigration measures of the Trump administration because this has been in the works for about 20 years, the implementation of this new Real ID. But with this implementation, there are measures that both U.S. citizens who couldn’t change their license and those who are legal residents of the country or foreigners residing in the United States must take. If they don’t have the Real ID, one of the measures they must follow is to carry the permanent resident card, valid passport for nonimmigrants, a government-issued document that shows their full name, a Department of Homeland Security document that proves their legal presence in the country, and for U.S. citizens, a valid or current passport, and if they don&#8217;t have a current one, the original or certified copy of a birth certificate, naturalization certificate issued by the Department of Homeland Security, or certificate of citizenship. That is, to travel domestically, they have to carry these documents. Now, where I want to go with attorney Martha Arias: we add the Real ID to the immigration measures of the administration. Should immigrants with legal status avoid leaving the United States?</p>
<p>Martha Arias:<br />
I think that depends on each case. Each case is going to be analyzed based on its facts. People who have committed crimes, have had arrests, even if they were declared innocent, those people must be careful about leaving because there can indeed be a repercussion upon entry. Although they may not be deportable or inadmissible at the time of entry, they must proceed with caution. I would not say that we all have to fall into that idea that we cannot leave, we cannot travel, we cannot do anything because we are afraid. I think not. We have to stay positive, especially, for example, a person who is a U.S. resident, has never been arrested, has no derogatory record in their immigration history, that is, they have never been accused of lying, have never submitted any fraudulent petition, have no arrests, nothing. She is a married woman with her family, going on a family trip with her children, her husband, or it could be a man likewise, without any criminal record, going on a trip with his wife, with his parents, or alone. That person should not be afraid because there is absolutely nothing derogatory in their record, neither criminal nor immigration-wise, that should cause them fear. So I am not telling people, and especially those who have this profile I am mentioning: continue your normal life. As long as you don’t do anything wrong and you have complied with the law, you have no problem. I personally, look, I traveled 15 days ago. I am a citizen. People are saying, &#8220;No, even citizens shouldn’t travel, and even immigration attorneys are saying so.&#8221; And I traveled without any problem because I have nothing derogatory in my record and, well, I am calm and believe me, the entry was smooth. I entered, there was no problem. I looked at the line of residents and I saw that people were flowing, passing, everyone’s facial expression was of satisfaction, well, that they passed without any problem. I also think we are making a lot of noise that causes a bit of fear. Now, I repeat, those who&#8230; There is a very popular expression we Latinos say: &#8220;He who has a straw tail should not get close to the fire.&#8221; That is, if a person has something to hide or something derogatory in their past, well, yes, be cautious and try not to travel. But for the rest, there should be no problem. Now, this Real ID Act, this is very important, especially for these domestic trips. This comes from the Patriot Act, which came out after the attack on the Twin Towers, where a number of measures were established, including this one, including the double verification of bank accounts. Now, the judge has given the government until April 23 to explain either why it disobeyed the order or to identify the officials responsible for ignoring it. If it&#8217;s proven that there was deliberate defiance, government officials could face criminal penalties — including jail time.</strong>

Immigrants must be informed why they are being deported and given a fair chance to defend themselves — particularly if they’re accused of gang involvement or national security concerns. In this case, the person was reportedly linked to MS-13, but the only proof was a document claiming he was from New York — a place he never lived.</p>
<p>The bigger concern is what happens when individuals are sent to a third country like El Salvador, especially when there are claims they belong to gangs. Without proper legal protections or evidence, and in regions where due process can be questionable, we risk exposing individuals to human rights violations and unjust imprisonment.</p>
<p>As we continue to monitor this case, it serves as a strong reminder that legal orders matter — and so does constitutional process, regardless of political agendas.</p>
<p>Let’s continue to stay informed and advocate for fair and lawful treatment of all immigrants.</p>

