USCIS Announces New EAD Validity Reductions and Enhanced Vetting Measures

In recent days, USCIS released an important update to the Policy Manual that will affect many individuals who rely on Employment Authorization Documents (EADs) to work legally in the United States. Because these changes begin to apply immediately to pending and newly filed applications, I want to offer a clear explanation of what was announced, who is impacted, and why these adjustments matter.

According to USCIS, the maximum validity period for certain EAD categories will now be reduced. While many applicants have become accustomed to longer validity periods—particularly the more recent five-year EADs—USCIS has now returned some categories to much shorter terms. The agency states that the goal is to increase the frequency of vetting and strengthen security reviews.

These policy updates also incorporate requirements from recently enacted legislation (H.R. 1 – One Big Beautiful Bill Act), which further limits EAD validity for applicants in Temporary Protected Status (TPS), parole categories, and related classifications.

Which EAD Categories Will Now Be Limited to 18 Months?

Effective for all applications pending or filed on or after December 5, 2025, the maximum validity period for both initial and renewal EADs will be reduced from 5 years back to 18 months for the following groups:

Individuals admitted as refugees
Individuals granted asylum
Individuals granted withholding of deportation or removal
Individuals with pending asylum or withholding of removal applications
Individuals with pending adjustment of status applications under INA §245
Individuals with pending applications for suspension of deportation, cancellation of removal, or NACARA relief

Applicants in these categories should expect a more frequent renewal cycle and should plan accordingly to avoid employment interruptions.

Which Categories Are Now Restricted to One Year of Validity?

Under H.R. 1, which became law on July 4, 2025, and was formally implemented by USCIS through a Federal Register notice on July 22, 2025, the following categories will now receive EADs valid for one year, or until the end of their parole or TPS period—whichever is earlier:

Individuals paroled as refugees
Individuals granted TPS
Individuals granted parole
Individuals with a pending TPS application
Spouses of entrepreneur parolees

These changes apply to all Form I-765 applications filed or pending on or after July 22, 2025.

Why Is USCIS Making These Changes?

The agency has explained that shorter validity periods allow USCIS to conduct more frequent security screenings. USCIS leadership has emphasized concerns regarding national security and the need to identify potential fraud or individuals who may pose risks.

While these changes do not alter eligibility standards, they do mean that many immigrants—especially those in long-pending categories—will now need to renew their documents far more often than in previous years.

What Should Applicants Do Now?

For anyone who currently holds an EAD or expects to apply soon, several steps are important:

Verify your category. Renewal timelines differ depending on which classification you fall under.
Track expiration dates carefully. With shorter validity periods, timely filing becomes even more critical.
Plan renewal filings early. Avoid waiting until the last minute, as processing times may fluctuate.
Seek trusted legal guidance. These new rules may affect employment stability, parole timelines, and future immigration filings.

Hola a todos, gracias por acompañarnos en otro Instagram Live de Actualidad Radio. Hoy vamos a hablar sobre migración y en segundos vamos a conectarnos con Martha Arias. Ella es una muy reconocida abogada experta en asuntos migratorios. Si están viendo esto en su feed, seguramente es una repetición de algo que hacemos todos los martes alrededor de las 5 de la tarde hora de Miami para abordar algunos temas relacionados con inmigración.

Cuáles son las leyes más recientes, qué es lo que puede cambiar próximamente, qué es lo que está pasando con temas, por ejemplo, con el nuevo presidente que va a asumir el próximo 20 de enero. Donald Trump va a cambiar algunas cosas en materia de inmigración o va a seguir todo exactamente igual que tanto podemos ver deportaciones o no. Muchas preguntas que no entendemos del todo, que queremos entender mejor. Así que esta es una gran oportunidad porque también vamos a abrir para que la gente que tenga alguna pregunta sobre inmigración pueda compartir también sus inquietudes con nosotros.

Entonces, si tienen alguna pregunta de inmigración, vamos a aprovechar este espacio y vamos a dejarla en la casilla de los comentarios. Ahí la vamos a contestar en breve con la abogada Martha Arias. Background para conocer un poco sobre la abogada. Martha Arias es una muy reconocida experta en asuntos migratorios, es una personalidad de radio y televisión de acá del sur de Florida y es una abogada licenciada para ejercer como abogada en asuntos migratorios en todo el territorio nacional. Recuerden que la ley de inmigración es una ley federal, no es como los abogados de pronto civiles o penales que tienen que sacar las licencias en cada uno de los estados en ley migratoria en Estados Unidos, es una ley que es la misma a nivel nacional.

Entonces, por eso siempre consultamos con ella porque tenemos muchas personas que se conectan, que nos ven desde Texas, desde New Jersey, desde cualquier cantidad de estados o desde el exterior. Hay gente que se conecta desde Colombia, desde Venezuela, así que muy bueno que también resolvamos muchas de esas inquietudes acá en este espacio con la abogada Martha Arias.

Normalmente no alcanzamos a realmente contestar muchos porque siempre el tiempo es corto. Hola Juan Camilo, buenas tardes, un saludo para usted y toda la audiencia que ya tenemos aquí en Actualidad Radio y en mi Instagram. Feliz semana, ya está empezando a ser frío, ¿cierto Juan Camilo?

JUAN CAMILO:
Ya, ya está comenzando acá en Miami a sentirse un poco más el frío. Entonces, de antemano y desde ya les invitamos a que sigan la cuenta de Martha Arias, que la encuentran acá arriba. Es Martha_Arias98. Eso es algo que les puede ayudar mucho a ustedes, por ejemplo, estar bien informados si se perdieron parte de estos Instagram Live. Luego quedan ahí publicados. Así que bueno, de antemano la invitación para que la sigan.

Abogada, antes de comenzar con algunos de los temas vamos vamos a también, por supuesto, darle oportunidad a los oyentes que están o a los televidentes, a los seguidores que están participando de este live y por acá ya tenemos algunas preguntas comenzando. El jefo dice tengo 10 años esperando la entrevista de miedo creíble una vez pregunté si se podía agilizar el trámite y la ahogada me dijo que se le cortó la pregunta que deportar no agilizar el trámite ya que el miedo creíble debía ser actual; pero el retardo del trámite es debido a la administración y no a mí, porque ese exceso de tiempo me perjudica. Ya sabemos con casos como el del jefe, porque tiene un caso, una humildencia medio creíble o esperando una cita de miedo creíble, pero si el miedo creíble tiene que ser reciente y lleva muchos años esperándolo, que podemos contarle a esta persona.

MARTHA ARIAS:
Ay, Juan Camilo, yo no sé si el señor tiene claro que está esperando la entrevista de miedo creíble o más bien la entrevista de su asilo, de su petición de asilo, porque aunque están relacionados son dos cosas distintas. La entrevista de miedo creíble la dan los oficiales de CBP o incluso de ICE a personas que están entrando por la frontera esas personas que se cruzan a la frontera, incluso los que hacen la aplicación en el CBP-1, la aplicación esta que tienen, estas personas son las que le dan en la entrevista de miedo creíble. Es una entrevista donde el gobierno de los Estados Unidos sabe que esta persona puede ser deportable porque no tiene, está entrando por la frontera y no tiene un parol o una visa para entrar y la persona reclama miedo de volver a su país y entonces le hacen esa entrevista de miedo creíble y si pasa la entrevista de miedo creíble lo puede ver a un juez de inmigración más adelante para su caso de deportación.

Va a tener la oportunidad de procesar esa aplicación de asilo ante un juez. En otras palabras, el miedo creíble o la entrevista de miedo creíble es el primer para un caso de asilo. También hay una entrevista de miedo creíble que se puede dar a la persona que entra por el aeropuerto. Llegó con una visa, entró al aeropuerto y dice yo tengo miedo de regresar a mi país, voy a aplicar para asilo. Los oficiales en el aeropuerto le hacen esa entrevista de miedo creíble. Esa tiene que ser inmediatamente antes de que lo dejen entrar. Por eso yo pienso que esta persona de pronto no está usando los términos correctos. Eso por eso le explico ahora.

La entrevista de asilo es otra cosa. Esa es la entrevista que le hace USCIS, si el caso está con ellos, para determinar el mérito de su asilo, de su aplicación. También, una vez se la niegan, si es que se la niegan, el juez le va a hacer otra audiencia o le va a hacer un proceso de deportación donde la persona puede continuar con su reclamo de asilo.

Entonces… Esta persona si lleva 10 años esperando, lo que me hace a mí pensar es que está esperando su entrevista de asilo. Es cierto, se están demorando mucho. Hay personas que tienen peticiones que presentaron en el 2012 y 2013 y todavía siguen pendiente. ¿Qué hay que hacer? La mayoría no pueden hacer mucho, lo que puede hacer es tratar de mandar una carta pidiendo la agilización que de hecho yo tengo algunos casos donde he pedido esta agilización, en algunos casos lo conceden en otros no. Así que no hay nada certeza que podamos decir vamos a invocar esta ley para que nos den el asilo antes, no, eso no existe. Ahora sí, hay algunos abogados que están presentando algunas demandas en las cortes distritales bajo una causa de, de, de, de, se llama cost of action bajo alguna sección que pues, eh, básicamente es decirle a la corte, eh, a un juez que por favor nos de, nos lo obliguen a inmigración a procesar mi caso más rápido. Eh, pero estos son casos que son costosos, la mayoría de la gente no va a pagar por esto, son casos que le pueden costar a una persona 15, 20 o 25 mil dólares y eso siendo económico. Entonces nadie presenta casi esas demandas porque es muy costoso.

Entonces, Juan Camilo, eso quería aclarar con la pregunta del señor y pues puede mandar una carta a su abogado pidiendo la agilización y la razón. Pero yo no creo que el señor se esté refiriendo a una entrevista de miedo creíble porque eso tenía que haber pasado hace mucho rato.

