			<p>First, we addressed the Trump administration’s request for the Supreme Court to permit the deportation of immigrants to countries that are not their nation of origin. This arose after eight individuals from countries like Cuba, Mexico, Myanmar, Laos, and Vietnam were deported to Sudan, and they filed a lawsuit against the U.S. government. The judge ordered that these individuals be returned, but the administration appealed to the Supreme Court. The situation is very delicate, especially when immigrants could be sent to unfamiliar and potentially unsafe countries, far from their culture and language. The case will be important to watch, especially for those who already have final deportation orders and whose home countries are not accepting their return.</p>
<p>We also talked about the suspension of student visa interviews. The Trump administration is currently pausing interviews worldwide as it considers stricter social media scrutiny for applicants. This pause mostly impacts universities in the United States, which rely on international students for cultural exchange and significant revenue. Although this measure is currently only a pause, it may cause delays for those seeking <a href="https://travel.state.gov/content/travel/en/us-visas/study/student-visa.html"><strong>F-1 visas</strong></a>, and students may consider studying in other countries.</p>
<p>For students already in the U.S., there are no changes for now—unless affected by specific issues, such as recent events involving Harvard University. A federal judge paused the attempt to suspend student visas at Harvard, so international students there can continue their studies.</p>
<p>I also addressed questions about documentation. The Real ID is not enough proof of immigration status if stopped by ICE. It’s essential to carry additional documentation showing your status, such as a <a href="https://ariasvilla.com/services/immigration-family-petitions-green-card/"><strong>green card</strong></a>, <a href="https://ariasvilla.com/services/citizenship-interview/"><strong>proof of citizenship</strong></a>, <a href="https://ariasvilla.com/services/daca-deferred-action-for-childhood-arrivals/"><strong>DACA work permit</strong></a>, or <a href="https://ariasvilla.com/services/political-asylum/"><strong>asylum-related documents</strong></a>. For those with pending <a href="https://www.uscis.gov/humanitarian/victims-of-criminal-activity-u-nonimmigrant-status"><strong>U visas</strong></a>, carrying your <a href="https://www.uscis.gov/policy-manual/volume-3-part-d-chapter-5"><strong>&#8220;Prima Facie Eligibility&#8221;</strong></a> document along with your license is recommended.</p>

<p>¿Cómo está, abogada? Muy buenos días.</p>
<p><strong>Abogada Martha Arias:</strong><br />
Buenos días, Andreina. Un saludo para usted y toda su audiencia. Feliz mitad de semana siempre.</p>
<p><strong>Andreina Gandica:</strong><br />
Sí, señor. Bueno, una semanita corta para muchos, pero abogada, el gobierno de Trump pide a la Corte Suprema permitir la deportación de inmigrantes a lugares diferentes a su nación de origen. ¿Qué implica exactamente esta petición del gobierno ante la Corte Suprema?</p>
<p><strong>Abogada Martha Arias:</strong><br />
Bueno, esta petición exactamente es una apelación de emergencia que la presidencia hizo después de que se presentara una demanda en una corte federal por ocho personas que fueron enviadas a Sudán y eran personas de otros países. Eran personas, tengo entendido, de Cuba, México, Myanmar, Laos y otros, Vietnam y otros países asiáticos.<br />
Estas personas fueron enviadas allí y pues presentaron una demanda en contra del gobierno porque dicen los demandantes que no se les dieron las garantías, no se les informó dónde iban a ser enviados y si sus vidas iban a estar o no en peligro en ese país, país que de por sí es un país que tiene un poco de inestabilidad o situaciones de seguridad.<br />
Entonces, el juez ordenó al gobierno que estas personas fueran regresadas. El presidente entonces apeló a la Corte Suprema. Vamos a ver qué dice la Corte Suprema. Es una situación delicada, Andreina, porque imagínese usted, sobre todo para gente como cubanos o mexicanos que están en este continente y ser enviados a un continente totalmente distinto, con otro idioma. Sabemos, no con mucha seguridad, pues es una situación un poco delicada.</p>
<p><strong>Andreina Gandica:</strong><br />
¿Y cuáles son esos países, abogada, donde podrían ser deportados?</p>
<p><strong>Abogada Martha Arias:</strong><br />