La verdad es que esto nos tiene en expectativa porque ha sido un &#8220;tira y afloje&#8221;, como decimos nosotros, ¿no?, el caso de la expulsión de venezolanos a El Salvador. ¿En qué puede desencadenar este inicio de proceso contra el gobierno de Trump para declararlo en desacato? ¿Qué puede estar ocurriendo?</p>
<p>Abogada Martha Arias:<br />
Bueno, lo que puede ocurrir es que el juez dio hasta el 23 de abril, hasta este mes, para que el gobierno escoja una de dos opciones.<br />
Una opción es explicar por qué incumplió la orden de no deportar a esta persona o de no enviarla a El Salvador, y qué pasos se han dado o se están dando para honrar esa orden y retornar a esa persona a los Estados Unidos.</p>
<p>La segunda opción es que provea los nombres de los funcionarios del gobierno que tuvieron a su cargo cumplir la orden y no lo hicieron.<br />
En este caso, si cualquiera de las opciones que se escojan demuestra que hubo una intención deliberada de no cumplir con la orden del juez, esta orden de desacato puede conllevar sanciones penales y cárcel para los funcionarios que no la ejecutaron, es decir, que deliberadamente la hubieran desacatado.</p>
<p>Host:<br />
Abogada, muy buenos días, pero este proceso puede tardar mucho tiempo. Es decir, ¿podemos pasar meses esperando a que haya una resolución?</p>
<p>Abogada Martha Arias:<br />
Sí, se pueden pasar varios meses porque de inicio ya tenemos hasta el 23 de abril para que el gobierno escoja una de estas opciones que mencioné. Después de eso, el juez va a revisar lo presentado y puede darle al gobierno la oportunidad de evitar ese proceso criminal de desacato. Es decir, puede haber una mediación entre las partes para determinar qué pasó y evitar llegar al proceso penal.</p>
<p>Si se llega al proceso penal —y aclaro que yo no soy abogada criminalista—, pero tengo entendido que seguirá todas las reglas de un proceso penal normal, lo cual puede tomar meses o incluso años.</p>
<p>Host:<br />
Ahora, esta presión que se está generando por el inicio de este proceso contra el gobierno de Trump, ¿qué nos dice? ¿El gobierno de Donald Trump no puede expulsar ahora a venezolanos o a personas de nacionalidades específicas a El Salvador? ¿Qué va a pasar con ese plan del expresidente, quien recientemente esta semana conversó con Nayib Bukele en la Casa Blanca? ¿Ya no va a poder deportar?</p>
<p>Abogada Martha Arias:<br />
No, él sí va a poder continuar deportando a las personas bajo la ley de enemigos extranjeros.</p>
<p>Le doy un recordatorio de lo que pasó: cuando esta persona fue enviada a El Salvador, el juez había emitido una orden de no enviarlo. El gobierno lo deportó igual, y luego presentó un recurso ante otra corte para que desestimara esa orden.</p>
<p>Esa segunda corte confirmó la orden del primer juez, y el gobierno continuó hasta llegar a la Corte Suprema. La Corte Suprema emitió una decisión donde dijo que la ley de enemigos extranjeros sí se puede usar para deportar inmigrantes a El Salvador en este caso, pero —y este es el punto más importante— el gobierno debe respetar el debido proceso.</p>
<p>Eso implica que debe informar a la persona que está siendo deportada bajo esa ley, y darle oportunidad de defensa. Por ejemplo, si la persona es acusada de pertenecer a una pandilla, un juez de inmigración debe darle las pruebas que lo justifiquen. En este caso, simplemente se alegó que pertenecía a una pandilla, lo detuvieron y lo deportaron.</p>
<p>A partir de ahora, cuando una persona vaya a ser enviada a la corte bajo esa ley, el documento debe indicar claramente que es bajo la ley de enemigos extranjeros, para que los jueces estén conscientes y garanticen el debido proceso.</p>
<p>Host:<br />
Ahora, abogada, cuando una persona es deportada a El Salvador, ¿qué opciones tiene de defensa? ¿Y quién tiene la custodia de esas personas expulsadas a El Salvador?</p>
<p>Abogada Martha Arias:<br />
Sí, esa es la parte que a mí me preocupa. Me preocupa porque, si se deportan salvadoreños, están en su país y enfrentarán su sistema judicial. Pero si la persona es de un tercer país y es acusada de pertenecer a una entidad terrorista o pandilla, es más complicado desde el punto de vista legal. Por ejemplo, la persona que fue deportada en este caso. El gobierno estadounidense debía probar con evidencia que pertenecía a la pandilla. Lo que he leído indica que solo había un documento del gobierno que decía que pertenecía a la MS-13 de Nueva York, pero el documento también indica que esa persona nunca había vivido en Nueva York.</p>
<p>Entonces, hay poca evidencia o evidencia débil sobre su pertenencia a una pandilla. Ahora lo deportan con esa escasa evidencia y sin debido proceso.<br />
Llega a El Salvador, y el gobierno salvadoreño dice que tiene evidencias de que pertenece a una pandilla. Pero sabemos que en Latinoamérica muchas veces se &#8220;crea&#8221; evidencia, como dicen, &#8220;el papel lo aguanta todo&#8221;.</p>
<p>Entonces, si allá le ponen cargos criminales, primero va a tener que enfrentar a la justicia de El Salvador antes de cualquier posibilidad de regresar a los Estados Unidos.</p>