JUAN CAMILO:
Realmente es la de asilo. Pero la mejor recomendación en esos casos es como bien dice la abogada consultar con abogados expertos en migración. Nosotros consultamos con Martha Arias porque tiene mucha experiencia en estos temas y dejamos el teléfono abajo para que ustedes la consulten, porque acá tratamos de brevemente contestar algunas inquietudes, pero siempre nos quedamos cortos. Abogada, ¿qué nos puede contar sobre una actualización que hizo USCIS, USCIS, sobre la interpretación de algunos requisitos de la ciudadanía derivativa? ¿Esto qué significa y qué es lo que cambió?

MARTHA ARIAS:
Sí, a ver, no creo que haya cambiado tanto. De pronto sí se aclararon muchos puntos. Juan Camilo, La ciudadanía derivativa es la ciudadanía que adquieren los jóvenes o los niños que tienen menos de 18 años cuando sus padres se hacen ciudadanos. Salió una ley en el 2000 que se llama el Child Citizenship Act y esa ley estableció unos requisitos para poder ese niño recibir la ciudadanía derivativa de sus padres.

Uno de los requisitos a grandes rasgos son que el papá o la mamá se hagan ciudadanos antes de ese niño tener 18 años. Segundo, el niño haber entrado como residente de los Estados Unidos. Tercero, tiene que estar bajo la custodia de ese papá o mamá que se hizo ciudadano americano aquí en los Estados Unidos. Entonces hay algunos problemas de interpretación.

Le voy a dar un ejemplo. Entra María, hija de Pedro. Pedro se hizo ciudadano antes de María cumplir 18 años. Pedro pide a María. María recibe la residencia y entra a los Estados Unidos cuando María tiene 18 años y medio. Sí?.

Entonces María pide la ciudadanía derivativa porque va y le dice emigración. Mi papá se hizo ciudadano cuando yo tenía 16 años. Yo soy residente. Ya entré a los Estados Unidos. Yo estoy bajo la custodia, yo estuve bajo la, mi papá tenía mi custodia.

Mi papá tenía mi custodia en papel porque no, la niña no estaba aquí, María no estaba físicamente en los Estados Unidos antes de los 18 años, entró a los 18 años y medio. Entonces la interpretación a veces de la ley era María se considera que estaba bajo la custodia de Pedro sabiendo que tenía cuando entró 18 años y medio y nosotros sabemos aquí que la ciudad la mayoría de aquí se adquiere a los 18 años. Para para licor será los 21 para ciertas cosas de inmigración también será los 21; pero técnicamente la mayoría de edad se adquiere a los 18 años entonces después de los 18 años no hay custodia de los hijos de estos se acaba la custodia.

Entonces se considera que Pedro tenía la custodia de María antes de los 18 años, sabiendo que María vivía en su país y Pedro está en los Estados Unidos. Esa interpretación ha ocasionado problemas. Este tipo de actualización que hizo Inmigración hoy no es que cambie la ley, sino que está interpretando cuando la custodia de María se considera que Pedro sí la tenía si ella entró a los 18 años y medio, por ejemplo.

María venía cada año, cada dos años a los Estados Unidos, parezaba seis meses, ocho meses, estudiaba aquí. Bueno, ¿qué son los requisitos? Esa es la interpretación. Otra cosa, por ejemplo, hay personas que mandaban a hacer la modificación de la custodia de los padres. Si en el documento de custodia quedaba que la mamá de María, Juana, tenía la custodia de María, pero no mencionaba a Pedro.

Después, lo abogado fue, hizo una modificación a la custodia para que quedaran ese documento que Pedro también tenía la custodia de Juana. Y ese documento era el que presentaban a inmigración. Esta aclaración dice cuando Estados Unidos va a considerar que la custodia legal de ese padre tiene efectos retroactivos por si hubo alguna modificación que fue después de que se aplicó, me entiende, porque la gente hacía eso.

Entonces lo que hace inmigración con este documento que emitió esta semana es aclarar estas interpretaciones que son requisitos de la ley, pero que se prestan para interpretaciones erróneas o de distintos ángulos, y entonces inmigración está aclarando. Muy importante, consulten con su abogado, consulten a nuestra oficina; para decirle pues si usted está en un caso de esto esta nueva interpretación le favorece o no.

JUAN CAMILO:
Qué buena aclaración abogada y sobre todo porque muchas veces estos casos o estos procesos demoran muchos años uno comienza tramitando para los hijos con los menores de edad se hacen mayores de edad se hacen residentes luego quieren hacerse ciudadanos y resulta que en todo ese espacio cambiaron tres o cuatro veces las normas y de pronto uno se quedó pensando que las cosas siguen igual; a cuando el hijo tenía 10 años y resulta que no.

Entonces, por eso una gran recomendación es precisamente consultar con abogados expertos en migración para que nos ayuden a entender qué ha cambiado, qué tenemos que llenar mejor, qué tenemos que modificar y sobre todo cómo nos ahorramos tiempo, una cantidad de dinero y papeles que muchas veces solamente se pueden llenar una vez.

Abogada, ¿qué nos puede contar acá? Mamba Jota pregunta, ¿hay alguna aplicación, alguna diferencia para aplicar a asilo dependiendo de los países o cualquier país o algún ciudadano de cualquier país puede aplicar para un asilo?

MARTHA ARIAS:
En teoría, sí, cualquier país pudiera aplicar en teoría no hay que hacer un análisis, por ejemplo, le doy un ejemplo, si una persona viene de Inglaterra y va a aplicar asilo y lo va a aplicar por cuestiones políticas, bueno, tendríamos que ver qué es, cuál es el argumento, porque yo sinceramente que sea recientemente y podría cuestiones políticas tan graves, por ejemplo, en Inglaterra, para que una persona pueda calificar para ese asilo político.

Pero, por ejemplo, una persona viene de algún país del Medio Oriente y aplica para un asilo basado en cuestiones religiosas. Sabemos que la religión es un punto supremamente importante en estos países de Medio Oriente y que hay mujeres que pueden ser incluso asesinadas, si está en un país que tenga esas culturas religiosas tan arraigadas, que tengan que usar la burka y que tienen que taparse toda de negro y los ojos y el pelo.

Entonces, de pronto, una si los religiosos de un país de estos tienen más mérito. Entonces, la ley no dice estos países sí y estos países no, no. La ley establece unos requisitos y uno mira, yo por ejemplo le doy un ejemplo, yo tuve hace muchos años cuando Chile era la economía número uno a nivel de Latinoamérica, de Suramérica, era el país más estable económicamente de Latinoamérica, no me acuerdo en ese momento qué año fue, creo que fue alrededor de los 2006-2007, de hecho eso fue una de las razones que tuvo el gobierno de Estados Unidos para darle el visa waiver o la excepción de visado a Chile, su solidez económica.

Entonces había gente que venía y pedía, decía, yo soy chileno y quiero pedir asilo que por el gobierno. Y yo decía, pero bueno, pero por Dios, o sea, que así lo puedo, yo ayudarle a una persona a presentar de Chile, si es un país que está muy abundante y próspero en este momento y no hay en ese momento ningún conflicto político como que pueda ser meritorio a una si.

Entonces la mayoría de veces uno le dice no señor o sea yo no veo ningún caso de asilo en su caso o sea entonces bueno esos son los análisis que hace uno Juan Camilo para contestarle al señor no es que haya una lista esta si estas no sino que es toda una evaluación del país de la situación del reclamo de la persona a ver si encaja dentro de los requisitos de ese asilo.

JUAN CAMILO:
Interesante eso abogada y si tenemos alguna inquietud alguna duda. Lo mejor es que sigan consultando con la abogada Martha Arias. Nosotros dejamos el teléfono abajo porque es una abogada de mucha experiencia en asuntos migratorios que nos ayuda a entender muchos de estos temas. Y la idea es hacer un con algún problema migratorio o que quiere regularizar su situación o que quiere tiene algún problema que se está tardando mucho y quiere realmente como retomarlo. Así que muchas de estas alternativas las pueden encontrar con Martha Arias. Que además es una abogada que ya cuántos años ya ha estado usted ejerciendo abogada el derecho migratorio.

MARTHA ARIAS:
21 años Juan Camilo.

JUAN CAMILO:
En todo el país porque la ley migratoria es federal.

MARTHA ARIAS:
Es correcto. La ley de inmigración es federal. Quiere decir que aplican todo el territorio de los Estados Unidos en todos los estados. Sí, es cierto que hay ciertas interpretaciones de la ley de inmigración que varían dependiendo del circuito. Por ejemplo, aquí en el sur de la Florida es nosotros o en la Florida, pertenecemos al circuito 11. El circuito 11 puede tener una interpretación distinta de lo que es, por ejemplo, un delito por posesión de marihuana de menos de 30 gramos, porque la ley estatal que sanciona la posesión de marihuana está escrita de una forma distinta a, por ejemplo, un caso que está en Chicago. Entonces, la corte del circuito al que pertenece Chicago puede tener una interpretación distinta a la corte del circuito del circuito 11. Entonces ahí es donde uno como abogado tiene que tener experiencia. Porque si yo estoy en la Florida y tengo a un cliente que se llama Juanito. Juanito fue convicto de posesión de dos o tres posesiones de marihuana menos de 30 gramos en Chicago. Pero Juanito está en la Florida y lo mandaron a un proceso de deportación en la Florida.

¿Cuál es la ley del circuito o el precedente del circuito que yo debo mirar? La Florida o el que pertenece a Chicago. Creo que Chicago es el segundo circuito, si no estoy mal. Entonces yo tengo que ir a mirar la interpretación de Chicago porque la convicción fue allá. Aunque él esté en este circuito, yo tengo que mirar eso. Entonces eso es lo que uno como abogado tiene que saber para ubicarse en la defensa de las personas y ahí la experiencia es muy importante.