En este momento fueron enviados a Sudán. El gobierno, tengo entendido, ha tratado de entrar en acuerdos con terceros países que estén dispuestos a recibir a aquellos inmigrantes que van a ser deportados de los Estados Unidos y cuyos países no los reciben. Tengo entendido que ya hicieron este acuerdo con Sudán, en Sudáfrica. El otro día estaba escuchando que estaban tratando de hacer un acuerdo también con Myanmar, otro país asiático. O sea, la administración está tratando de buscar países, básicamente en otro continente, que acepten inmigrantes deportados de los Estados Unidos.</p>
<p><strong>Andreina Gandica:</strong><br />
Recuerden que si tienen pregunta pueden hacerlo a través del 1-833-867-234, sí abogada. Pero ¿esto afectaría a personas con casos de asilo en curso o solo a quienes ya tienen una orden de deportación?</p>
<p><strong>Abogada Martha Arias:</strong><br />
Solo a quienes tienen ya una orden de deportación y personas, básicamente, que no sean recibidas en su país de origen. Por ejemplo, los cubanos, no todos los meses Cuba recibe deportados de aquí, de Estados Unidos.<br />
No sé por qué mandaron a un mexicano. Tengo entendido que México sí acepta a sus deportados, pero bueno, aquí supuestamente fueron personas que fueron enviadas a estos países porque sus países no los recibían. Eso es lo que aduce la administración.<br />
El juez federal que tuvo esta demanda dice, según la noticia, que le dio la oportunidad al gobierno de que explicara la razón por la que fueron enviadas y si se les dio a esas personas la oportunidad de conocer a dónde iban a ir.<br />
Según la documentación que estaba leyendo, no es claro si estas personas tuvieron esa oportunidad porque aparentemente todo fue súper rápido, en menos de 16 horas se procesó la partida de ellos y no se les dio la oportunidad. Entonces, es una demanda que obviamente creo que va a continuar, pero es muy muy importante que vaya a la Corte Suprema, porque ahí es donde vamos a ver si el gobierno va a poder continuar, que dice la corte si va a poder continuar deportando personas a terceros países.</p>
<p><strong>Andreina Gandica:</strong><br />
Ahora, abogada, tenemos otro asunto y me desprendo un poco de este tema como tal para hablar de las entrevistas de visas estudiantiles, porque el gobierno de Trump pausa estas entrevistas de visas de todo el mundo mientras valora elevar ese escrutinio de redes sociales de aspirantes. ¿Qué impacto tiene esta pausa para quienes ya estaban en proceso de obtener una <strong><a href="https://travel.state.gov/content/travel/en/us-visas/study/student-visa.html">visa F-1</a></strong>, por ejemplo?</p>
<p><strong>Abogada Martha Arias:</strong><br />
El impacto es grande, es muy grande para las, sobre todo para las universidades, Andreina. No es solamente los estudiantes que quieran venir a los Estados Unidos. Recuerde que hay muchos otros países europeos que tienen buena calidad de universidades, entre esos, Inglaterra.<br />
Pero el punto es, más me pienso yo para las universidades. Usted sabe que las universidades de los Estados Unidos cobran el doble, a veces tres veces más, sus matrículas de lo que le cobran a estudiantes nacionales o residentes.<br />
Entonces, el ingreso para las universidades de estas visas de estudiantes es grande. Además, que es una culturización y un intercambio de información y de educación muy importante para personas que vienen de países como Suramérica, Centroamérica.<br />
Entonces, pienso que el impacto grande va a estar en las universidades, Andreina. Las universidades están siendo víctimas de esta situación y espero, espero pues que el gobierno recapacite en esto porque igual a las personas les hacen, toman huellas y les hacen una evaluación de sus antecedentes penales antes de otorgarles una visa de estudiante.<br />
Entonces, yo pienso, es mi opinión, que puede ser más impactante para las universidades que para los mismos estudiantes porque los mismos estudiantes pueden encontrar otros países.</p>
<p><strong>Andreina Gandica:</strong><br />
Claro, y justamente Trump está ordenando suspender todas las visas para estudiar en Estados Unidos. ¿Esta orden ya está vigente o aún se encuentra en evaluación, abogada?</p>
<p><strong>Abogada Martha Arias:</strong><br />
Yo lo que tengo entendido, lo que pude haber revisado el día de ayer, es que por ahora están simplemente suspendiendo lo que son las entrevistas, es decir, pausando tal vez las entrevistas, pero todavía no es algo como que se van a suspender, no. Están pausadas, seguramente van a tener un retraso, pero sí, esto es inmediato porque recuerde que el Departamento de Estado es el que maneja los consulados y las embajadas.<br />
Entonces, el Departamento de Estado depende directamente del Ejecutivo. Entonces, este tipo de medidas sí pueden ser tomadas por el Ejecutivo a través del Departamento de Estado o de su Secretario de Estado, como en este caso el señor Marco Rubio. Entonces, pues esta medida está operando en este momento.</p>
<p><strong>Andreina Gandica:</strong><br />