Alright, at this time we&#8217;re talking about the judge who has begun proceedings against the Trump administration to declare it in contempt after disobeying an order not to expel Venezuelans to El Salvador. With us now is Martha Arias, an immigration attorney. How are you, attorney? Good morning.</p>
<p>Attorney Martha Arias:<br />
Reina, greetings to you, your audience, and of course your entire team.</p>
<p>Host:<br />
Thank you very much. The truth is this has us on alert because it&#8217;s been a back and forth, as we say, right? The case of the expulsion of Venezuelans to El Salvador. What could come of this process being initiated to declare the Trump administration in contempt? What could be happening?</p>
<p>Attorney Martha Arias:<br />
Well, what could happen is that the judge gave a deadline of April 23, this month, for the government to choose one of two options.</p>
<p>One option is to explain why it disobeyed the order not to deport this person or not to send them to El Salvador, and what steps have been taken or are being taken to honor that order and return that person to the United States.</p>
<p>The second option is to provide the names of the government officials who were responsible for carrying out the order and did not do so. In this case, if either of the chosen options shows that there was a deliberate intent not to comply with the judge’s order, the contempt order can result in criminal sanctions and jail time for the government officials who failed to carry it out — that is, who deliberately disobeyed it.</p>
<p>Host:<br />
Attorney, good morning, but could this process take a long time? That is, could we go months waiting for a resolution?</p>
<p>Attorney Martha Arias:<br />
Yes, it could take several months because initially, the government has until April 23 to choose one of the options I mentioned. After that, the judge will review what was presented and may give the government an opportunity to avoid that criminal contempt process. That is, there could be a mediation between the parties to determine what happened and perhaps avoid going to a criminal proceeding.</p>
<p>If it does go to a criminal proceeding — and I clarify that I am not a criminal attorney — but I understand that it will follow all the rules of a normal criminal process, which can take months or even years.</p>
<p>Host:<br />
Now, this pressure that is being generated by the beginning of this process against the Trump administration, what does it tell us? That the Trump government cannot now expel Venezuelans or people of specific nationalities to El Salvador? What will happen to Trump’s plan, especially considering he met with Nayib Bukele at the White House just this week? Will he no longer be able to deport?</p>
<p>Attorney Martha Arias:<br />
No, he can still continue deporting people under the Enemy Alien Act.</p>
<p>Let me give you a reminder of what happened: when this person was sent to El Salvador, the judge had issued an order not to send him. The government deported him anyway and then filed an appeal with another court to dismiss that judge’s order.</p>
<p>That second court confirmed the first judge’s order, and the government continued on to the Supreme Court. The Supreme Court issued a decision saying that the Enemy Alien Act can be used to deport immigrants to El Salvador in this case, but — and this is the most important part — the government must provide due process.</p>
<p>That means informing the person that they are being deported under the Enemy Alien Act and giving them a chance to defend themselves.<br />
For example, if someone is accused of belonging to a gang and is going to be deported for that reason, an immigration judge must provide the evidence and proof supporting the accusation.</p>
<p>In this case, that didn’t happen. They simply said this person belonged to a gang, detained him, and deported him. So now, when someone is sent to immigration court under that law, the document that sends them must state “Enemy Alien Act” very clearly so that judges are aware and can ensure due process is followed.</p>
<p>Host:<br />
Now attorney, when someone is deported to El Salvador, what defense options do they have? And who has custody of those expelled to El Salvador?</p>
<p>Attorney Martha Arias:<br />
Yes, that’s the part that concerns me. It concerns me because if Salvadoran nationals are deported, well, they are going to their own country and will have to face the laws of their country.</p>
<p>But if the person is from a third country and is accused of belonging to a terrorist group or gang, I think it’s very complicated legally.<br />
For example, the person currently over there. First, the U.S. government had to prove with evidence that he belonged to a gang. From what I’ve read, there was only one government document saying he belonged to the MS-13 gang from New York, and that same document stated he had never lived in New York.<br />
So we’re starting with very little or weak evidence of his gang affiliation.</p>
<p>Now they deport him with that little evidence, without due process. He arrives in El Salvador, and the Salvadoran government claims they have evidence that he belongs to a gang. But we all know that in Latin America, evidence — as we say — “paper can take anything.” People fabricate evidence. So now, if this person is going to be charged with criminal offenses in El Salvador, I imagine he will have to face the Salvadoran justice system before he can ever return to the United States.</p>
<p>Host:<br />

We discussed how the IRS is now publicly committing to share taxpayer information with Department of Homeland Security to identify immigrants subject to deportation, and what that might mean for those who file taxes with an ITIN number. From my experience, this collaboration isn’t entirely new, but the official announcement has certainly caught the public’s attention.</p>
<p>We also touched on President Trump’s move to revoke legal status for those who entered with CBP-1 and the possibility of ending work permits for many who came in under various humanitarian paroles. Another critical topic was the revival of an old 1996 measure dating back to the Clinton era: fines of $998 per day against those who defy deportation orders. Whether or not this rule has truly been enforced before, the potential financial burden is staggering.</p>