JUAN CAMILO:
tal vez para conocer un poquito más sobre usted abogada que siempre nos ayuda mucho a entender un poco lo que ocurre en materia migratoria. Cuéntanos en dónde estudió Derecho y cómo cómo se especializó en Derecho Migratorio.

MARTHA ARIAS:
Yo estudié Derecho aquí en la me grabe. Aquí hay un la carrera Derecho aquí se llama Juris Doctor. O sea, es un doctorado en leyes porque se supone que uno va al colegio de leyes; después de que obtiene un bachelor’s degree de cuatro, aquí la carrera son siete. Entonces yo fui a la Universidad de St. Thomas a ser mi Juris Doctor o el título de abogada de aquí, pero yo me gradué de abogada inicialmente en Colombia. Cuando vine aquí, hice la validación y me tocaba ir al colegio de leyes por los tres años, porque me vale mi título de Colombia como un bachelor y entonces voy al colegio de leyes tres años más. Pero yo también hice una maestría en leyes aquí en la Universidad de Miami. Entonces sí, son más o menos nueve años de leyes que estudié. De los cinco de Colombia más uno que uno hace una tesis en Colombia, yo diría seis. Y los tres de aquí sería nueve y el año de maestría sería uno.

Entonces, el total más o menos 10 años de estudio de leches. Eso ayuda mucho a la interpretación de la ley, cómo uno analiza los casos, Juan Camilo, porque, pues, obviamente, entre más estudia uno, como su mente analítica funciona distinto.

JUAN CAMILO:
Abogada, ¿y por qué? Porque se decantó por el derecho migratorio, porque no por habiendo tantas ramas penal, tributario, comercial. ¿Por qué dijo me vuelco a migración?

MARTHA ARIAS:
Esa es una buena pregunta y me alegra que estemos hablando en este momento de mi experiencia y de mi, vamos a decir, mis estudios y esta parte personal, porque también es importante que las personas que nos han escuchado y han visto por tanto tiempo acá, pues sepan quién es Martha Arias. La razón de que empecé a ejercer el derecho emigratorio, que ahora me encanta, digamos, esta rama de la ley, fue un accidente. Fue un accidente porque yo quería ejercer el derecho de impuestos, Taxation, y había trabajado en la universidad como haciendo investigaciones legales en impuestos por dos años y llevaba también muchos años haciendo y escribiendo artículos sobre derecho de impuestos, sobre todo relacionado con el Internet o lo que se llama el e-commerce. De hecho tengo un libro que escribí, bueno no escribí, lo ayudé a editar, yo no lo escribí, con una de las compañías que trabajaba editando esto. Pero entonces el derecho de impuesto, Juan Camilo, es muy demandante en el sentido de que uno entra a trabajar a las 8 de la mañana y sale a las 11 o 12 de la noche. Pero yo tenía un hijo, tengo un hijo y en ese momento mi hijo tenía cinco añitos. Iba a empezar su colegio y entonces yo tuve que decidir entre ser una madre ausente dedicada al derecho, el derecho de impuestos; que no me iba a ver, yo creo que ni los fines de semana, porque imagínense yo para salir y estar en el trabajo a las ocho y llegar a las once, no iba a ver a mi hijo. Y si le iba a ver el fin de semana, me imagino que yo iba a estar muerta, agotada, que quería dormir y no lo quería ni ver.

Entonces, entre ser una madre ausente o una madre presente, pues decidí ser una madre presente. Y mi jefe de la maestría en impuestos que era donde trabajaba haciendo la investigación de legales de impuestos, me digo, si tú quieres estar en la casa y tener un trabajo de 9 a 5 como abogada, vaya a una oficina pequeña y sea algo de familia o inmigración. Y yo me quedé pensando, Juan Camilo, oh my gosh, me va a tocar cambiar el área. Y sí, efectivamente, que ejercía el derecho migratorio y ahí empecé y le cogí cariño y amor a la práctica y eso me permitió ser una madre presente, trabajar. Mientras mi hijo iba al colegio, yo veía a mis clientes y en la tarde, yo me encerraba en una oficina en mi casa a trabajar, terminaba a las seis, hacía las tareas con mi hijo, le hacía la comida, conversábamos y lo acostaba y a las diez seguía trabajando hasta la una de la mañana o dos. Y así fue que crecí mi práctica Juan Camilo, o sea, tratando de manejar los dos roles de abogada y de madre y bueno, creo que creo que lo logré con los dos.

La abogada que gran historia. Gracias por compartirla un poco, porque siempre nos enfocamos tanto en su conocimiento, pero pero nos hacía falta también conocer un poco de dónde había venido y esa historia. Y ya entonces más de 20 años de experiencia en derecho migratorio.

USCIS Halts “Keeping Families Together” Parole Process Following Court Order

On November 13, 2024, the U.S. Citizenship and Immigration Services (USCIS) announced the suspension of the Keeping Families Together (KFT) parole process following a recent federal court ruling. This decision has substantial implications for individuals and families who were relying on this program to reunite with loved ones in the United States. This article provides an in-depth understanding of the background, the immediate actions taken by USCIS, the implications for affected individuals, and the next steps they should consider.

This action effectively leaves these applications in a state of limbo, which could be distressing for families who were depending on the program to reunite with their loved ones. If you are in this situation, it is advisable to consult with an immigration attorney to explore other options that may still be available to you, such as family-based petitions or other humanitarian programs.

Ceasing Intake of New Applications:

Effective immediately, USCIS will no longer accept new Form I-131F applications. Turned Away at Centers:

Anyone who appears at an ASC for an appointment related to Form I-131F will be turned away by USCIS personnel. This directive applies across the board, regardless of the location of the ASC or the specific case. It is crucial for applicants to understand that these appointments will not be honored, and attending the ASC will not provide an opportunity to move your case forward. This policy will remain in place until further instructions are issued by USCIS.

3. Cancellation of External Engagements

USCIS has also cancelled all external engagements related to the KFT parole process. Hello, everyone, and thank you for joining us on another Instagram Live session with Actualidad Radio. Today, we discussed key immigration topics, particularly how recent political changes might impact immigration policies. With the recent election of Donald Trump, many of you are understandably concerned. I encourage you to stay calm—there are things we can do, and not everything will change overnight.

First, remember that changes in immigration policy aren’t immediate. Laws must go through Congress, which is a lengthy process. If you have an immigration case in progress, check the status and ensure everything is in order. Often, there’s only so much an attorney can do to speed up the process. Patience is essential, as immigration cases do take time.

For those of you with Temporary Protected Status (TPS) or a deportation order, I know you may be anxious. While it’s possible that this administration might choose not to renew TPS for certain countries, the logistics of mass deportations make them unlikely to happen immediately. Also, remember that legal procedures grant many of you the right to appear before a judge, so please avoid any unnecessary panic.

Regarding DACA and other protections, don’t believe rumors about mass deportations just yet. Even under President Trump, it would take considerable time and resources for large-scale deportations to occur. That said, it’s a good idea to work with your employers on any immigration certifications or documentation you may need to prepare.

I also want to highlight some optimism. The new Republican administration and Congress could present an opportunity for positive immigration reform. There is talk of a bill known as the Dignity Act, which may include pathways for undocumented individuals to work toward residency by paying fines. Historically, major reforms have often come under Republican presidents, so let’s remain hopeful.

Lastly, I want to touch on the recent decision by a Texas federal judge to end the ‘Parole in Place’ program. This ruling impacts certain residency applications for people with military family members. Unfortunately, this decision limits some options for immigrants, and while it’s a district ruling, it could influence similar cases in other states.

In today’s program on Actualidad Radio with Juan Camilo, I addressed highly relevant immigration topics, discussed recent changes in the H-1B visa and the I-907 form (Request for Premium Processing), highlighting the importance of selecting premium processing at the beginning of the electronic application.

We also warned about fraud related to the National Interest Waiver and the EB2 visa. Many people are being misled with promises of easily obtaining residency under this category without truly meeting the strict requirements set by immigration authorities. We recommend always consulting with an expert attorney before investing in costly processes.

I answered audience questions about how to obtain marriage and divorce records for citizenship, and clarified that having a payment agreement with the IRS does not affect the citizenship application if payments are up to date. Additionally, we discussed travel permits, especially for those with TPS or DACA, emphasizing that they should not stay outside the country for more than six months.

I explained the new interpretations of the Child Status Protection Act (CSPA), which can benefit certain children over 21 years old in immigration processes, and advised consulting with an attorney to understand how to correctly apply this law.

Well, let’s see. Juan Camilo, the H-1B is the visa for professional people, those who have a university degree of four years or more. That visa is given for three years and can be extended for three more years if the person has an employer here in the United States.

Remember, the visas have a quota; in total, there are 85,000 per year, so they fill up quickly. Applications start in March; there’s an electronic registration, and if the person is selected in a process that’s like a visa lottery, that person can submit the petition on April 1st of each year, so there’s a deadline to apply.

Now, what’s the information I want to give people? Nowadays, this application for the H-1B visa, which is the I-129 form, can be done electronically. At the same time, you can also pay for the expedited processing time, which is called Premium Processing.

In an application called the I-907 form. What I want to tell people is that nowadays, since it can be done electronically, if you’re going to do both petitions—the H-1B visa petition and the premium processing application—you have, at the beginning of the I-129 application, the person must indicate that they will apply for Premium Processing; otherwise, the electronic system will not let you make that decision at the end of the electronic application. That’s the important part.

That’s good because it’s not like it’s an option you can change midway or at the end.

