1. Mass Deportations: A Reality or Just Campaign Rhetoric?
One of the most talked-about topics today is the proposal of mass deportations by some presidential candidates. Martha explained that while a president does have the authority to increase detentions and enforcement, mass deportations, as envisioned by some politicians, are not logistically feasible.
“There are many people who have protected statuses, such as TPS (Temporary Protected Status) or parole, which makes it complicated to deport them en masse,” she clarified. Throughout history, there have been peaks in deportations, but implementing a large-scale operation, like placing people on planes every half hour, faces significant legal and logistical barriers.
2. Advice of the Day: Happiness Is Within You, Not Just in a Country
During the session, Martha shared an important piece of advice for immigrants: happiness and the ability to thrive depend on the individual, not just the country where they live. She recalled cases where immigrants spent large sums of money fighting losing legal battles and advised them to make a pragmatic assessment of their situation.
“If you find yourself fighting against the current, it might be time to reconsider. The ability to succeed lies within you, and it can be developed no matter where you are,” she emphasized. This underscores the importance of assessing one’s circumstances and considering alternatives, whether in the U.S. or other countries.
3. Common Questions: TPS, Asylum, and Naturalization
During the interview, Martha answered several audience questions. One of the most common was whether someone with approved TPS and a pending asylum application can apply for an EB1 or EB2 visa.
Martha’s Response: Yes, they can apply with the I-140 application, but obtaining residency within the U.S. is not possible if their only status is asylum. To get residency, they would need to go through consular processing outside the country. This situation requires a careful and thorough legal analysis before investing in applications that may not succeed.
Another question concerned delays in naturalization applications. Martha explained that while these delays are not normal, they are common. Some cases become complicated due to investigations into how a person obtained their residency or because of past criminal convictions. She advised applicants to follow up regularly with immigration and, if needed, consult a lawyer to file a “writ of mandamus” if no decision is made within 120 days after their interview.
4. Diversity Visa Lottery 2026
Martha also took the opportunity to inform viewers about the opening of the Diversity Visa Lottery 2026 registration, which runs from October 4 to November 7, 2024. The lottery allows people from countries with low immigration rates to the United States to apply for residency. This year, Cuba was excluded due to the high number of individuals entering the U.S. through humanitarian parole.
It’s important to note that countries like Colombia and Mexico are not eligible to participate in the lottery because of the high volume of immigrants they send to the U.S.
5. Backlog in Affirmative Asylum Cases
Martha addressed the significant backlog in affirmative asylum cases in the U.S. Currently, there are more than 1.2 million pending cases. She explained that processing each asylum case is time-consuming and that while there are many asylum officers nationwide, the number is insufficient to handle such a large volume of pending applications.
“This is a major problem, as new asylum applications continue to pour in, further straining an already overwhelmed system,” she remarked. This backlog highlights the importance of being well-informed and seeking professional guidance when applying for asylum.
