During my recent Instagram Live with Juan Camilo on Actualidad Radio, we covered several important immigration topics that affect many of you. We discussed the Parole in Place program, which is still accepting applications even though USCIS is not making final decisions at this time. While we are waiting for a court ruling by October 23rd, I’m advising my clients to submit their applications because it’s a great opportunity to potentially obtain legal residency within the U.S. The financial risk is limited to the application fees and attorney costs, but it may be worth it for the chance to move forward with your case.
I also touched on TPS (Temporary Protected Status), particularly for individuals from Venezuela, Cuba, and Nicaragua, and some of the updates regarding the fingerprinting process for sponsors. Although new applicants are receiving fingerprint appointments, we are still waiting for more guidance from USCIS on how they will handle pending cases.
One key issue we discussed is the effect of being outside the U.S. for more than a year, which can lead to the loss of permanent residency. For example, if someone has been out of the country for over a year, their green card is considered abandoned, and the chances of getting it back are slim unless there are extraordinary circumstances.
We also answered several listener questions about asylum cases, lost residency, and the process of removing conditions from residency, especially for minors. I always recommend seeking legal help from an experienced immigration attorney to avoid making costly mistakes that can delay or even jeopardize your case.