Well, I think he can do it electronically. If he at least remembers in which county it was—if it was in Queens, if it was in Crescent, in Brooklyn—he can go to the Clerk of Court‘s website. So, if it’s Clerk of Court New York, Clerk of Court Queens, he can go to the website, and there should be a section for civil records, and he can go there to see if he can obtain them.

Those records are public, just like here in Miami-Dade County. I can search public civil or criminal records of people. So that’s the easiest way he can do it.

The other way is to pay someone to go to the office where the records are and get a copy of the divorce.

When a person pays a debt through an agreement with the IRS, if the person is up to date with the payments—that is, they’re paying according to the agreement they made with the IRS—they have no problems with citizenship, but they will have to present two things.

One, the agreement they made, and two, proof that they are up to date with the payments.

Attorney, what can you tell us about a fraud scandal we’re seeing where people promise a ‘green card’, promising permanent residence through the National Interest Waiver and the preferences of the EB-2 visa? What’s that about?

Attorney Martha Arias:

That’s something people need to be careful about, especially because the investment is very high.

Let me explain, the EB-2 is a preference for people who have extraordinary abilities in an area that can be the arts, science, or sports as well.

So in that area, what’s happening? I’ve heard, and many people have been victims of this, that they promise that if you have a four-year university degree and more than five years of experience, you will automatically qualify to apply for this residence under this preference of extraordinary abilities, by submitting a National Interest Waiver, which basically is so that the person can do it alone without needing a job offer from an employer; basically, that’s what the National Interest Waiver is.

So, what’s happening? Many people are selling it, we’re seeing it in conferences, and we’re seeing it constantly, they’re selling the idea that it’s very easy, that if you have that university degree and those five years of experience, you can do it easily. And it’s not like that, Juan Camilo, because the evaluation of the requirements for the National Interest Waiver and the requirements for the EB-2 is very detailed; immigration analyzes each of the criteria needed to receive a residence under this preference in detail.

So it’s very… people have to be careful, why? What’s happening? Nowadays, number one, there are quotas assigned for that visa, so many people are applying, and so many people are applying that the quotas are being filled up, so there’s less and less availability of those visas, number one.

Number two, it’s getting more difficult each day to obtain an approval precisely because there’s been a lot of fraud, many of these petitions without merit are being submitted, so they’re reviewing them more carefully. I invite people that before investing in this, which is extremely costly—because a petition like that can cost between, I don’t know, $12,000-$13,000 to $20,000—before you invest, be very careful to analyze well if this is something that has merit and something that has at least a 50% chance of winning.

Juan Camilo:

It’s very important; we always make this recommendation, but it’s good to insist on this. The immigration issue is a very big concern for many; there are many people who really have financial worries, personal issues, health issues, the immigration issue is a really big concern for many people.

And sadly, there are people who take advantage of people’s anxiety, people’s needs, people’s concerns, and they promise things that are really not true. They tell them, ‘Look, I’ll get you the residence in such a time, I’ll help you get the papers, and I can make everything faster.’

This is a matter that we cannot do improvised; the immigration issue is so important that we always have to seek guidance from people who know, from experts, from expert lawyers and licensed in immigration in the United States, who can really tell us, ‘Look, this is a lie.

This is fine; let’s do it this way; this is the best way.’ They might tell you, ‘What you’re doing is not good,’ or they might tell you, ‘You’re doing well, but let’s do it this way to speed up the process.’ I think it can save us a lot of money, a lot of time, and many headaches; let’s not do improvised things when it comes to immigration.

Attorney Martha Arias:

People who have a travel permit, normally… let’s see, the travel permit is divided into several categories. So it’s not very clear which one she has, but I’ll quickly answer this.

There’s a travel permit called Reentry Permit, which is given to those who are residents of the United States, to be able to stay outside for more than a year without losing their residence. So those people can basically request it for up to two years, which means that person can be outside for up to two years.

Now, there’s another travel permit, which is the one people present when they have either a pending residence petition or they have TPS, or they even have DACA. When a person is applying for residence, they request a travel permit; that permit is called Advance Parole. Advance Parole is a permit that allows the person to travel outside the country and re-enter to resume their residence petition.

In that case, the person can leave normally, although they give it for up to a year, the person should never stay more than six months. So, I have clients who, when they have the Advance Parole, which they give for a year, they travel, they stay a reasonable term—what could be two weeks, three weeks—they return, and if they have to go out again, they can, because normally immigration gives it for a year. It’s not very advisable; I always tell my clients if they’re applying for residence, not to stay more than six months outside.

Now, there are people who have TPS or DACA, for example, which are protection statuses, and they also request a travel permit. For those people too, particularly those who have DACA, never, never, never, never is it advisable to stay more than six months outside U.S. That can have a serious repercussion when they return and even more so when they go to renew that DACA.

TPS also implies a problem if the person stays more than six months. So, that’s the conclusion: if you have a travel permit for TPS or DACA, never dare to stay that long outside. I would say more than three weeks or more than a month is risking it. Although they will be able to do it, but never, never, never more than six months.

Now that you mentioned DACA, about the young people or children, there are new rules of interpretation for the Child Status Protection Act, for the Protection Law of Minors’ Status. What’s that about?

Attorney Martha Arias:

Yes, let’s see, the law for the protection of minors, as you say in English, is called the Child Status Protection Act. The law for the protection of minors, or CSPA as we lawyers call it by its initials, is a law that allows certain minors, who are either direct beneficiaries of a petition or derivative beneficiaries of that petition, to receive it even if they are over 21 years old.

To clarify, the term derivative refers to the one who receives the benefits of a petition that their father or mother has. For example, an American citizen woman requests her adult single son, but that man has two or three children; those children will be able to derive benefits from the petition, they are derivative beneficiaries, but the principal would be the father or mother.

So, the Child Status Protection Act allows that minor who has already turned 21 to still be considered a minor and receive the immigration benefit. There are rules that apply, among them, the first is to apply a mathematical formula that, in summary, is like reducing the term that immigration took to process the petition; it’s reduced from the age that the minor has at the time that petition became available.

I won’t delve into that because people get tangled up with this math, but well, that’s the rule in simple terms, but there are other additional requirements, and that’s what we’re going to discuss now. The additional requirement is that the minor has to request the right or the immigration benefit within the year after it becomes available.

What happens? The availability depends on a bulletin called the Visa Bulletin, and that bulletin fluctuates; sometimes it moves forward, and sometimes it goes back when there’s a delay or a retrogression. So that means that minor could have requested the residence in the year, but then we’re going to take the first date or the second date when it retrogressed. So there was the question that the law hadn’t clarified; recently, immigration clarified that the date we’re going to take is the second date, that is, the date where there was a retrogression.

If the person wants to use the second date, they will have to state the extraordinary reason why they didn’t do it on the first date. There will be a problem because obviously, the longer they take to apply, the older they will be, and the calculation might not work out. So that’s where I tell people, consult an immigration lawyer if you have children who are direct beneficiaries or derivative beneficiaries of a petition who have passed 21 years, consult with an immigration lawyer who knows how to apply this law of protection of minors to be sure if they will qualify for that protection and if they will be able to be direct beneficiaries of the petition or not.

So that’s very important, Juan Camilo. It’s one of the most complex laws and least known by people, and obviously, most notaries or processors that exist in abundance are not very familiar with this law; they’re not very good at applying it, so you always have to seek a lawyer.

Juan Camilo:

Glad you make that clarification, attorney, because many people also handle time thinking that the times of mortals are the same as immigration times, and it turns out they’re not. It turns out that sometimes they set us laws or some procedures that we can do if people are of a certain age or have been in a certain condition for a certain time, and then those papers take many years, and the conditions change. And one doesn’t understand how someone who is already of legal age is going to benefit from a program that was originally for minors or something similar. So thanks for making that clarification and helping us understand this topic.

Attorney, of course, we are in an immigration era, we’re in a presidential campaign, and we’re already two weeks away from having a new elected president of the United States. Former President Trump announced recently what his immigration policy will be for 2025. Can you tell us about that?

Attorney Martha Arias:

Yes, indeed, we’re less than a month away, I believe, from the presidential elections. Basically, what I’ve seen announced by President Trump, he says there will be massive or greater deportations. Some critics say, for example, this can’t happen because obviously there are benefits that people have rights to in the courts, and also looking at the statistics, during President Trump’s time, they didn’t manage to deport even 355,000 people, and this is compared to the deportations that occurred during Obama’s time. During Obama’s time, who we all know was a Democratic president, in 2013 there were 432,000 deportations, one of the highest in the history of presidents.

So compared to Obama, really Trump didn’t deport as many people. Now he talks about massive deportations, but well, obviously this is something he’s stating. He claims he’s going to use the National Guard to help control the immigration part. I think as president he can and has federal authority to handle these immigration issues with the National Guard, especially at the border, but well, we repeat, this is something we’ll have to see if he achieves.

There’s an old law called the Alien Enemies Act, a law that came out in 1798. The law allows the President of the United States, that is, the head of the executive, to deport people who are not citizens of this country and are not legally here and who belong or have the nationality of a country that is at war with the United States.

So, that is to say, if the United States is at war with a country and there’s a national from that country, the president, by authority of this Alien Enemies Act, can deport him. He says he’s going to use this law.

Now, at this moment there’s no war, let’s say, declared with the United States against many countries, but well, there may be some countries where the United States might consider it’s at war, and well, then that would be it. The majority of countries that are sending immigrants to the United States are countries from Latin America and Central America, and as far as I know, the United States is not at war with any of them. So I think there won’t be many people he can deport using this law.

Now, another thing, he intends to re-implement these measures that he implemented during his presidency to face the case at the border and force people who want to request asylum in the United States to return to Mexico and wait there for the asylum petition process, which is another thing being discussed.