			<p>HOST: Amigas, amigos, vamos a hablar de inmigración, y para hablar de inmigración hay que hacerlo con una persona que conozca las leyes migratorias. Tenemos precisamente en línea a la abogada Martha Arias. Abogada Arias, buenos días, gracias por atender la llamada.</p>
<p>DRA. MARTHA L. ARIAS.: Buenos días, Eduardo y Aaron, un saludo para ustedes y toda la audiencia que tienen en esta mañana de hoy.</p>
<p>HOST: Muchísimas gracias, bienvenida. Bueno, quisiera comenzar con la información del Servicio de Rentas Internas (IRS). El IRS ha acordado ayudar a los funcionarios de Seguridad Nacional a encontrar a los inmigrantes que están tratando de deportar, comprometiéndose a compartir información en lo que representa un cambio fundamental en la forma en que el IRS utiliza sus registros, que son estrictamente regulados. ¿Cuál es el impacto de esta “asociación”, si cabe el término, entre el IRS y el ICE?</p>
<p>DRA. MARTHA L. ARIAS.: El impacto obviamente es grande, sobre todo para aquellas personas que están presentando taxes con un ITIN number, no con un Social Security. La mayoría —diría yo, no todos— de quienes tienen un número de Seguro Social es porque han presentado alguna petición con Inmigración que les ha dado ese derecho.<br />
Si no estoy mal, fue en 1999 o por esa fecha cuando el Seguro Social dejó de otorgar números a las personas, a menos que tuvieran un trámite migratorio. Antes de 1999 o 2000, por ejemplo, alguien con visa de turista pedía un Seguro Social y se lo daban. Pero ya después de esa fecha, no.</p>
<p>Entonces, la mayoría de las personas que están con un Social es porque tienen algún tipo de estatus. Si no lo tienen, es difícil para las autoridades determinar si esa persona está legal o no. No sé cómo van a hacer esa selección. Obviamente, quienes tienen un ITIN number y están dentro de Estados Unidos pagando impuestos podrían ser observados. Pero hay gente con ITIN que sí está legal; no necesariamente todos los que tienen un ITIN están en estatus ilegal.</p>
<p>Mira, ese es mi primer comentario. El segundo es que tampoco nos volvamos locos, porque esto no es nada nuevo. Tal vez el gobierno lo está anunciando así para que quede claro, lo están notificando públicamente y concretándolo en un acuerdo formal. Pero yo, como abogada de inmigración, sé —en mis 21 años de experiencia— que Inmigración, por ejemplo, sí tiene acceso a las bases de datos del IRS. No sé a qué nivel, pero sé que lo tienen.</p>
<p>Les voy a poner un ejemplo: tuve un cliente que había presentado por su cuenta la solicitud de ciudadanía por estar casado con una ciudadana estadounidense durante tres años. Cuando fue a la entrevista, la oficial le preguntó si él presentaba los taxes junto con su esposa, y él dijo que no, que los presentaba separados. La oficial lo indagó; ya tenía toda la información de sus impuestos. A la persona le negaron la ciudadanía, porque la esposa, que había declarado los impuestos por separado, había reclamado que vivía sola, que no recibía nada de él, e incluso había pedido ayuda del gobierno. Inmigración los confrontó, porque para pedir la ciudadanía por los tres años de matrimonio, deben vivir juntos. Así que era obvio que la oficial había revisado la información del IRS tanto de mi cliente como de su esposa.</p>
<p>Así como este, hay más ejemplos donde Inmigración ha confrontado a una persona con su información del IRS. Para mí no es algo nuevo; creo que siempre ha existido. Lo que pasa es que, al hacerlo público, al notificarlo, al pueblo le asusta, y creo que en este momento también es una táctica para asustar, crear pánico.</p>
<p>HOST: Abogada Arias, el gobierno del presidente Trump revoca el estatus legal a migrantes que entraron a Estados Unidos con el CBP-1. El mensaje fue contundente: “Es hora de que abandonen Estados Unidos.” Lo enviaron a través de un correo electrónico que las familias migrantes recibieron en estos últimos días. ¿Qué va a pasar con toda esta gente? Se habla de más de 900,000 personas.</p>
<p>DRA. MARTHA L. ARIAS.: Cada persona tendrá un caso distinto. Unas podrán —y lo harán— registrarse en el CBP-Home, que fue la nueva aplicación que creó esta administración para que las personas salgan del país. Algunos lo harán, muchos no. Otros ya tendrán un estatus o un caso presentado. Por ejemplo, hay cubanos con una solicitud de residencia bajo la Ley de Ajuste Cubano. Otras personas habrán pedido asilo, otras se habrán casado con ciudadanos americanos, o tendrán una petición familiar lista para residencia, etcétera. Cada caso es diferente.</p>