¿Y qué pasará con los estudiantes internacionales que ya están dentro de Estados Unidos?</p>
<p><strong>Abogada Martha Arias:</strong><br />
Bueno, por ahora los estudiantes que están en Estados Unidos no tienen ningún problema, a no ser que estén en Harvard. Usted ya sabe este problema que surgió con los estudiantes de Harvard, que la universidad, el gobierno quería suspender las visas de estudiantes para esta universidad.<br />
Por lo que el gobierno alega es que la universidad no está ejerciendo o no está haciendo cumplir políticas antisemitas que en este momento están dando revueltas y paros y cosas de antisemitismo. Esa es la situación en Harvard, pero usted ya también sabe que un juez federal pausó esto y dijo que no, que no se puede ejercer o que no se puede eliminar la posibilidad de estudiantes extranjeros en Harvard.<br />
Pero en las otras universidades, continúan los estudiantes extranjeros con comunicación corriente haciendo con su arrojo, cursando sus estudios.</p>
<p><strong>Andreina Gandica:</strong><br />
Aquí tenemos una pregunta de Nelson Humana, abogada, dice: ¿para la abogada es más que suficiente prueba el Real ID si ICE lo detiene a uno?</p>
<p><strong>Abogada Martha Arias:</strong><br />
Bueno, lo que pasa es que el Real ID es una prueba de que la persona tiene una licencia de conducir y de quién es y tiene su foto, pero no es prueba de un estatus migratorio.<br />
Claro, hay muchos estados que requieren un estatus migratorio para la persona poder tener una licencia, pero hay otros que no. Entonces, no es suficiente. Tiene que tener alguna otra prueba que muestre su estatus migratorio, como una residencia, como la prueba de que es ciudadano, como también tiene DACA, entonces la prueba de su permiso de trabajo con <a href="https://www.uscis.gov/DACA"><strong>DACA</strong></a>.<br />
Si tiene un asilo pendiente, la prueba de que tiene ese asilo pendiente o su permiso de trabajo a través del asilo, cualquier cosa que muestre ese estatus.<br />
Por ejemplo, otra cosa, y esto es algo que me han preguntado, las personas que tienen una visa U, mientras la visa U está pendiente, realmente la persona no tiene mucho que mostrar más que unos recibos. Pero después de tres o cuatro años de esa visa estar pendiente, inmigración emite un documento que se llama &#8220;Prima Fashion Eligibility&#8221;. Es decir, es un documento que dice a primera vista elegible para este beneficio. Ese documento le da derecho a permisos, a licencia de conducir.<br />
Yo, si fuera una persona que tengo una <a href="https://www.uscis.gov/humanitarian/victims-of-criminal-activity-u-nonimmigrant-status"><strong>visa U</strong></a> pendiente y ya tengo mi &#8220;Prima Fashion Eligibility&#8221;, ese documento le saco una copia y lo cargo conmigo porque ese documento más la licencia es lo que va a mostrar su estatus.</p>
<p><strong>Andreina Gandica:</strong><br />

Fíjese, abogada, aquí dice Beto Pérez: pero para el Real ID, si no tienes seguro social acá en California, no te dan el Real ID.</p>
<p><strong>Abogada Martha Arias:</strong><br />
Es correcto, muchas personas aquí también en la Florida, es lo mismo. Cada estado tiene sus propias regulaciones, el estado de la Florida también está requiriendo el Social Security. Por eso, por ejemplo, el ejemplo que puse de la visa U, cuando ya le dan el &#8220;Prima Fashion Eligibility&#8221;, la persona tiene derecho a permiso de trabajo, cuando pide permiso de trabajo, se le emite ese Social Security.<br />
Entonces, pues, esa es la situación.</p>

How are you, attorney? Good morning.</p>
<p><strong>Attorney Martha Arias:</strong><br />
Good morning, Andreina. A greeting to you and your entire audience. Happy week as always.</p>
<p><strong>Andreina Gandica:</strong><br />
Yes, indeed. Well, a short week for many, but attorney, the Trump administration is asking the Supreme Court to allow the deportation of immigrants to places other than their country of origin. What does this government request to the Supreme Court actually mean?</p>
<p><strong>Attorney Martha Arias:</strong><br />
Well, this request is specifically an emergency appeal that the presidency made after a lawsuit was filed in a federal court by eight people who were sent to Sudan and were people from other countries. They were people, I understand, from Cuba, Mexico, Myanmar, Laos, and others—Vietnam and other Asian countries.<br />
These people were sent there and filed a lawsuit against the government because the plaintiffs say that they were not given guarantees, they were not informed where they would be sent, or if their lives would be in danger in that country—a country that, by itself, has some unrest or security situations.<br />