I’m going to tell you something, Juan Camilo, what I think; what I just said is public on social networks, on the president’s website, Mr. Trump’s. What I think is this: most people act out of fear, so most people when they’re told ‘Oh, massive deportations,‘ many people self-deport, many people during his time left because they were scared to death.

And I think what I see most problematic is that there aren’t many laws that benefit people who are illegal in the United States and who don’t have a way to stay, and so it seems to me that’s where the biggest problem of immigration in this country lies, which could be solved with a law from Congress if there were a consensus, which there isn’t yet.

So I think what Mr. Trump can do, during the time he was president, he had a very, very knowledgeable advisor on immigration law, Mr. Miller. I see Mr. Miller as a person who knows extremely well; I haven’t met another person who doesn’t even work in immigration who knows immigration law like this man, and he’s an advisor who, let’s say, can advise the president and cause a lot of, I don’t know if damage, but implement in a strict way, let’s say, the immigration law.

Because Miller had very strong immigration policies, and all under the law, because he’s a super connoisseur of the law, so we’ll see what happens.

But if we go to the other side, the Democrats‘ side, Mrs. Harris, she has also talked about enforcing the border, that she will also have more troops or that she will be more careful, let’s say, in terms of security at that border, especially to eliminate drug trafficking, fentanyl, and everything that’s entering through that border.

Well, let’s say she might do it soon, but the problem is that we haven’t seen that policy in this administration. She is the vice president, and in this administration, basically the border is more than open, so yes, there are officers at the border obviously, but there’s not such strict control.

Perhaps Mrs. Harris will follow President Biden’s policies regarding asylum; in fact, on some platforms, I’ve read that she will continue with the same policies, particularly those issued this year that greatly limit asylum, people entering through the border. So she’s not talking about being so permissive, let’s use that word, with people entering through the border to request asylum, that is, the policies she’s talking about are also quite limiting.

So sometimes people get scared by the one who talks the most, but then the other one who seems quieter maybe deports more. I was looking at Obama’s cases, he was always an excellent speaker, a very peaceful person, but the president who deported the most people and is a Democrat, and with his very pleasant smile and excellent oratory, deported many people without needing to make much noise.

It could be a month, it could be three months, but generally, in less than three months, the person should already have a response after sending, it could be the response to the Request for Evidence.

Abogada Martha Arias:
No si está al día con los pagos. Cuando la persona paga una deuda a través de un acuerdo que hace con el IRS, si la persona está al día con los pagos, es decir, está pagando de acuerdo al acuerdo que hizo con el IRS, no tiene problemas con la ciudadanía, pero sí va a tener que presentar dos cosas.

Una, el acuerdo que hizo y dos, la prueba de que está al día con los pagos.

Juan Camilo:

Abogada, ¿qué nos puede contar sobre algún escándalo de fraude que estamos viendo para gente que promete una ‘gringa’, que promete una residencia permanente a través del National Interest Waiver y las preferencias de la visa EB-2, de qué se trata eso?

Abogada Martha Arias:
Eso es algo que la gente tiene que tener cuidado sobre todo porque la inversión es muy alta.

Me explico, la EB-2 es una preferencia para personas que tienen habilidades extraordinarias en un área que puede ser las artes, la ciencia, los deportes también.

Entonces en esa área, ¿qué pasa? He escuchado y mucha gente que ha víctima de esto que prometen que si usted tiene un título universitario de cuatro años y más de cinco años de experiencia, que automáticamente va a calificar para pedir esta residencia en esa preferencia de habilidades extraordinarias, presentando un waiver de interés nacional que básicamente es para que la persona lo haga sola sin necesidad de una oferta de empleo de un empleador, básicamente eso es lo que es el National Interest Waiver.

Entonces, ¿qué pasa? Muchos personales lo están vendiendo, lo estamos viendo en conferencias y lo estamos viendo constantemente, que están vendiendo la idea que es como muy fácil que si usted tiene, pues ese título universitario y esos cinco años de experiencia, ya se hace fácilmente. Y no es así Juan Camilo, porque la valoración de los requisitos del National Interest Waiver y de los requisitos de la EB2 es muy detallada; como inmigración analiza cada uno de los criterios que se necesitan, para recibir una residencia bajo esta preferencia, es detallado.

Entonces es muy… la gente tiene que tener cuidado, ¿por qué? ¿Qué es lo que está pasando? Hoy en día número uno que también hay unas cuotas asignadas para esa visa, entonces tanta gente está aplicando y tanta gente está aplicando, que se están copando las cuotas, entonces cada vez hay menos disponibilidad de esas visas, número uno.

Número dos, está cada día más difícil obtener una aprobación precisamente porque ahí se ha estado dando mucho fraude, se están dando mucho estas peticiones sin mérito; entonces como que las están revisando con más cuidado. Yo invito a las personas que antes de invertir en esto que es supremamente costoso, porque una petición de esa puede salir entre, no sé yo, $12.000-$13.000 a $20.000, antes de que invierta, tenga mucho cuidado con analizar bien, si este es algo que tiene mérito y algo que tiene siquiera 50% de chance de ganarlo.

Juan Camilo:
Es muy importante que siempre hacemos esta recomendación, pero es bueno que insistamos en esto. El tema migratorio para muchos es una preocupación muy grande, hay muchas personas que realmente tienen preocupaciones de dinero, tienen preocupaciones por temas personales, por temas de salud, el tema migratorio es una preocupación realmente grande para mucha gente.

Y tristemente hay personas que se aprovechan de la angustia de la gente, de la necesidad de la gente, de las preocupaciones de la gente, y les prometen unas cosas que realmente no son ciertas, que les dicen, vea, yo le consigo la residencia en tanto tiempo, yo le ayudaré a tener los papeles y yo puedo hacer que todo sea más acelerado.

Este es un asunto del que nosotros no podemos hacerlo de forma improvisada, el tema migratorio es algo tan importante que tenemos siempre que orientarnos con personas que sepan, con personas expertas, con abogados expertos y licenciados en inmigración en los Estados Unidos, que realmente nos puedan decir, vea esto, mentira.

Esto está bien, vamos a hacerlo por este lado, esta es la mejor forma, de pronto le pueden decir, ¿eso que usted viene haciendo? Eso no es para bien, o de pronto le pueden decir, sí va bien, pero vamos a hacerlo de esta forma para acelerar el proceso. Creo que nos puede ahorrar mucho dinero, mucho tiempo y muchísimos dolores de cabeza, no hagamos temas improvisados cuando se trata de inmigración.

Vamos con más preguntas, si no alcanzamos a abordarlas y ya están llegando otras más, pueden llamar al teléfono que dejamos abajo, que es el (305) 671-0018, es el teléfono de Martha Arias, de su despacho de abogados. Por acá nos saludan Renato, Enrique, Rigoberto, Camila Vanegas tiene una pregunta: “¿Cuánto tiempo puedo estar por fuera de Estados Unidos con permiso de viajes?”

Abogada Martha Arias:
Las personas que tienen un permiso de viaje, normalmente, a ver, el permiso de viaje se divide en varias categorías. Entonces no es muy claro cuál es el que ella tiene, pero voy a rápidamente contestarle esto.

Hay un permiso de viaje que se llama Reentry Permit, que se lo dan a los que son residentes de los Estados Unidos, para poder estar por fuera más de un año sin perder su residencia. Entonces esas personas básicamente pueden pedirlo hasta por dos años, lo que quiere decir que esa persona puede estar por fuera hasta los dos años.

Ahora, hay otro permiso de viaje, que es el que presentan las personas cuando tienen o una petición de residencia pendiente o tienen TPS, o tienen incluso el DACA. Cuando la persona está aplicando para la residencia, pide un permiso de viaje, ese permiso se llama Advance Parole. Advance Parole, es un permiso que le permite a la persona viajar fuera del país y volver a entrar a retomar su petición de residencia.

En ese caso la persona puede salir normalmente, aunque lo dan hasta por un año, la persona no debería nunca quedarse más de seis meses. Entonces, yo tengo clientes que cuando tienen el Advance Parole, que lo dan por un año, viajan, se quedan un término razonable, lo que sean dos semanas, tres semanas, regresan y después si tienen que volver a salir, pueden salir, porque normalmente migración lo da por un año. No es muy aconsejable, siempre digo a mis clientes si están aplicando por una residencia, no quedarse más de seis meses por fuera.

Ahora, hay personas que tienen el TPS o el DACA, por ejemplo, que son estatus de protección y piden también un permiso de viaje. A esas personas también, particularmente a los que tengan el DACA, nunca nunca nunca nunca es aconsejable que se queden más de seis meses por fuera. Eso puede tener una repercusión grave en el momento que regresan y sobre todo más aún cuando vayan a renovar ese DACA.

El TPS también implica un problema si la persona se queda más de seis meses. Entonces, esa es la conclusión, si tienen un permiso de viaje de TPS o DACA, nunca se atreva a quedarse tanto por fuera. Yo diría más de tres semanas o más de un mes, es arriesgar. Aunque lo van a poder hacer, pero nunca nunca nunca más de seis meses.

Juan Camilo:

Ahora que hablaba sobre los DACA, sobre los muchachos o los niños, hay unas nuevas reglas de interpretación para el Child Status Protection Act, para la Ley de Protección de Estatus de los Menores. ¿De qué se trata eso?

Abogada Martha Arias:
Sí, a ver, la ley de protección al menor, como usted la diga en inglés, se llama así Child Status Protection Act. La ley de protección al menor o CSPA, como le llamamos nosotros los abogados por sus siglas, es una ley que le permite a ciertos menores, que sean o beneficiarios directos de una petición o de derivativos beneficiarios de esa petición, recibirla aunque pasen de los 21 años.

