Recently, I had the opportunity to discuss on Univision a critical topic that has raised many questions and concerns within our community: the possible implementation of a new travel ban affecting several Latin American countries, including Venezuela and Cuba, with rumors also suggesting Nicaragua might soon be included. Given the seriousness of this issue, I’d like to share some key points from that conversation and provide clarity about what this could mean for those impacted.

Background of the Proposed Travel Ban

As I shared during the interview, what we’re witnessing today closely resembles what occurred during the initial administration of President Trump, who issued travel bans restricting entry to the United States for citizens from certain countries. Initially, the previous bans primarily affected predominantly Muslim countries. Now, the proposed travel ban would directly affect Latin American nations experiencing significant internal turmoil—specifically, Venezuela and Cuba.

Presidential Authority for Implementing Travel Bans

A common question I addressed was regarding the authority required to implement such measures. It’s important to clarify that a travel ban does not require prior approval from Congress. Instead, it can be implemented directly by the President of the United States through executive action, citing reasons related to national security, foreign policy, or national defense.

Historically, as we saw during the previous administration, these executive orders were issued independently by the president. Nevertheless, such executive orders can face legal challenges. In the past, travel bans were contested in federal courts, and certain portions of these bans were temporarily blocked, allowing affected individuals to regain entry.

Could the Travel Ban Be Challenged in Court?

Finally, the constitutional validity of travel bans was a critical part of our discussion. While travel bans can be constitutional if supported by substantial evidence demonstrating genuine national security threats, previous bans faced significant legal challenges. The courts closely examine the justifications provided by the government. If documentation supporting the national security claims is weak or inadequate—as it was perceived in some previous instances—such restrictions could be successfully contested in court again.

The immigration landscape in Florida is shifting dramatically, leaving many members of our community in a state of concern and uncertainty. Recently, I had the opportunity to discuss these changes on Univision TV with journalist Félix de Bedout. This law, spearheaded by Governor Ron DeSantis, aligns with policies from President Trump but has sparked considerable debate, with many experts—including myself—raising concerns about its constitutionality and its impact on immigrant communities.

This new legislation introduces a series of measures that make life increasingly difficult for immigrants in Florida. Among the most concerning changes:

1. Law Enforcement’s New Role in Immigration Enforcement
Traditionally, enforcing immigration laws has been the responsibility of federal agencies like Immigration and Customs Enforcement (ICE). However, this law grants local police the authority to stop individuals and inquire about their immigration status. Police officers will receive training to determine whether someone is legally residing in the U.S., which is a significant and worrisome shift from the standard enforcement process.

This raises serious legal concerns, as immigration status is a federal matter. The involvement of state and local law enforcement in immigration checks could lead to racial profiling, increased fear in immigrant communities, and a reluctance to report crimes due to the fear of being questioned about immigration status.

2. The Death Penalty as a Consequence for Undocumented Status?
Another highly controversial aspect of this law is its potential connection between undocumented status and the death penalty. In Florida, violent crimes can already result in capital punishment. However, what is unprecedented is the possibility that being an undocumented immigrant could be considered an aggravating factor in criminal cases, potentially increasing the severity of sentencing—including eligibility for the death penalty.

This is a deeply concerning legal precedent. Typically, aggravating factors in criminal cases involve intentional and particularly harmful actions, such as violence against pregnant women or elderly individuals. Suggesting that simply being undocumented is a comparable aggravating factor challenges fundamental principles of justice.

From a constitutional perspective, this is highly problematic. The U.S. Constitution guarantees equal protection under the law, and it prohibits cruel and unusual punishment. Undocumented immigration is a civil matter, not a criminal offense, which makes the idea of linking it to the death penalty particularly disturbing.

Higher Education Costs for Immigrant Students
Another major issue under this law is its impact on immigrant students. Previously, undocumented students who had lived in Florida for years could qualify for in-state tuition rates at public universities. This law eliminates that possibility, forcing them to pay out-of-state tuition rates, which can be more than $12,000 higher per year.

Unfortunately, this policy is harder to challenge legally because tuition regulations fall under the control of state governments. Unlike other provisions of the law that may be deemed unconstitutional, this measure is within the state’s authority to implement. However, this will have devastating consequences for many students who have lived in Florida for most of their lives and now face financial barriers to continuing their education.

As I emphasized in my Univision interview, this law is likely to face numerous legal challenges. Some of its provisions may violate constitutional protections related to equal treatment, due process, and protection from cruel and unusual punishment. We expect lawsuits to be filed in the coming weeks, particularly against the law’s more extreme measures.

However, while legal battles take time, it is crucial for immigrants and their families to stay informed and understand their rights. If you or someone you know is affected by this law, it is important to seek legal advice from an immigration attorney as soon as possible.

Final Thoughts

This new Florida immigration law is one of the most restrictive measures we have seen in years. While it is likely to face legal challenges, it is already causing fear and hardship among immigrant families. Now, more than ever, it is essential to be informed, prepared, and proactive in protecting your rights.

For Cuban nationals, the path is somewhat clearer because they can apply for the Cuban Adjustment Act after being in the country for a year and a day, providing them with a straightforward solution.

However, for non-Cubans, the options are more limited. To justify an extension of parole, one must demonstrate extraordinary circumstances. For example, some individuals have suffered persecution in their home countries and can prove they are experiencing post-traumatic stress disorder. Others may have serious medical issues that prevented them from acting sooner, such as hospitalization or extended convalescence. Unfortunately, common excuses like not knowing the law, language barriers, or having been defrauded by someone are not considered valid reasons for an extension.

I also warned about the dangers of unlicensed individuals offering legal advice. Some people present themselves as lawyers without proper U.S. license, which can lead to misinformation and financial loss. I stressed the importance of verifying an attorney’s credentials by checking with the state Bar Association. This resource allows you to confirm if a lawyer is licensed, see their registration details, and check for any disciplinary actions or complaints against them.

Understanding that the immigration process is complex and delicate, I urged individuals to seek qualified legal assistance to navigate their unique situations effectively.

During the Copa America final, chaos erupted, leading to serious disruptions and safety concerns. Authorities have employed cutting-edge biometric technology to identify around 7,000 fans involved in the disorder. These individuals, many of whom are legal residents in the United States, now face severe legal consequences. The measures being considered include fines, jail time, loss of visas and residency, and even deportation.

When applying for a visa, residency, or citizenship in the United States, there is an inherent commitment to being a responsible and law-abiding resident. The recent events serve as a stark reminder of this obligation. While U.S. citizenship is challenging to revoke and can only be taken away under specific circumstances such as fraud, terrorism, or serious crimes against national security, legal residents can face serious repercussions for actions like trespassing, assault, and destruction of property.

The strict measures being considered are part of a broader policy aimed at maintaining national security and public order. It’s crucial for everyone to understand the importance of adhering to laws and behaving responsibly, especially in public events that draw significant attention and pose potential risks to safety.