So, the judge ordered the government to have these people returned. The president then appealed to the Supreme Court. Let&#8217;s see what the Supreme Court says. It&#8217;s a delicate situation, Andreina, because just imagine, especially for people like Cubans or Mexicans who are from this continent, being sent to a completely different continent, with another language. We know not much security—well, the situation is a little delicate.</p>
<p><strong>Andreina Gandica:</strong><br />
And what are those countries, attorney, where they could be deported?</p>
<p><strong>Attorney Martha Arias:</strong><br />
At this moment, they were sent to Sudan. The government, as I understand, has tried to enter into agreements with third countries that are willing to receive those immigrants who are going to be deported from the United States and whose countries will not receive them. I understand they already made this agreement with Sudan, in South Africa. The other day I was hearing that they were also trying to make an agreement with Myanmar, another Asian country.<br />
That is, the administration is trying to find countries, basically on another continent, that accept immigrants deported from the United States.</p>
<p><strong>Andreina Gandica:</strong><br />
Remember, if you have a question you can do it through 1-833-867-234, yes attorney. But would this affect people with asylum cases in process or only those who already have a deportation order?</p>
<p><strong>Attorney Martha Arias:</strong><br />
Only those who already have a deportation order and basically people who are not received in their country of origin. For example, Cubans—not every month does Cuba receive deportees from here, from the United States. I don&#8217;t know why they sent a Mexican. I understand that Mexico does accept its deportees, but well, here supposedly these were people who were sent to these countries because their countries were not receiving them. That&#8217;s what the administration claims.<br />
The federal judge who handled this lawsuit, according to the news, gave the government the opportunity to explain the reason they were sent and whether those people were given the chance to know where they would go.<br />
According to the documentation I was reading, it’s not clear if these people had that opportunity because apparently everything was super quick—in less than 16 hours their departure was processed and they were not given the opportunity. So, it’s a lawsuit that I obviously think will continue, but it’s very, very important that it goes to the Supreme Court, because that&#8217;s where we’ll see if the government will be able to continue—what the court says about whether it will be able to continue deporting people to third countries.</p>
<p><strong>Andreina Gandica:</strong><br />
Now, attorney, we have another matter and I’ll separate a bit from this topic to talk about student visa interviews, because the Trump administration is pausing these interviews for visas worldwide while considering raising the scrutiny of social media for applicants. What impact does this pause have for those who were already in the process of obtaining an <a href="https://travel.state.gov/content/travel/en/us-visas/study/student-visa.html" target="_blank" rel="noopener"><strong>F-1 visa</strong></a>, for example?</p>
<p><strong>Attorney Martha Arias:</strong><br />
The impact is big, it&#8217;s very big, especially for the universities, Andreina. It’s not just the students who want to come to the United States. Remember, there are many other European countries that have good quality universities, among them England. But the point is, more so I think for the universities. You know that U.S. universities charge double, sometimes three times more, tuition than they charge to national or resident students.<br />
So, the income for universities from these students is significant. Besides, it is a culturalization and a very important exchange of information and education for people who come from countries like South America, Central America. So, I think the big impact will be on the universities, Andreina. The universities are being victims of this situation and I hope, I really hope the government reconsiders this because people still have fingerprints taken and their criminal background is checked before granting a student visa. So, I think, in my opinion, it could be more impactful for the universities than for the students themselves because students can find other countries.</p>
<p><strong>Andreina Gandica:</strong><br />
Of course, and just now Trump is ordering all visas for studying in the United States to be suspended. Is this order already in effect or is it still under evaluation, attorney?</p>
<p><strong>Attorney Martha Arias:</strong><br />