Aclaro, el término de derivativo es a que el que recibe los beneficios de una petición que tiene su padre o su mamá. Por ejemplo, es una señora ciudadana americana pide a su hijo adulto soltero, pero ese señor tiene dos o tres hijos, esos hijos van a poder derivar beneficios de la petición, son beneficiarios derivativos, pero el principal sería el papá o la mamá.

Entonces, el Child Status Protection Act permite que ese menor que ha cumplido ya 21 años, todavía sea considerado como menor y recibir el beneficio migratorio. Hay unas reglas que se aplican, dentro de ellas la primera es hay que aplicar una fórmula matemática que en resumen es como reducir el término que migración se demoró el proceso de la petición, se le reduce a la edad que tenga el menor en el momento en que esa petición se hizo disponible.

No voy a ahondar en eso porque la gente se pega una enredada con esta matemática, pero bueno, esa es la regla en términos sencillos, pero hay otros requisitos adicionales y esa es la que vamos ahora con esta información. El requisito adicional es que el menor tiene que pedir el derecho o el beneficio migratorio dentro del año después de que se hace disponible.

¿Qué pasa? La disponibilidad depende de un boletín que se llama el boletín de visas y ese boletín fluctúa, a veces se adelanta y a veces se atrasa; cuando hay un atraso o una retrogresión. Entonces quiere decir que ese menor pudo haber pedido la residencia al año, pero entonces vamos a tomar la primera fecha o la segunda fecha cuando se retrocedió. Entonces ahí estaba la pregunta que la ley no había aclarado, hace poquito inmigración aclaró que la fecha que vamos a tomar es la segunda fecha, o sea la fecha donde hubo una retrogresión.

La persona si quiere usar la primera fecha va a tener que decir la razón extraordinaria de por qué no lo hizo en la primera fecha. Ahí va a haber un problema porque obviamente entre más se demoren en aplicar pues más viejitos van a estar y la cuenta puede que no les dé. Entonces ahí es donde le digo yo a las personas, consulten a un abogado de inmigración si tienen hijos que son beneficiarios directos o derivativos de una petición que hayan pasado los 21 años, consulten con un abogado de inmigración que es el que sabe cómo aplicar esta ley de protección al menor para estar seguro si van a calificar para esa protección y si van a poder ser directos beneficiarios de la petición o no.

Entonces eso es bien importante, Juan Camilo. Es una de las leyes más complejas y de menos conocidas por las personas y obviamente la mayoría de notarios o tramitadores que existen por montones, no están muy familiarizados con esta ley, no son muy buenos para aplicarla, entonces siempre hay que buscar un abogado.

Juan Camilo:
Qué bueno que haga la aclaración, abogada, porque también mucha gente maneja los tiempos pensando que los tiempos de los mortales son los mismos tiempos de inmigración y resulta que no, resulta que a veces nos ponen unas leyes o algunos trámites que podemos hacer si las personas tienen tantos años o determinada edad o llevan tanto tiempo en determinada condición y luego se demoran esos papeles muchos años y pues las condiciones cambian. Y uno no entiende si cómo se va a beneficiar alguien que ya mayor de edad de un programa que era originalmente para menores o algo similar. Así que gracias por hacer esa aclaración y por ayudarnos a entender este tema.

Abogada, por supuesto estamos en una época migratoria, estamos en campaña presidencial y ya estamos a dos semanas de que tengamos un nuevo presidente electo de Estados Unidos. El expresidente Trump anunció hace poco también cuál va a ser su política de migración para el 2025. ¿Y nos puede contar sobre eso?

Abogada Martha Arias:
Sí, efectivamente ya estamos a menos de un mes yo creo de las elecciones presidenciales. Básicamente lo que he visto anunciado por el presidente Trump, él dice que va a haber unas deportaciones masivas o mayores. Algunos críticos dicen, por ejemplo, esto no puede pasar porque obviamente hay beneficios que las personas tienen derecho en las cortes y también mirando las estadísticas en la época del presidente Trump no se alcanzaron a deportar ni 355.000 personas y esto lo comparan con las deportaciones que hubo en la época de Obama. La época de Obama, que obviamente todos sabemos era un presidente demócrata, en el 2013 hubo 432.000 deportaciones, es una de las más altas en la historia de los presidentes.

Entonces comparado con Obama realmente Trump no deportó tantas personas. Ahora pues habla de unas deportaciones masivas, pero bueno, obviamente esto es algo que él está aduciendo. Él aduce que va a usar la Guardia Nacional, el National Guard, para ayudar a controlar la parte migratoria. Creo que como presidente puede y tiene la autoridad federal para manejar estos temas de inmigración con la Guardia Nacional, sobre todo en la frontera, pero bueno, esto volvemos a repetir, es algo pues que tendremos que mirar si lo logra.

Hay una ley antigua que se llama el Alien Enemies Act, es una ley que salió en 1798. La ley le permite al presidente de los Estados Unidos, o sea el jefe del ejecutivo, deportar a personas que no sean ciudadanos de este país y no estén legalmente y que pertenezcan o que tengan la nacionalidad de un país que está en guerra con los Estados Unidos.

Entonces es decir, si Estados Unidos está en guerra con un país y hay un nacional de ese país, el presidente por autoridad de esta ley Alien Enemies Act lo puede deportar. Él dice que va a usar esta ley. Ahora, en este momento no hay una guerra, vamos a decir, declarada con Estados Unidos contra muchos países, pero bueno, si habrá algunos países donde Estados Unidos pueda considerar que está en guerra y bueno, entonces esa sería. La mayoría de los países que están mandando inmigración a los Estados Unidos son los países de Latinoamérica y Centroamérica y pues Estados Unidos que yo sepa no está en guerra con ninguno de ellos.

Entonces pues creo que no va a ser mucha la gente que pueda deportar usando esta ley.

Ahora, otra cosa, él pretende volver a implantar estas medidas que implantó durante su presidencia para enfrentar el caso en la frontera y obligar a las personas que quieren pedir asilo en los Estados Unidos a regresar a México y esperar allí el proceso de petición de asilo, que es otra cosa de la que se está hablando.

Yo le voy a decir una cosa, Juan Camilo, que lo que opino yo, esto que acabo de decir está público en las redes sociales, en la página web del presidente, del señor Trump. Yo lo que pienso es esto, la mayoría de la gente actúa por miedo, entonces la mayoría de la gente cuando le dicen ‘Uy, deportaciones masivas’, mucha gente se auto-deporta, mucha gente en la época de él se iba porque estaban muertos de susto.

Y pienso que lo que yo más veo problemático es que no hay muchas leyes que beneficien a las personas que están ilegales en los Estados Unidos y que no tienen una forma de quedarse, y entonces me parece que ahí es donde está el mayor problema de la inmigración en este país, que pudiera ser resuelto con una ley del Congreso si hubiera un consenso, no lo hay todavía.

Entonces pues pienso que lo que el señor Trump puede hacer, en la época que él fue presidente tuvo un asesor muy muy conocedor de la ley de inmigración que es el señor Miller. Yo veo al señor Miller como una persona que sabe extremadamente, entonces yo no he conocido otra persona que ni siquiera trabaja en inmigración que sepa la ley de inmigración como este señor, y este es un asesor que, vamos a decir, puede asesorar al presidente y causar mucho mucho, no sé si daño, pero implantar en una forma estricta, vamos a decirlo así, la ley de inmigración.

Porque Miller tenía unas políticas bien fuertes migratorias y todas bajo la ley, porque la ley súper conocedor de la ley, así que vamos a ver qué pasa.

Pero si vamos al otro lado, al lado de los demócratas, la señora Harris, ella también ha hablado de que va a enfocar la frontera, que va a tener también más tropas o que va a ser más cuidadosa, vamos a decir, en cuanto a seguridad en esa frontera, sobre todo para eliminar el tráfico de drogas, de fentanilo y de todo lo que está entrando por esa frontera.

Bueno, vamos a decir que pronto lo puede hacer, pero el problema es que no hemos visto esa política en esta administración. Ella es la vicepresidenta y en esta administración básicamente la frontera está más que abierta, entonces sí hay oficiales en la frontera obviamente, pero no hay un control tan estricto.

De pronto la señora Harris seguirá las políticas del presidente Biden en cuanto a los asilos, de hecho en alguna de las plataformas he leído que ella va a continuar con las mismas políticas, particularmente las que se emitieron este año que limitan mucho los asilos, las personas que entran por la frontera. O sea que ella tampoco es que esté hablando que va a ser tan permisiva, vamos a usar esa palabra, con las personas que estén entrando por la frontera a pedir asilo, o sea las políticas que ella está hablando también son bastante limitantes.

Entonces a veces la gente se asusta por el que más habla, pero entonces el otro que se ve como más tranquilito a lo mejor deporta más. Yo miraba los casos de Obama, siempre fue un excelente orador, una persona muy pacífica, pero el presidente que más personas ha deportado y es demócrata, y con su sonrisa bien agradable y con su excelente oratoria deportó muchas personas sin necesidad de hacer mucha bulla.

Juan Camilo:
Pues abogada, gracias por generalizar y sí, es que esa es la inmigración y muy de cerca el tema, es bueno que la gente también considere sus opiniones para tomar también ellos las propias.

Antes de irnos, brevemente una pregunta extra que nos dejaba por acá otra persona conectada. Joel Lennon pregunta: “¿En cuánto tiempo me darán una respuesta de perdón I-601? Hice un RFE, un perdón I601.”

Abogada Martha Arias:
Sí, el perdón I-601, la aplicación se usa para muchas cosas, no sólo para personas que ya han sido convictas de delitos sino también para presencia ilegal. Lo que le puedo decir es esto: normalmente cuando hay un requerimiento de evidencias, es lo que quiere decir un RFE, Request for Evidence, cuando hay un requerimiento de evidencias y la persona contesta, la decisión viene muy cerca de ser, en términos generales, cerca de cuánto después. Así como puede ser un mes, puede ser tres meses, pero en términos generales en menos de tres meses la persona debería ya tener una respuesta después de que envía, puede ser la contestación al requerimiento de evidencias.