<p>De esos 900,000, me atrevería a decir que más del 50% va a quedar en situación de ilegalidad, y de esos, algunos saldrán, otros no. Pero no podemos decir que todos están en la misma situación.</p>
<p>HOST: ¿Qué pasa con los permisos de trabajo de esa gente, abogada?</p>
<p>DRA. MARTHA L. ARIAS.: Se cancelan. Lo mismo que para quienes entraron con el parole humanitario de Haití, Cuba, Nicaragua y Venezuela, que supuestamente terminaría ahora en abril de 2024. Digo “supuestamente” porque ya está anunciado en el Registro Federal desde marzo de 2025 y debe estar allí 30 días para entrar en vigor, a no ser que haya —como todos sabemos— una demanda y se dicte una medida temporal ordenada por un juez. Pero tal como están las cosas en este momento, concluiría en abril de 2024 y se cancela el permiso de trabajo. Lo mismo para quienes entraron con CBP-1 y también obtuvieron un parole humanitario.</p>
<p>HOST: Usted mencionaba en uno de sus comentarios que nada de esto es nuevo, que estas son resoluciones viejas, leyes anteriores. De hecho, la administración ha revivido otra ley. Esta es de la era de Bill Clinton, de 1996, para cobrar a los inmigrantes indocumentados por cada día que permanezcan en el país. La cifra, creo, son 998 dólares al día por no auto-deportarse. Repito, es una ley de la era Clinton. Mucha gente se ha sorprendido porque no sabía que el propio Bill Clinton había promulgado una ley que imponía una multa tan cuantiosa a los extranjeros que desafiaran una orden de deportación. ¿Qué comentario tiene al respecto?</p>
<p>DRA. MARTHA L. ARIAS.: Dos cosas. Primero, para aclarar: el acuerdo de Inmigración con el IRS no es una ley y tampoco sé si estaba firmado antes. Yo sí soy testigo de que siempre se ha compartido esa información. No sé si era un acuerdo que ya existía y expiró, o si se había ratificado antes. Pero lo que quiero decir es que sí ha existido esa comunicación entre agencias antes de anunciarlo ahora.</p>
<p>En cuanto a la multa, pues yo, como abogada de inmigración, no tengo conocimiento de que el presidente Clinton haya establecido una multa de este rango, como lo dice el presidente Trump ahora. La única sanción monetaria de la que me acuerdo —y hay varias— son los mil dólares de la 245(i), cuando la persona podía ajustar estatus pagando esa penalidad, y eso todavía existe. Otra sanción se da cuando las personas pagan una fianza para salir, etcétera.</p>
<p>Pero una sanción como la que anunció el presidente, de pagar casi mil dólares diarios las personas que han sido deportadas, discúlpenme, pero nunca había escuchado de algo así. Esto sí es nuevo. No sé si tendríamos que ir a revisar en los libros de historia, pero desde 2003 que ejerzo como abogada de inmigración, no existía.</p>
<p>Me parece injusto, primero, que sea tan alta, y segundo, que sea diaria. Podría ser un monto fijo, por ejemplo, 2,000, 3,000 o 5,000 dólares, pero fijar 1,000 dólares diarios es excesivo. Además, si las personas no lo pagan, podrían tener que responder con sus propiedades. Hay gente que lleva muchos años aquí y ha adquirido una casita o apartamento —lo único que tienen de ahorros— y podrían perderlo.<br />
Sí, violaron la ley, pero me parece una penalidad excesiva.</p>
<p>HOST: Abogada Arias, para finalizar este encuentro, ¿qué mensaje le puede enviar a la gente que hoy está pendiente de estos casos, de los procedimientos que han cambiado, que podrían seguir cambiando? Hay mucha incertidumbre y angustia. ¿Qué mensaje les puede enviar?</p>
<p>DRA. MARTHA L. ARIAS.: El mensaje es que tengan calma, tengan fe y se asesoren con un buen abogado de inmigración que les hable claro y les explique bien su caso ante las nuevas medidas. Esos son mis tres consejos. Hemos pasado por administraciones anteriores donde también hubo situaciones difíciles. Mientras estén bien asesorados, no cometan delitos y cuiden su conducta —por ejemplo, cómo manejan—, eso les ayuda a estar un poco más protegidos mientras se atraviesa esto.<br />
Puede que venga una reforma, puede que pase algo que beneficie a muchos, no sabemos. Por ahora, mi consejo es que guarden la calma y mantengan la esperanza.</p>