What I understand, what I was able to review yesterday, is that for now they are simply suspending what are the interviews—that is, perhaps pausing the interviews—but it&#8217;s not yet something like they are going to be suspended, no. They are paused, they will surely have a delay, but yes, this is immediate because remember that the Department of State is the one that manages the consulates and embassies.<br />
So, the Department of State depends directly on the Executive. So, this type of measure can be taken by the Executive through the Department of State or its Secretary of State, as in this case Mr. Marco Rubio. So, this measure is operating at this time.</p>
<p><strong>Andreina Gandica:</strong><br />
And what will happen to international students who are already inside the United States?</p>
<p><strong>Attorney Martha Arias:</strong><br />
Well, for now the students who are in the United States do not have any problem, unless they are at Harvard. You already know about this problem that arose with Harvard students, that the university—the government wanted to suspend student visas for this university.<br />
What the government alleges is that the university is not enforcing or not applying antisemitic policies and that right now there are protests and strikes and antisemitism issues. That is the situation at Harvard, but you also know that a federal judge paused this and said that no, you can&#8217;t do that, you can&#8217;t eliminate the possibility of foreign students at Harvard.<br />
But at other universities, foreign students continue with regular communication and continue studying as usual.</p>
<p><strong>Andreina Gandica:</strong><br />
Here we have a question from Nelson Humana, attorney, he says: For the attorney, is the Real ID sufficient proof if ICE detains someone?</p>
<p><strong>Attorney Martha Arias:</strong><br />
Well, what happens is that the Real ID is proof that the person has a driver&#8217;s license and who they are and has their photo, but it is not proof of immigration status.<br />
Of course, there are many states that require immigration status for a person to have a license, but there are others that do not. So, it is not sufficient. You must have some other proof that shows your immigration status, such as a green card, proof of citizenship, also if you have DACA, then proof of your work permit with DACA.<br />
If you have a pending asylum, the proof that you have that asylum pending or your work permit through asylum, anything that shows that status.<br />
For example, another thing, and this is something I have been asked, people who have a U visa, while the U visa is pending, really the person does not have much to show except some receipts. But after three or four years of that visa being pending, immigration issues a document called &#8220;Prima Fashion Eligibility.&#8221; That is, it’s a document that says at first sight eligible for this benefit. That document gives the right to permits, to a driver’s license.<br />
If I were a person who has a pending U visa and already have my &#8220;Prima Fashion Eligibility,&#8221; I would make a copy of that document and carry it with me because that document plus the license is what will show your status.</p>
<p><strong>Andreina Gandica:</strong><br />

The Supreme Court has clearly stated that the government must demonstrate evidence of a person&#8217;s affiliation with terrorist or criminal organizations before deportation. However, in this specific case, the government has repeatedly failed to provide sufficient proof, which has raised concerns of constitutional violations.</p>
<p>This situation underscores a critical issue: the risk we face when laws are applied without adequate oversight. Today it&#8217;s Ábrego García, but tomorrow it could be someone else closer to us. Upholding constitutional guarantees isn&#8217;t optional—it&#8217;s essential to our democracy.</p>
<p>We also discussed practical advice for immigrants who have upcoming immigration court dates. I urged individuals to seek legal counsel and follow their attorney’s recommendations to navigate these stressful situations safely.</p>

Amigos, vamos a hablar de inmigración, y para ello tenemos en línea telefónica a una abogada experta en este tema. Ella es Martha Arias. Abogada Arias, buenos días. Gracias por estar con nosotros.</p>
<p>Abogada Martha L. Arias:<br />
Buenos días, Eduardo y Aaron. Un saludo para ustedes. Feliz mitad de semana, como digo siempre.</p>
<p>Host:<br />