Juan Camilo:

The U.S. government has confirmed that it will not renew the parole for Venezuelans, Cubans, Nicaraguans, and Haitians. If you entered the U.S. under this program, especially my Venezuelan clients whose parole expires at the end of October 2024, now is the time to act. You can still apply for asylum, TPS, or adjust your status through marriage to a U.S. citizen. It’s critical to make these decisions now to avoid losing your legal status.

For those from Nicaragua and Haiti, your parole will begin to expire in January 2025, and unfortunately, there will be no new applicants accepted into the program. Martha Arias:
Yes, Juan Camilo. Look, initially this information was leaked, let’s say, someone from the administration informed that the humanitarian parole for those who were already here would not be renewed or extended. But yesterday, the government officially stated that the humanitarian parole for these countries—Haiti, Venezuela, Cuba, and Nicaragua—will not continue.

This is the humanitarian parole that grants two years to legally stay in the United States with a work permit. The problem we are seeing is that the parole started in October 2022 with Venezuelans. So, those first Venezuelans who entered under the parole are about to expire now at the end of this October 2024. Those people, if they have not applied for asylum, if they have not applied for TPS, and have no other benefit, will have to leave the United States once the parole expires. If Venezuelan individuals whose parole is expiring have TPS, they can continue in the United States under that TPS. If they are married to U.S. citizens, they can also apply for residency through that American citizen.

Or if they have applied for asylum and their asylum case is pending, they can also continue under that asylum. In other words, they need to do something that gives them a legal immigration status for the remainder of their stay here, or otherwise, they must leave the country.

Juan Camilo:
And what will happen with the rest? The humanitarian parole for Nicaragua and Haiti, which will start expiring in January 2025.

Martha Arias:
Yes, because for those countries, it was established in January 2023. No, residents cannot petition for married children. So, if a resident petitions for a single child and that child gets married, the petition is void. Based on what you’re saying, Juan, a person from Nicaragua helped another person from Nicaragua fill out an asylum application, and this man was accused of immigration fraud. He charged almost as much as a lawyer, supposedly saying he didn’t advise on asylum cases, that he had someone else who helped or referred the cases, but in reality, he was the one doing these asylum cases and was convicted.

This is because filling out an immigration application involves giving legal advice. It’s not just filling out a form. That form has questions that are drafted and designed according to the law. So, a person needs to know immigration law to fill out that application, and it’s considered legal advice. The Florida Bar considers that anyone giving immigration advice must be a lawyer, and a person cannot fill out an application without the support of a lawyer. Even if they are a paralegal or notary, they must be under the supervision of a lawyer.

This includes a petition known as I-130, which is what the person would file for their daughter, along with the I-485, which is the residency application. Of course, it includes many other applications that are part of the adjustment of status package.

Now, if the daughter is outside the United States, the process is different. Only the first part of the petition, the I-130, is filed. If the daughter is in the U.S. but entered illegally, meaning she entered through the border without inspection, then adjustment of status cannot be filed, only the first part of the petition, the I-130.

So, I’m explaining to people that not all petitions are done in the same way. That’s why it’s important to consult us, immigration attorneys, so we can tell you the correct steps to follow and prevent you from losing money as well.

Once we explain the steps, the person can decide whether to do it themselves or seek a lawyer. But first, they need to get informed, as not all cases are the same. We’ve had clients who are citizens and petitioned for their children, but the children entered the country illegally through the border. So, the petition is filed, but if the child is still a minor, they must leave the U.S. before turning 18 to receive their residency abroad. This must be done before they accrue unlawful presence and have to request a waiver.

These are all things that immigration lawyers are trained to advise on. It’s not just filling out a form; it’s also understanding the particular situation and the exact forms that the person must complete.

Juan Camilo:
Of course. And this is a great opportunity, attorney, because perhaps in Luis’ case, his cousin might have done the petition themselves, but Luis’ cousin’s circumstances and Luis’ circumstances may not be the same. The cousin’s daughter’s circumstances and Luis’ daughter’s circumstances might not be the same. Age might be a factor, the country they’re in, the conditions under which they went through the process, or whether someone has encountered any problems or illegalities.

All these things matter, and that’s why we always say that just because someone else did it on their own and it worked out well for them, doesn’t mean it will work the same for you. It’s not that we’re less capable, but because each family, each petition, is different. We’re filling out the same form, but the reality of me filling out the form is very different from Luis filling out his form.

So, I can give advice to Luis on how I filled out my form. But if Luis makes a mistake, the consequences are for Luis, not for me. That’s why the recommendation is always to clear up any doubts, consult experts to ensure you’re filling out the right form, in the right way, and meeting all the necessary requirements. Doing it wrong can lead to delays, additional processes, or costs because some mistakes aren’t easily corrected, like, “Oh, I made a mistake, let me send in a correction.” Some processes, as the attorney has explained, can’t be corrected easily, and you might have to start all over, and you won’t get your money back. Or there are forms that can only be submitted once.

Moving on to the visa lottery question, the Diversity Visa Lottery—or the lottery, or “bombo” as Cubans call it—is a program the United States has to diversify immigrants, meaning to bring in people from countries with low immigration rates to the U.S.

Registration began on October 4, so it started four days ago and runs until November 7. People can start applying through the website set up by the Department of State.

The application is free. So, make sure you’re on the correct State Department website where the application is made. Don’t go to fake websites that trick you into thinking they’re official and charge you a fee to apply. This doesn’t cost anything. You enter your information and pay nothing. Absolutely nothing. Keep that in mind.

Another important point, Juan Camilo, which I was reading about today and didn’t get to mention here on Actualidad Radio yesterday, is that the Texas district court, where a lawsuit was filed against Biden’s program called Keeping Families Together—this refers to Parole in Place for spouses of U.S. citizens who have been in the United States for more than ten years—if you remember, people filed a lawsuit in Texas, and there was a stay issued, meaning a moratorium where people could apply, but immigration would not decide on those applications.

Yesterday, that stay was extended until November 8 of this year. It was originally set to expire on October 23.

Now it’s extended until November 8. What does this mean? It means that people can continue to apply for Parole in Place on the USCIS website or the Citizenship and Immigration Services website, but USCIS won’t decide on those applications yet. They can’t because the government isn’t allowing it. But at least people can keep applying, and they’ve given an extension until November 8 to apply.

So, if you are married to a U.S. citizen and have been in the U.S. for more than ten years and haven’t been able to adjust your immigration status, consult with our office and apply for Parole in Place as soon as possible. The money order costs $580, which is the fee paid to immigration. You also need proof that you’ve been in the U.S. for ten years and that you’re married to a U.S. citizen. That’s important—there’s still time to apply, Juan Camilo. I forgot to mention it yesterday because I don’t know why most news outlets haven’t announced this extension of the moratorium.

Y, por supuesto, abogada, tal vez la noticia más esperada o más comentada en los últimos días, viene por cuenta de que la administración del presidente Biden confirmó que no se va a renovar el programa del parole humanitario para cubanos, nicaragüenses, venezolanos y haitianos. ¿Qué nos puede contar sobre eso?

Martha Arias:
Sí, Juan Camilo. Mire, inicialmente esta información salió filtrada, vamos a decir, se salió de alguien de la administración que informó que no se iba a renovar o extender el parole humanitario para los que ya estaban aquí. Pero ayer oficialmente el gobierno ya dijo que no va a continuar con el parole humanitario para estos países: para Haití, Venezuela, Cuba y Nicaragua.

Este es el parole humanitario que les da dos años para estar dentro de los Estados Unidos legalmente y con un permiso de trabajo. El problema que estamos viendo es que el parole se inició en octubre del 2022 con los venezolanos. O sea que esos primeros venezolanos que entraron con el parole están a punto de expirar ahora a finales de este mes de octubre del 2024.

Esas personas, si no han aplicado para asilo, si no aplicaron para el TPS y no tienen ningún otro beneficio, tendrían que salir de los Estados Unidos una vez venza el parole. Si las personas venezolanas cuyo parole va a expirar tienen el TPS, pues pueden continuar en los Estados Unidos con ese TPS. Si están casados con ciudadanos americanos, pues también pueden hacer su petición de residencia a través de ese ciudadano americano.

O si aplicaron para asilo y su asilo está pendiente, también pueden continuar con su asilo. Es decir, tienen que hacer algo que les dé un estatus migratorio por el resto de tiempo que vayan a estar aquí, o de lo contrario, deben salir del país.

Juan Camilo:
¿Y qué va a pasar con el resto? El resto es el parole humanitario para Nicaragua y Haití, que se va a empezar a expirar a partir de enero del 2025.

Martha Arias:
Sí, porque el de esos países se estableció en enero del 2023. Entonces, los que hayan entrado a partir de enero del 2023, que tuvieron dos años, a partir de enero del 2025 se les va a empezar a expirar y van a estar en la misma situación. Los cubanos tienen una situación distinta porque son personas que tienen derecho al ajuste cubano después de un año y un día de estar en los Estados Unidos. Así que, vamos a decir que ese parole humanitario les ha beneficiado más a los cubanos, pues porque son los que van a poder permanecer en los Estados Unidos con un ajuste de estatus. Los otros países, pues ya lo que dijimos anteriormente, tendrán que hacer algo o salir de los Estados Unidos. Pero tampoco se va a renovar, no se va a continuar recibiendo aplicaciones nuevas de este parole humanitario para nuevos aplicantes. Esa sí fue la información que salió ayer.

Juan Camilo:
Abogada, ¿qué puede significar eso para la aplicación CBP One que en este momento ya va a parar o cuándo va a parar? Y, sobre todo, la gente que ya envió la aplicación pero no han recibido respuesta, ¿qué le podemos decir a esa gente?