Friends, let’s talk about immigration, and to talk about immigration we have to do it with a person who knows immigration laws. We have precisely on the line attorney Martha Arias. Attorney Arias, good morning, thank you for taking our call.</p>
<p>IMMIGRATION ATTORNEY MARTHA L. ARIAS, ESQ.::<br />
Good morning, Eduardo and Aaron, greetings to you and all the audience you have this morning.</p>
<p>HOST:<br />
Thank you very much, welcome. Well, I would like to begin with the information from the Internal Revenue Service (IRS). The IRS has agreed to help Homeland Security officials find immigrants who they are trying to deport, committing to share information in what represents a fundamental change in how the IRS uses its strictly regulated records. What is the impact of this “association,” if the term fits, between the IRS and ICE?</p>
<p>IMMIGRATION ATTORNEY MARTHA L. ARIAS, ESQ.::<br />
The impact is obviously significant, especially for those people who are filing taxes with an ITIN number, not a Social Security. The majority —I would say not all, but most— of those who have a Social Security number is because they have submitted some petition with Immigration that granted them that right.<br />
If I’m not mistaken, it was in 1999 or around that date when Social Security stopped giving out numbers to people unless they had a pending immigration procedure. Before 1999 or 2000, for example, someone with a tourist visa would ask for a Social Security and they would give it to them. But after that date, no.</p>
<p>So, most people with a Social Security have some type of status. If they don’t, it’s difficult for the authorities to determine if that person is legal or not. I don’t know how they will select people. Obviously, those with an ITIN number who are inside the United States paying taxes, well, those might be looked at. But there are people with an ITIN who are legal; not everyone with an ITIN is illegal.</p>
<p>Look, that’s my first comment. My second comment is, let’s not go crazy because this is nothing new. Maybe the government is announcing it this way so it’s clear, they’re notifying it publicly and formalizing it in an agreement. But I, as an immigration attorney, know —in my 21 years of experience— that Immigration, for example, does have access to IRS databases. I don’t know what type of access or at what level, but I know it does.</p>
<p>I’ll give you an example: I had a client who had filed his citizenship request on his own for having been married to an American citizen for three years. When he went to the interview, the officer only asked him if he filed taxes together with his wife, and he said no, separately. The officer questioned him; the officer already had all his tax information. They denied the person citizenship because the wife, who had filed taxes separately, had claimed that she lived alone, that she received nothing from her husband, and had even requested assistance. Immigration confronted them, because to request citizenship through three years of marriage, they have to be living together. So it was obvious the officer had reviewed the IRS information for both my client and his wife.</p>
<p>So, just like this, I can give you examples where Immigration has confronted a person with their IRS information. For me, it’s nothing new; I believe it has always existed. The thing is that by making it public, by notifying it, it scares people, and I believe that at this moment one of the tactics is to scare, to create panic.</p>
<p>HOST:<br />
Attorney Arias, President Trump’s government is revoking the legal status of migrants who entered the United States with CBP-1. The message was forceful: “It is time for you to leave the United States.” They sent it via an email that migrant families received in these last days. What will happen to all these people? It’s said there are more than 900,000 people.</p>
<p>IMMIGRATION ATTORNEY MARTHA L. ARIAS, ESQ.::<br />
Those people, each person will have a different case. Some, obviously, will be able to —and will— register in CBP-Home, which was the new app this administration created so people can leave the country. Some will do it, many won’t. Others will already have some status or a filed case. For example, some Cubans might have a residency application through the Cuban Adjustment Act. Other people might have requested asylum, others may have married an American citizen, or have a family petition that is already ready for residency, etc. Each person could have a different case.</p>
<p>Of those 900,000, I would say a large number —and I could dare to say more than 50%— will end up in that situation of illegality, and of those, some will leave, others won’t. That’s the situation, but we can’t say that everyone is in the same position.</p>
<p>HOST:<br />
What happens to the work permits of those people, attorney?</p>
<p>IMMIGRATION ATTORNEY MARTHA L. ARIAS, ESQ.::<br />
They get canceled. The same as those who entered with the humanitarian parole for Haiti, Cuba, Nicaragua, and Venezuela, which supposedly would end now in April 2024. I say “supposedly” because it’s already announced in the Federal Register from March 2025, and it has to be there for 30 days to go into effect, unless there is —as we all know— a lawsuit and perhaps a pause or temporary measure ordered by a judge. But as things stand right now, it ends April 2024 and your work permit is canceled. The same for those who entered with CBP-1 and also obtained humanitarian parole.</p>
<p>HOST:<br />
You mentioned in one of your comments that none of this is new, that these are old resolutions, old laws, previous laws. In fact, the administration has revived another law. This is from the Clinton era, William Jefferson Clinton, from 1996, to charge undocumented immigrants for each day they remain in the country. The figure, I believe, is $998 a day for not self-deporting. I repeat, it is a law from the Clinton era; many people were even surprised because they did not know that Bill Clinton himself had enacted a law imposing such a large fine on foreigners who defied a deportation order. I’d like to hear your comment on that.</p>
<p>IMMIGRATION ATTORNEY MARTHA L. ARIAS, ESQ.::<br />
Two things. One, to clarify: the Immigration agreement with the IRS is not a law, and I also don’t necessarily know if it was signed before. What I do know is that this information has always been shared. I don’t know if it was an agreement that might have been signed and never ratified or expired, but what I mean is that the communication between those agencies existed before announcing it now.</p>
<p>Now, regarding the fine, as an immigration attorney I don’t have knowledge that President Clinton established a fine of this range, as President Trump says now. The only monetary sanction I recall —and there are several— was the $1,000 of 245(i) when the person could adjust status by paying that penalty, and that still exists. Then there were penalties when people posted a bond or had to leave.</p>
<p>But a fine like the one the president announced, paying almost $1,000 a day by people who have been deported, excuse me, but I had never heard of a sanction or penalty of that kind. This is new. I don’t know; we might have to go look in the books, but since 2003 when I started practicing as an immigration attorney, it didn’t exist.</p>
<p>But if it did exist, well, it seems unfair. Two things: unfair that it is so high and unfair that it is daily. It could be a lump sum penalty, for example, $3,000, $2,000, up to $5,000, I don’t know, some determined amount. But imposing $1,000 daily, and the second unfair part is that if people don’t pay it, they might have to answer with their properties. Some people have been here for so many years, they have a house or a small apartment —the only thing they have from their savings— and now face losing that. Yes, they broke the law, obviously, we won’t deny that, but this kind of penalty seems excessive under the law.</p>
<p>HOST:<br />
Attorney Arias, to close this conversation, what message can you send to people who today are waiting for news on these cases, procedures that have changed, that could keep changing? There’s a lot of uncertainty and many people are anxious. What message can you give them?</p>