Bienvenida, bienvenida. Muchísimas gracias nuevamente por conversar con nosotros. Empecemos hablando sobre un caso que ha tomado tintes políticos: el caso de Quilmar Ábrego García. Quiero recordar primero palabras de la Fiscal General Pam Bondi y también de Stephen Miller, asesor del Departamento de Seguridad Nacional, respondiendo preguntas de una periodista de CNN durante la reunión del presidente Donald Trump con el presidente salvadoreño Nayib Bukele. Entró ilegalmente al país, tenía una orden de deportación, se le considera miembro de la MS-13 (Mara Salvatrucha), que es considerada una organización terrorista, y por ese hecho no tiene ningún beneficio migratorio. En términos generales, esa fue la posición tanto de Pam Bondi como de Stephen Miller. Quisiera escuchar la opinión de la abogada Martha Arias sobre este caso específico de Ábrego García.</p>
<p>Abogada Martha L. Arias:<br />
Sí, muchas gracias. Según lo que entiendo—obviamente no he leído todo el expediente—esta persona fue enviada a la corte y posteriormente a su país, ya que el gobierno invocó la Ley de Enemigos Extranjeros. Al invocarla, mandaron a esta persona de regreso sin brindarle el debido proceso, sin darle la oportunidad de presentar evidencia sobre su supuesta pertenencia a estas pandillas.</p>
<p>La Corte Suprema de los Estados Unidos, al revisar este caso, afirmó claramente que el gobierno puede utilizar esta ley, pero siempre respetando el debido proceso. Es decir, se debe demostrar previamente que la persona es miembro de una organización terrorista o justificar las acusaciones antes de proceder con la deportación. La jueza que ordenó el retorno solicitó pruebas de la supuesta membresía en pandillas y hasta ahora solo ha recibido un documento superficial que simplemente afirma que pertenece a una pandilla.</p>
<p>Si escuchan un ruido, es un pavo real que tengo en casa. Es curioso porque hacía años que no veía uno, y mucho menos sabía cómo cantaban. Está en un árbol grande en mi casa y ha estado dándome serenata toda la mañana.</p>
<p>Continuando, como abogada creo firmemente que el debido proceso es un derecho fundamental que todos tenemos. Aunque entendemos que no queremos en el país a personas vinculadas con pandillas u organizaciones criminales, no podemos saltarnos los derechos básicos de las personas. El problema es decidir arbitrariamente a quién se le aplica el debido proceso y a quién no. La jueza ha insistido en solicitar pruebas claras que vinculen a esta persona con la pandilla, y hasta ahora no se han presentado. Incluso, hace dos semanas, un abogado del gobierno fue suspendido por admitir ante la jueza que tampoco tenía evidencias.</p>
<p>Esta persona sí tenía una orden de deportación, pero se le había concedido un beneficio conocido como &#8220;withholding of removal&#8221;, que implica que, aunque debe ser deportado, su deportación está suspendida temporalmente debido al peligro que corre en su país. Por eso, legalmente sí podría ser enviado a un tercer país dispuesto a recibirlo.</p>
<p>Host:<br />
Abogada Arias, la jueza federal encargada del caso está considerando iniciar un proceso por desacato contra la administración Trump por no presentar evidencias. ¿Puede hacer esto?</p>
<p>Abogada Martha L. Arias:<br />
Sí, absolutamente. Ella está pidiendo evidencias claras y esfuerzos reales del gobierno para retornar a esta persona. Este caso pone en práctica el principio constitucional de checks and balances (pesos y contrapesos). Personalmente, me preocupa el uso arbitrario de la Ley de Enemigos Extranjeros sin pruebas contundentes, porque hoy es esta persona, pero mañana podría ser alguien más cercano a nosotros.</p>
<p>Host:<br />
Según lo visto en la Casa Blanca, este asunto parece estar fuera del alcance de la justicia estadounidense, ya que está bajo custodia de la justicia salvadoreña. El presidente Bukele ha dicho que no liberará terroristas. ¿Cómo queda entonces la parte legal migratoria?</p>
<p>Abogada Martha L. Arias:<br />
Es complicado. Desde mi perspectiva como abogada de inmigración y especialista en derecho internacional, si Estados Unidos deportó erróneamente a una persona, tiene la obligación de intentar regresarla. Pero si El Salvador tiene evidencias o cargos propios contra esta persona, se complicará su retorno a Estados Unidos. Por ahora, no conocemos documentación oficial que pruebe estos cargos en El Salvador. El debido proceso y la claridad legal son esenciales en toda democracia.</p>

Finalmente, abogada, ¿qué recomienda a quienes tienen citas en cortes migratorias y tienen miedo de presentarse?</p>
<p>Abogada Martha L. Arias:<br />
Recomiendo seguir el consejo específico de su abogado. Si no tienen abogado, deben buscar uno. En mi experiencia, quienes no tienen órdenes previas de deportación ni antecedentes criminales no deberían tener problemas en presentarse.</p>

<p>Attorney Martha L. Arias:<br />
Good morning, Eduardo and Aaron. Greetings to you. Happy mid-week, as I always say.</p>
<p>Host:<br />
