Court Ruling on Asylum & Florida Sheriffs’ ICE Partnership
In my latest interview on Actualidad Radio, I discussed two key topics:
- A federal court ruling that temporarily blocks an executive order restricting asylum applications at the border.
- An agreement signed by 67 Florida sheriffs with Immigration and Customs Enforcement (ICE) under the 287(g) program, expanding local enforcement of immigration laws.
Federal Court Ruling on Asylum Restrictions
A federal judge has issued a preliminary injunction blocking an executive order that sought to halt asylum applications at the U.S.-Mexico border. The ruling states that while the President has authority over immigration policy, it cannot override established U.S. asylum laws and international obligations.
Key Points:
- Asylum seekers arriving at the border can still apply while the case proceeds in court.
- CBP One remains operational for scheduling asylum interviews, though policies have changed. More details here.
- The case is in a Washington State federal court and may proceed to the Ninth Circuit Court of Appeals if appealed.
Florida Sheriffs’ Agreement with ICE
67 sheriffs in Florida have signed 287(g) agreements with ICE, allowing local law enforcement officers to assist in immigration enforcement. More details here.
How This Works:
- Officers can check immigration status during arrests.
- Applies to both serious crimes and minor infractions, like driving without a license.
- Individuals without legal status may be referred to ICE and face deportation
Advice for Immigrants in Florida
- Carry valid ID and legal documents.
- Know your rights—you have the right to remain silent and the right to an attorney.
- If detained, contact an immigration attorney immediately.