The message is have calm, have faith, consult a good immigration attorney who will tell you things clearly and explain your case well under the new measures. Those are my three pieces of advice. We’ve gone through previous administrations where difficult situations also arose. So as long as you’re well advised, don’t commit crimes, be careful about your behavior —for example, how you drive— that helps you be a bit more protected while all this goes on.<br />
It could be that a reform might come, maybe something will happen that benefits us, we don’t know. For now, my advice is remain calm and keep hope.</p>

These traffickers profit off human tragedy, and unfortunately, <strong>many migrants do not survive the journey</strong>.</p>
<p>I emphasized during the interview that this is human trafficking, and those making these journeys are putting their lives and their children’s lives at great risk. Meanwhile, border security is tighter than ever, making it even more dangerous for those attempting to enter this way.</p>

			<p>A major topic of discussion was the new challenges asylum seekers face. Many are trying to seek protection in the U.S., but the rules to prove persecution have become much stricter.</p>
<p>One of the biggest changes is that <strong>ICE is now allowed to detain individuals in court</strong>, including state and immigration courts. Under new <strong>ICE guidelines</strong>, people can be detained if they fall into one of these five categories:</p>
<ol>
<li><strong>Individuals associated with gangs</strong></li>
<li><strong>People considered a threat to public or national security</strong></li>
<li><strong>Individuals previously deported who did not comply with their removal orders</strong></li>
<li><strong>People who were deported and illegally re-entered the U.S.</strong></li>
<li><strong>Those with certain criminal convictions.</strong></li>
</ol>
<p>However, state cooperation is <strong>required</strong> for ICE to carry out these arrests. For example, in <strong>New York, state law prohibits ICE from detaining people inside state courts</strong>, but this protection <strong>does not exist in most states</strong>.</p>
<p>If you have an immigration court hearing, <strong>you must attend</strong>—but you should also be aware of your rights.</p>

			<p>We also discussed reports of <strong>marriages happening at the border</strong> with the goal of obtaining legal status. I want to be very clear—<strong>this is a terrible idea</strong> and comes with <strong>serious consequences</strong>.</p>
<p>There is a <strong>very specific rule</strong> stating that if a person gets married <strong>within 30 days of entering the U.S.</strong>, it is presumed to be <strong>marriage fraud</strong>. This means that:</p>
<ul>
<li>The couple will have to <strong>prove twice as much evidence</strong> as a regular marriage case.</li>
<li>If the immigrant <strong>entered illegally</strong>, meaning without a visa or parole, <strong>they cannot apply for a green card from within the U.S.</strong> and will <strong>have to leave the country</strong>.</li>
<li>Marriage fraud is a <strong>federal crime</strong> with <strong>severe penalties</strong>:
<ul>
<li><strong>Up to 5 years in prison</strong> for both the U.S. citizen and the immigrant.</li>
<li><strong>A $250,000 fine</strong>—which, if unpaid, can lead to more prison time.</li>
<li><strong>Permanent inadmissibility</strong>—if found guilty of marriage fraud, the immigrant will <strong>never be eligible for any U.S. visa or green card</strong> for the rest of their life.</li>
</ul>
</li>
</ul>
<p>I strongly advise against <strong>risky shortcuts like this</strong>. Immigration law is complex, and making a <strong>wrong decision</strong> can have <strong>life-long consequences</strong>.</p>