Martha Arias:
A ver, los que están esperando su cita a través de la aplicación CBP One pueden seguir esperando. Lo digo de una forma, pues, un poquito triste, irónica, porque realmente esa aplicación de CBP One… son muchas personas las que continúan esperando. El parole humanitario, supuestamente… Yo digo supuestamente, porque muchas personas dejaron de entrar a los Estados Unidos durante esa época en la que se estaba dando este parole humanitario. No sé si es cierto, porque yo hablaba con ciertos oficiales de CBP y me decían que las entradas por la frontera continuaban a gran escala. Entonces, bueno, esas personas van a continuar esperando su cita de CBP porque ese programa, esa aplicación todavía continúa.

Juan Camilo:

A ver, vamos a definir el grupo familiar. Un residente puede pedir a un hijo o a una hija adulta o menor de edad. Si es un hijo adulto, es decir, mayor de 21 años, esos hijos del hijo, o sea, los nietos, vamos a decir, si es un papá que está pidiendo a su hijo adulto y ese hijo adulto tiene un hijo o dos hijos, pueden entrar en la petición. Pero no los cónyuges. ¿Por qué? Porque los residentes no pueden pedir a hijos casados. Entonces, el grupo familiar puede ser únicamente hijos menores de edad, no más.

Juan Camilo:
¿Y la esposa?

Martha Arias:
No, los residentes no pueden pedir a los hijos casados. Entonces, si un residente pide a un hijo soltero y ese hijo se casa, la petición se pierde. Pero el hijo puede traer a sus hijos, o sea, que si está, vamos a decir, conviviendo con una persona pero no son casados, el residente pide a su hijo y sus hijos menores de edad pueden venir con él, pero no los cónyuges.

Juan Camilo:
Ok, gracias por la aclaración, abogada. A raíz de esto que usted está diciendo, Juan, una persona de Nicaragua le ayudó a otra persona de Nicaragua a llenar una aplicación de asilo, y este señor fue acusado de fraude migratorio. Cobraba casi igual que un abogado, supuestamente decía que él no asesoraba en casos de asilo, que tenía otra persona que le ayudaba o refería los casos, pero realmente él era el que hacía estos casos de asilo y fue condenado.

Esto es porque llenar una aplicación de inmigración conlleva dar un consejo legal. No es simplemente que una persona está llenando un formato. Ese formato tiene unas preguntas que son redactadas y diseñadas de acuerdo a la ley. Entonces, una persona necesita saber de inmigración, créalo o no, para llenar esa aplicación, y se considera consejo legal. La Barra de Abogados de la Florida considera que quien dé consejo migratorio tiene que ser un abogado, y una persona no puede llenar una aplicación sin el apoyo de un abogado. O sea, sea paralegal o notario, tiene que estar bajo la supervisión de un abogado.

La de West Palm Beach está cerrada hoy martes y también va a estar cerrada miércoles y viernes. Todos los que son céremones de juramentación van a estar canceladas. Bien importante eso y nuevamente si tienen alguna pregunta están en medio de un trámite de migración o con ICE o de una juramentación y tienen preguntas sobre esto, visiten la página de Instagram de la abogada Martha Arias, porque ya tiene totalmente delglozada toda esta información. La encuentran acá mismo. Es Martha_Arias98, Martha con la intermedia.

Vamos con más personas que tengan preguntas. Luis Ramírez dice: “Me hice ciudadano hace cuatro meses y quiero pedir a mi hija. ¿Cuál es el procedimiento?”

Martha Arias:
Hay muchos familiares, amigos y personas que hacen los procesos ellos mismos, pero eso no quiere decir que quedan bien hechos. Así que mejor busque un abogado para que le ayude. Yo con mucho gusto le puedo ayudar. De ahí es la necesidad de un abogado porque, si esa hija de esta persona está aquí en los Estados Unidos y entró legalmente, entonces se puede hacer la petición de una vez de ajuste de estatus, que se incluye una petición que es la I-130, que es la que esta persona hace por su hija, más la I-485, que es la petición de residencia. Obviamente, incluye muchas otras aplicaciones que hacen parte de ese paquete que se llama ajuste de estatus.

Ahora, si esa hija está fuera de los Estados Unidos, entonces el proceso es distinto. Se hace solamente la primera parte de la petición, que es la I-130. Si la hija está en los Estados Unidos, pero no entró legalmente, es decir, entró por la frontera sin inspección, tampoco se puede presentar el ajuste de estatus, solo se presenta una parte de la petición que es la I-130. Entonces, con esto le estoy explicando a las personas que no todas las peticiones se hacen de la misma forma. Por eso es importante consultar primero con nosotros, un abogado de inmigración, para que le digamos cuál es el correcto paso a seguir y no vaya a perder también su dinero.

Ya cuando uno les dice cuál es el paso a seguir, la persona puede determinar si lo hacen ellos mismos o buscan un abogado. Pero primero es informarse, porque no todos los casos son iguales. Varios clientes que han llegado… ellos son ciudadanos, pidieron a sus hijos, pero los hijos entraron ilegales por la frontera. Entonces, los piden, los hijos todavía están menores, se hace la petición, pero ese menor tiene que salir de los Estados Unidos antes de los 18 años a recibir la residencia afuera si quiere recibirla antes de que incurra en presencia ilegal y tenga que pedir un perdón.

Entonces, todo esto son cosas que nosotros, los abogados, estamos preparados con la ley de inmigración para asesorar a la persona. No es simplemente la forma, es también cuál es la situación particular que implica, cuáles son las formas exactas o concretas que la persona tiene que llenar.

Juan Camilo:
Claro. Y qué qué buena oportunidad esta abogada, porque de pronto el caso de Luis el primo pudo haber hecho la petición por su lado, pero las condiciones del primo de Luis y las condiciones de Luis de pronto no están las mismas. Entonces yo le puedo dar consejo al Luis sobre la forma en la que yo llene mi formulario. Si de pronto Luis pone algo mal, las consecuencias no son para mí, las consecuencias son para Luis. Entonces por eso la recomendación siempre es salga de las dudas, acésore ese bien para saber que está llenando el formulario que tiene que llenar, de la forma en la que la tiene que llenar, que tiene que cumplir con unos requisitos porque hacerlo de pronto le pueda acarrear, si lo hace mal, una cantidad de demoras, una cantidad de procesos, una cantidad de dinero porque unas cosas que hacen mal no es como que, ah, me equivoqué, espérame, ya le mando la corrección. Pasando al tema y la pregunta de la diversidad de visas la diversidad de visas o la loto o la baloto creo que los cubanos le llaman el bombo es un programa que tiene los estados unidos para diversificar los inmigrantes, es decir, para que puedan venir personas de países que tienen poca inmigración hacia los Estados Unidos.

Empieza la registración octubre 4, o sea, ya empezó hace cuatro días y se extiende hasta noviembre 7. Las personas van a poder empezar a aplicar y pues esto es la página web del Departamento de Estado que tiene diseñado para esto.

La aplicación no cuesta nada. Así que asegúrese que usted esté en la página correcta del departamento de estado donde se hace la aplicación. No vayan a páginas piratas que los engañan pensando que es una página oficial y les cobran un fee o un dinero para aplicar. Esto no cuesta nada. Ustedes entran ahí, entran toda su información y pagan nada. No van a pagar absolutamente nada. Tengan eso en cuenta.

Ahora, otra cosa importante, Juan Camilo, que estaba leyendo en el día de hoy y es que no lo habíamos dicho y no lo alcancé a decir tampoco aquí en actualidad radio en el día de ayer, y es que la corte del distrito de Texas, donde se presentó la demanda en contra del programa de Biden que se llama Manteniendo las Familias Juntas, me estoy refiriendo al “Parole in Place“. Para los cónyos es que te de ciudadanos americanos que tenga más de 10 años en los Estados Unidos que si se acuerdan las personas fue demandado en Texas y dieron un este y es decir como una moratoria donde se puede aplicar pero inmigración no va a decidir las aplicaciones.

El día de ayer se extendió este este y es decir esta moratoria hasta noviembre 8 de este año estaba hasta octubre 23.

Ahora se extendió hasta noviembre 8. Quiere decir esto. Quiere decir que las personas pueden continuar aplicando para el “Parole in Place” en la página de USCIS o de Citizenship and Immigration Services, pero USCIS no va a decidir esas aplicaciones todavía. No lo puede hacer porque el gobierno no le está permitiendo. Bueno, pero por lo menos pueden seguir aplicando y les dieron una extensión de tiempo para aplicar hasta noviembre 8. Si.

Entonces el esposo que la persona que tenga su cónyuge es ciudadano americano y que esa persona lleve más de diez años en los Estados Unidos y no haya podido ajustar su estatus migratorio consulten nuestra oficina y aplique para ese parón in place lo más rápido posible el costo del money order son $580 dólares eso es lo que le pagan a inmigración. Y necesita prueba de que lleva los diez años en los Estados Unidos y que está casado con un ciudadano americano eso es importante todavía hay plazo para aplicar Juan Camilo. Pena porque realmente hay tantas familias que se pueden beneficiar de eso y lo importante es hagamos la vuelta mientras tanto para que cuando entre en vigor ya tengamos la mitad del camino recorrido. Un ciudadano estadounidense y una persona que es una persona que ingresó de forma ilegal a los Estados Unidos o que no tienen en este momento papeles y están casados. O sea, uno de los dos esposos es ciudadano y el otro es indocumentado y hay solución para ellos en este momento que, como bien dice la abogada, estamos esperando que levanten para que pueda comenzar a operar ya, pero las aplicaciones pueden comenzar a serlas y no tenemos que esperar.