Welcome, welcome. Thank you very much once again for speaking with us. Let&#8217;s begin by discussing a case that has taken political overtones: the case of Quilmar Ábrego García. I&#8217;d first like to recall words from Attorney General Pam Bondi and also from Stephen Miller, advisor to the Department of Homeland Security, responding to questions from a CNN journalist during the meeting between President Donald Trump and Salvadoran President Nayib Bukele. He entered the country illegally, had a deportation order, is considered a member of MS-13 (Mara Salvatrucha), which is designated as a terrorist organization, and due to that, he does not have any immigration benefit. Generally speaking, that was the position of both Pam Bondi and Stephen Miller. I&#8217;d like to hear the opinion of immigration attorney Martha Arias regarding this specific case of Ábrego García.</p>
<p>Attorney Martha L. Arias:<br />
Yes, thank you very much. From what I understand—obviously, I haven&#8217;t read the entire file—this person was sent to court and subsequently to his country because the government invoked the Alien Enemies Act. Upon invoking this act, they simply sent the person back without providing due process, without giving him the opportunity to present evidence regarding his alleged affiliation with these gangs.</p>
<p>The Supreme Court of the United States, when reviewing this case, clearly stated that the government may use this act, but always respecting due process. In other words, it must be demonstrated beforehand that the person is a member of a terrorist organization or justify the accusations before proceeding with deportation. The judge who ordered the return requested evidence of the alleged gang membership, and until now, she has only received a superficial document simply stating he belongs to a gang.</p>
<p>If you hear any noise, it&#8217;s a peacock that I have at home. It&#8217;s curious because I hadn&#8217;t seen one in years, let alone knew how they sounded. It&#8217;s on a large tree in my house and has been serenading me all morning.</p>
<p>Continuing, as an attorney, I firmly believe that due process is a fundamental right we all possess. Even though we understand we don&#8217;t want people linked to gangs or criminal organizations in the country, we can&#8217;t bypass people&#8217;s basic rights. The problem is arbitrarily deciding who is entitled to due process and who isn&#8217;t. The judge has insisted on receiving clear evidence linking this person to the gang, and until now, it hasn&#8217;t been presented. In fact, two weeks ago, a government lawyer was suspended after admitting to the judge that he also didn&#8217;t have evidence.</p>
<p>This person did indeed have a deportation order, but was granted a benefit called &#8220;withholding of removal,&#8221; which means that although he must be deported, his deportation is temporarily suspended due to the danger he faces in his country. Therefore, legally he could be sent to a third country willing to accept him.</p>
<p>Host:<br />
Attorney Arias, the federal judge in charge of this case is considering initiating a contempt proceeding against the Trump administration for not providing evidence. Can she do this?</p>
<p>Attorney Martha L. Arias:<br />
Yes, absolutely. She is requesting clear evidence and tangible efforts from the government to return this person. This case applies the constitutional principle of checks and balances. Personally, I&#8217;m concerned about the arbitrary use of the Alien Enemies Act without solid evidence because today it&#8217;s this person, but tomorrow it could be someone closer to us.</p>
<p>Host:<br />
According to what was seen at the White House, this issue seems to be beyond the reach of U.S. justice, as he is under the custody of Salvadoran justice. President Bukele has stated he will not release terrorists. How does this affect the immigration legal aspect?</p>
<p>Attorney Martha L. Arias:<br />
It&#8217;s complicated. From my perspective as an immigration attorney and specialist in international law, if the United States mistakenly deported someone, it is obliged to try to bring him back. But if El Salvador has evidence or its own charges against this person, his return to the United States will be complicated. Right now, we don&#8217;t have official documentation proving these charges in El Salvador. Due process and legal clarity are essential in any democracy.</p>
<p>Host:<br />
Finally, attorney, what do you recommend for people who have immigration court appointments and are afraid to attend?</p>
<p>Attorney Martha L. Arias:<br />
I recommend following your attorney&#8217;s specific advice. If you don&#8217;t have an attorney, you should find one. In my experience, those who do not have previous deportation orders or criminal records shouldn&#8217;t have issues attending.</p>