			<p>During the interview, we also talked about the <strong>severe backlog in immigration courts</strong>. As of late last year, there were <strong>over 3 million cases pending</strong>. This has created <strong>long wait times</strong>, especially for <strong>asylum seekers</strong> and those in <strong>deportation proceedings</strong>.</p>
<p>At <strong>USCIS</strong>, there have been some improvements. Last year, I noticed that <strong>green card renewals</strong> and <strong>adjustment of status applications</strong> were being processed faster. However, with <strong>recent staff reductions</strong>—including the dismissal of <strong>20 immigration judges</strong>—I am concerned that wait times may increase again.</p>
<p>If you have an <strong>open case</strong>, I recommend staying <strong>informed</strong> and making sure you <strong>follow up</strong> on your application status.</p>

<p>As for possible <strong>policy changes</strong>, I do not believe the current administration is actively working to <strong>eliminate DACA</strong>. In fact, there have been discussions about providing <strong>a more permanent legal solution</strong> for DACA recipients. While nothing has been finalized yet, I remain hopeful that <strong>a better path to legal status</strong> will be made available.</p>

However, this law grants local police the authority to stop individuals and inquire about their immigration status. Police officers will receive training to determine whether someone is legally residing in the U.S., which is a <strong data-start="1321" data-end="1356">significant and worrisome shift</strong> from the standard enforcement process.</p>
<p data-start="1402" data-end="1728">This raises serious legal concerns, as immigration status is a federal matter. The involvement of state and local law enforcement in immigration checks could <strong data-start="1560" data-end="1664">lead to racial profiling, increased fear in immigrant communities, and a reluctance to report crimes</strong> due to the fear of being questioned about immigration status.</p>

The Death Penalty as a Consequence for Undocumented Status?</strong><br data-start="1796" data-end="1799" />Another highly controversial aspect of this law is its potential connection between <strong data-start="1886" data-end="1931">undocumented status and the death penalty</strong>. In Florida, violent crimes can already result in capital punishment. However, what is unprecedented is the possibility that <strong data-start="2057" data-end="2152">being an undocumented immigrant could be considered an aggravating factor in criminal cases</strong>, potentially increasing the severity of sentencing—including eligibility for the death penalty.</p>
<p data-start="2255" data-end="2599">This is a <strong data-start="2265" data-end="2302">deeply concerning legal precedent</strong>. Typically, aggravating factors in criminal cases involve intentional and particularly harmful actions, such as violence against pregnant women or elderly individuals. Suggesting that <strong data-start="2487" data-end="2516">simply being undocumented</strong> is a comparable aggravating factor challenges fundamental principles of justice.</p>
<p data-start="2604" data-end="2933"><strong data-start="2604" data-end="2670">From a constitutional perspective, this is highly problematic.</strong> The U.S. Constitution guarantees equal protection under the law, and it prohibits cruel and unusual punishment. Undocumented immigration is a civil matter, not a criminal offense, which makes the idea of linking it to the death penalty particularly disturbing.</p>

Previously, undocumented students who had lived in Florida for years could qualify for <strong data-start="3152" data-end="3178">in-state tuition rates</strong> at public universities. This law eliminates that possibility, forcing them to pay <strong data-start="3261" data-end="3339">out-of-state tuition rates, which can be more than $12,000 higher per year</strong>.</p>
<p data-start="3347" data-end="3798">Unfortunately, this policy is <strong data-start="3377" data-end="3408">harder to challenge legally</strong> because tuition regulations fall under the control of state governments. Unlike other provisions of the law that may be deemed unconstitutional, <strong data-start="3554" data-end="3615">this measure is within the state’s authority to implement</strong>. However, this will have devastating consequences for many students who have lived in Florida for most of their lives and now face financial barriers to continuing their education.</p>

As I explained in the interview, under Florida’s new legislation, crimes such as murder and sexual offenses against minors committed by undocumented individuals are considered <strong>aggravating factors</strong>, making the application of the death penalty more likely.</p>
<p>However, this measure could face serious constitutional challenges. The Eighth Amendment of the U.S. Constitution prohibits &#8220;cruel and unusual punishment,&#8221; which means this law could be contested in federal courts.
